Code of Ordinances (by reference) 8. 2003 Comprehensive Plan (by reference) STAFF COMMENTS Scott Allen, Director of Community Development, stated that before the Commission is a Conditional Use Permit request to allow a “Vehicle Rental Establishment” use. The property is located at Jessica’s Corner shopping center on NW 7 Hwy. with an address of 2009 NW 7 Highway. The applicant will be locating in the north tenant space of the shopping center. The shopping center currently has a shared parking lot with eighty (80) parking spaces. The owner has designated fifteen (15) parking spaces to the north of the tenant space for rental vehicles. Employees or visitors will park in the shared parking lot of the shopping center. Hertz may have 100 vehicles in their fleet but there is only room for a designated 15 vehicles for this site. A landscaping plan meeting the requirements of Section 407.040 will be required and administratively approved with the installation of any necessary plant units, prior to the issuance of a building permit or business license. There is a lack of landscaping and staff is asking that the applicant install those plant units. Maintenance is not proposed to be conducted on site except for the vacuuming of vehicles. Staff has recommended a space be designated for just that. The applicant does meet all the other requirements and staff does recommend approval with three conditions, APPLICANT Not present. QUESTIONS Planning Commissioner Mark Trosen asked staff if vehicles would be brought in by trailer or individually and where is the storage of the other, vehicles in relationship to this facility? Mr. Allen stated that it is staffs understanding that vehicles would be returned and / or picked up by customers and through that rotation they have 100 vehicles in their fleet that are assigned to this particular location. Staff doesn’t believe that there will be trucks or semis in this area. Planning Commissioner Lynn Banks asked if the applicant was planning on washing the cars at this location. Mr. Allen stated no; the applicant doesn’t plan on washing vehicles at this site. The applicant noted that they would only vacuum the vechicles at this site. P.C. RE-OPENED THE Chairman Billups re-opened the public hearing for Agenda Item 2 at 6:46 PUBLIC HEARING p.m. APPLICANT Andrew Haferkamp 7271 W 105th Street Overland Park, Kansas Mr. Haferkamp stated that the landlord only allows 15 parking spaces and secondly Hertz has a shared national fleet. If Hertz has more than 15 cars idle at any given time then they will be moved to a location that will rent the cars. The transportation of cars on site will be individually driven to the site by transporters. Mr. Haferkamp stated that cars will not be washed on site. Hertz takes the vehicles to car washes to clean the outside of the cars. Hertz is requesting a parking stall to only vacuum the vehicles. WITNESSES IN FAVOR None. WITNESSES OPPOSED None. Code of Ordinances (by reference) 8. 2003 Comprehensive Plan (by reference) STAFF COMMENTS Jim Holley, Assistant Director of Community Development stated that before the Commission is a request to change the zoning for Blue Springs Christian Church from “AG” (County Agriculture), to “GB” (General Business). The property is located on the west side of SW 7 Highway approximately 2,000 feet north of SW Wyatt Road with an address of 7920 SW 7 Highway. P.C. Minutes – 09.09.13 Page 4 of 9 kf NOT APPROVED The Comprehensive Plan designates the front portion of the lot, adjacent to SW 7 Highway, as General Commercial while the back portion of the lot (western) is designated for Low Density Residential. The General Business zoning district is generally consistent with the Comprehensive Plan land use designation in that the lot is adjacent to SW 7 Highway and most of the lots in this area that are adjacent to the highway have the general commercial plan designation and general business zoning designation. The applicant wishes to plat this property with the ultimate goal of connecting to the City’s sanitary sewer. There is a 25-foot utility easement located on the east portion of the lot adjacent to SW 7 Highway. The applicant will need to provide an easement acceptable to the City’s Public Works Department for the extension of the sanitary sewer main and installation of the associated manhole. Per Section 406.030, Pedestrian Ways and Sidewalks, the applicant/property owner is required to install a 5- foot sidewalk along the west side of SW 7 Highway. The Final Plat must be approved and recorded prior to final acceptance of the sanitary sewer extension. QUESTIONS Chairman Billups stated that because this is an existing property that is already developed we