i. Reduce the minimum front setback from 40-ft. to 20-ft.

ii. Waive the requirement for a 5-ft. wide sidewalk
connecting the public realm to the building entrance due to
the security gate which will prohibit the general public from
entering the property.
c. Section 407.040, Site and Landscape Design:
i. Reduce the required buffer width on the Northwest corner
from 15-ft. minimum to 2-ft. The pavement is existing,
and the US 40 Highway right-of-way occupies much of
the northwestern corner of the site.
2. The Preliminary Plat is not in effect until the City Council has approved
the General Development Plan (GDP-06-23-8814) for the subject
property. If the City Council denies the General Development Plan
request, the Planning Commission’s approval of the Preliminary Plat is
rescinded.
3. The General Development Plan is not in effect until the City Council
has approved the Rezoning (RZ-06-23-8813) for the subject property.
If the City Council denies the Rezoning request, the General
Development Plan is rescinded.
4. The General Development Plan shall expire after one (1) year of
approval if the following does not occur:
a. A Site Plan Design Review shall be approved within six (6)
months of General Development Plan approval; and,
b. A building permit shall be issued within one (1) year of
General Development Plan approval.
5. There shall be no outdoor overnight parking of trucks or outdoor
storage of vehicles and/or materials, equipment, etc. unrelated to the
“Warehouse/Distribution Center” land use.
a. The proposed land use is “Warehouse/Distribution Center” and
does not include the “Storage, Yard” land use.
6. The applicant shall erect a 6-ft. tall privacy fence around the perimeter
of the property to help with screening.

5. Prior to Building Permit issuance, the Final Plat must be recorded at
Jackson County.
6. Prior to occupancy, the following must occur:
a. All parking and access improvements, landscaping, and public
sidewalks required must be completed.
b. All public improvements, unless stated otherwise, shall be
completed.

11-13.

BACKGROUND INFORMATION/SUMMARY:
The proposed UDC Text Amendments are being proposed as part of a larger City effort to raise the
City’s CRS rating which in turns lowers floodplain insurance for homeowners and property owners
that have property in the floodplain.
The proposed amendments specifically change the effective date of the Flood Insurance Study to
December 7, 2023. Staff recommends approval of the UDC changes.
PREVIOUS ACTIONS/APPROVALS:
• The City of Blue Springs adopted a Unified Development Code (UDC) in 1996 by passage
of Ordinance No. 2738 on November 18, 1996.
• An amended Unified Development Code was adopted on August 3, 2015, by passage of
Ordinance No. 4558.
• The Unified Development Code has been further amended since 2015 for maintenance
purposes, as well as to respond to changing development patterns and keep up to date with
current trends.

• The UDC was amended in May 2023 to update the City’s Floodplain regulations to help
increase the City’s rating under the National Flood Insurance Program’s (NFIP) Community
Rating System.
The Development Advisory Commission recommended approval (3 aye, 0 no) of the UDC
Text Amendments on September 28, 2023.
STAFF ANALYSIS
Text amendments ensure that the generally applicable laws in this Development Code reflect the
broad public interest and long-range planning goals of the community, as reflected in the
Comprehensive Plan. The City may determine that it is necessary from time to time to revise and
update this Development Code to implement the Comprehensive Plan.
Section 403.020 of the UDC states a Text Amendment shall be reviewed according to the following
criteria:
Review Criteria. All review bodies shall use the following criteria for review, recommendations and
decisions on text amendments:
1. Whether the change is in accordance with the Comprehensive Plan, Design and Construction
Manual, or any official plans or programs developed under the guidance of the Comprehensive
Plan;
2. Whether such change is consistent with the purposes of this Development Code, and the intent
or objectives of any Chapter or Subsection containing the change;
3. The areas that are most likely to be directly affected by the amendment and in what way they
will be affected;
4. Whether the proposed amendment is made necessary because of changed or changing social
values, new planning concepts or other social or economic conditions in the areas and zoning
districts affected; and
5. The recommendations of professional staff.
Staff finds that the proposed UDC amendments meet the above criteria and therefore
recommends approval of the UDC Text Amendments.

