1. CALL TO ORDER BY THE MAYOR
The meeting was called to order at 7:30 p.m. by Mayor Ryan followed by the
Pledge of Allegiance and the Roll Call.

4. APPROVAL OF MINUTES
4.-1 MIN 16-33 RECENTLY HELD MEETINGS
Moved by Councilmember Hovland, seconded by Councilmember Herbst, that
the Workshop Meeting Minutes of October 6, 2016; the Regular Meeting Minutes
of October 6, 2016, and the Closed Workshop Meeting Minutes of October 13,
2016; be approved.
Motion adopted 3-0-1 (Councilmember Herbst abstained from the Workshop
Meeting Minutes and the Regular Meeting Minutes of October 6, 2016, due to
his absence.).

5.-1 SPEAKER 2016 EXPLORER POST RECOGNITION

Safety Services Manager/Police Chief Chris Olson gave an overview of the Blaine
Law Enforcement Program.
Police Officer and Explorer Lead Advisor Brad Norby thanked the following
companies for their support of the Explorer program: Cub Foods; Dave’s Sanding
& Installing, Inc.; 3M Championship; Shield Pattern Works Inc.; 21st Century
Bank; TJB Homes Inc.; Plasti Dip International Inc.; Hope Church; Jes Sales
Company Inc.; Wheeler Dyno Service Inc.; American Student Transportation;
Bauer Built; Northview Villa Inc.; Great Garage Products Inc.; Sandpiper Blend
Inc.; and M.J. Dunn Company.
Mayor Ryan congratulated the Explorer Post on their success at the National
Conference.

Councilmember Clark noted that new information on the proposed Community
Center referendum is on the City’s website.

Mayor Ryan opened the Open Forum at 7:48 p.m.
There being no input, Mayor Ryan closed the Open Forum at 7:49 p.m.

City Clerk Sorensen stated the applicant Iyad Sati has submitted an application for
a tobacco and tobacco products license at Sati 1999 Inc. which is the former Hot
Market. She stated the applicant has met the licensing requirements and the City
has received articles of incorporation and by-laws, and successful background
investigation. She noted the certificate of occupancy remains outstanding. Safety
Services Manager/Police Chief Olson commented the applicant has an impending
criminal charge for sale without a license.
Councilmember Clark asked if this is a new license or a renewal. City Clerk
Sorensen replied this is a new owner and requires a new license.
Councilmember Clark asked what would happen if a conviction or a plea with the
criminal charge, what is the impact to the license. City Clerk Sorensen replied it
would considered at the time of license renewal.
Moved by Councilmember Clark, seconded by Councilmember Herbst that
Motion 16-089, “Approve a Tobacco and Tobacco Products License for Sati
1999, Inc. at 10519 University Avenue NE,” be approved.

11. DEVELOPMENT BUSINESS
11.-1 RES 16-157 GRANTING A CONDITIONAL USE PERMIT TO OPERATE A FITNESS
CLUB IN A B-2 ZONING DISTRICT, LOCATED AT 10731 UNIVERSITY
AVENUE NE. ANYTIME FITNESS. (CASE FILE NO. 16-0044/SLK)
Planning and Community Development Director Schafer stated the applicant,
Anytime Fitness, is proposing to occupy 5,000 square feet in Oak Park Plaza
which requires a conditional use permit. He noted members will have entrance key
access to the fitness center 24 hours a day and 7 days a week and no more than 40
people in the gym at one time. He stated the site plan identifies adequate parking in
front of the proposed location.
Moved by Councilmember Herbst, seconded by Mayor Ryan, that Resolution
16-157, “Granting a Conditional Use Permit to Operate a Fitness Club in a B-2
Zoning District, Located at 10731 University Avenue NE. Anytime Fitness,” be
approved.
Motion adopted unanimously.

12. ADMINISTRATION
12.-1 ORD 16-2366 SECOND READING
AMENDING ORDINANCE SECTION 74-82(a)(11) - REVISION TO
SIDEWALK REQUIREMENTS
City Engineer Keely read the proposed wording to ordinance to Chapter 74,
Subdivisions, Article III. Subdivision Design Standards, Section 74-82(a)(11)
Sidewalks. Sidewalks shall be constructed along both sides of arterial and
collector streets. Sidewalks and Trails. Sidewalk or trail shall be required on one
side of collector streets. Sidewalks and/or trails may be required along both sides
of collector streets depending upon pedestrian needs and connectivity to existing or
planned sidewalk and trail systems. Sidewalks and trails shall be constructed in
accordance with design standards filed in the office of the city engineer. Variation to
these sidewalk and trail requirements may be approved upon the discretion of the
City Council.
Declared by Mayor Ryan that Ordinance 16-2366, “Amending Ordinance
Section 74-82(a)(11) – Revision to Sidewalk Requirements” be introduced and
placed on file for second reading at the November 3, 2016, Council meeting.
12.-2 RES 16-158 A RESOLUTION APPROVING THE ARBITRATION AWARD
COVERING THE COLLECTIVE BARGAINING AGREEMENT

BETWEEN THE CITY OF BLAINE AND LAW ENFORCEMENT LABOR
SERVICES, INC. REPRESENTING THE POLICE OFFICER UNIT FOR
THE CALENDAR YEAR 2016
City Manager Arneson stated the Council is asked to approve the revised LELS
contract with the police officer unit for 2016. He noted there will be four open
contracts for 2017.
Moved by Councilmember Hovland, seconded by Councilmember Swanson
that Resolution 16-158, “A Resolution Approving the Arbitration Award
Covering the Collective Bargaining Agreement between the City of Blaine and
Law Enforcement Labor Services, Inc. Representing the Police Officer Unit for
the Calendar Year 2016,” be approved.
Motion adopted unanimously.
13. OTHER BUSINESS
Councilmember Hovland requested staff bring forward for discussion the impact of
a potential decrease in the tax levy rate of 0.5 percent.
