CITY OF BLUE SPRINGS, MISSOURI MINUTES OF COUNCIL MEETING NOVEMBER 15, 2021 A meeting of the City Council of the City of Blue Springs, Missouri, was held on Monday, November 15, 2021, 6:00 p.m. in the Council Chambers of the Howard L. Brown Public Safety Building, 1100 SW Smith Street., Blue Springs, Missouri with Mayor Pro Tern Kent Edmondson presiding. COUNCILMEMBERS IN Jerry Kaylor Galen Ericson ATTENDANCE Chris Lievsay Kent Edmondson Ron Fowler Susan Culpepper Also present were Acting City Administrator Christine Cates, City Attorney Jacqueline Sommer, and Deputy City Clerk Julia Porter. CALL MEETING TO Mayor Pro Tern Edmondson called the meeting to order at 6:00 p.m. ORDER and Boy Scout Troop 763 of Chapel Hill Presbyterian Church led in the pledge of allegiance. The Deputy City Clerk confirmed a quorum of the Council was present. CONSENT AGENDA Councilmember Culpepper moved to approve the following Consent Agenda items and the motion was seconded by Councilmember --------------+-ricsor-.-------------------------- • Minutes of the October 18, 2021 City Council Meeting and the Minutes of the October 22 and 23, 2021 City Council Strategic Planning Session • Resolution No. 97-2021 approving an Amendment/Change Order in the amount of $15,000.00 with Shawnee Mission Tree Service, Inc. dba Arbor Masters Tree and Landscape for Tree Services • Resolution No. 98-2021 approving the disposition of Information Technology department records which have met the required retention period as prescribed by the Blue Springs Records Retention, Management, and Destruction Policy dated November 28, 2016 and in accordance with the Missouri Secretary of State's records retention guidelines • Resolution No. 99-2021 entering into a contract in the amount of $61,105.00 with Triad, Inc, for the replacement of shingle roofs at Hidden Valley Park's baseball concession/restroom buildings and press box • Resolution No. 100-2021 approving a purchase in the amount of $199,924.00 from Veolia Water Technologies, Inc. dba Kruger for panel filters for the Wastewater Treatment system • Resolution No. 101-2021 approving an agreement with the Mid- America Regional Council's Solid Waste Management District to participate in the 2022 Regional Household Hazardous Waste Collection Program • Resolution No. 102-2021 appointing Successor Directors to the North Blue Springs Community Improvement District • Resolution No. 103-2021 approving a Compensation Philosophy • Liquor License for KS Crown LLC dba Crown Liquor 2 located at 1922 NW Woods Chapel Rd., Blue Springs, MO 64015, to sell intoxicating liquors in the original package, for consumption off premises, to include retail selling on Sunday intoxicating liquor on November 15, 2021 City Council Minutes Page 2 the premises where sold, in original package at retail not to be opened or consumed on the premises where sold, or in retailer- packaged container for off-premises consumption • Liquor License for GB License LLC dba GoPuff located at 1715 SW 7 Highway, Blue Springs, MO 64015, to sell intoxicating liquors in the original package, for consumption off premises, to include retail selling on Sunday intoxicating liquor on the premises where sold, in original package at retail not to be opened or consumed on the premises where sold, or in retailer-packaged container for off-premises consumption • Resolution No. 104-2021 approving a purchase in the amount of $61,246.00 from Joe Machens Ford Lincoln for two vehicles for Codes Administration in the Community Development Department The above Consent Agenda items were approved with the following vote: Kaylor-Aye Ericson - Aye Lievsay - Aye Culpepper - Aye Fowler-Aye Mayor Pro Tern Edmondson - Aye PUBLIC HEARING - Mayor Pro Tern Edmondson advised the Council the applicant, Tyler REZONING (RZ-09-21- Sallee, Sallee Development, on behalf of the property owners, CB&T -----1956·)-AND-Pt;ANNEDr---Holaings 11-icc and The Gardens at Chapman Farms Homes DEVELOPMENT CONCEPT Association, Inc., has requested a continuance of the public hearing PLAN (PDC-0 9 -21 •7957 ) to the December 6, 2021 Council Meeting. Councilmember Culpepper FOR CHAPMAN RIDGE 2ND PHASE- MOTION TO moved to continue the public hearing for consideration of a Rezoning CONTINUE (RZ-09-21-7956) and a Planned Development (PD) Concept Plan (PDC-09-21-7957) be continued to the December 6, 2021 City Council meeting (Continued from October 18, 2021 Council meeting). Motion seconded by Councilmember Ericson and carried unanimously. Lievsay - Aye Culpepper - Aye Fowler-Aye Kaylor-Aye Ericson - Aye Mayor Pro Tern Edmondson -Aye PUBLIC HEARING - Mayor Pro Tern Edmondson advised the Council the applicant, Brad REZONING (RZ-09-21- Kempf, representing Clayton Properties Group, Inc. dba Summit 7963) AND PLANNED UNIT Homes, on behalf of the property owners, Chariton Lands Investors, DEVELOPMENT CONCEPT LLC, CB&T Holdings II LLC, and Chariton Capital Management, LLC, PLAN (PUDC-09-21-7964) has requested a continuance of the public hearing to the December 6, FOR THE RETREAT AT CHAPMAN FARMS - 2021 Council Meeting. Councilmember Culpepper moved to continue MOTION TO CONTINUE the public hearing for consideration of a Rezoning (RZ-09-21-7963) and a Planned Unit Development Concept Plan (PUDC-09-21-7964) be continued to