CITY OF BLUE SPRINGS, MISSOURI MINUTES OF COUNCIL MEETING AUGUST 21, 2017 A meeting of the City Council of the City of Blue Springs, Missouri, was held on Monday, August 21 , 2017, 5:30p.m. in the Council Chambers of the Howard L. Brown Public Safety Building, 1100 Smith Street with Mayor Carson Ross presiding. COUNCILMEN IN Jerry Kaylor Dale Carter ATTENDANCE Chris Lievsay Kent Edmondson Ron Fowler Susan Culpepper Also present were City Administrator Eric Johnson, Assistant City Adm inistrator Christine Cates, City Attorney Jacqueline Sommer, and City Clerk Sheryl Morgan. CALL MEETING Mayor Ross called the City Council meeting to order and led the TO ORDER audience in the Pledge of Allegiance. CLOSED SESSION At 5:30p.m. , Councilman Edmondson moved for the Council go into closed session pursuant to Section 610.021 , subparagraph (1 ), Revised Statutes of Missouri, for the purpose of privileged communications between a governmental body or its representative and legal counsel relating to litigation and that any minutes, documents and other records discussed or taken during the closed session remain closed , and at the conclusion of the closed session, Council shall return to Open Session. Motion seconded by Councilman Edmondson and carried with the following votes: Councilman Lievsay - Aye Councilman Edmondson - Aye Councilman Fowler- Aye Councilman Culpepper- Aye Councilman Carter- Aye Councilman Kaylor- Aye Mayor Ross -Aye PUBLIC HEARING- Mayor Ross opened the Public Hearing to consider amendments to UNIFIED DEVELOPMENT the Unified Development Code at 6:02 p.m. The minutes of the CODE AMENDMENTS public hearing were recorded by a certified court reporter. City Clerk Sheryl Morgan entered one exhibit into the record for the public hearing. STAFF REPORT Community Development Director Scott Allen presented the requested amendments to the Blue Springs Unified Development Code. Mr. Allen stated the amendments were unanimously recommended for approval by the Downtown Review Board, Development Advisory Commission, and Planning Commission. City Attorney Jacqueline Sommer outlined three scrivener's errors in in the Bill and distributed a Memo outlining the three minor changes required . A copy of the Memo is attached to these Minutes for reference. The Mayor hearing no further comments for or against, closed the public hearing at 6:08p.m . INTRODUCTION AND 15 T Councilman Culpepper introduced Bill No. 4510 approving READING - BILL NO. amendments to Unified Development Code. City Clerk Sheryl 4510- AMENDMENT TO Morgan made the first reading of Bill No. 4510 by title; copies of the UNIFIED DEVELOPMENT proposed Bill having previously been made available to the public. CODE Councilman Fowler moved to approve Bill No. 4510 upon its first reading and proceed with the second reading . Motion seconded by Councilman Kaylor and carried with the following vote: Councilman Fowler- Aye Councilman Culpepper- Aye Councilman Carter- Aye Councilman Kaylor- Aye Councilman Edmondson -Aye Councilman Lievsay - Aye Mayor Ross -Aye PUBLIC HEARINGS - Mayor Ross opened the Public Hearings on the Rezoning of the REZONING (RZ-07-17- Villas at the Parkway from "GB/ADP-0 & SO/ADP-0" (General 5925) AND PLANNED Business/Adams Dairy Parkway Overlay & Service Office/Adams DEVELOPMENT Dairy Parkway Overlay) to "MF-10/ADP-0" (Low Density Multi- CONCEPT PLAN (PDC- Family/Adams Dairy Parkway Overlay) (RZ-07-17-5925) and the 07-17-5924) FOR THE Planned Development (PO) Concept Plan for the Villas at the VILLAS AT THE PARKWAY Parkway (PDC-07-17-5924) concurrently at 6:09p.m. The minutes of the public hearing were recorded by a certified court reporter. City Clerk Sheryl Morgan entered one exhibit for each public hearing into the record for the public hearing. STAFF REPORT Community Development Director Scott Allen presented the proposed Rezoning and Planned Development Concept Plan for the Villas at the Parkway. Mr. Allen stated the Planning Commission unanimously recommended both items on August 14, 2017. APPLICANT Scott Auman of SWD Architects discussed the plan for the original Adams Dairy building at the location. Mr. Auman stated he will request the owners to construct a monument to recognize the original building. IN OPPOSITION TO Vernon Scoville expressed his concern about tearing down the Adams Dairy Building which he considers a Blue Springs icon. "G B/ADP-0 & SO/ADP-0" (General Business/Adams Dairy 4511 - REZONING THE Parkway Overlay & Service Office/Adams Dairy Parkway Overlay) VILLAS AT THE to "MF-10/ADP-0" (Low Density Multi-Family/Adams Dairy Parkway PARKWAY (RZ-07-17- Overlay) for approximately 3.2 +/- acres located on the east side of 5925) NE Napoleon Drive between NE R. D. Mize Road and NE Adams Dairy Parkway. Rezoning includes Lot 1, the Parkway, 2nd Plat and Part of Lot 2, Parkway West 1st Plat, Lots 1 thru 3 development. City Clerk Sheryl Morgan made the first reading of Bill No. 4511 by title; copies of the proposed Bill having previously been made available to the public. Councilman Fowler moved to approve Bill No. 4511 upon its first reading and proceed with the second reading. Ms. Morgan made the second reading of Bill No. 4511 by title. 4511 Councilman Carter moved to adopt Bill No. 4511 upon its second reading and give it ORDINANCE NO. 4680, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilman Edmondson and carried with the following vote after discussion: COUNCIL DISCUSSION Council and staff discussed the possibility of restricted parking to allow for better access for emergency vehicles. A motion to continue this EAGLE'S CREEK (PDC- public hearing is in order. 07 -17 -5930) MOTION TO CONTINUE Councilman Edmondson moved to continue the public hearing on PDC-07-17-5930 the Planned Development Concept Plan for Eagle's Creek to the September 6, 2017 Council meeting. MARY'S Mary's 2nd Plat at 6:30 p.m. The Applicant is requesting the public 2ND PLAT (RZ-06-17-5874) hearing be continued to the September 6, 2017 Council meeting. A motion to continue this public hearing is in order. MOTION TO CONTINUE Councilman Edmondson moved to continue the public hearing on (RZ-06-17 -587 4) the rezoning St. Mary's 2nd Plat to the September 6, 2017 Council meeting. Motion seconded by Councilman Culpepper and carried unanimously. INTRODUCTION AND 15 T Councilman Culpepper introduced Bill No. 4513 amending Section READING - BILL NO. 120.280 of the Code of Ordinances to establish and clarify the 4513- AMEND CODE number, appointment and qualification of members of the RELATING TO Development Advisory Commission.