Section 408.010. Floodplain Management — FW-O And FF-O Districts.
A. Statutory Authorization. The Legislature of the State of Missouri has in Section 89.020,

RSMo., delegated the responsibility to local governmental units to adopt floodplain
management regulations designed to protect the health, safety, and general welfare.
Therefore, the City Council of the City of Blue Springs, Missouri exercises such responsibility
as follows:
1. Findings Of Fact.
a. Flood Losses Resulting From Periodic Inundation. The special flood hazard areas
of the City of Blue Springs, Missouri, are subject to inundation which results in loss
of life and property, health and safety hazards, disruption of commerce and
governmental services, extraordinary public expenditures for flood protection and
relief, and impairment of the tax base; all of which adversely affect the public health,
safety and general welfare.
b. General Causes Of The Flood Losses. These flood losses are caused by:
(1) The cumulative effect of development in any delineated floodplain causing
increases in flood heights and velocities; and
(2) The occupancy of flood hazard areas by uses vulnerable to floods, hazardous
to others, inadequately elevated, or otherwise unprotected from flood
damages.
c. Methods Used To Analyze Hazards. The Flood Insurance Study (FIS) that is the
basis of this Section uses a standard engineering method of analyzing flood
hazards which consist of a series of interrelated steps.
(1) Selection of a base flood that is based upon engineering calculations which
permit a consideration of such flood factors as its expected frequency of
occurrence, the area inundated, and the depth of inundation. The base flood
selected for this Section is representative of large floods which are
characteristic of what can be expected to occur on the particular streams
subject to this Section. It is in the general order of a flood which could be
expected to have a one percent (1%) chance of occurrence in any one (1)
year as delineated on the Federal Insurance Administrator's FIS, and
illustrative materials for Jackson County dated January 20, 2017 December
7, 2023, as amended, and any future revisions thereto.
D. Districts Established.
1. The mapped floodplain areas within the City are hereby redivided into two (2) Overlay
Zoning Districts: (1) the FW-O, Floodway Overlay District, and (2) the FF-O, Floodway
Fringe Overlay District. Within these Overlay Districts all uses shall be required to
comply with the standards of this Section and the standards of the underlying zoning
district. This Section and the districts to be established hereafter shall apply to all lands
within the jurisdiction of the City of Blue Springs identified as numbered or unnumbered
A Zones and AE, AO and AH Zones on the Flood Insurance Rate Maps (FIRM) for
Jackson County Panels 29095C0309G, 29095C0312G, 29095C0314G,
29095C0316G, 29095C0317G, 29095C0318G, 29095C0319G, 29095C0336G,
29095C0338G, 29095C0434G, 29095C0435G, 29095C0451G, and 29095C0453G
dated January 20, 2017, as amended, and any future revisions.

PLAT ANALYSIS
Platting is a process where a proposed division, or partition of land and property interests therein, is
reviewed to ensure development patterns in compliance with long-range comprehensive plans;
coordinating infrastructure with existing, future and potential capital improvements; and that all lots are
buildable, served with adequate public facilities, and capable of meeting the zoning and development
standards.
Preservation: The site is currently undeveloped and is primarily open grass. The site is slightly elevated
compared to the rest of the subdivision, but no major topographical features are present.
Phasing: The entire Four Pillars subdivision encompasses five (5) phases. The other four (4)
phases have been completed. The fifth and final phase consists of 39 lots and two (2)
tracts.
Streets &
Sidewalks: The proposed public street network matches the approved Preliminary Plat. All proposed
lots have access to a local street. The proposed local streets connect to a minor collector
(NE Roanoke Rd.) and a local road (NE Porter Rd.) via NE Colonnade Avenue and NE
Sparta Drive. The proposed public pedestrian network matches the approved Preliminary
Plat. All proposed lots have direct access to a public sidewalk or are directly across the
street from a public sidewalk.
Traffic: Additional traffic improvements were not required with this phase of the development.
Required Right-of-Way and easements have been shown on the Final Plat.
Stormwater: A stormwater management letter was received by Public Works addressing drainage for
this subdivision. On site detention was not included in the development as the requirement
was not adopted in the beginning phases of the development. Detention and stormwater
management will be utilized using turf swales and a regional wet detention in Lake
Remembrance.
Sanitary
Sewer: Gravity sanitary sewer is available to the south of this development. The sewer has
capacity to convey flows generated from this development, but the developer is
responsible for extending sewer within the property or otherwise connecting to the existing
sanitary sewer.
Open Space: The Four Pillars Subdivision meets the minimum 8% open space requirement, as required
in the “SF-7/PR-O” zoning district. The fifth phase of the subdivision will contain open
space tracts M & N which will contain the final portion of the previously approved trail. The
open space tracts shown on final plat are in compliance with the approved Preliminary
Plat and PR-O Final Plan.
Land Use
& Density: The proposed land use of the property is “single-family residential.” The entire subdivision
consists of 156 single-family lots and 14 tracts, A-N, for residential use which is allowed
in the underlying zoning. Lots 1-102, 146-160 and Tracts A-L are already platted. Lots
102-141 and Tracts M-N are proposed to be platted with this application. The proposed
density of the development is 3.19 units/acre based on the 12.19 +/- acre site.

