In 1998, the County deeded several parcels to the City along Blackduck Lake, all under one legal description. That deed was in the stack of Pine Tree Park materials you sent and I used that legal description because the PID numbers lined up. In 2002, however, the City split one of the parcels and deeded the boat ramp/parking lot to the DNR. That deed is attached for your reference. To remedy this situation, it sounds like the OAH will allow us to simply substitute the last page of the Exhibit A with a revised page that includes the exception for the DNR parcel that was split off. I put the new language in the attached Word document. Can you copy that into your Word version of Exhibit A at the end and send it back to me? If you have any questions, please let me know. The use of this funding will provide an economic benefit to residents, businesses, and visitors from outside of our jurisdiction. The proposed tax rate is $0.005, or one-half cent, on local sales, which will include food and beverage, lodging and entertainment sales. Based on tax collections in 2018, we anticipate a 0.5% local sales tax would generate $40,000 per year (data provided by MN Department of Revenue, December 7, 2020). We are requesting the tax period be 20 years or until the $1,000,000 has been raised. The local sales tax option will provide revenue for the following improvements:  Electricity and utilities at the City Campground  Playground and ADA compliant restroom facility at the City Wayside Rest  Trail extensions and improvements adjacent to the Wayside Rest Park  Irrigation at the City Golf Course  Rehabilitation of the Community Library The projects draw tourism from the neighboring states and internationally, as we are approximately 66 miles from Canada. Enclosed you will find specific information on the five capital projects and how they will provide regional benefit. It was founded in 1900 as a logging community and has grown to be a hub between Bemidji and the Canadian border. Blackduck offers outdoor and recreational activities for tourists who visit Blackduck Lake and travelers who pass through on US Highway 71 and State Highway 72. The city draws from a large regional base for employment at The Shade Store (formerly Anderson Fabrics custom workroom). The City of Blackduck is strategically located for regional commerce. Canada is 66 miles to the north, and international tourists frequent Blackduck. In 2019, there were 292,223 personal vehicles coming in at the Canada–Baudette crossing. State Highway 72 offers a direct route into Blackduck from Baudette. US Highway 71 and State Highway 72 intersect in downtown Blackduck. According to MnDOT, 4,900 vehicles pass by this corner each day, bringing regional traffic into Blackduck. The Shade Store has 154 active employees who travel a great distance to Blackduck each day. This regional location creates a strong economic base for the city. With 845 residents, Blackduck needs assistance in supporting the activities that outdoor enthusiasts, day visitors, and a regional employment base require. The income level of the residents is about 59% of that of the non-metro state average. The local sales tax requested will fund five capital projects that will support the city amenities that draw outside revenue and sustain a destination site. To tackle this, the city would like to implement a 0.5% Local Sales and Use tax to help fund the capital improvement projects outlined below. City Campground | $200,000 The city would like to implement a 0.5%, or Walking Trail | $300,000 one-half cent, Local Sales and Use tax on local sales, which will include food and Wayside Rest | $250,000 beverage, lodging, and entertainment sales for 20 years or until City Golf Course | $150,000 $1 million is raised. Library | $100,000 Blackduck Local Option Sales Tax | Resolution 2023-04 2 of 40 Page 11  Blackduck City Campground Project Description Less than five minutes from the center of Blackduck is Pine Tree Park Municipal Campground. This is a city-owned campground along the eastern shore of Blackduck Lake. The park currently has 32 camping sites including: 9 primitive sites, 10 sites with electrical hookups, and 13 RV sites with water and power, and a sewer dumping station. In 2020–2021, along with COVID restrictions, there was increased interest in outdoor recreation which created a strong uptick in campers. Pine Tree Municipal Campground had 182 campers in 2021, which was more than double the figure in 2020. The city would like to upgrade the campground to have 30 RV sites that include electricity, water and sewer hookups. They will keep five primitive sites for a total of 35 camping sites. The upgrades proposed include both sewer and water lines throughout the campground, putting in 30 new sewer and water hookup locations, and developing thirty 50-foot gravel camping spots. Along