CITY OF BLUE SPRINGS, MISSOURI MINUTES OF COUNCIL MEETING JULY 5, 2022 A meeting of the City Council of the City of Blue Springs, Missouri, was held on Tuesday, July 5, 2022, 6:00 p.m. in the Council Chambers of the Howard L. Brown Public Safety Building, 1100 SW Smith Street., Blue Springs, Missouri with Mayor Carson Ross presiding. COUNCILMEMBERS IN Jerry Kaylor Galen Ericson ATTENDANCE Chris Lievsay Kent Edmondson Ron Fowler Susan Culpepper Also present were City Administrator Mike Ekey, Assistant City Administrator Christine Cates, City Attorney Jacqueline Sommer, Deputy City Clerk Julia Porter, and Assistant City Clerk Erin Ford. CALL MEETING TO Mayor Ross called the meeting to order at 6:00 p.m. and led in the ORDER AND pledge of allegiance. The Deputy City Clerk confirmed a quorum of the CONFIRMATION OF Council was present. QUORUM CONSENT AGENDA Councilmember Culpepper moved to approve the following Consent Agenda items and the motion was seconded by Councilmember Kaylor. • Minutes of the June 21, 2022 City Council Meeting • Resolution No. 50-2022 approving the disposition of Information Technology and Police Department records which have met the required retention period as prescribed by the Blue Springs Records Retention, Management, and Destruction Policy dated Nov. 28, 2016, and in accordance with the Missouri Secretary of State's records retention guidelines • Resolution No. 51-2022 approving a contract with AVI Systems Inc. in the amount of $164,313 for the purchase of equipment and labor to upgrade the Emergency Operations Center at the Police Department • Resolution No. 52-2022 approving a contract in the amount of $86,125 with Stantec Consulting Services Inc., for pavement management analysis and condition survey for the City's roadway system from CIP project ST-06 • Resolution No. 53-2022 rescinding Resolution No. 37-2022 approving Contract 2022-067 and approving an Elements XS Sales Agreement and Software License Agreement for Asset Management Program with Novotx LLC • Resolution No. 54-2022 approving a contract with Mid-America Regional Council (MARC) for reimbursement to continue meal preparation for congregate meals and meal delivery for homebound recipients as well as continuing to provide site transportation via OATS Inc. to and from Vesper Hall. This contract will also include frozen meal delivery to homebound patrons, evidence-based programming and the administration of Vesper Hall July 5, 2022 City Council Minutes Page 2 • Board Appointment: Land Bank of Blue Springs: New Appointment: Rodney Hill The above Consent Agenda items were approved with the following vote: Kaylor-Aye Ericson - Aye Lievsay - Aye Edmondson - Aye Fowler-Aye Culpepper - Aye Mayor Ross - Aye PUBLIC HEARING - Mayor Ross opened the Public Hearing to consider approval of an ANNEXATION OF 30002 W annexation of property at 30002 W Jefferson Road (approximately JEFFERSON ROAD FOR 46.92 +/-acres) into the City limits (ANNX-05-22-8313) at 6:02 p.m. VALLEY OAKS The minutes of the public hearing were recorded by a certified court INVESTMENTS LLC reporter. Deputy City Clerk Julia Porter entered one exhibit into the (ANNX-05-22-8313) record. STAFF REPORT Director of Community Development Mike Mallon reviewed the details of the proposed annexation and addressed questions from the Council. The Mayor hearing no further comments for or against, closed the public hearing at 6:05 p.m. INTRODUCTION AND 1ST Councilmember Culpepper introduced Bill No. 4994 approving an READING - BILL NO. 4994 annexation of property at 30002 W Jefferson Road (approximately -ANNEXATION OF 30002 46.92 +/-acres) into the City limits (ANNX-05-22-8313). Deputy City W JEFFERSON ROAD FOR Clerk Julia Porter made the first reading of Bill No. 4994 by title; copies ~~LELsF/M~~~: LLC of t~e proposed Bill having previously been made available to the (ANNX-05-22-8313) public. Councilmember Fowler moved to approve Bill No. 4994 upon its first reading and proceed with the second reading on August 1, 2022. Motion seconded by Councilmember Kaylor and carried unanimously. PUBLIC HEARING - Mayor Ross advised the Council that the City, on behalf of the DWELLINGS BY DESIGN applicant, John Broker, Dwellings by Design KC, has requested a KC REZONING