CITY OF BLUE SPRINGS, MISSOURI MINUTES OF COUNCIL MEETING MARCH 5, 2018 A meeting of the City Council of the City of Blue Springs, Missouri, was held on Monday, March 5, 2018, 6:00 p.m. in the Council Chambers of the Howard L. Brown Public Safety Building, 1100 Smith Street with Mayor Carson Ross presiding. COUNCILMEN IN Jerry Kaylor Dale Carter ATTENDANCE Chris Lievsay Kent Edmondson Ron Fowler Susan Culpepper Also present were Assistant City Administrator Christine Cates, City Attorney Jacqueline Sommer, and City Clerk Sheryl Morgan. CALL MEETING Mayor Ross called the City Council meeting to order and Scouts TO ORDER from Troop 4175 led in the Pledge of Allegiance. APPROVE CITY COUNCIL Councilman Culpepper moved to approve the Minutes of the MINUTES February 20, 2018 City Council meeting. Motion seconded by Councilman Edmondson and carried with the following votes: Councilman Kaylor - Aye Councilman Carter - Aye Councilman Lievsay - Aye Councilman Edmondson - Aye Councilman Fowler - Aye Councilman Culpepper - Aye Mayor Ross - Aye RESOLUTION NO. 13- Councilman Culpepper moved to adopt Resolution No. 13-2018 2018 - JACKSON approving an agreement with the Cities of Buckner, Grain Valley, COUNTY DRUG TASK Grandview, Greenwood, Independence, Lake Lotawana, Lake FORCE Tapawingo, Lee's Summit, Lone Jack, Oak Grove, Raytown and Sugar Creek, all of the State of Missouri; Missouri Highway Patrol, and Jackson County, Missouri, including the Jackson County Sheriff's Office for law enforcement services related to the Jackson County Drug Task Force. Motion seconded by Councilman Edmondson and carried with the following votes: Councilman Kaylor - Aye Councilman Carter - Aye Councilman Lievsay - Aye Councilman Edmondson - Aye Councilman Fowler - Aye Councilman Culpepper - Aye Mayor Ross - Aye LIQUOR LICENSE - EAST Councilman Culpepper moved to approve a new liquor license for FORTY BREWING LLC East Forty Brewing LLC dba East Forty Brewing located at 1201 Main St, Suite A, Blue Springs, MO 64015 to manufacture, distill and blend intoxicating liquors as well as retail selling intoxicating liquors by the drink for consumption on premises to include Sunday sales, Restaurant-Bar/Lounge Bar. Dirty Harry's Pub LLC used to occupy this space. Motion seconded by Councilman Edmondson and carried with the following votes: Councilman Kaylor - Aye Councilman Carter - Aye Councilman Lievsay - Aye Councilman Edmondson - Aye Councilman Fowler - Aye Councilman Culpepper - Aye Mayor Ross - Aye RESOLUTION NO. 14• Councilman Culpepper moved to adopt Resolution No. 14-2018 2018 -AMENDMENT TO approving an amendment in the amount of $43,329.00 to contract# ON CALL ELECTRICAL 2015-096.1 A with Superior Electrical Construction, Inc. for On Call SERVICES CONTRACT Electrical Services. Motion seconded by Councilman Edmondson and carried with the following votes: Councilman Kaylor - Aye Councilman Carter - Aye Councilman Lievsay - Aye Councilman Edmondson - Aye Councilman Fowler - Aye Councilman Culpepper - Aye Mayor Ross - Aye RESOLUTION NO. 15- Councilman Culpepper moved to adopt Resolution No. 15-2018 2018 - DISPOSITION OF approving the disposition of Information Technology, Finance and RECORDS Community Development department records which have met the required retention period as prescribed by the Blue Springs Records Retention, Management, and Destruction Policy dated November 28, 2016 and in accordance with the Missouri Secretary of State's records retention guidelines. Motion seconded by Councilman Edmondson and carried with the following votes: Councilman Kaylor - Aye Councilman Carter - Aye Councilman Lievsay - Aye Councilman Edmondson - Aye Councilman Fowler - Aye Councilman Culpepper - Aye Mayor Ross - Aye PUBLIC HEARING - Mayor Ross opened the Public Hearing to consider an Industrial FAURECIA INTERIOR Development Project and issuance of Chapter 100 Bonds for SYSTEMS, INC. - Faurecia Interior Systems, Inc. at 6:02 p.m. The minutes of the public INDUSTRIAL hearing were recorded by a certified court reporter. City Clerk Sheryl DEVELOPMENT PROJECT AND CHAPTER Morgan entered two exhibits into the record. 100 BONDS 2 March 5, 2018 City Council Meeting Page 3 STAFF REPORT Mark Stombaugh, Economic Growth and Development Manager, reviewed the details of the request for Chapter 100 Bonds and the Industrial Development Project. The Mayor hearing no further comments for or against, closed the public hearing at 6:06 p.m. INTRODUCTION AND 1ST Councilman Culpepper introduced Bill No. 4552 approving the plan READING - BILL NO. for an Industrial Development Project and the issuance of Chapter 4552 - FAURECIA 100 Bonds for Faurecia Interior Systems, Inc. City Clerk Sheryl INTERIOR SYSTEMS, INC. - INDUSTRIAL Morgan made the first reading of Bill No. 4552 by title; copies of the DEVELOPMENT proposed Bill having previously been made available to the public. PROJECT AND CHAPTER 100 BONDS Councilman Fowler moved to approve Bill No. 4552 upon its first reading and proceed with the second reading. Motion seconded by Councilman Edmondson and, after Council discussion, carried unanimously. 