with campground improvements, a 120-foot fishing pier and 12 boat slips will be constructed with this project. The final upgrade to the campground and beach area will be the reconstruction of the parking lot. It is essential that the city improve the aging water and sewer utilities. The increased use from regional campers has the potential to damage natural resources from an aging sewer dumping facility, and a lack of available full RV hook up sites. Planning for increased use will protect Blackduck Lake and the beautiful Northwoods for many generations of enjoyment. The cost estimates and improvement locations are found in the Appendix A. Project Benefits  The campground brings in people from all over the country. Most travelers are from Iowa, Wisconsin, North Dakota, South Dakota, and occasionally from Arizona and Florida. The main reason for travel is to visit extended family.  Increasing the capacity would bring more people to Blackduck, where they will spend money and boost economic growth.  An improved campground would be appealing to off-road vehicle users and would be a big draw for “weekend warriors.” The Pine Tree Municipal Campground improvements are estimated to cost $632,250; the city would like to use $200,000 of revenue generated from the sales tax to help pay for this project. Blackduck Local Option Sales Tax | Resolution 2023-04 3 of 40 Page 12  Blackduck City Walking Trail Project Description Visitors coming to Blackduck on Highway 72 will notice a wayside rest along the highway. Just north of the rest area is an adjacent trail. Access to the Blackduck Trail offers a healthy exercise break for travelers and their families. The current walking trail loops around the city but stops at Summit Avenue West, just north of the wayside rest. This project would extend Blackduck Trail around the west edge of the city, in front of the wayside rest, to meet the existing trail to the south along Highway 47. The proposed extension would span 1731 feet, north to south, with a 10-foot width. The new trail would be paved and will include access to businesses along the frontage road. Another addition to the trail system includes an extension to the west side of town. The trail would cross TH 71 at Brandl Drive and continue south paralleling Oscar Avenue until it intersects with Summit Avenue. This would also be a paved extension, and like the others, the existing trail would receive a 1.5-inch bituminous overlay and 1-foot gravel shoulders. The cost estimates and improvement locations are found in the Appendix A. Project Benefits  The walking trail has a close proximity to the Blue Ox Trail, which is a widely used ATV/snowmobile trail.  The Blackduck walking trail is often used by visitors who don’t golf or fish yet desire an outdoor recreation opportunity.  The trail is plowed and maintained through the winter, which creates a draw for runners and walkers during the colder, snowier months.  Trail users, including families who bicycle, will be safer with an off-road alternative. The two walking trail extensions and resurfacing of the existing trail is estimated to cost $859,400; the city would like to use $300,000 of revenue generated from the sales tax to help pay for this project. Blackduck Local Option Sales Tax | Resolution 2023-04 4 of 40 Page 13  Blackduck City Wayside Rest Project Description The Blackduck City Wayside Rest is along the busy US Highway 71, just south of the junction of US Highway 71 and State Highway 72. As a potential 4,900 vehicles pass by each day, travelers are welcomed by a picnic shelter, playground, and restroom. This offers a needed break for families traveling through the region and an easy access from the highway. The restroom at the site is not ADA compliant nor winterized. It is functional only in warmer months, while traffic along the highway is year-round and restrooms are used frequently by northern travelers. The city would like to winterize the building, expand it to offer tourism information, and rehabilitate it to comply with ADA standards. The goal is to offer year-round functionality and access for all users. The park is home to a playground for which the city would like to upgrade and enhance the playground equipment. The cost estimates and improvement locations are found in the Appendix A. Project Benefits  Offers a rest stop for travelers with an accessible restroom with tourist information.  Restroom for travelers who stop to use the Electric Vehicle (EV) charging station already located at the wayside rest.  Headquarters for tourism events, such as the Blackduck Woodcarvers Festival, and others that occur throughout the year.  