STAFF REPORT Scott Allen, Director, Community Development, stated that before the
Planning Commission is a request for approval of a Unified Development
Code Text Amendment. The request includes six amendments to the
previously approved UDC. Amendments are intended to correct errors and
modify certain sections to make them easier to implement and understand.
Mr. Allen stated that the currently proposed amendments have previously
been presented to the Downtown Review Board, the Development Advisory
Commission, and City Council. The six amendments discussed by Mr. Allen
can be found in the staff report. Also in the staff report is a seventh
amendment that is currently in progress and not currently being proposed for
approval, which has to do with Construction Site Standards and impacts of
runoff and erosion from developing subdivisions.
QUESTIONS Commissioner Jackie Fairbanks asked, regarding the seventh potential
amendment, if there are constraints on what a builder can do with dirt
excavated from a basement foundation. Mr. Allen stated that there are
currently no restrictions on what a builder does with excavated dirt.
Commissioner Scott Casey asked, regarding amendment number one, if an
existing property would be required to install parapet walls to upgrade or add
rooftop mounted equipment, or if the amendment would only be required of
new construction. Mr. Allen stated that installation of parapet walls would be
required for any new rooftop equipment, including replacement of rooftop
equipment. Mr. Allen stated that the regulation is primarily targeted at new

construction but may also be used to indicate the need for replacement of
screens along with replacement of equipment.

07-17-5924 / “The Villas at before the Planning Commission is a request for approval of a Rezoning and
the Parkway” / 510 & 525 a Planned Development Concept Plan for The Villas at the Parkway and a
NW Napoleon / East side of Preliminary Plat for the Parkway 3rd Plat. This proposal includes two sites,
NE Napoleon Drive between which lie along the east side of NE Napoleon Drive between NE R. D. Mize
NE R. D. Mize Road and NE Road and NE Adams Dairy Parkway. The north lot is comprised of
Adams Dairy Parkway approximately 1.5 +\- acres and the south lot is comprised of approximately

& Mr. Jurey stated that there is an existing assisted living center currently

PRELIMINARY PLAT / southeast of the properties. The south lot was a part of the originally approved
PP-07-17-5926 / “The Adams Dairy Senior Community Center PUD from 2013. The north property
Parkway, Third Plat, A was not included in the original PUD, and is being requested to be added to
Replat of Part of Lot 2, that PUD.

thru 3” / NE Adams Dairy The applicant is requesting to change the existing zoning of the north
Parkway & NE R. D. Mize property from “SO/ADP-O” (Service Office / Adams Dairy Parkway
Road (Related to Agenda Overlay) to “MF-10/ADP-O” (Low Density Multi-Family / Adams Dairy
Items 5 & 6) Parkway Overlay) and the north property from “GB/ADP-O” (General
Business / Adams Dairy Parkway Overlay) to “MF-10/ADP-O” (Low
Density Multi-Family / Adams Dairy Parkway Overlay). The zoning changes
would allow the addition of the 20-unit multi-family development currently
proposed. The density proposed by this development does fall within the
requested zoning requirements. Staff recommends approval of the zoning
request.
Mr. Jurey stated that the Planned Development Concept Plan is an
amendment to the originally approved PUD which adds 20 living units on
3.2 +\- acres by adding the 1.5 +\- acre north lot and changing the 1.7 +\-
acre south lot from commercial development to multi-family development.
Four modifications are being requested. The first request is to allow the north
property to be a part of the Planned Development Concept Plan and be
regulated by the 1996 UDC to provide consistency across the development.
The second request is to reduce the minimum interior side yard setback for
the southern lot from 87 feet to 37 feet. The other two requests concern the
interior landscape buffer. The landscape buffer along the east property
boundary of the south lot is being requested to change from 15 feet to 10 feet.
The landscape buffer along the south property line of the north lot is being
requested to change from 15 feet to 10 feet.
Mr. Jurey stated that some public improvements will be required by staff,
including improvements to an existing drive and the addition of sidewalks to
the north and south property. The applicant is seeking to complete
development of both the south and north lot simultaneously. Pedestrian and
vehicle improvements associated with each lot should be constructed with
each development. Minimum square footage is not required for multi-family
developments. Staff recommends approval of the Planned Development
Concept Plan with nine (9) staff conditions.
Staff recommends approval of the Preliminary Plat with four (4) staff
conditions.
QUESTIONS Commissioner Fairbanks asked if Lot 2 of the Second Plat would be
landlocked. Mr. Jurey stated that a cross-access drive is existing.

Commissioner Ken Billups Jr. stated that there is an existing building on the
north lot that was previously discussed to potentially be a historical structure
and asked what would happen to that building. Mr. Jurey stated that he had
no knowledge of what would happen to the building but said the applicant
may be able to answer.
Commissioner Billups Jr. asked about the function of a section of the
northern development. Mr. Jurey stated that the applicant would be able to
answer his question.
APPLICANT Scott Auman, SWD Architects, appeared on behalf of the applicant. Mr.
Auman stated that the section of the development Commissioner Billups Jr.
asked about would be a maintenance and storage shed. Mr. Auman stated that
the building asked about by Commissioner Billups Jr. would be torn down.

