One of the Commission’s functions is to hold public hearings and make recommendations to the City Council. The City Council makes all final decisions on these matters. Blaine City Ordinances require that certain documents and information be included in applications. The Planning Commission may postpone consideration of an application that is incomplete and may, for other reasons, postpone final action on an application. For each item the Commission will receive reports prepared by the City staff, open the hearing to the public, and discuss and act on the application. Chair Ouellette called the meeting to order at 7:00PM Members Present: Commission Members: Goracke, Halpern, Homan, and Chair Ouellette. Also present was Adjunct Member Drew Brown. Members Absent: Commission Members: Olson and Ponds. Approval of Minutes 2.-1 Approval of February 12, 2020 Planning Commission Minutes Attachments: Unapproved Minutes Motion by Commissioner Homan to approve the minutes of February 12, 2020, as presented. Motion seconded by Chair Ouellette. The motion passed 4-0. Aye: 4 - Chair Ouellette, Commissioner Homan, Commissioner Goracke, and Commissioner Halpern Abstain: 1 - Commissioner Olson 3. New Business 4.-1 Public Hearing Case File No. 20-0001 // King of Glory Lutheran Church // 10103 University Avenue NE The applicant is requesting a conditional use permit to construct a 720 square foot brick storage building on the north side of the church building in a B-2 (Community Commercial) zoning district. Attachments: Attachments The report to the Planning Commission was presented by Shawn Kaye, Associate Planner. The public hearing for Case File 20-0001 was opened at 7:06PM Stephen Walther, 259 120th Lane NW, Coon Rapids, asked if the existing shed could remain in place until the new one was completed. He explained this would allow the mowers, grass seed, and other items in the shed to remain indoors and out of view. Associate Planner, Shawn Kaye stated staff could amend the conditions for approval to require the existing shed to be removed at the time the church receives a certificate of occupancy for the new shed. The public hearing was closed at 7:08PM Motion by Commissioner Goracke to recommend approval of Planning Case 20-0001 based on the following conditions: Case 20-0001: City of Blaine Page 2 Planning Commission Minutes March 10, 2020 1. Building to be constructed consistent with submitted materials attached to the staff report 2. Building to be constructed of brick in a color that matches the existing church building. 3. The applicant must obtain site plan approval prior to any work being performed on site and prior to issuance of a building permit. 4. The existing shed on the property shall be removed prior to issuance of a building permit for the new storage building or the applicant shall provide a $5,000 escrow. 5. Building to be used for storage purposes only and not for any other use that includes assembly of people. Motion seconded by Commissioner Halpern. The motion passed 4-0. Aye: 4 - Chair Ouellette, Commissioner Homan, Commissioner Goracke, and Commissioner Halpern Chair Ouellette noted this would be on the agenda of the April 6, 2020 City Council meeting. 4.-2 Public Hearing Case File No. 19-0049// Waters Edge Investments, LLC // 12750 Harpers Street NE The applicant is requesting the following: a) Preliminary plat approval to subdivide 4.01 acres into 14 single family lots to be known as Harpers Haven. b) Conditional use permit to allow for construction of 14 single family homes in a DF (Development Flex) zoning district. Attachments: Attachments The report to the Planning Commission was presented by Shawn Kaye, Associate Planner. The public hearing for Case File 19-0049 was opened at 7:12PM Rick Mrugala, 2550 128th Ave NE, stated he owned the property west of the proposed development. He asked if Lot 2 on the west side had a utility easement. Project Coordinator, Tom Scott reported this easement would drain the lot to the south. He explained the water would run into the adjacent pond. Mr. Mrugala questioned if the bituminous path would stop at his property line. Project Coordinator, Tom Scott stated this was the case. City of Blaine Page 3 Planning Commission Minutes March 10, 2020 Mr. Mrugala inquired when grading work would begin for this project. Associate Planner, Shawn Kaye indicated the grading work would begin this spring and the developer plans to complete the grading work by July of 2020. James Golgart, 3100 128th Avenue NE, stated he has lived in his home for the past eight years. He commented on how many homes have developed in his neighborhood over that time. He recommended the intersection of Harpers Street and 128th Avenue be a four-way stop. He encouraged the developer to save as many of the large oak trees as he could. The public hearing was closed at 7:17PM Commissioner Goracke asked when the developer would begin work on the development. Greg Peterson, Waters Edge Investments, stated work would begin this spring as he would have to tear down the existing house, take out trees, and grade the site. It was his hope the builder could begin putting in basements in July. Mr. Golgart questioned if 128th would become a through street to assist in mitigating some of the traffic on Harpers Street. Project Coordinator, Tom Scott explained there was a chance, but commented on the wetlands that were in place. Motion by Commissioner Homan to recommend approval of Planning Case 19-0049A the preliminary plat for Harpers Haven based on the following conditions: Case 19-0049A: 1. All streets will follow the Anoka County street name grid system. 2. Developer installed improvements shall include construction of Guadalcanal Street within the plat including lateral sanitary sewer and water main with services, storm drainage improvements, storm water management and water quality treatment infrastructure, streets with concrete curb and gutter, 6-foot concrete sidewalk along the east side of Guadalcanal St NE, 8 -foot bituminous trail along the south side of 128th Avenue, 8-foot bituminous trail connecting 128th Avenue and Guadalcanal St NE, streetlights, mailboxes, traffic control signs, street signs, and all appurtenant items. 3. Plans and specifications must be approved by the city prior to start of construction. 