Informational: no action required 5. COMMUNICATIONS Councilmember Robertson congratulated all Blaine, Spring Lake Park and Centennial 2022 graduates. Councilmember Jeppson discussed the fatal accident that occurred on Highway 65 at 109th Avenue and shared her deepest condolences to the families who have been impacted. She stated there was a dire need to discuss additional funding to improve the safety of this roadway 6. OPEN FORUM Mayor Sanders opened the Open Forum at 7:49PM. Mark Ouellette, 1336 95th Avenue, shared concerns he had regarding the dog park and access to the Arris II apartment project that would be located at 97th Avenue and Cloverleaf Parkway. He was concerned the engineering design for this project was off as the driveway was misaligned and hidden. He noted he also had concerns with the fact construction traffic was blocking Ulysses Street on the frontage road. He encouraged the city to post signs to keep addressing this concern. Elmer Stevenson, 12565 Zest Avenue, expressed frustration with a neighboring property that was currently being marketed as commercial. He was concerned how this would lead to increased traffic and other concerns if the property was developed as high density. He stated he did not want a commercial property next to his residential home. Community Development Director Thorvig reported a broker reached out to him last week regarding this corner property. He explained the corner property is guided for residential and staff has made the broker aware that the property is not zoned or guided for commercial. Walters has been searching for property, or an appropriate existing facility, for several years for the growth of their business. They are not able to expand on their existing property located at 2830 101st Avenue due to wetland constraints. The applicant is proposing to construct a 13,624 square foot maintenance/office building with an attached 3,050 square foot truck wash bay. The new maintenance building bays will be used exclusively for container and cart washing and repair. No truck maintenance will take place in the new facility. The application does not propose to change or intensify the existing transfer facility on the property. Councilmember Newland thanked Walter’s for raising the bar on how they maintained their property in the community. Mayor Sanders agreed, stating Walter’s was a great community partner. Preserve at Lexington Waters (Blaine 2022, LLC) (Case File No. 22-0021/SAS) Attachments: Attachments Unapproved PC Minutes 051022 Mr. Thorvig stated Preserve at Lexington Waters is a 106-lot single family subdivision. The development requires a rezoning, conditional use permit and preliminary plat. The subject site is zoned FR (Farm Residential), and the applicant is requesting to rezone the property to DF (Development Flex) to develop the site. The DF District is intended to provide for greater flexibility in land use planning and maximize the choice of housing types and styles than is possible under the strict application of other sections of this ordinance. The DF District also attempts to create a reasonable balance between greater flexibility in land uses, and at the same time protect the interest of surrounding City of Blaine Page 6 City Council Minutes June 6, 2022 properties. Councilmember Robertson asked if this neighborhood was part of the original Environmental Assessment Worksheet (EAW). Mr. Thorvig stated this development was outside the EAW done for Lexington Waters. Councilmember Robertson explained the city has no control over what private property owners do with their land. She commented this project was working with local builders, which she appreciated, along with the fact the lot sizes were larger and wetlands would be preserved. She requested comment from the developer on how long he had been working on this project. Nathan Fair, Jonathan Homes, discussed the process that must be followed for the development process. He explained he began working on this project last fall and he has been working with the DNR to protect rare plants on the site. He discussed the type of homes that would be built on these lots and thanked staff for always being prompt and responsive to his questions. He stated he looked forward to creating 42 additional homes in Blaine. Councilmember Massoglia indicated he received comments from residents on Lever Street regarding the proposed side yard setbacks. He was of the opinion the six-foot side yard setback was too small. He supported this development having larger lots and setbacks. Mr. Fair stated each piece of land has different factors that must be considered. He explained he would like to do a full Jonathan Homes project, but stated with the high-water table, it did not make financial sense to raise the entire site to have homes with full basements so for this reason the project would have two different housing types. As proposed, 64 lots will have a lot width of 60 feet and 42 lots will have a lot width of 75 feet or larger. The lots range in size from 7,752 square feet to 18,837 square feet. The smaller lots are for raised ranch homes that are one level living with a lower level and the larger lots will be for traditional two-story homes. The development requires preliminary plat and is generally consistent with adjacent developments. Staff commented on the new conifer trees that would be brought in to buffer the area. ADMINISTRATION 11.