RECOMMENDATONS Staff recommends approval of the PD Concept Plan application subject to the
following conditions:
1. The recommendation of the Planning Commission is based on the
representations of any drawings presented as part of this application
and does not waive any requirement or development standard
contained in the UDC.

2. Per section 406.030 of the City of Blue Springs city code, Pedestrian
Ways and Sidewalks, a 5-foot sidewalk is required along NE
Napoleon Drive and shall be shown on the Final Plat. An ADA
Sidewalk Plan shall be submitted with final construction plans.
Sidewalk sections that are not located in the right-of-way shall be
shown, labeled, and dedicated on the Final Plat as a pedestrian access
easement (“P/E”) to allow for the access and maintenance of the trail.
3. Prior to Final Plat approval, all public improvements associated with
each phase of development must be installed or financially
guaranteed as allowed by the Director of Public Works. All public
improvements shall be installed according to City standards as
approved by the Director of Public Works.
4. All required utility, water, drainage, and landscape easements must
be shown on each Final Plat as required by the City of Blue Springs.
Drainage easements will be required as directed by Public Works
when the final stormwater calculations are determined.
5. The approved setback reductions shall be noted on each PD Final Plan
and Final Plat. The final design of all buildings within this PD will be
reviewed by the Appearance Review Committee as noted in Section
402.040 of the UDC and will be approved by the Planning
Commission through the PD Final Plan and Site Plan & Design
Review application process. The proposed attached multi-family
buildings shall follow the design standards provided in Chapter 408
and Section 404.200.B.1.b of the City’s 1996 UDC.
6. With the subsequent PD Final Plan and Site Plan & Design Review
application, the applicant shall provide cost estimates showing that
the landscaping associated with the proposed attached housing meets
the minimum standards provided in Section 404.200.B.2.b.
Furthermore, the applicant shall provide area and plant unit
calculations associated with the Open Space Plan for the Adams
Dairy Senior Community Planned Development. Any existing plant
units removed from the approved landscape plan of the existing
development must be reallocated in the same general vicinity from
which it was removed.
7. Prior to issuance of building permits, all electrical and mechanical
equipment associated with any principle buildings on the lots shall be
screened in accordance with Section 407.100.H, Screening of
Equipment.
8. Prior to issuance of construction permits, a Missouri Department of
Natural Resources (MDNR) Land Disturbance Permit and the
associated stormwater pollution prevention plan (SWPPP) is required
to ensure maintenance, inspection, and flexibility for erosion control
and stormwater quality on the project during construction.

RECOMMENDATIONS Staff recommends approval of the proposed application subject to the
following conditions:
1. Approval by the Planning Commission based on the representations
of any drawings presented as part of this application does not waive
any requirement or development standard contained in the UDC.
2. Prior to Final Plat approval, the sidewalk, curb and gutter
improvements must be constructed or a security escrow provided in
accordance with the 1996 Unified Development Code, Section
403.050.E.1, and said improvements must be shown on the Final Plat.
An ADA Sidewalk Plan shall be submitted with final construction
plans. Sidewalk sections that are not located in the right-of-way shall
be shown, labeled, and dedicated on the Final Plat as a pedestrian
access easement (“P/E”) to allow for the access and maintenance of
the trail.
3. All required utility, water, drainage, and landscape easements must
be shown on each Final Plat as required by the City of Blue Springs.
Drainage easements will be required as directed by Public Works
when the final stormwater calculations are determined.
4. A Final Plat shall be approved and recorded prior to the release of any
building permits.

OTHER BUSINESS Commissioner Ken Billups Jr. stated that Saturday, August 19th, from 4:00
p.m. to 7:00 p.m. the Historical Society would be holding the 3rd annual Taste
of Blue Springs at the Blue Springs High School. There will be 33 local
restaurants participating, along with a silent auction. Six raffle tickets will be
given out for each gift card donated to the food bank. Tickets are $12.
Scott Allen, Director, Community Development, stated that the next Eastern
Jackson County Planning Commissioner Training will be tentatively held
Tuesday, October 3rd, in Lee’s Summit. In addition, the annual Missouri APA
conference will be held in St. Louis October 18th – 20th. The City will be able
to take one Planning Commissioner to the conference.
Chairman Lynn Banks stated that the City’s paper shredding event will be
held Saturday, August 26th from 9:00 a.m. to 12:00 p.m. at City Hall in Blue
Springs. Four paper grocery bags will be accepted per person.
The next scheduled meeting is Monday, August 28, 2017.
Commissioner Mitchell Peil stated that the Technology Entertainment and
Design (TED) conference will be held at the Kauffman Center August 19th
and 20th.