the December 6, 2021 City Council meeting (The public hearing was opened, testimony was taken, and the hearing was continued from the October 18, 2021 Council meeting). Motion seconded by Councilmember Lievsay and carried unanimously. Fowler-Aye Kaylor-Aye Ericson - Aye Lievsay - Aye Culpepper - Aye Mayor Pro Tern Edmondson - Aye INTRODUCTION AND 1ST Councilmember Culpepper introduced Bill No. 4923 approving the READING - BILL NO. 4923 Final Plat for Cambridge Park - -1st Plat (PF-10-21-8002) Cambridge - FINAL PLAT FOR November 15, 2021 City Council Minutes Page 3 CAMBRIDGE PARK, 1sr Park, generally located North of SE Major Rd. at SE 6th St. Deputy PLAT (PF-10-21-8002) City Clerk Julia Porter made the first reading of Bill No. 4923 by title; copies of the proposed Bill having previously been made available to the public. Councilmember Fowler moved to approve Bill No. 4923 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Lievsay and, after Council discussion, carried with a vote of 4-2 with Councilmembers Culpepper and Ericson voting no. 2ND READING - BILL NO. Ms. Porter made the second reading of Bill No. 4923 by title. 4923 Councilmember Fowler moved to adopt Bill No. 4923 upon its second reading and give it ORDINANCE NO. 5060, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Lievsay and carried with the following vote: Ericson - No Lievsay - Aye Culpepper - No Fowler-Aye Kaylor-Aye Mayor Pro Tern Edmondson - Aye INTRODUCTION AND 1ST Councilmember Culpepper introduced Bill No. 4924 amending the City READING - BILL NO. 4924 Council District boundaries as adopted by Ordinance No. 5057 to -AMEND CITY COUNCIL correct a mapping and district boundary description discrepancy to ~----LJDIS+RIC1'-BOUNDARIES ensure Coonc1rDistr1ct 1 Is contiguous and compact by moving the AS ADOPTED BY ORD- Adams Dairy Parkway Right-of-Way (ROW) between US Highway 40 5057 on the north and Ryan Road on the south from District 2 to District 1. Deputy City Clerk Julia Porter made the first reading of Bill No. 4924 by title; copies of the proposed Bill having previously been made available to the public. Councilmember Fowler moved to approve Bill No. 4924 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Kaylor and, after Council discussion, carried unanimously. 2ND READING - BILL NO. Ms. Porter made the second reading of Bill No. 4924 by title. 4924 Councilmember Fowler moved to adopt Bill No. 4924 upon its second reading and give it ORDINANCE NO. 5061, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Kaylor and carried with the following vote: Culpepper - Aye Fowler-Aye Kaylor-Aye Ericson - Aye Lievsay - Aye Mayor Pro Tern Edmondson - Aye INTRODUCTION AND 1ST Councilmember Culpepper introduced Bill No. 4925 amending Article READING - BILL NO. 4925 11 City Districts, Section 105. 060 City Districts Established - -AMEND SECTION Boundaries, of the Code of Ordinances, City of Blue Springs, Missouri, 105.060 OF THE CODE TO to reflect the new City Districts established by Ordinance No. 5057 on REFLECT NEW CITY October 18, 2021 as corrected on November 15, 2021. Deputy City DISTRICTS Clerk Julia Porter made the first reading of Bill No. 4925 by title; copies of the proposed Bill having previously been made available to the public. November 15, 2021 City Council Minutes Page 4 Councilmember Fowler moved to approve Bill No. 4925 upon its first reading and proceed with the second reading . Motion seconded by Councilmember Kaylor and carried unanimously. 2ND READING - BILL NO . Ms. Morgan made the second reading of Bill No. 4925 by title . 4925 Councilmember Fowler moved to adopt Bill No . 4925 upon its second reading and give it ORDINANCE NO. 5062, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Kaylor and carried with the following vote : Kaylor-Aye Ericson - Aye Lievsay - Aye Culpepper - Aye Fowler-Aye Mayor Pro Tern Edmondson - Aye PRESENTATION - Assistant Emergency Management Director for CJCEMA, Melinda CJCEMA OUTDOOR Cheney, presented information on new Commander One software and WARNING SIRENS its capabilities for outdoor warning sirens . A copy of the PowerPoint Presentation are attached hereto and made a part of the Minutes. PRESENTATION- LAND Julia Porter, Board Secretary for the Land Bank of Blue Springs, BANK ANNUAL REPORT presented the Land Bank Annual Report for FY 2020-21 and FY 2020-21 addressed questions from the Council. A copy of the PowerPoint Presentation and the Land Bank Annual Report are attached hereto -aria ma e a part of the Minutes. MAYORAL Mayor Pro Tern Edmondson reminded the public that the Mayor's ANNOUNCEMENTS Christmas Tree Lighting Ceremony is at City Hall on Tuesday , November 30 at 6:00 p.m. Thoughts to Ponder: "It's not about what it is, it's about what it can become." (Dr. Suess) CLOSED SESSION At 6:30 p.m ., Councilmember Kaylor moved for the Council go into closed session pursuant to Section 610.021 (1) and (2) Revised Statutes of Missouri, for the purpose of privileged communications between a governmental body or its representative and legal counsel relating to litigation and real estate , and that any minutes, documents and other records discussed or taken during the closed session remain closed, and that the special meeting of this body stand adjourned at the completion of such session.