are not requiring them to come up to any current codes except for the sidewalk and the installation of the sanitary sewer extension as well as the manhole. Mr. Holley stated that those things that are not compliant with our current code come in as legal non-conforming. In this case the applicant has a pole sign with a reader board and that is classified as non-conforming. If the applicant wants to enlarge or change the sign then the applicant would have to meet our current code. Currently the sign meets our code except for the fact it is on a pole. Also along Highway 7 there is a 25 foot buffer and the applicant is short of landscaping along this area. The parking lot and the landscaping in the parking lot looks to meet code. However, staff didn’t count plant units. For future reference if the applicant constructed an addition that exceeded 25% of the current buildings then they would be required to bring the entire site into compliance. Chairman Billups noted that the buildings are already large. APPLICANT Matt Schlicht, Engineering Solutions 50 SE 30th Street Lee’s Summit, MO 64082 Mr. Schlicht is the representative for Blue Springs Christian Church. Mr. Schlicht stated that the church has an existing septic system and they would like to hook up to the City’s gravity sewer system. The Annexation public hearing was heard on the 4th of September and will be finalized on the 7th of October by the City Council. The property is located on the southeast corner of R. D. Mize and Townhomes” / 450 NE R. D. Sunnyside School Road with an address of 450 NE R. D. Mize Road. Mize Road & The Site Plan/Design Review was heard and approved by the Planning AGENDA ITEM 6 Commission on August 26, 2013. The Final Plat will be heard by the City FINAL PLAT / PF-8-13 Council on October 7, 2013. 4067 / “Brookwood Townhomes” / 450 NE R. D. The drainage easement related to the remainder of Brookwood Village Mize Road would need to be recorded. Sidewalks are required along 5th Street and Sunnyside School Road and are to be installed before the 7th of October Final Plat approval or the applicant can escrow for the sidewalks. A Property Owners Association agreement will not be required for this project. This development will consist of one lot with rental units. Project Site (Aerial Photo) Page 2 of 6 Project: Coronado Shoppes Plan Case Number: ASP-8-13-4082 BACKGROUND INFORMATION/SUMMARY: The applicant is requesting to allow an additional shopping center monument sign for the Coronado Shoppes. The shopping center is located on northeast corner of the NE Coronado Drive and NE Sunnyside School Road intersection. The applicant is requesting an additional multi-tenant monument sign that is not currently provided for in the existing Master / Alternative Sign Plan (ASP-8-07-1301). The applicant is requesting to place the sign five (5) feet from the property line in lieu of fourteen (14) feet required. The sign is ten (10) feet in height and has a total sign area of sixty-six and one-half (66.5) square feet. Section 501.060.F(3)(a) with regard to sign faces and overall height states: “Non- residential maximum area seventy-five (75) square feet per face, maximum height eight (8) feet except as described in Section F.4.c.” Section 501.060.F(4)(c) states that “For each additional 2-foot setback from the street right-of-way over 10-feet, one (1) additional foot may be added to the height of the sign, to a maximum of twelve (12) feet, and an additional four (4) square feet per face per two (2) foot setback may be added to the area of the sign, for a maximum of sixteen (16) square feet additional per sign face.” As stated the height of the proposed monument sign is ten (10) feet and as such the corresponding setback required is fourteen (14) feet. PREVIOUS ACTIONS/APPROVALS: Preliminary Plat (PP-4-07-1043) was approved by the Planning Commission on May 5, 2007. PUD Concept Plan (PUDC-4-07-1045) was approved by the Planning Commission on May 30, 2007. Rezoning (RZ-4-07-1044) was recommended for approval by the Planning Commission on May 30, 2007 and approved by the City Council on June 4, 2007. Final Plat (PF-7-07-1221) was recommended for approval by the Planning Commission on August 13, 2007 and approved by the City Council on August 20, 2007. Master/Alternative Sign Plan (ASP-8-07-1301) was approved by the Planning Commission on November 26, 2007. This Master/Alternative Sign Plan provided a monument sign plan that allowed the five (5) foot setbacks for the Sonic and Taco Bell monument signs. It also included the modified setbacks for the Panda Express, NTB, and the standard setback for the multi-tenant monument sign for Coronado Place shopping center east of the Coronado