Typology: The proposed development is classified as an “Detached House – Neighborhood Lot”
which is defined as “one (1) principal dwelling unit that is not connected to any other
dwelling unit.” The Detached House – Neighborhood Lot building type is permitted in the
“SF-7” zoning districts. The applicable development standards are provided in the table.
However, the minimum lot width is 65-ft. for all lots based on the previously approved PR-

Architectural
Character: The site will include 39 single-family homes with attached garages. The housing style will
be consistent with what is existing and under construction in the previous phases of the
subdivision. All elevations and building designs have been previously approved with the
PR-O Concept Plan and the PR-O Final Plan. There are no specific design features or
building materials required as part of the PR-O.
Minimum
Livable
Floor Area: A minimum livable floor area classification of 1,600-sf. (Class “F”) was approved with the
Preliminary Plat and PR-O Concept Plan based on the average house size of adjacent
single-family houses. The classification has been noted on the Final Plat.
Frontage &
Landscaping: The applicant is not proposing any changes to the previously approved landscape and
street tree plan. All landscaping approved with the PR-O Final Plan has been installed.
Signage: No additional signage is shown on the plan for the third phase. If the applicant would like
to request signage at a later date, administrative sign permit approval will be required.
Modifications
Requested: No modifications have been requested with previous applications and the final plat is
consistent with previous actions. The subdivision is in compliance with the approved PR-
O Concept and Final Plan.
Review Criteria: A Final Plat shall be reviewed based on the following criteria:

1. The layout and design of the final plat is in substantial compliance with the approved
preliminary plat considering the number of lots or parcels; the block layout, street
designs and access; the open space systems and civic design elements; the
infrastructure systems; or other elements of coordinated developments.
STAFF RESPONSE: The layout and design of the final plat is in substantial
compliance with the approved Preliminary Plat and PR-O Concept and Final Plan.
2. The construction plans meet all technical specifications.
STAFF RESPONSE: Construction plans were reviewed for adequacy and
conformance with adopted technical specifications and were approved by Staff.
3. The phasing and timing of public improvements ensures construction and performance
guarantees.
STAFF RESPONSE: The public improvements required by Public Works have
been completed and certified. The open space landscaping has been financially
guaranteed.
4. Any deviations in the final plat brings the application in further compliance with the
Comprehensive Plan and the purposes and intent of this Code.
STAFF RESPONSE: There are no deviations in the final plat. The application is,
however, in compliance with the Comprehensive Plan and the purposes and intent
of the UDC.
5. Covenants meeting the City's approval and containing all requirements of the UDC are
approved by the City Attorney's office.
STAFF RESPONSE: The developer is responsible for the drafting and recording
of covenants and restrictions for the Final Plat which must include the extension of
the HOA and address the maintenance of all common tracts and amenities. The
City does not approve nor enforce private covenants and restrictions.
6. The recommendations of professional staff.
STAFF RESPONSE: Staff recommends approval with conditions of the Final Plat
application as it is in substantial compliance with the previously approved
Preliminary Plat and PR-O Final Plan.
Approval of a final plat shall not constitute acceptance of public improvements. Such
acceptance will require separate, formal action of the City Council.
Staff
Recommendation:
Staff recommends approval of the Final Plat application with the following conditions:
1. Approval based on the representations of any drawings presented as part of this
application does not waive any requirements or development standards contained in
the UDC unless modified under the PR-O Concept Plan.
2. Prior to recording the Final Plat at Jackson County the applicant must provide a copy
of the Declarations of Restrictions to the City.
3. Prior to building permit issuance, the following must occur:

a. The Final Plat must be recorded with Jackson County and returned to the City;
and,
b. The recorded Declaration of Restriction documents shall be recorded.
4. Prior to occupancy of each lot, the following must occur:

b. The required public sidewalk for each lot shall be installed.
