A meeting of the Downtown Review Board of the City of Blue Springs was held in the City Hall Development
Conf. Room 128 located at 903 W. Main Street on Tuesday, October 1, 2019 with the following members, guests

CALL TO ORDER Chairperson Cindy Miller called the meeting to order at 4:02 p.m.
CONSENT AGENDA Chairperson Miller requested action on the Consent Agenda with a motion
APPROVAL by Board Member Jennifer Hauschild, to approve the Minutes of August 12,
2019, a second from Board Member Jason Ellis, and a unanimous vote, the
Minutes of August 12, 2019, were approved as submitted.
AGENDA ITEM 2A / Matt Wright, Senior Planner, reviewed the proposed UDC text amendments
UDCT-09-19-7081 / to the Downtown Development Code with the Board. The first amendment
Amendments to Downtown is to add “rooftop decks, patios, and associated enclosures” to the permitted
Development Code building types in the “T-5” zoning district. This would allow rooftop decks,
patios, and associated enclosures to be constructed as part of a permitted
building type in the “T5” zoning district. The second amendment is related

to building heights in the “T4” and “T5” zoning districts for mixed-use, live-
work, and small commercial building types. Staff is recommending to reduce
the minimum first floor height (sidewalk-level) from 15’ floor to ceiling to
12’ floor to floor (or floor to roof if single-story). Upper floors would be
reduced from 10’ floor to ceiling to 9’ floor to floor (or floor to roof for top
floor). Staff compared this requirement to other downtown development
codes and found it to be more restrictive than many others. Staff did not like
the idea that they were enforcing the building height of the interior of the
building with the floor to ceiling requirement, as typically other than the use,
planning doesn’t get involved with the interior requirements of the building.
Those requirements are determined by Building Code. The Board will make
a recommendation to the Planning Commission and City Council.
QUESTIONS Chairperson Cindy Miller asked for clarification on the floor to floor
requirement and that the drop-down ceiling is included within the 12’ or 9’
floor to floor/roof requirement. Mr. Wright confirmed that the drop-down
ceiling was included, so for example if there was 2’ of space between the
ceiling and the floor above, the minimum floor to drop-down ceiling would
be 10’. Building codes would likely also limit a minimum floor to ceiling
height for access purposes.

AGENDA ITEM 2A / Matt Wright, Senior Planner, informed the Board that the property owner,
DRB-08-19-7033 / “McAtee Chad McAtee is requesting the approval of a Conditional Use Permit “CUP”
Meadows” / 707 SW South for seven (7) paired houses and flat over flat building types at 707 SW South
Street / Conditional Use Avenue. The development will include a mix of two-family residential
Permit for 7 two-family buildings, totaling 14 dwelling units at the northwest corner of SW South
buildings Ave. and SW 7th St. Terrace. This agenda item will go in front of the Planning

Commission on Monday, August 26th. The applicant will be submitting a
Preliminary Plat as well.
QUESTIONS Planning Commission Rep. Ken Billups Jr. asked which was the most intense
zoning T3 or T5. Mr. Wright stated that the T5 is the Commercial Zoning
District and T3 is Residential. T3 is primarily single-family, but it does allow
two-family units to be built with a Cond. Use Permit. The home that was
located on this lot was demolished last year.

AGENDA ITEM 2B / Mike Mallon, Assistant Director, Community Development, stated that the
UDCT-08-19-7029 / “DRB next agenda item is UDC Text Amendment to adopt an appeal process for
Appeal Process” the DRB. After going through the code staff noticed that the DRB for
applications that meet all the standards of the UDC and the Downtown
Development Code the DRB is the final decision-making body and there is
no appeal process. That is the only such board or commission in the UDC
that doesn’t have an appeal process. If an appeal is submitted the appeal will
go to the City Council. If the applicant wants to appeal City Council decision,
then the item will be heard by the Board of Adjustment and any appeals to
that Board will go in front of the Circuit Court.

SUBJECT: Amendments to the Unified Development Code (UDC) related to Building Types
and Height Requirements
The Downtown Development Code (DDC), Section 404.240 of the UDC, regulates the development of
property and certain building standards in the Downtown Zoning District. City staff maintain a list of
potential code amendments related to development standards for consideration by applicable review and
decision-making bodies.
Staff has identified the following potential code amendments related to permitted building types and
height standards that could be amended to provide more flexibility in development options within the
Downtown Zoning District:
Section 404.240 DDC, Downtown Development Code.
E. Permitted Uses And Uses Allowed By Conditional Use. Within the area covered by the DDC, a
wide variety of uses and structures, from residential to commercial, are allowed or allowed by
conditional use. All uses and structures must be approved by the Downtown Review Board.
Structures shall be regulated by T-zone.
5.Zone T5.
a. Allowed. Accessory units; row houses; apartment buildings; mixed-use buildings;
live/work units; small civic buildings; rooftop decks, patios, and associated
enclosures.
G.Height And Area Standards. All buildings and structures shall incorporate the following minimum
standards:
b. Zone T-4. Not more than three (3) and not less than two (2) stories. Mixed-use buildings
and live/work buildings shall have a sidewalk-level floor to ceiling floor height of fifteen
twelve (1512) feet minimum. Upper levels in mixed-use buildings and live/work buildings
shall have floor to floor or floor to roof ceiling heights of minimum ten nine (109) feet.
c. Zone T-5. Not more than five (5) and not less than two (2) stories. Mixed-use buildings,
live/work buildings and small commercial buildings shall have a sidewalk-level floor to
ceiling floor or floor to roof height of fifteen twelve (1512) feet minimum. Upper levels in
mixed-use buildings and live/work buildings shall have floor to floor or floor to roof ceiling
heights of minimum ten nine (109) feet.