Shelter for families that stop and take photos in front of the duck statue. Improving the wayside rest facility and upgrading the playground equipment is estimated to cost $856,700; the city would like to use $250,000 of revenue generated from the sales tax to help pay for this project. Blackduck Local Option Sales Tax | Resolution 2023-04 5 of 40 Page 14  Blackduck City Golf Course Project Description The city’s public golf course was built 1938–1939 as one of the region’s Works Progress Administration (WPA) projects. The club house, greens and tee boxes were built and maintained primarily by volunteers. The course has undergone only small changes throughout its life. Over the past 80-plus years the course has catered to tourists visiting the area’s resorts and campgrounds and offers healthy outdoor recreation. In 2021, the course had 9,081 golfers, and it has increased by 27.5% in the past year. Golfers from North Dakota, South Dakota, Iowa, and Wisconsin frequent the course. Recognized by the MGA and USGA, the course is a regional asset and home to Blackduck’s and Northome/Kelliher’s high school golf teams. The golf course struggles with drought from year to year from a lack of irrigation as the only irrigation the course has is around the greens. The city would like to be able to irrigate all the fairways and tee boxes. This would require running mainline watermain throughout the course with branched lines for sprinkler heads. This would also include installing a pumphouse to handle the increased flow demands. Project Benefits  Draw regional golfers for a longer season in the fall.  Provide visitors an excellent recreation activity for out-of-state visitors who may be staying with family.  Host regional tournaments, such as the Drake Scramble that brings high school teams from the regional area.  Golf offers a healthy outdoor activity, especially needed during COVID outbreaks during summer months. The proposed golf course irrigation improvement project is estimated to cost $750,000; the city would like to use $150,000 of revenue generated from the sales tax to help pay for this project. Blackduck Local Option Sales Tax | Resolution 2023-04 6 of 40 Page 15  Blackduck City Library Project Description The Blackduck City Library is used by residents, students and employees who commute to Blackduck from a regional area. It is a small building without ADA accessibility. The city would like to expand and rehabilitate their existing library or construct a new building at an undetermined location. The Blackduck School District has 705 students who commute from a wide region. They will use the city library for research and study projects. The Blackduck Library is part of the Kitchigami Regional Library System that shares resources throughout the region. The new proposed building would be one story tall with block framing and a brick veneer exterior. A 2,000-square-foot buildng would be the perfect size for this community. A cost estimate of $250 per square foot provides a total cost estimate of $500,000. Project Benefits  Publicly open and free to the public.  The library is part of the Kitchigami Regional Library System (KRLS). KRLS’s mission is “to enhance the quality of life throughout a five-county area by providing access to library resources and services that meet residents’ varied and continually evolving needs.” The proposed Library Reconstruction project is estimated to cost $500,000; the city would like to use $100,000 of revenue generated from the sales tax to help pay for this project. The City expects to select an Engineer who will serve the City for an indefinite period of time, commencing upon approval by the City Council. Detailed information concerning the City’s needs is outlined below. The City of Blackduck will select an Engineer that best meets the needs of the City. City Overview The City of Blackduck is located in Beltrami County. Approximately twenty-five miles from Bemidji. ❖ The City’s current population is 854 (2020 census) and has 310 utility services. ❖ The City of Blackduck has a council of four council members and one mayor. The City Administrator is accountable to the city council for implementing council direction. ❖ The City Council meets the 1st Monday after the 3rd of each month, with work sessions conducted on the 3rd Monday. ❖ The City staff consists of the City Administrator, Deputy Clerk, Public Works Director, Director of Liquor Operations; Police Department of two full-time officers; Volunteer Fire Department; and Golf Director with several part-time and seasonal employees. ❖ Blackduck maintains numerous City streets. In addition, the City works with Beltrami County and state departments to maintain county and state-owned roads in its jurisdiction. ❖ The City operates a public campground with swim beach; a public park with restroom facilities; a 2.0-mile biking/walking trail; a public library that is part of the Kitchigami Regional Library System; a 9-hole golf course and club house; an On & off Sale Liquor store; City Hall. ❖ Future and Current