CITY OF BLUE SPRINGS, MISSOURI MINUTES OF LAND BANK MEETING FEBRUARY 21, 2023 A meeting of the Land Bank of Blue Springs, Missouri was held on Tuesday, February 21, 2023 at 3:00 p.m. with Chairman May presiding. CALL TO ORDER AND Chair May called the Land Bank meeting to order at 3:00 p.m. The CONFIRMATION OF A Board Secretary confirmed a quorum of the Lank Bank was present. QUORUM APPROVE BOARD Commissioner White-Baldridge moved to approve the minutes of the MINUTES January 17, 2023 Meeting of the Land Bank of Blue Springs. Motion seconded by Commissioner Irey and carried with the following votes: Sampson - Aye Irey-Aye White-Baldridge - Aye Hill-ABSENT May-Aye STATUS UPDATE ON Deputy City Administrator Christine Cates gave the staff update on PARCEL 2013-28 the replat of Land Bank Parcel 2013-28-36-940-15-01-01-0-00-000 and outlined the information included in the Staff Memo. CONVEYANCE PLAT Commissioner White-Baldridge moved to authorize staff to get new FOR 2013-28 TO conveyance plat to create creek area for the creek area for Blue CREATE NEW TRACT Springs Reserve on Parcel 2013-28-36-940-15-01-01-0-00-000. FOR CREEK AREA Motion seconded by Commissioner Irey and carried with the following votes: Sampson - Aye Irey-Aye White-Baldridge - Aye Hill-ABSENT May-Aye INFO ONLY - FARM Board Secretary Julia Porter informed the Board that an invitation to LEASE BID bid for a farm lease on Parcels 2017-03-41-700-03-03-00-0-00-000, 2017-04-54-100-02-03-00-0-00-000, and 2017-05-B-54-200-01-08- 01-0-00-000 will be published on February 23, 2023. All bids must be submitted by March 9, 2023 and the farm lease will be awarded at the Land Bank meeting on March 20, 2023. STATUS UPDATE ON City Administrator Mike Ekey gave the staff update on the replat of PARCEL 2013-28 Land Bank Parcel 2013-28-36-940-15-01-01-0-00-000. AUTHORIZE PAYMENT Commissioner White-Baldridge moved to authorize payments for AND RELATED tree removal and related expenses for the replat of Parcel 2013-28- EXPENSES FOR 36-940-15-01-01-0-00-000. Motion seconded by Commissioner Irey and carried with the following votes: Sampson – Aye Irey – Aye White-Baldridge – Aye Hill – Aye May – Aye _____________________________ ________________________ James May, Chair Julia Porter, Board Secretary MEMORANDUM DATE: February 16, 2023 TO: Land Bank Commissioners FROM: Julia Porter, Board Secretary SUBJECT: Replat of Parcel 2013-28-36-940-15-01-01-0-00-000 – Blue Springs Reserve Staff held a neighborhood meeting on January 30, 2023 to answer questions from the residents and obtain signatures on the Authorization for Land Bank to represent as the applicant for the approval of the preliminary and final plats. During this meeting the following issues were brought up: • The owners of 208 SE 2nd Street have sold their property and the new owners will take possession on February 22, 2023. Staff contacted the soon-to-be new owners and are working with them to acquire the signed authorization form • Several residents expressed concern about their liability for the creek area and their ability to maintain the area to the east of the creek. Staff is requesting authorization from the Land Bank board to get a new conveyance plat that will create a new and separate tract to encompass the entirety of the creek area and the east side of the creek. • The owner of 118 SE 2nd Street had previously agreed to accept the tract behind 204 SE 2nd Street. She has decided that she is no longer interested in acquiring the property behind her neighbor’s house. • The property located at 110 SE 2nd Street has been listed for sale, this should not impact the Land Bank property since the tract behind this property has been accepted by the owner of the property located at 114 SE 2nd Street. Next steps: • Conveyance Plat #2 o Request authorization from the Land Bank board to get a new conveyance plat to create a separate tract that will encompass the creek area. o Staff will work with City contractor to draft the new conveyance plat and determine the width of the new tract. o Mark the new tract line in the grass with spray paint • Notify residents of the new Conveyance Plat o Share the Conveyance Plat with the residents and communicate easement restrictions are still in place • Preliminary and Final Plats o The City’s contractor will prepare a preliminary and final plat to merge the new properties o Plats will be submitted to Planning Commission and City Council for review o Lot owners will sign the plats after Planning Commission and City Council approval o Plats will grant drainage easement to City Land Bank of Blue Springs, Missouri Invitation to Bid Farm Lease Documents Due and Bid Opening March 9, 2023 at 2:00 p.m. Blue Springs City Hall Training Room 210 903 W Main Street Blue Springs, MO 64015 (816) 220-4596 INVITATION AND INFORMATION FOR BIDDERS PROJECT: Farming Lease for Various Land Bank of Blue Springs, Missouri PROJECT OWNER: Land Bank of Blue Springs, Missouri PROJECT CONTACT: Julia Porter, Board Secretary Land Bank of Blue Springs, Missouri 903 W Main Street Blue Springs, Missouri 64015 (816) 220-4596 PROJECT CONSULTANTS: None INVITATION TO BID You are invited to submit a Lump Sum sealed Bid for the farming of approximately 70+/- acres leased Land Bank of Blue Springs, Missouri property (Parcel Nos. 41-700-03-03-00-0-00-000, 