CITY OF BLUE SPRINGS, MISSOURI MINUTES OF COUNCIL MEETING NOVEMBER 16, 2020 A meeting of the City Council of the City of Blue Springs, Missouri, was held on Monday, November 16, 2020, 6:00 p.m. in the Council Chambers of the Howard L. Brown Public Safety Building, 1100 Smith Street with Mayor Carson Ross presiding. Face coverings were required pursuant to Order of the Jackson County Health Director dated July 1, 2020, and Phase 2.5 of the Eastern Jackson County Recovery Plan. COUNCILMEMBERS IN Jerry Kaylor Galen Ericson ATTENDANCE Chris Lievsay Kent Edmondson Ron Fowler Susan Culpepper Also present were City Administrator Eric Johnson, Assistant City Administrator Christine Cates, City Attorney Jacqueline Sommer, and City Clerk Sheryl Morgan. CALL MEETING TO Mayor Ross called the meeting to order at 6:00 p.m. and led in the ORDER Pledge of Allegiance. CONSENT AGENDA Councilmember Ericson moved to approve the following Consent Agenda items and the motion was seconded by Councilmember Kaylor. • Minutes of the November 2, 2020 City Council Meeting • Liquor license for Shmaz LLC dba Food Mart located at 501 NE Napoleon Drive Blue Springs, MO 64014, to sell retail intoxicating liquors in the original package, for consumption off premises, including Sunday retail selling of intoxicating liquors by the drink for consumption on premises; or in original package for consumption on or off premises and wine tasting • Resolution No. 105-2020 approving a contract amendment with Stirling Lawn and Landscape, Inc OBA US Lawns of Kansas City to include additional acreage at Hidden Valley Park • Liquor license for Cubed Wine Bar located at 807 W Main Street Suite C, Blue Springs, MO 64015, to sell retail intoxicating liquors by the drink for consumption on premises, Restaurant Bar/Lounge, to include Sunday retail selling of intoxicating liquors by the drink, on the premises; or in original package for consumption on or off premise. City SOUTH STATE ROUTE 7 (ANNX-10-20-7527) Clerk Sheryl Morgan entered one exhibit into the record. STAFF REPORT Interim Community Development Director Mike Mallon reviewed the details of the proposed annexation. The Mayor hearing no further comments for or against, closed the public hearing at 6:04 p.m. INTRODUCTION AND 1ST Councilmember Culpepper introduced Bill No. 4819 annexing READING - BILL NO. 4819 approximately 1.92 +/- acres property at Cowherd Road right-of-way -ANNEXATION OF located west of the intersection of East Cowherd Road and South PROPERTY NEAR EAST State Route 7 into the City limits (ANNX-10-20-7527). City Clerk COWHERD ROAD AND Sheryl Morgan made the first reading of Bill No. 4819 by title; copies SOUTH STATE ROUTE 7 (ANNX-10-20-7527) of the proposed Bill having previously been made available to the public. Councilmember Fowler moved to approve Bill No. 4819 upon its first reading and proceed with the second reading at the City Council Meeting on December 7, 2020. Motion seconded by Councilmember Culpepper and carried unanimously. PUBLIC HEARING - Mayor Ross opened the Public Hearing to consider annexing property ANNEXATION OF (approximately 1.20 +/- acres), Shepherd Road right-of-way, located SHEPHERD ROAD RIGHT- at the east of the intersection of NW RD Mize Road and NW Shepherd OF-WAY LOCATED NEAR Road into the City limits (ANNX-10-20-7526) at 6:05 p.m. The minutes NW RD MIZE ROAD AND of the public hearing were recorded by a certified court reporter. PUBLIC HEARING - Mayor Ross opened the Public Hearing to consider approving the AMENDED PR-O Amended PR-O Concept Plan for Adams Pointe Village, located at CONCEPT PLAN FOR 2610 East RD. Mize Road and 403 & 701 NE Greenview Drive, to ADAMS POINTE VILLAGE reduce the approved open space in the Adams Pointe Village (PROC-10-20-7532) subdivision in an effort to enlarge the lot sizes of several residential properties and to change the housing classification of Lot 43 from Class A to Class B (PROC-10-20-7532) at 6:13 p.m. The minutes of the public hearing were recorded by a certified court reporter. City Clerk Sheryl Morgan entered one exhibit into the record. STAFF REPORT Senior Planner Nathan Jury reviewed the details of the project. APPLICANT Tyler Sallee was present to answer any questions of Council regarding the project. IN SUPPORT OF Melodie Chrisman of Community Services League addressed Council expressing gratitude for funds dedicated to CSL. The Mayor hearing no further comments for or against, closed the public hearing at 6:25 p.m. RESOLUTION NO. 106- Councilmember Culpepper moved to adopt Resolution No. 106-2020 2020 - SUBSTANTIAL approving substantial amendments to the 2019-2020 CDBG Annual AMENDMENTS TO THE Action Plan to accommodate and allocate $230,469 in CDBG-CV 2019-20 CDBG ANNUAL funds received through the CARES Act. Motion seconded by ACTION PLAN Councilmember Kaylor and carried unanimously. INTRODUCTION AND 1ST Councilmember Culpepper introduced Bill No. 4822 authorizing legal READING - BILL NO. 4822 counsel to institute condemnation proceedings if property interests - AUTHORIZING LEGAL cannot be acquired by purchase through good faith negotiations and COUNSEL TO INSTITUTE authorizing the City to file a Petition for Voluntary Annexation following CONDEMNATION acquisition of the permanent right of way. Councilmember Fowler moved to approve Bill No. 4822 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Kaylor and carried with a vote of 5-2 (Councilmembers Edmondson and Lievsay voting NO). 2ND READING - BILL NO. Ms. Morgan made the second reading of Bill No. 4822 by title. 4822 Councilmember Fowler moved to adopt Bill No. 4822 upon its second reading and give it ORDINANCE NO. 4965, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Kaylor and carried with the following vote: Fowler-Aye Culpepper - Aye Ericson - Aye Kaylor-Aye Edmondson - NO Lievsay- NO Mayor Ross - Aye MAYORAL Mayor Ross wished everyone a happy Thanksgiving and reminded to ANNOUNCEMENTS practice suggestions regarding social distancing. Mayor Ross announced the 2020 Mayor's Tree Lighting will be a virtual event this year and will be in conjunction with lighting the downtown gateway and buildings. There will not be children's choirs singing or other activities at City Hall. Council expressed appreciation to Downtown Alive! for fundraising efforts to make the downtown lighting to possible. November 16, 2020 City Council Minutes Page 5 Councilmember Culpepper reminded that leaves should not be blown into the street as this causes blockages in the City's drainage system. City Administrator Eric Johnson announced that staff will be reviewing the anticipated County Health direction and expects upcoming City Council meetings to be held virtually until further notice. (Mattie Stepanek) CLOSED SESSION At 6:38 p.m., Councilmember Kaylor moved for the Council go into closed session pursuant to Section 610.021(2), Revised Statutes of Missouri, for the purpose of privileged communications between a governmental body or its representative and legal counsel relating to real estate, and that any minutes, documents and other records discussed or taken during the closed session remain closed, and that the special meeting of this body stand adjourned at the completion of such session.
