CALL TO ORDER Chairman Cindy Miller called the meeting to order at 4:00 p.m. CONSENT AGENDA Chairman Miller requested action on the Consent Agenda with a motion by APPROVAL Board Member Yvonne Woods, to approve the minutes for June 16, 2016 a second from Board Member James Wallace,, and a unanimous vote, the Minutes of June 16, 2016, were approved as submitted. AGENDA ITEM 2A. Matt Wright, Senior Planner, stated before the Downtown Review Board is DRB-08-16-5452/ a request for approval for Contactors Storage, which is located at 806, 808, “Contractor Storage – Clay and 902 SW South Ave. There are three parcels. Two of those parcels, Swope” / 9th Street & South 806A and 806B, are currently being used as residential warehouse storage. Ave. The parcel next to that previously was a home and a garage that were demolished this past spring. All three parcels are zoned “T3” (Sub-Urban). The applicant is requesting that all three parcels be rezoned to “T5” (Urban Center). That is the only zoning district in Downtown that will permit an DRB Minutes – 08.31.2016 Page 1 of 4 kf expansion of the existing residential warehouse storage use. Mr. Wright explained the history of this property stating that the properties south of South Ave. were zoned “LI” (Light Industrial), before the Downtown Zoning District and Downtown Master Plan were approved. At that time the property was a legal conforming use, but with the change in zoning it’s now a legal non-conforming use, and the applicant is proposing to expand that. The applicant can’t expand unless they rezone and obtain a Conditional Use Permit. QUESTIONS Board Member Yvonne Woods asked what the rationale for the zoning change was. Mr. Scott Allen, Director of Community Development, stated that it was part of the overall Downtown Development Code and Downtown Master Plan. The railroad tracks were the ideal buffer to distinguish downtown going further south. This item will be heard by the Planning Commission, and they will recommend approval or denial to the City Council for their final approval or denial of the Rezoning. If approved, once the applicant submits the Conditional Use Permit and the Site Plan/Design Review applications they both will be heard by this board. Chairman Miller asked if the applicant has to provide public notice to the surrounding property owners. Mr. Wright stated that the resident letters have been mailed out and the large public notification sign has been posted on the property. APPLICANT Clay Swope, Owner Board Member James Wallace asked what goes in the storage units. Mr. Clay Swope, owner stated that he has owned this property for 35 years and just recently purchased the property to the west. Mr. Swope stated that he felt a need to provide storage for contractors, motor homes or the like. Mr. Swope stated that the most of the surrounding area included the railroad tracks, Fike Corporation and numerous industrial buildings. VOTE Yvonne Woods – Aye James Wallace – Aye Joe Haney - Absent Kent Edmondson – Absent Jennifer Hauschild - Aye Chris Lievsay - Absent Scott Allen – Aye Chris Sandie - Aye Cindy Miller, Chairman - Aye (APPROVED 6-Aye, 0-No) DRB Minutes – 08.31.2016 Page 2 of 4 kf Matt Wright, Senior Planner, stated before the Downtown Review Board is AGENDA ITEM 2B. a request for approval of a new addition on a home located at 1608 SW DRB-08-16-5459 / “Smith Smith Street. This is single-family home in the “T3” (Sub-Urban) zoning Street House” / 1608 SW district. The property is also in the Historic Overlay. The applicant is Smith Street proposing a 400 sq. ft. addition, along with a façade change on the exterior of the home. The existing façade is vinyl siding and the applicant would like to change that to stucco with stone veneer along the foundation. It meets the height, setback and area requirements. The building materials meet and exceeds the minimum 10% with the stucco and stone. The Historic Preservation Commission will review further plans and look at how it is comparable with the surrounding neighborhood. APPLICANT Jennifer Hauschild, Owner Ms. Hauschild stated that when the vinyl siding was added to the house the edges and the eaves didn’t match up and there are holes in the vinyl. Board Member Woods asked if the new plan incorporates most of the