Shoppes. The standard monument height allowance is eight (8) feet, but can be increased by an additional foot for each additional two (2) feet to the setback. The proposed sign would be allowed with a fourteen (14) foot setback from the property line as well as a fifty (50) foot setback from surrounding signs on the same lot. Page 4 of 6 Project: Coronado Shoppes Plan Case Number: ASP-8-13-4082 Location: The sign is generally located on the southeast corner of the Coronado Shoppes. The sign will be five (5) feet from the south property line. The Sign Code requires a fourteen (14) foot setback. The sign will be sixty four (64) feet from the Coronado Shoppes building and approximately eleven (11) feet from the northern parking lot. The Sign will be fifty (50) feet from the adjacent Sonic monument sign. Staff recommends the sign be moved to the west entrance of the Coronado Shoppes to avoid clustering more monument signs at the east entrance/exit drive that is shared with other restaurants. The east drive currently has the Sonic monument sign just west of the drive and the Taco Bell monument sign on the east side of the drive. The west entrance has no monument signs. Colors: The monument sign face will match the primary color of the Coronado Shoppes building, while the brick base will match the style and color of the brick on the building. The font type will be Garamond Bold in white, which matches the Coronado Place multi-tenant monument sign located to the east of the NTB. Type: The sign will be a monument sign. Illumination: The sign will be internally illuminated with fluorescents. Landscaping: The applicant will be placing two (2) feet of mulch around the base of the sign similar to the surrounding signs with landscaping. No landscape plan was submitted. Staff recommends submitting a landscape plan for the sign with the standard sign application. In the case that the sign is located on the west entrance of Coronado Shoppes, removal of any current landscaping that causes sign visibility issues could be considered, but all landscaping removed must be replaced elsewhere on the site. Replacement landscaping should be an equal value of plant units as the landscaping removed. There is an existing landscape buffer for the south side of the property. The applicant must remain compliant with the required buffer landscaping of forty- five (45) plant units per each one hundred (100) feet of the ten (10) foot buffer. ACTION BY PLANNING COMMISSION The Planning Commission has the responsibility to determine if the proposed signage is appropriate for the proposed use, activity, or building, and may approve or deny an application for the Master/Alternative Sign Plan. Action of the Planning Commission may be appealed to the City Council. REVIEW CRITERIA In order to approve the Master/Alternative Sign Plan the Planning Commission should either agree that the sign meets the criteria defined in the Sign Code or approve an alternative sign program based on the following: Page 5 of 6 Project: Coronado Shoppes Plan Case Number: ASP-8-13-4082 1. The applicant has submitted a complete application; 2. The development site contains unique or unusual physical conditions such as topography, proportion, size or relations to a public street that would limit or restrict normal sign visibility; 3. The proposed or existing development exhibits unique characteristics of land use, architectural style, site location, physical scale, historical interest or other distinguishing features that represent clear variation from conventional development; or 4. The proposed signage incorporates special design features such as logos, emblems murals or statuaries that are integrated with building architecture. STAFF RECOMMENDATION: Staff recommends approval of the Master/Alternative Sign Plan application subject to the following conditions: 1. The applicant shall reposition the sign with the requested five (5) foot setback from the property line on the West entrance for the Coronado Shoppes. Any landscaping removed for sign visibility must be replaced with the equivalent landscaping elsewhere on the site subject to administrative approval. Any new landscaping arrangement must remain compliant with the open space and buffer landscaping requirements. 2. In their efforts to meet the City’s requirements for connecting to the sewer the applicant is requesting to annex the property into the City (ANNX-8-13-4070) and for approval of a Final Plat; Blue Springs Christian Church – 1st Plat. PREVIOUS ACTIONS/APPROVALS:  The applicant is requesting that the property be annexed into the city limits (ANNX-8-13-4070). The City Council held the public hearing for the annexation on September 4, 2013 and will consider an ordinance to approve the annexation on October 7, 2013.  