Projects the City of Blackduck is/has worked on include (not complete): 1. New Public Works / Public Safety Facility (Police Department) 2022 – present; 2. Expansion and extensive remodel to City Liquor Store (On and Off Sale) 2021; 3. Brownfield Redevelopment Project removing 3 hazardous commercial building from downtown 2021 to present; 4. Local Option Sales Tax for improvements to Campground, Walking Trail, Golf Course irrigation, and Library facility (2020 – present); 5. Construction of new public swim beach at public campground 2020 – 2022; 6. Annexation of publicly owned property into city limits 2022-present; 7. The City may select firms for oral presentations. Each firm selected will provide a summary of their qualifications and their approach to the position of City Engineer, and answer questions posed by the interview panel. Also include information about the firm’s experience in performing similar work. 2|Page Page 26 of 40  3) Identification and Qualification of Assigned Personnel The ideal firm should have experience in municipal engineering including: - planning and reviewing of construction projects (public and private) - preparation of feasibility reports - construction inspection - preparation of assessment rolls - plat and site plan review - LGU implementation and services (WCA) - capital improvement planning - funding and grant writing assistance - city park development - water/sewer/storm water expertise - utility studies - GIS/technical mapping services - Surveying services. The ideal firm will be a full-service firm. Designate the person who would be assigned as the Blackduck City Engineer. This is the person who will be responsible for the management and administration of engineering services with the City. Include a resume describing that person’s experience and qualifications. Provide the names and resumes of other professional staff that will be assigned to providing professional services to the City. Submit an organizational chart identifying team members and their areas of responsibility. 4) Proposer’s Detailed Approach to the Scope of Services The proposal shall address in detailed fashion the approach of the firm for providing services to the City. 5) Basis for Compensation The proposal shall include a fee schedule showing hourly rates for the individuals serving the City and other professionals who may provide services to the City, along with an outline of any additional fees customarily incurred. 6) List of References and Potential Conflicts A minimum of five references from public clients for the designated Engineer and firm shall be provided, preferably for comparable city engineering services performed within the past five years. Potential conflicts of interest must be disclosed including whether your firm works for developers, other government agencies, or others in the public/private sector that may impact business in the City of Blackduck. 3|Page Page 27 of 40  7) Insurance Coverage Documentation of current insurance coverage and limits, including professional liability insurance shall be provided with the proposal. 8) Funding for Municipal Projects Describe your firm’s experience with the application for and in receiving funding for municipal projects. Identify the individuals employed by your firm who provide services for funding assistance or if you use sub consultants. Include their resumes. Scope of Work The City of Blackduck is searching for a firm that will provide a wide range of professional services. The general work elements are outlined below: 1) General Engineering Services ✓ Assists in planning, coordinating, supervising, and evaluating programs, plans, services, equipment, infrastructure, assist with funding solutions. ✓ Assists in development and implementation of CIPs (capital improvement plans). ✓ Manage infrastructure issues for the City through proactive planning, monitoring, and operations and maintenance management. ✓ Develops and recommends policies and procedures for effective operation of the City consistent with City policies and relevant regulations. ✓ Formulates short and long-range plans for design and constructing Public Works improvements, including streets, water, sanitary, storm sewer, parks, and buildings. ✓ Assists in implementing all water resource functions. ✓ Reviews land use applications and construction plans for private developments for consistency with City adopted engineering specifications, City policies, and relevant laws, rules, and regulations, and ensures Council actions are implemented if requested. ✓ Partners with City to update City maps and utility records, including maintaining a GIS/database. ✓ Obtain proper approval and documentation from local, state, and federal authorities prior to implementing projects. ✓ Provides engineering services on projects and oversees project management for constructing municipal Public Works projects. ✓ Assists in planning, layout, and design of parks, trails, and other recreational amenities. 