porch. Ms. Hauschild stated that the porch will be removed and a new porch will be built. Member Woods stated that this would be a great improvement. MOTION Board Member James Wallace, moved to approve DRB-08-16-5459 / AGENDA ITEM 2B. “Smith Street House.” DRB-08-16-5459 / “Smith Street House” / 1608 SW Smith Street Seconded by Board Member Yvonne Woods. He stated that the Rezoning will be heard by the Planning Commission at the September 12th meeting, and the City Council at their September 19th meeting. The 1608 SW Smith Street will be heard by the Historic Preservation Commission, meeting date to be determined. Chairman Miller informed the Board that there is a Downtown Alive Design Team meeting scheduled for September 9th and Scott Allen is bringing in a presenter. Mr. Allen stated that Aaron Steele, Brick Industry Association, out of Iowa, will talk about Downtown Design Standards. The meeting will start at 7:30 a.m. – 9:00 a.m. in the Journagan Room located at 1100 SW Smith Street. Project Site (Aerial Photo) Page 2 of 4 Project: DRB – 812 SW Jones St. BACKGROUND INFORMATION/SUMMARY: The applicant is requesting to build a 1,433 square foot single-family house in the Downtown Zoning District. The proposed house will match the size, scale, materials, and setbacks of the existing 3 houses to the east along SW Jones Street. PREVIOUS ACTIONS/APPROVALS:  On March 26, 2007, the Planning Commission recommended approval of a rezoning from “SF-7” (Single-Family Residential) to “T4” (General Urban) as part of the rezoning for the Downtown Zoning District. The City Council approved the rezoning on April 2, 2007.  On October 22, 2007, the Planning Commission approved a Preliminary Plat (PP- 10-07-1356) for “Hannah’s Place, 1st Plat.”  On October 22, 2007, the Planning Commission recommended approval of a Final Plat (PF-10-07-1355) for “Hannah’s Place, 1st Plat.” The City Council approved the Final Plat on November 5, 2007.  The City Council approved the designation of Conservation Areas in the Downtown Blue Springs area (Resolution No. 76-2015) on October 5, 2015.  The Historic Preservation Commission recommended approval of the new house construction on September 14, 2016 (5 aye, 0 no) FUTURE APPLICATIONS/REVIEWS ANTICIPATED OR REQUIRED: The building plans must be reviewed and approved administratively prior to the issuance of a building permit. The new house will be a two- stories. Setbacks from the property line: Front yard setback of not less than zero (0) feet and not more than fifteen (15) feet to Page 3 of 4 Project: DRB – 812 SW Jones St. the building wall; Side yard, interior setback of not less than zero (0) feet and not more than ten (10) feet from the building wall; Side yard, corner setback of not less than zero (0) feet and not more than ten (10) feet from the building wall or to match that of the existing side street; and Rear yard setback of not less than five (5) feet from the building wall. The new house will be 20-feet from the front property line, 5-feet from both side property lines, and 37.3-feet from the rear property line. The house will match the setbacks of the 3 existing homes to the east. In order to maintain the existing streetscape, staff will permit the average setback of the block to be used, which is 20-feet, instead of the maximum 15-foot setback. Setback averaging is permitted under UDC Section 411.020.E.3 for the setbacks of lots within the same block, within the same zoning district, and fronting on the same side of the street. Building Materials: High quality masonry building materials approved for the Downtown Zoning District are stone, brick, cast stone, and stucco. Synthetic stone, such as pre-manufactured fiberglass, cultured stone, or glass-fiber reinforced concrete, is permitted, provided that it is identical in appearance and equal or greater durability to natural stone. These masonry materials material shall be required on ten percent (10%) of the sum total of all facades for single-family houses. The applicant will meet the minimum 10% required with most of the front façade being stucco. Lap siding will be installed on the front façade within the gable. The sides and rear of the house will be lap siding. RECOMMENDATION: Staff recommends approval of the proposed new construction. Page 4 of 4
