CITY OF BLUE SPRINGS, MISSOURI MINUTES OF COUNCIL MEETING MAY 1, 2023 A meeting of the City Council of the City of Blue Springs, Missouri, was held on Monday, May 1, 2023, 6:00 p.m. in the Council Chambers of the Howard L. Brown Public Safety Building, 1100 SW Smith Street, Blue Springs, Missouri with Mayor Carson Ross presiding. COUNCILMEMBERS IN Jerry Kaylor Galen Ericson ATTENDANCE Chris Lievsay Kent Edmondson Ron Fowler Susan Culpepper Also present were City Administrator Mike Ekey, Deputy City Administrator Christine Cates, City Attorney Sarah Carnes, and City Clerk Sheryl Morgan. CALL MEETING TO Mayor Ross called the meeting to order at 6:00 p.m. and led in the ORDER AND pledge of allegiance. The City Clerk confirmed a quorum of the Council CONFIRMATION OF was present. QUORUM Councilmembers Fowler and Ericson requested Item 3e - Funding Agreement for review of a Chapter 100 Incentive Proposal with Valley Oaks Investments, L.L.C., to be pulled for separate discussion and consideration. CONSENT AGENDA Councilmember Ericson moved to approve the following Consent Agenda items and the motion was seconded by Councilmember Kaylor. • Minutes of the April 17, 2023 City Council Meeting • Resolution No. 21-2023 approving the disposition of Information Technology department and City records which have met the required retention period as prescribed by the Blue Springs Records Retention, Management, and Destruction Policy dated November 28, 2016 and in accordance with the Missouri Secretary of State's records retention guidelines • Liquor License for Tikiboy LLC dba Private Reserve Venue and Bar located at 1200 NW 7 Highway Blue Springs, MO 64014, to sell retail intoxicating liquors by the drink for consumption on premises, Restaurant- Bar/ Lounge Bar, to include Sunday retail selling of intoxicating liquors by the drink, on the premises; or in original package for consumption on or off premises • Resolution No. 22-2023 approving a five-year contract with one automatic two-year renewal with Flock Group Inc. in the amount not to exceed $148,350 annually for video and audio services, software and cameras • Board and Commission Appointments Appearance Review Committee: Reappointment: David Smith, Chair Bob Frost, Vice Chair Bob Frost David Smith May 1, 2023 City Council Minutes Page 3 Springs Industrial Project. The motion was seconded by Councilmember Culpepper and failed with a 3-4 vote as follows: Kaylor- No Ericson -No Lievsay- No Edmondson - No Fowler-Aye Culpepper - Aye Mayor Ross - Aye INTRODUCTION AND Councilmember Edmondson introduced Bill No. 5085 approving a 1ST READING- BILL Final Plat for Stonecreek 24th Plat, generally located south of SW NO. 5085- FINAL PLAT Stonecreek Drive, north of SW Moreland School Road and west of SW FOR STONECREEK 7 Highway (PF-03-23-8681 ). City Clerk Sheryl Morgan made the first 24TH PLAT reading of Bill No. 5085 by title; copies of the proposed Bill having (PF-03-23-8681) previously been made available to the public. Councilmember Fowler moved to approve Bill No. 5085 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Culpepper. COUNCIL DISCUSSION Brian Rahn spoke on behalf of the applicant regarding the debris pile on the property and the timeline to clean up the property. After Council discussion, the motion to approve carried unanimously. 2ND READING - BILL Ms. Morgan made the second reading of Bill No. 5085 by title. NO. 5085 Councilmember Edmondson moved to adopt Bill No. 5085 upon its second reading and give it ORDINANCE NO. 5214, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Ericson and carried with the following vote: Lievsay - Aye Edmondson - Aye Fowler-Aye Culpepper - Aye Ericson - Aye Kaylor-Aye Mayor Ross - Aye INTRODUCTION AND Councilmember Culpepper introduced Bill No. 5086 approving a Final 1ST READING - BILL Plat for Eagles Ridge Estates PR-O 4th Plat generally located NO. 5086- FINAL PLAT northeast of the intersection of SW Eagles Ridge Drive and SW 7 FOR EAGLES RIDGE Highway (PF-03-23-8683). City Clerk Sheryl Morgan made the first ESTATES PR-O 4TH reading of Bill No. 5086 by title; copies of the proposed Bill having PLAT (PF-03-23-8683) previously been made available to the public. Councilmember Fowler moved to approve Bill No. 5086 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Lievsay and, after Council discussion, carried unanimously. NO. 5086 Councilmember Edmondson moved to adopt Bill No. 5086 upon its second reading and give it ORDINANCE NO. 5215, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Kaylor and carried with the following vote: Fowler-Aye Culpepper - Aye Ericson - Aye Kaylor-Aye Edmondson - Aye Lievsay - Aye Mayor Ross - Aye INTRODUCTION AND Councilmember Culpepper introduced Bill No. 5087 approving an 1ST READING - BILL Intergovernmental Agreement with Jackson County Public Water NO. 5087- Supply District No. 13 for the provision of and the termination of water INTERGOVERNMENTAL service and sewer service and exchange of information. City Clerk AGREEMENT WITH Sheryl Morgan made the first reading of Bill No. 5087 by title; copies WATER DISTRICT 13 of the proposed Bill having previously been made available to the FOR WATER SERVICE public. Councilmember Fowler moved to approve Bill No. 5087 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Kaylor and carried unanimously. 2ND READING - BILL Ms. Morgan made the second reading of Bill No. 5087 by title. NO. 5087 Councilmember Edmondson moved to adopt Bill No. 5087 upon its second reading and give it ORDINANCE NO. 5216, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Kaylor and carried with the following vote: Ericson - Aye Kaylor-Aye Edmondson - Aye Lievsay - Aye Culpepper - Aye Fowler-Aye Mayor Ross - Aye INTRODUCTION AND Councilmember Culpepper introduced Bill No. 5088 amending the 1ST READING - BILL 2022-23 annual budget increasing the previously adopted budget of NO. 5088 - FY 2022-23 $109,834,284 by $7,284,530 to $117,118,814. City Clerk Sheryl BUDGET INCREASE Morgan made the first reading of Bill No. 5088 by title; copies of the proposed Bill having previously been made available to the public. Councilmember Fowler moved to approve Bill No. 5088 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Kaylor and carried unanimously. 2ND READING - BILL Ms. Morgan made the second reading of Bill No. 5088 by title. NO. 5088 Councilmember Edmondson moved to adopt Bill No. 5088 upon its second reading and give it ORDINANCE NO. 5217 with a copy attached hereto and made a part of the minutes. (Eldridge Cleaver) CLOSED SESSION At 6:35 p.m., Councilmember Kaylor moved for the Council go into closed session pursuant to Section 610.021 (1) and (3) Revised Statutes of Missouri, for the purpose of privileged communications between a governmental body or its representative and legal counsel relating to litigation and personnel matters and that any minutes, documents and other records discussed or taken during the closed session remain closed, and that the special meeting of this body stand adjourned at the completion of such session.