4. Trunk sanitary sewer area charges become due with platting for upland acreage. The 2020 rate for Sanitary Sewer District 6-5 of $7,962.00 per acre of upland will apply. City of Blaine Page 4 Planning Commission Minutes March 10, 2020 5. Standard utility and drainage easements must be dedicated along all lot lines and over areas of delineated wetlands, wetland mitigation, infiltration trenches, drainage swales, and storm water management ponds. 6. Each lot shall have a minimum rear yard area behind each structure of a minimum of 20 feet from the structure at a maximum grade of 5%. 7. The developer is to provide access for inspection and maintenance of storm water management infrastructure. Restrictions will be placed on lot lines as needed to limit fences and landscaping to insure access. 8. Development requires a National Pollutant Discharge Elimination System (NPDES) Permit from Minnesota Pollution Control Agency (MPCA). 9. Construction contract documents shall include a rough grading, erosion protection, sediment control, development, utilities, roadway, and storm drainage plans. Supporting wetland delineation report, geotechnical investigation report, soil boring logs, and hydrology report shall be included in the submittal for city review and approval. 10. The development plan shall indicate all structures will be protected from flooding. 11. Coon Creek Watershed District (CCWD) will need to approve and permit this plat, prior to any site work. 12. As-built surveys shall be required to verify structure elevations, custom grading requirements, and final lot grading elevations. 13. Developer to install grouped mailboxes with design and locations approved by city and US Postal Service. 14. Water and sanitary sewer availability charges (WAC & SAC) become due with each building permit at the rate established at the time the building permit is issued. 15. All development signage by separate review. 16. All wells and septic systems to be properly abandoned per all local and state requirements. 17. Park dedication is required for each of the 14 lots at the rate in effect at time of Final Plat. The 2020 rate is $4,449 per lot for a total of $62,286 (14 lots) if platted and paid in 2020. 18. Execution and recording of a Development Agreement, which sets forth in greater detail the plat conditions as well as other responsibilities for the development of this plat. 19. The Mayor, City Clerk and City Manager are hereby authorized to execute any and all necessary documents, agreements and releases related to the approval, recording or administration of Harpers Haven. City of Blaine Page 5 Planning Commission Minutes March 10, 2020 Motion by Commissioner Homan to recommend approval of Planning Case 19-0049B the conditional use permit to allow for construction of 14 single family homes in a DF (Development Flex) zoning district based on the following conditions: Case 19-0049B: Single Family - DF Development Standards Permitted Uses 1. Single-family detached dwellings. 2. Group family daycare. Accessory Uses 1. Private garages - one detached accessory structure, with area less than 120 square feet, will be permitted. 2. Private swimming pools/meeting the requirements of Blaine Municipal Code Chapter 18 Article IX Swimming Pools. 3. Keeping of not more than two (2) boarders and/or roomers per dwelling unit. Conditional Uses 1. Home occupations listed as Conditional Uses fewer than 33.11. Standards 1. Front yard setback - 25 feet 2. Side yard setback - 7.5 feet for house and garage. 3. Corner side yard setback - 20 feet. 4. Rear yard setback - 30 feet 5. Maximum building height - 2 1/2 stories or 35 feet. 6. It shall be required for all single-family dwellings that there be an attached garage constructed of a minimum of four hundred (400) square feet, with no dimension less than 20 feet. Total garage space shall not exceed one thousand (1,000) square feet. Detached garages or accessory storage buildings above 120 square feet are not permitted. Accessory storage buildings below 120 square feet must meet 5-foot side and rear yard setbacks and be located within the rear yard. 7. The minimum finished floor area above grade for all homes shall be: • One story with basement: 1,400 square feet. • Multi-level dwellings: 1,500 square feet. City of Blaine Page 6 Planning Commission Minutes March 10, 2020 8. All homes to be constructed utilizing pre-approved exterior materials, roof pitches and elevations. All house exteriors to utilize maintenance-free materials to the extent possible. Care to be taken to utilize a variety of home styles, front elevations and colors to provide maximum housing variety within each neighborhood. Developer to establish criteria to ensure that adjacent single-family homes built within the development do not have the same exterior color or architectural elevations. 9. All homes shall have a minimum depth and width of 24 feet. 10. All residential dwellings must be built in conformance with the current edition of the Minnesota State Building Code. 11. Driveways shall not be constructed closer than 3 feet to the property line. All driveways and approaches shall be hard surfaced using concrete, bituminous asphalt or other city approved material that is consistent in durability and quality. 12. It shall be required that all yards of a new single-family dwelling be sodded over a minimum of 4 inches of topsoil (black dirt containing not more than 35 percent sand). Yards may be seeded over 4 inches of black dirt if underground irrigation is installed with the home. 13. Each lot shall contain three new trees. Two yard trees must be overstory and be placed in the front yard. The third yard tree may be placed in the rear yard and may be a conifer, overstory, or ornamental. Minimum size for overstory tree is 2.5 inch caliper, 6-foot height on conifer, and 2 inch ornamental. 14. The plat contains a significant number of trees that will be removed as part of the grading for lots and storm water improvements. The city’s tree replacement requirements would require 32 (eight trees per acre) to be replaced. The 14 lots (with one corner lot) would normally plant 29 trees. This is best achieved by requiring as part of the DF zoning approval the planting of 3 trees per lot (42 trees) as shown on the attached landscape plan. Motion seconded by Commissioner Halpern. The motion passed 4-0.
