Belton City Council Meeting November 22, 2022 – 5:30 P.M. The Belton City Council met in regular session in the Wright Room of the Harris Community Center. Members present included Mayor Wayne Carpenter, Mayor Pro Tem David K. Leigh and Councilmembers Dan Kirkley, John R. Holmes, Sr., Daniel Bucher and Stephanie O’Banion. Councilmember Craig Pearson was absent. Staff present included Sam Listi, Gene Ellis, John Messer, Amy Casey, Mike Rodgers, Jon Fontenot, Larry Berg, Alex Munger, Matt Bates, Bob van Til, Tina Moore, Cynthia Hernandez and Kim Kroll. The Pledge of Allegiance to the U.S. Flag was led by Councilmember Stephanie O’Banion, and the pledge to the Texas Flag was led by City Manager Sam Listi. The Invocation was given by Councilmember Dan Kirkley. 1. Call to order. Mayor Carpenter called the meeting to order at 5:31 p.m. 2. Public Comments. (Audio 1:42) Troy Finley spoke about his property at 702 S. Pearl Street. No other comments were received. Consent Agenda Items 3-6 under this section are considered to be routine by the City Council and may be enacted by one motion. If discussion is desired by the Council, any item may be removed from the Consent Agenda prior to voting, at the request of any Councilmember, and it will be considered separately. (Audio 6:13) 3. Consider minutes of the November 8, 2022, meeting. 4. Consider appointments/reappointments to the following Boards/Commissions: A. Library Board of Directors (reappoint Janice Pustka and Sandra Velo; appoint Ann Locklin to fill unexpired term vacated by Kari Martin) B. Belton Economic Development Corporation’s Board of Directors (reappoint Brandon Bozon and Matt Wood) C. Tax Appraisal District Board of Directors (appoint Joe Shepperd) 5. Consider an ordinance amending Sec. 8-71 and Sec. 8-72 of the City of Belton Fee and Rate Schedule related to solid waste collection rates for 2023. 6. Consider authorizing the purchase of the following items from Kraftsman through the Buy Board Purchasing Cooperative: A. New splash pad features for the Harris Community Park Splash Pad. B. Exercise equipment for the Nolan Creek Hike and Bike Trail. Belton City Council Meeting November 22, 2022 – Page 2 Upon a motion by Councilmember Holmes, and a second by Councilmember Bucher, the Consent Agenda, including the following captioned resolution and ordinance, was unanimously approved upon a vote of 6-0. RESOLUTION NO. 2022-33-R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELTON, TEXAS, APPOINTING A REPRESENTATIVE TO THE TAX APPRAISAL DISTRICT BOARD OF DIRECTORS. ORDINANCE NO. 2022-63 AN ORDINANCE AMENDING THE FEE SCHEDULE OF THE CITY OF BELTON FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2022, AND ENDING SEPTEMBER 30, 2023. Planning and Zoning 7. Hold a public hearing and consider a zoning change from Agricultural to Single Family-1 District (SF-1) for approximately 2.2 acres located at 7102 Long Bow, west of Simmons Road. (Audio 7:42) Planner Tina Moore presented this item. Public Hearing: Roy Zoch, 3496 Simmons Road, spoke in favor of the zoning change. No one else spoke for or against the item. Upon a motion for approval of the rezoning by Councilmember Holmes, and a second by Councilmember O’Banion, the following captioned ordinance was approved upon a vote of 6-0 with the following conditions: • The use of the property shall conform to the requirements of the Single Family-1 District. • An approval letter from Dog Ridge Water Supply Corporation is required for domestic water services. • An approval letter from Bell County Health Department is required for on-site sewage facilities. ORDINANCE NO. 2022-64 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF BELTON BY CHANGING THE DESCRIBED DISTRICT FROM AGRICULTURAL TO SINGLE FAMILY-1 DISTRICT ON APPROXIMATELY 2.2 ACRE PROPERTY LOCATED AT 7102 LONG BOW ROAD. 8. Hold a public hearing and consider a zoning change from Neighborhood Services to Retail (R) on approximately 0.406 acres located at 1404 N. Main Street. Upon a motion for approval of the rezoning by Councilmember Bucher, and a second by Councilmember Holmes, the following captioned ordinance was approved upon a vote of 6-0. ORDINANCE NO. 2022-65 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF BELTON BY CHANGING THE DESCRIBED DISTRICT FROM NEIGHBORHOOD SERVICES TO RETAIL DISTRICT ON APPROXIMATELY 0.406 ACRE PROPERTY LOCATED AT 1404 N. MAIN STREET. 9. Z-22-42 – Hold a public hearing and consider a zoning change from Single Family-3 District to Planned Development – Single Family-3 (PD-SF-3) on approximately 6.226 acres in the Connell Subdivision, located at the northwest intersection of South Connell Street and Huey Drive. THIS ITEM HAS BEEN WITHDRAWN. (Audio 17:46) No action was required by the Council. 10. Z-22-43 – Hold a public hearing and consider a zoning change from Agricultural to Planned Development – Commercial-2 and Multifamily District (PD–C-2/MF) on approximately 41.64 acres located at 703 West Loop 121, located at the intersection of West Loop 121 and Southwest Parkway, as submitted by applicant High Side Real Estates LLC. THIS ITEM HAS BEEN WITHDRAWN. (Audio 18:10) No action was required by the Council. 11. P-22-24 – Consider a final plat of Three Creeks Phase X, comprising 72.67 acres, located generally south of IH-14 and east of FM 1670, on the south side of Three Creeks Boulevard, near the intersection FM 1670, in Belton’s Extra Territorial Jurisdiction (ETJ). (Audio 18:35) Planner Tina Moore presented this item. Mayor Pro Tem Leigh made a motion for approval of the final plat including approval of a variance for fire flow requirements for fire protection. Councilmember Holmes seconded the motion which was approved upon a vote of 6-0. 12. P-22-25 – Consider a final plat for Hidden Trails Phase I, comprising 20.67 acres, located east of Interstate 35, north of Loop 121, and south of Avenue R.
