CITY OF BLUE SPRINGS, MISSOURI MINUTES OF COUNCIL MEETING JUNE 6, 2022 A meeting of the City Council of the City of Blue Springs, Missouri, was held on Monday, June 6, 2022, 6:00 p.m. in the Council Chambers of the Howard L. Brown Public Safety Building, 1100 SW Smith Street., Blue Springs, Missouri with Mayor Pro Tempore Chris Lievsay presiding. COUNCILMEMBERS IN Jerry Kaylor Galen Ericson ATTENDANCE Chris Lievsay Kent Edmondson Ron Fowler Susan Culpepper Also present were City Administrator Mike Ekey, Assistant City Administrator Christine Cates, City Attorney Jacqueline Sommer, and City Clerk Sheryl Morgan. CALL MEETING TO Mayor Pro Tern Lievsay called the meeting to order at 6:00 p.m. and ORDER AND Councilmember Fowler led in the pledge of allegiance. The City Clerk CONFIRMATION OF confirmed a quorum of the Council was present. Mayor Pro Tern QUORUM Lievsay stated Mayor Ross was out of town and would be returning for the meeting on June 21. CONSENT AGENDA Mayor Pro Tern Lievsay stated he received requests to have Items 3c - Acting City Administrator and 3f - Amendment to Contract with Mccown Gordon for Aquatic Center pulled for separate discussion and consideration. Councilmember Edmondson moved to approve the following Consent Agenda items and the motion was seconded by Councilmember Culpepper. • Minutes of the May 16, 2022 City Council Meeting and Minutes of the May 24, 2022 Special City Council Meeting • Resolution No. 39-2022 designating Friday, September 16 through Sunday, September 18, 2022 as the dates for the 2022 Blue Springs Fall Fun Festival • Resolution No. 41-2022 approving the disposition of Information Technology, Law, and Economic Development department records which have met the required retention period as prescribed by the Blue Springs Records Retention, Management, and Destruction Policy dated November 28, 2016 and in accordance with the Missouri Secretary of State's records retention guidelines • Resolution No. 42-2022 approving a contract amendment with SFS Architecture Inc., for increases in Basic Services and Supplemental Services related to the construction of the Blue Springs Aquatic Center for the sum of $525,721 • Resolution No. 44-2022 approving a contract in the amount of $739,085.00 with The Public Restroom Company, for Park Restroom facilities June 6, 2022 City Council Minutes Page 2 The above Consent Agenda items were approved with the following vote: Kaylor-Aye Edmondson - Aye Fowler-Aye Culpepper - Aye Ericson - Aye Mayor Pro Tern Lievsay - Aye Mayor Ross -Absent AMEND RESOLUTION NO. City Attorney Jacqueline Sommer stated an amendment to 43-2022 - AMENDMENT TO Resolution No. 43-2022 was in order to include the Contract as MCCOWN GORDON Exhibit A and incorporated into the Resolution. Councilmember CONTRACT Culpepper moved to amend Resolution No. 43-2022 to add the sentence "A copy of the proposed Addendum and Amendment is attached hereto as Exhibit A and is incorporated herein" to Section 1 of the Resolution. Motion seconded by Councilmember Ericson and approved unanimously. APPROVE RESOLUTION Council expressed their appreciation to Assistant City Administrator NO. 40-2022 AND Christine Cates for serving as Acting City Administrator since RESOUL TION NO. 43-2022, September of last year and stated there would be a small reception AS AMENDED for Ms. Cates immediately after the meeting. Councilmember Culpepper moved to approve Resolution No. 40- 2022 designating an Acting City Administrator in the absence of City Administrator Mike Ekey pursuant to Section 5.3 of the City of Blue Springs Home Rule Charter, and rescinding Resolution No. 63-2021 and Resolution No. 43-2022, as amended, to approve an Addendum and Amendment to the contract with Mccown Gordon Construction L.L.C., for early release packages in the amount of $1,000,000 related to the construction of the Blue Springs Aquatic Center. Motion seconded by Councilmember Ericson and carried unanimously. PUBLIC HEARING - Mayor Pro Tern Lievsay opened the Public Hearing to consider ANNEXATION OF approving an Annexation of property (approximately 1.85 +/- acres) PROPERTY FOR located at the southwest corner of Brookside Drive and SW Highway FLANDERS ASSET 7 into the City limits (ANNX-05-22-8272) at 6:05 p.m. The minutes of MANAGEMENT the public hearing were recorded by a certified court reporter. City (ANNX-05-22-8272) Clerk Sheryl Morgan entered one exhibit into the record. STAFF REPORT Community Development Director Mike Mallon reviewed the details of the proposed annexation and addressed questions from the Council. APPLICANTS The applicants were present and available for questions from Council. The Mayor Pro Tern hearing no further comments for or against, closed the public hearing at 6:08 p.m. INTRODUCTION AND 1ST Councilmember Culpepper introduced Bill No. 4987 approving the READING - BILL NO. 4987 Annexation of property (approximately 1.85 +/- acres) located at the -ANNEXATION OF southwest corner of Brookside Drive and SW Highway 7 into the City PROPERTY FOR limits (ANNX-05-22-8272). City Clerk Sheryl Morgan made the first FLANDERS ASSET MANAGEMENT June 6, 2022 City Council Minutes Page 3 (ANNX-05-22-8272) reading of Bill No. 4987 by title ; copies of the proposed Bill having previously been made available to the public. Councilmember Fowler moved to approve Bill No. 4987 upon its first reading and proceed with the second reading at the Council meeting on June 21, 2022. Motion seconded by Councilmember Kaylor and carried unanimously. PUBLIC HEARING - Mayor Pro Tern Lievsay advised the Council that the applicant, John REZONING (RZ-12-21- Broker, Dwellings by Design KC , has requested a continuance of the 8095) AND GENERAL public hearing to the July 5, 2022 Council Meeting . Councilmember DEVELOPMENT PLAN Culpepper moved to continue the public hearing for consideration to (GDP -12-21-8096) FOR rezone from Sub-Urban and General Urban to Urban Center (RZ-12- DWELLINGS BY DESIGN - MOTION TO CONTINUE 21-8095) for the 1.1317+/- acre multi-family residential development with a General Development Plan (GDP-12-21-8096) located 106 NW 9th Street and 110 SW 9th Street be continued to the July 5, 2022 City Council meeting . Motion seconded by Councilmember Ericson and carried unanimously. MAYORAL Thoughts to Ponder: ANNOUNCEMENTS "Those who have long enjoyed such as privileges as we enjoy forget in time that men have died to win them ." (President Franklin D. Roosevelt) Councilmember Kaylor congratulated Mayor Pro Tern Lievsay on recently graduating with his Juris Doctor degree from Law School. ADJOURNMENT At 6:11 p.m., there was no further business to come before the Council , Councilmember Ericson moved the meeting be adjourned.