-1 Approve 3M Open Security Plan - Including Proposed Temporary Road Closures Attachments: TPC Parking Restrictions Map 2022 Safety Services Director/Police Chief Podany stated the Blaine Police Department will provide security for the 3M Open PGA Tour event on July 18-24, 2022. As part of the security plan, staff is requesting council adopt City of Blaine Page 8 City Council Minutes June 6, 2022 a resolution that will address necessary security aspects of the tournament and authorize staff the ability to make changes as deemed necessary to ensure the event is safe for members, guests, neighborhood residents, and any public. Staff will work closely with Anoka County, 3M Open staff, TPC, and other officials to ensure communication continues for all involved. Mayor Sanders thanked Chief Podany and his entire team for their efforts to keep all the visitors and guests at this event safe. Moved by Councilmember Jeppson, seconded by Councilmember Massoglia, that Resolution No. 22-099, “Approve 3M Open Security Plan - Including Proposed Temporary Road Closures,” be approved. Motion adopted unanimously. Aye: 6 - Councilmember Robertson, Councilmember Paul, Councilmember Massoglia, Mayor Sanders, Hovland and Jeppson 11.-2 Approval of Residential Building Inspections Contract with Rum River Consulting Mr. Thorvig stated due to unanticipated large commercial projects, which includes multiple apartments and increasing level of residential single-family and townhome construction, staff is requesting contracting for back-up residential inspection services. Staff explained on April 18, 2022, the council approved a contract with MNSPECT for residential inspection services in the amount of $89,600. Unfortunately, MNSPECT has not been able to commit an inspector to the City of Blaine and unable to provide a timeline of if or when an inspector will be made available. Given the urgency to obtain additional help, staff is proposing to cancel the contract with MNSPECT and hire Rum River Consulting. Rum River Consulting submitted a proposal for the initial request. The proposal is to enter a seven-month contract June through December, five days per week. Rum River Consulting charges $120/hour, so the total amount of the contract would be $134,400. Unfortunately, there is a limited pool of companies that provide this type of service. Staff contacted Rum River Consulting and they confirmed they would have a residential inspector available immediately. Staff also asked about the possibility of hiring a second inspector for three months for June through August. Rum River Consulting believes they would have another inspector available at an additional cost of $57,600. He noted the permit revenue would pay for this service. Councilmember Newland stated he supported staff’s recommendation in order to meet the demand for inspections this summer and supported the council moving forward with both the seven-month and three-month contracts. City of Blaine Page 9 City Council Minutes June 6, 2022 Councilmember Hovland agreed it was important for the city to have enough inspectors to meet the construction demands that would occur this summer. He indicated it was vital for the city to have highly skilled inspectors working on behalf of the community and supported both contracts moving forward. Councilmember Jeppson concurred and thanked staff for focusing on ways to improve customer service within the building inspection department. She indicated she supported both the seven-month and three-month contracts as proposed by staff. She recommended that staff needs of the building inspection department be further reviewed at a future workshop meeting. Mr. Thorvig explained he has spoken to the city manager regarding any additional staffing needs but said it was difficult to fully staff because the work does ebb and flow. Councilmember Robertson stated she would reluctantly support the request because she understood the need for these two inspectors was an anomaly for the building inspection department and supported the council further discussing the building inspection department needs during this year’s budget discussions. Mayor Sanders requested staff speak to the consulting inspectors to ensure they were properly representing the City of Blaine when working with the public. Councilmember Paul stated he could support the seven-month contract as proposed by staff. Councilmember Massoglia explained he would be voting against the proposed contracts. He understood the city needed additional help within the building inspection department but opposed the additional $20,000 per month expense. He stated he had a hard time understanding why the city could not hire a full-time staff member to do this work instead so a consultant would not be needed. Mayor Sanders reported the city had a contract in place that would have cost the city less but the consultant was not able to deliver as promised. Moved by Councilmember Newland, seconded by Councilmember Hovland, that Motion 22-105, “Approval of Residential Building Inspections Contracts (both the seven and three-month options) with Rum River Consulting,” be approved. Staff requests council approval to amend the contract with TKDA for professional engineering services to expand the scope of the Lift Station 13 Force Main Project. Councilmember Robertson asked that as the city goes into the 2023 budget, she requested further thought be given by staff of