2) Design and Bidding Services ✓ Prepare plans and specification for projects with the input of City staff. Present plans and specifications to the City Council for approval. ✓ Consults with state and federal agencies having jurisdictional authority over the project as warranted. ✓ Prepare and send Advertisements for Bids to the legal newspaper and the Construction Bulletin for solicitation of bids. ✓ Prepare Contract Documents for bidding purposes. ✓ Review the bids and prepare bid tabulations. ✓ Provide assistance to City staff in preparing a recommendation to the City Council for the award of contracts. 4|Page Page 28 of 40  3) Project Management/Construction Services ✓ Convene a preconstruction conference with staff, contractor, utility company representatives, etc. ✓ Perform construction staking and surveying. ✓ Provide construction observation during construction. ✓ Prepare and maintain necessary documentation, including photographs and/or video if warranted, and a log of the contractor’s progress. ✓ Convene regular construction progress meetings, as required. ✓ Prepare, review, and recommend action for proposed change orders. ✓ Review and recommend final acceptance by the City. Assist the City in ensuring that contractors have been paid and lien waivers have been acquired. ✓ Provide record drawings upon conclusion of projects to the City. 4) Prepare Engineering Reports and Technical Correspondence ✓ Determine the need for preliminary studies, reviews all preliminary studies for compliance with ordinances, comprehensive plans, engineering standards, and financial guidelines including: - Feasibility Reports - Prepare preliminary (and final) assessment rolls - Plat review - Utility studies - Surface water system analysis and design - Capital Improvement Program studies - Prepare comments regarding reports, plans, and studies of other agencies - Presents feasibility studies at public meetings. ✓ The engineer shall establish and maintain a library of the following records: - Permits and applications - Contract Documents - Addenda - Copies of referenced standard specification - Project schedules - Shop drawings and submittals - Applicable correspondence - Records of pertinent telephone conversations - File memoranda, directives, and change orders - Requests and recommendations for payment - Project budget and cost information - Diaries and logs - Records of noncompliance - Field test results - Materials testing reports - Record Drawings - Project photographs - Project studies and reports - Project progress and meeting minutes - Other information as necessary or required 5|Page Page 29 of 40  5) At the direction of the City Council or City Clerk, participates in meetings, including: ✓ Internal and external meetings with City staff or other engineering firms involving engineering questions and issues. ✓ Meets with developers and members of the public on proposed development projects in order to relate the processes and procedures involved with engineering and infrastructure development. Reviews development proposals for conformance with City Standards. ✓ Attend City Council meetings and work sessions, Planning Commission meetings, and other City meetings as needed. ✓ Facilitating/overseeing public hearings. ✓ Meeting with citizens one on one. Terms and Conditions The City reserves the right to reject any or all proposals or to negotiate a contract that is in the best interest of the City at the absolute and sole discretion of the City Council. The City will not be liable for any costs by the firm responding to this request. The firm shall not assign nor transfer any interest in this proposal without the prior written consent of the City of Blackduck. For the purposes of this agreement, the engineering consultant shall be deemed to be an independent contractor, and not an employee of the City. Any and all agents, servants, or employees of the firm or other persons, while engaged in the performance of any work or services required to be performed by the City of Blackduck under this agreement, shall not be considered employees of the City and any and all actions which arise as a consequence of any actor omission on the part of the firm, its agents, servants, employees, or other persons shall in no way be the obligation or responsibility of the City. The 2023 event is scheduled to take place on Sunday, March 5th, 2023, on Blackduck Lake. Our goal is to give a fishing opportunity to children 15 years of age and under in a fun and safe environment. We would like to ask for your support to make this kids fishing event a success and to have every kid go home with a prize and memories from their day of fishing their first Blackduck Kids Fishing Derby!