The applicant has also requested the property be rezoned from “AG” (County Agriculture) to “GB” (General Business) (RZ-8-13-4069). The Planning Commission recommended approval of the rezoning on September 9th. The City Council will consider an ordinance to rezone the property on October 7th.  The Planning Commission approved the Preliminary Plat (PP-8-13-4068) for Blue Springs Christian Church on September 9, 2013 subject to City Council approval of the annexation noted above. FUTURE APPLICATIONS/REVIEWS ANTICIPATED OR REQUIRED: The applicant is required to have the improvement plans approved by the Public Works Department prior to commencing work on the sanitary sewer extension and will need a building permit for on-site plumbing work prior to commencing construction of the on-site sewer connections. The applicant intends to extend the public sewer main from SW 10th Street. The applicant will be required to extend the sanitary sewer main to their property and install a manhole. In order to do that the applicant is required to provide the necessary easements on their property. Stormwater Management: The property currently has stormwater detention on the western portion of the property. There is no additional stormwater requirements at this time. Access / Parking: Access to the property is provided from SW 7 Highway and no changes are proposed at this time. Easements: Areas have been provided for the necessary utility and access easements, and landscape buffers and are shown on the Final Plat. Sidewalks: Per Section 406.030, Pedestrian Ways and Sidewalks, the applicant/property owner is required to install a 5-foot sidewalk along the west side of SW 7 Highway or provide a security escrow for the same. In discussions with the applicant their first choice is to have the sidewalk installed. However, if time does not permit this to occur they have agreed that an escrow agreement and a security escrow will be posted with the City prior to City Council approval. Street Improvements: All street improvements along SW 7 Highway have been installed and accepted by the City of Blue Springs Public Works Department and MoDOT. Plat Approval: The Final Plat is consistent with the UDC requirements for Final Plat approval and should therefore be approved. ACTION BY PLANNING COMMISSION: The Commission is being asked to provide a recommendation on the Final Plat. Plats are reviewed at this time to determine if they conform to the requirements of the City’s development codes; and there are appropriate assurances that the proposed improvements will be, or have been completed by the developer. The Planning Commission may recommend approval, modified approval or, if the Final Plat does not meet the requirements of the City, recommend denial. Approval of the Final Plat by the City constitutes an acceptance of the easements shown on the plat. RECOMMENDATION: Staff recommends approval of the Final Plat for Blue Springs Christian Church – 1st Plat, with the following conditions: 1. The Final Plat shall be recorded with Jackson County and all required documents must be returned to the Community Development Department once the Plat has been recorded. 2. The applicant shall either install the 5-foot sidewalk required along SW 7 Highway or provide the escrow agreement and security escrow for the sidewalk prior to City Council approval of the Final Plat. 3. Final sanitary sewer construction plans and any associated studies shall be sealed by a registered professional engineer in the State of Missouri. 4. The latest edition of the American Public Works Association and City of Blue Springs standards, specifications, and materials shall be followed. 5. A construction permit for public utilities is required from the Engineering Division prior to commencing construction activities. 6. Per City Code performance and maintenance bonding is required for public infrastructure – sanitary sewer extension. 7. An erosion control plan is required before construction activities commence to ensure the implementation of proper erosion and sediment controls, and controls for other wastes on the construction project. 8. As-Built Drawings (also known as Record Drawings) marked up to reflect changes made during the construction process shall be prepared and submitted to the Public Works Department in both electronic and hard copy versions. 9. A permanent sanitary sewer easement 15-foot wide shall be provided encompassing the new 8-inch sanitary sewer line and manhole. 10. The sanitary sewer service line shall connect to the new sanitary sewer line via a wye fitting and not connect directly to the new manhole.
