O 8th Plat, Tract A” / Corner of SE Shamrock Lane & SE The property is located on the Northwest corner of SE Shamrock Lane and Monterrey Drive SE Monterrey Drive. AGENDA ITEM 3 Jim Holley stated that before the Commission is a request for approval of PLANNED UNIT the Final PUD Plan and Site Plan for “The Parkway.” DEVELOPMENT FINAL PLAN & SITE The property is located west of NE Adams Dairy Parkway, south of NE R. PLAN/DESIGN REVIEW / D. Mize Road and north and east of NE Napoleon Drive with an address of P.C. Minutes – 02.24.2014 Page 2 of 6 kf NOT APPROVED PUDS-11-13-4196 / ”The 601 NE Adams Dairy Parkway. The property consist of 9.4+\- acres. Parkway” / 601 NE Adams Dairy Parkway In June of 2013 the City Council approved a PUD Concept Plan (PUDC-5- 13-3950) for this property that included the assisted living facility. This request is for a Final PUD Plan and Site Plan and Design Review approval for the first phase of the assisted living facility. The assisted living facility will be constructed on approximately 9.4 acres. The first phase includes the construction of a three story building that will house 76 assisted living units and a single story building that will house 32 memory care units. In addition the building will house a reception area, recreation room, kitchen and dining facilities. The current parking exceeds the needs of the first phase of the development, providing 115 parking spaces. However, the UDC does not define parking standards for “Memory Care” units. Based on recent information it is staff’s belief that “Memory Care” units may require less than 1 parking space per unit. When the applicant proceeds with Phase 2 of the project they will need to provide a parking study as required in Section 407.010.D, Schedule C. Based on the parking study the Director of Community Development will determine if an adequate number of parking spaces are provided to meet the needs of the development type. Alternatively the applicant could provide parking for the development as defined for an Assisted Living facility at a rate of one parking space per dwelling unit, in which case an additional 33 spaces would be required for the 148 unit development or request a variance to the parking requirement. Lastly, the City is currently updating the UDC and, as part of that update, will be reviewing our parking standards for various uses. Because the City does not define a parking standard for “Memory Care” units the City will likely establish a standard for such uses. The applicant will be required to install sidewalk along NE Napoleon Drive and resurface the walking trail/bike path along the west side of NE Adams Dairy Parkway. The Appearance Review Committee recommended that the dumpster enclosure be relocated so that it would not be visible from Adams Dairy Parkway. The building is composed of a variety of materials including horizontal and vertical vinyl siding, brick, stone, EIFS, hardi-plank, and asphalt shingles. The three story building is located in the west portion of the site, adjacent to NE Napoleon Drive. This portion of the building has pronounced entrance and two “wings”, one north and one south of the main entrance. The wings are mirror images of one another. The building has a varied roof line, projecting walls, balconies, and a regular pattern of windows that run along each floor. The height of the building at the top of roof will be approximately 41 feet, it is approximately 32 feet to the eave line. P.C. Minutes – 02.24.2014 Page 3 of 6 kf NOT APPROVED Attached to the three story building and situated immediately east of the southern wing is a single-story building that will be utilized for 32 memory care units. This building is composed primarily of a brick “base”, horizontal handi-plank siding vinyl siding and asphalt shingles. The south elevation provides a varied look as the connection hall from the three story building provides access to the one story building. Along this elevation you have a projecting building feature with a central window that gives the appearance of a “great hall.” Other than that the north and east elevations do not offer much of a visually appealing façade with a regular pattern of windows along a hardi-plank siding clad facade. QUESTIONS Planning Commissioner James Wallace asked Mr. Holley, “How does staff determine how many parking spaces will be required for this development?” Mr. Holley stated that the City’s UDC determines the spaces. An assisted living facility in the code reads: one space per unit. There are other things that staff looks as well when determining the space like how many Memory Care units will be available. APPLICANT Tim Wilson and Scott Almond, SWD Architects, representing the