what other worse case scenario projects may be needed in the next couple of years. Moved by Councilmember Massoglia, seconded by Councilmember Newland, that Motion 22-106, “Approve a Contract Amendment with TKDA for Professional Engineering Services for the Lift Station 13 Force Main Project,” be approved. Rud & Sons, Inc. in Accordance with Proposal Dated April, 25 2022 for Stormwater Pond Surveys Attachments: E22080- Blaine Pond Survey Estimate- 5 year Mr. Schluender stated since 2008 the city has surveyed its stormwater ponds to determine the need for maintenance excavation. Twenty percent of the ponds are surveyed each winter under frozen conditions to facilitate the ease of working over the water. E.G. Rud & Sons, Inc. has performed the work with their bid being the lowest in each of the past three five-year cycles. E.G. Rud & Sons is in the engineering pool for this scope of work and provided a quote for this project. Deliverables included an electronic copy of the surveys for each pond. Mr. Schluender explained the city has been divided into five regions with on average 61 ponds in each region. All ponds have been surveyed three times providing a valuable base of data. Ensuing surveys will be compared to the previous work to see if pond depths have changed to a City of Blaine Page 11 City Council Minutes June 6, 2022 point where excavation is necessary. This enables the city to be compliant with the requirements of the MS4 permit. It is recommended that the city enter into a contract with E.G. Rud & Sons, Inc. for the next five-year cycle of surveys to build on their experience on this project and ensure consistency and accuracy with the end product. Councilmember Robertson asked that staff communicate clearly with the neighbors who will be impacted by the pond surveys. Mr. Schluender stated staff would communicate clearly with these residents. Councilmember Massoglia questioned why an RFP was not completed for this contract. Mr. Schluender reported the rates proposed by E.G. Rud & Sons were lower than the rates submitted by all other vendors that responded to the RFP in 2018 and noted E.G. Rud & Sons has capped their price per pond with no inflator within their five-year contract. Moved by Councilmember Jeppson, seconded by Councilmember Hovland, that Motion 22-107, “Authorize City Manager to Enter into Five-Year Contract with E.G. Rud & Sons, Inc. in Accordance with Proposal Dated April 25, 2022, for Stormwater Pond Surveys,” be approved. Motion adopted unanimously. Aye: 6 - Councilmember Robertson, Councilmember Paul, Councilmember Massoglia, Mayor Sanders, Hovland and Jeppson 11.-5 Accept Bid from Park Construction Company in the Amount of $3,929,526.57 for the 2022 Street Reconstructions, Improvement Project No. 22-04 Attachments: 2022 Street Reconstructions Location Map Mr. Schluender stated the city council approved plans and specifications and ordered advertisement for bids for the 2022 Street Reconstructions project on April 18, 2022. The streets within the project area were reviewed. It was noted bids were received electronically for Project No. 22-04. A total of six bids were received ranging from $3,929,526.57 to $4,674,123.70. Bids have been checked and tabulated, and it has been determined that Park Construction Company of Minneapolis, Minnesota is the lowest bidder. The Engineering Department has worked with Park Construction Company on previous contracts and recommends that the low bid be accepted, and a contract entered into with Park Construction Company. City Council is also asked to approve a 10% contingency to bring the total project budget to $4,322,479.00. The funding sources for this project are the Pavement Management Fund, Public Utility Funds, Municipal State Aid System Fund and Special Assessments and there are sufficient funds budgeted to cover these costs. Councilmember Newland commented on the three different road City of Blaine Page 12 City Council Minutes June 6, 2022 construction projects that would be completed in the city this summer and noted the projects would be completed by three different firms and asked if this would be a concern for the city. Mr. Schluender stated the open bidding process led to multiple firms bidding on these projects. He indicated the contractors bid on the projects that best suit them and there was no overlap on this year’s projects. Mr. Haukaas discussed how staff has worked to properly size its street reconstruction projects to ensure they are completed within the project timeline. He stated it was very intentional that the city has divided its street improvement projects into three separate projects to ensure the work is done by November of this year. A total of 6 bids were received ranging from $3,028,822.32 to $3,484,415.18. Bids have been checked and tabulated, and it has been determined that Douglas-Kerr Underground, LLC of Mora, Minnesota is the lowest bidder. The funding sources for this project are the Pavement Management Fund, Public Utility Funds, and Special Assessments and there are sufficient funds budgeted to cover these costs. The streets within the project area were reviewed. It was noted bids were received electronically for Project No. 22-05. A total of four bids were received ranging from $5,676,285.00 to $6,808,139.95. Bids have been checked and tabulated, and it has been determined that New Look Contracting, Inc. of Rogers, Minnesota is the lowest bidder.