54-100-02-03-00-0-00-000, and 54-200-01-08-00-0-00-000 less approximately 58 acres indicated on the attached photo, outlined in red – aerial photos attached). LEASE PERIOD The period for this lease begins on the date that the Lease Agreement is fully executed and ends on December 31, 2023. The Land Bank of Blue Springs, Missouri reserves the right, if mutually agreed by the contractor, to extend this lease or a portion thereof for one additional period ending on December 31, 2024, and the rental to be paid for the additional year shall be the same as for the first period, adjusted proportionately for any changes to the leased land. Notice of Award: Proposed approval the week of March 20, 2023. DESCRIPTION OF REAL ESTATE. Lessor hereby leases to Lessee and Lessee hereby takes from Lessor the real estate set forth above, located in Jackson County, Missouri, for the purpose of planting row crops on approximately 70+/- tillable acres of the premises. 3. RENT. As rent for the premises through December 31, 2023, Lessor shall receive the sum of $ to be paid upon execution of this Lease. 4. POSSESSION. Lessee shall be entitled to possession immediately, and shall yield possession to Lessor on December 31, 2023 or upon termination of this lease, whichever occurs first. 5. OPTION TO RENEW. The Land Bank of Blue Springs and Lessee may mutually agree to extend this Lease or a portion of this Lease for one year, terminating on December 31, 2024. The rent for the extended term will be the same as the original term, adjusted proportionately for changes to the leased land, due to Land Bank of Blue Springs on January 1, 2024. 6. CONVEYANCE OF REAL ESTATE. Nothing herein contained shall prevent Lessor from conveying real estate to any other person and thereby modifying this Lease. It is agreed that any sale will be contingent on either buyer honoring the terms of this Lease or at a minimum allowing Lessee to remove any crops planted at the proper time to market them and to receive the money they bring when sold. 7. LAND USE. It is particularly understood and agreed between the parties that this Lease shall only authorize Lessee to plant row crops on approximately 70+/- acres of the premises at the sole cost of Lessee. Further, Lessor and Lessee agree that Lessee shall not be authorized to run cattle on the premises; shall not be authorized to hunt game; and shall not be authorized to cut live trees for sale or personal use. Lessee agrees to commit no waste or damage on said premises and to permit none to be committed including but not limited to fencing, timber, nor damage to any building or structure thereon, natural wear and tear or damage by the elements excepted. 8. RIGHT TO RE-ENTER. The Lessor reserves the right for itself, its agents or employees or its assigns to enter the real estate at any reasonable time to: a. Consult with the Lessee; and b. Make repairs, improvements and inspections. 9. NO RIGHT TO SUB-LEASE. The Lessor does not convey to the Lessee the right to lease or sublet any part of the premises or to assign the Lease to any person or persons whomsoever. Lessee shall not allow any other persons or entities to possess or use the premises or to remove from the premises any trees, dirt, fixtures, or any other thing, living or not, without Lessor’s express written consent. 10. DUTY OF LESSEE. The Lessee agrees to comply with all rules, conditions and provisions as set forth by the Natural Resources Conservation Service of the U.S. Department of Agriculture in order to keep “qualified” all land rented under this contract and thereby said land will continue to meet any and all requirements set as a condition for various crop and insurance programs. 11. AMENDMENT AND ALTERATIONS. Amendment and alterations of this Lease shall be in writing and shall be signed by both the Lessor and Lessee. 12. LIABILITY AND INSURANCE. Lessor will not be liable for personal injury or for damage to or loss of Lessee’s machinery or other personal property of Lessee, unless such injury or damage is by willful or intentional acts of Lessor. Lessee shall indemnify and hold Lessor and its property, including the premises, free and harmless from all obligations and liabilities incurred by Lessee in conducting farming or other operations on the premises, whether under this lease or otherwise. Should any other party recover or seek to recover any damages for injury described in this paragraph, except those resulting from the willful and intentional acts of the Lessor, Lessee shall indemnify and hold the Lessor harmless concerning any amounts recovered and Lessor’s reasonable attorney’s fees in defending any such action. Lessee agrees to maintain Comprehensive General Liability insurance with a minimum limit $2,000,000 combined single limit for bodily injury and property damage per occurrence with Land Bank of Blue Springs named as an additional insured on the policy. 13. TERMINATION. Failure of Lessee to fulfill its obligations under this Lease shall constitute a breach of the Lease, and Lessor shall thereupon have the right to terminate the contract by giving thirty (30) days’ notice in writing by U.S. Postal Service Mail to Lessee at the address above. 14. BINDING EFFECT. This Lease shall be binding upon the parties thereto, their heirs, personal representatives, successors and assigns.