AND continuance of the public hearing to a future meeting. The public GENERAL DEVELOPMENT hearing for consideration to rezone from Sub-Urban and General PLAN - MOTION TO Urban to Urban Center (RZ-12-21-8095) for the 1.1317+/- acre multi- CONTINUE family residential development with a General Development Plan (GDP -12-21-8096) located 106 NW 9th Street and 110 SW 9th Street is continued to a later Council meeting that will be determined by Staff. The Public Hearing was continued from the June 6, 2022, Council meeting without testimony. INTRODUCTION AND 1 ST Councilmember Culpepper introduced Bill No. 4995 approving the READING - BILL NO. 4995 Final Plat for Summit Behavioral Services, Lot 1, located at 2100 NW - FINAL PLAT FOR 7 Highway and 615 NW Manor Drive (PF-06-22-8317). Deputy City Clerk Julia Porter made the first reading of Bill No. 4995 by title; copies July 5, 2022 City Council Minutes Page 3 SUMMIT BEHAVIORAL of the proposed Bill having previously been made available to the SERVICES, LOT 1 public. (PF-06-22-8317) Councilmember Fowler moved to approve Bill No. 4995 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Kaylor and carried unanimously. 2ND READING - BILL NO. Ms. Porter made the second reading of Bill No. 4995 by title. 4995 Councilmember Fowler moved to adopt Bill No. 4995 upon its second reading and give it ORDINANCE NO. 5127, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Kaylor and carried with the following vote: Lievsay - Aye Edmondson - Aye Fowler-Aye Culpepper - Aye Ericson - Aye Kaylor-Aye Mayor Ross - Aye INTRODUCTION AND 1ST Councilmember Culpepper introduced Bill No. 4996 amending READING - BILL NO. 4996 Schedule Ill. Prohibited Parking - Certain Sections of Designated - CODE AMENDMENT TO Streets, Table Ill-A. No Parking at Any Time, in Title Ill, Section SCHEDULE Ill., TABLE 111- 355.010 of the of the Code of Ordinances, City of Blue Springs, A OF THE CODE OF Missouri, to include portions of NW 36th Street, SW 6th Street, and ORDINANCES RELATING TO NO PARKING ANY SW Lincoln Avenue. Deputy City Clerk Julia Porter made the first TIME reading of Bill No. 4996 by title; copies of the proposed Bill having previously been made available to the public. Councilmember Fowler moved to approve Bill No. 4996 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Kaylor and carried unanimously. 2ND READING - BILL NO. Ms. Porter made the second reading of Bill No. 4996 by title. 4996 Councilmember Fowler moved to adopt Bill No. 4996 upon its second reading and give it ORDINANCE NO. 5128, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Kaylor and carried with the following vote: Fowler-Aye Culpepper - Aye Ericson - Aye Kaylor-Aye Edmondson -Aye Lievsay - Aye Mayor Ross - Aye INTRODUCTION AND 1ST Councilmember Culpepper introduced Bill No. 4997 amending READING - BILL NO. 4997 Schedule Ill. Prohibited Parking - Certain Sections of Designated - CODE AMENDMENT TO Streets in Title 111, Section 355.010 of the Code of Ordinances, City of SCHEDULE Ill. OF THE Blue Springs, Missouri, adding Table III-F - Parking Prohibited CODE OF ORDINANCES Monday Through Sunday, 10pm - 6am, portions of NW Garrett Drive. TO ADD TABLE 111-F RELATING TO Deputy City Clerk Julia Porter made the first reading of Bill No. 4997 PROHIBITED PARKING by title; copies of the proposed Bill having previously been made available to the public. July 5, 2022 City Council Minutes Page 4 Councilmember Fowler moved to approve Bill No. 4997 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Kaylor and carried unanimously. 2ND READING - BILL NO. Ms. Porter made the second reading of Bill No. 4997 by title. 4997 Councilmember Fowler moved to adopt Bill No. 4997 upon its second reading and give it ORDINANCE NO. 5129, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Kaylor and carried with the following vote: Ericson - Aye Kaylor-Aye Edmondson -Aye Lievsay - Aye Culpepper - Aye Fowler-Aye Mayor Ross - Aye DISCUSSION - VIRTUAL Councilmembers Ericson and Edmondson introduced and led the MEETINGS discussion items regarding virtual meetings for City Boards and Commissions. No action was taken at this time . MAYORAL Mayor Ross introduced K James, who is visiting him from Galveston , ANNOUNCEMENTS Texas.