2ND READING - BILL NO. Ms. Morgan made the second reading of Bill No. 4552 by title. 4552 Councilman Carter moved to adopt Bill No. 4552 upon its second reading and give it ORDINANCE NO. 4721, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilman Kaylor and carried with the following vote: Councilman Lievsay - Aye Councilman Edmondson - Aye Councilman Fowler - Aye Councilman Culpepper -Aye· Councilman Carter - Aye Councilman Kaylor - Aye Mayor Ross - Aye PUBLIC HEARING - TAX Mayor Ross opened the Public Hearing on the Tax Increment INCREMENT FINANCING Financing and Economic Development Incentives Annual Report at AND ECONOMIC 6:08 p.m. The minutes of the public hearing were recorded by a DEVELOPMENT INCENTIVES ANNUAL certified court reporter. City Clerk Sheryl Morgan entered one REPORT exhibit into the record. STAFF REPORT Assistant City Administrator Christine Cates provided an update on Tax Increment Financing and Economic Development Incentive as required by Section 99.865 RSMo. The report included an update on all Tax Increment Financing projects that are currently active, as well as the South Area Neighborhood Improvement District and Land Bank. A copy of the PowerPoint presentation and Annual Report are attached to these Minutes and incorporated herein. The Mayor hearing no further comments for or against, closed the public hearing at 6:21 p.m. MOTION TO CONTINUE - Councilman Culpepper moved to continue the public hearing on the REZONE SOUTHWEST proposed rezoning of Southwest Park to the March 19, 2018 Council PARK (RZ-12-17-6192) meeting. Motion seconded by Councilman Carter and carried unanimously. 3 March 5, 2018 City Council Meeting Page 4 MOTION TO CONTINUE - Councilman Culpepper moved to continue the public hearing on the AMENDMENT TO MALL Amendment to Mall at Fall Creek Community Improvement District AT FALL CREEK CID and Amendment to Cooperative Agreement to the March 19, 2018 AND AMENDMENT TO Council meeting. Motion seconded by Councilman Carter and COOPERATIVE AGREEMENT carried unanimously. MOTION TO CONTINUE - Councilman Culpepper moved to continue the public hearing on the AMENDMENTS TO proposed amendments to the Unified Development Code to the UNIFIED DEVELOPMENT March 19, 2018 Council meeting. Motion seconded by Councilman CODE (UDCT-02-18-6233) Carter and carried unanimously. PRESENTATION - Bill Large, Fire Chief for Lotawana and Prairie Township Fire PRAIRIE TOWNSHIP FIRE Protection Districts, will give a presentation on the consolidation of PROTECTION DISTRICT the two fire districts into one new district, the Southern Jackson County Fire Protection District. A copy of the PowerPoint presentation and documents presented to Council are attached to these Minutes by reference. INTRODUCTION AND 1ST Councilman Culpepper introduced Bill No. 4551 approving the Final READING - BILL NO. Plat for Blue Springs City Hall. City Clerk Sheryl Morgan made the 4551 - FINAL PLAT BLUE first reading of Bill No. 4551 by title; copies of the proposed Bill SPRINGS CITY HALL (PF- having previously been made available to the public. 12-17-6187) Councilman Fowler moved to approve Bill No. 4551 upon its first reading and proceed with the second reading. Motion seconded by Councilman Lievsay and, after Council discussion, carried unanimously. 2ND READING - BILL NO. Ms. Morgan made the second reading of Bill No. 4551 by title. 4551 Councilman Carter moved to adopt Bill No. 4551 upon its second reading and give it ORDINANCE NO. 4722, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilman Edmondson and carried with the following vote: Councilman Fowler - Aye Councilman Culpepper - Aye Councilman Carter - Aye Councilman Kaylor - Aye Councilman Edmondson - Aye Councilman Lievsay - Aye Mayor Ross - Aye MAYORAL Police Chief Bob Muenz introduced the assessors from the ANNOUNCEMENTS Commission on Accreditation for Law Enforcement Agencies, Inc. who were on-site to conduct the Police Department's re- accreditation process. Chief Muenz also invited the Council and Public to attend a session to hear public comments related to the Blue Springs Police Department on Wednesday evening, March 7th at 5:30 p.m. in the Council Chambers at the Public Safety Building.