applicant presented a powerpoint of color renderings for the development. Mr. Wilson confirmed that the building façade will be hardi-plank siding and brick. Mr. Wilson stated there are pockets that are built in to the pitched roofs. The space is about 14 ft. wide and all of the condensing units will be located there so that nothing is on the ground to keep the appearance clean. The dining area and kitchen area are to the east and all of the air handling equipment and cooling equipment will also be up on the pocket of the pitched roof. The only two pieces of mechanical equipment that are on the ground are the transformer and backup generator and they will be screened with landscaping. The applicant shall provide a parking study as defined in Section 407.010.D of the UDC prior to approval of Phase 2 of this development. Alternatively, the applicant can provide an additional 33 parking spaces in order to meet the UDC requirements for an Assisted Living Facility and/or meet the requirements of the updated UDC at the time of the Phase 2 development application review. 3. The applicant shall install sidewalk along the east side of NE Napoleon Drive adjacent to the frontage of Lot 1 as shown on the Final Plat. 4. The applicant is required to resurface the walking trail/bike path on the west side of NE Adams Dairy Parkway. The design, specifications and construction shall be reviewed, inspected and approved by the City’s Parks Department. 5. All mechanical equipment including but not limited to electrical transformers, cable and telephone boxes, meters and HVAC units shall be screened from view as required by the UDC (Section 407.100.H). 6. The applicant is approved for the Alternative Compliance Landscape Plan in accordance with Section 407.040.I of the UDC. 7. Signage will need to be issued a standard sign permit prior to building permit issuance. OTHER BUSINESS Scott Allen, Director of Community Development, announced the April 14th Planning Commission meeting will be located at Vesper Hall. The meetings will not be televised but will be audio recorded, (podcast). This is a temporary move but will last about 18 months. Chairman Billups announced the Piccadilly Event on March 6th at Adams Pointe Conf. Center. The next Comprehensive Plan Steering Committee meeting is scheduled for Monday, March 10, 2014 at 5:00 p.m. in the Howard L. Brown Multi- Purpose room. The next Planning Commission meeting is scheduled for March 10, 2014. The property is currently zoned “GB” (General Business). In accordance with Section 407.040, Use Table, Indoor Shooting Ranges are only allowed with a Conditional Use Permit (CUP) in the “RC” (Regional Commercial), “LI” (Light Industrial), and “HI” (Heavy Industrial) zoning districts. As such the applicant must rezone the property in order to allow for the proposed use. Given the location of the property and surrounding land uses, the applicant is requesting to change the zoning from “GB” (General Business) to “RC” (Regional Commercial). Zoning: Section 404.145.C.1 requires that the property within the “RC” zoning district be a minimum of 1 acre. The subject property meets this requirement. REVIEW CRITERIA: In reviewing any application for an amendment to the official Zoning Map (zoning change), the Planning Commission and City Council shall review the proposed amendment in light of the Comprehensive Plan, the general requirements of the Unified Development Code and the following considerations: 1. Whether or not the requested zoning change is justified by a change in conditions since the original ordinance was adopted or by an error in the original ordinance; 2. The precedents, and the possible effects of such precedents, that might result from approval or denial of the petition; 3. The ability of the City or other government agencies to provide any services, facilities or programs that might be required if the petition were approved; 4. The effect of approval on the condition or value of property in the City or in the vicinity; 5. The consistency of the application with adopted policies of the City; and 6. The zoning and land use recommended by the Comprehensive Plan. The Blue Springs Unified Development Code defines the Regional Commercial zoning district as a district that “is intended primarily to accommodate retail and commercial land uses that serve community and regional needs and is appropriate adjoining a major highway.” This classification describes common uses located along NW South Outer Road well and is consistent with the proposed use of the subject property. STAFF RECOMMENDATION: The Rezoning request is consistent with the review criteria noted above and as such staff recommends approval of the Rezoning application.
