NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS FOR TIERED PROJECTS AND PROGRAMS June 1, 2024 City of Blue Springs 903 W. Main Street Blue Springs, MO 64015 816-220-4504 On or after Wednesday, June 12, 2024 the City of Blue Springs will submit a request to the Department of Housing and Urban Development (HUD) for the release of 2023 funds under Title I of the Housing and Community Development Act of 1974, as amended, to undertake the following project: Tier 1 Broad Review Project/Program Title: Minor Home Repair Program Purpose: Single-family, owner-occupied, minor rehabilitation Location: City of Blue Springs (citywide) Project/Program Description: The emphasis of the Minor Home Repair Program is neighborhood conservation and provides grant assistance to low-moderate income owner-occupied single-family households to make home repairs. Eligible repairs include: window/glass repair, exterior door repair, minor roof repair, flashing or gutter repair, exterior paint, minor repair of exterior porches, steps, and railings, repair of exterior siding and trim, HVAC and water heater repair or replacement, and exterior accessibility ramp improvements. Tier 2 site specific reviews will be complete for those laws and authorities not addressed in the Tier 1 broad review for each address under this program when addresses become known. Level of Environmental Review Citation: 24 CFR Part 58.5(a)(3)(i) Tier 2 Site Specific Review: The site specific reviews will cover the following laws and authorities not addressed in the Tier 1 broad review: Flood Disaster Protection Act of 1973 and National Flood Insurance Reform Act of 1974 (Flood Insurance); Executive Order 11988, particularly section 2(a), 24 CFR Part 55 (Floodplain Management); 24 CFR 50.3(i) & 58.5(i)(2) (Contamination and Toxic Substances), 24 CFR Part 35 (Lead-Based Paint), and National Historic Preservation Act of 1966, particularly sections 106 & 110, 36 CFR Part 800 (Historic Preservation). Mitigation Measures/Conditions/Permits: Prior to program approval each address will be reviewed for floodplain zone status, reviewed through the Section 106 process in consultation with the Missouri SHPO (State Historic Preservation Office), and contamination risks will be evaluated through EPA mapping databases and site visits. Houses built prior to 1978 must comply with lead-based paint requirements. The following properties are ineligible for program funds: properties within a designated flood hazard area, properties in which the proposed rehabilitation would negatively impact a historic property or structure, properties where rehabilitation could pose a health or safety risk due to contamination, and property owners who refuse to comply with lead-based paint requirements. Estimated Project Cost: $154,000 The activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA) requirements per 24 CFR Part 58.5(a)(3)(i). PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to the Community Development Department at 903 W. Main Street, Blue Springs, MO 64015 or by email to Cara Elbert, celbert@bluespringsgov.com. All comments received by Wednesday, June 12, 2024 will be considered by the City of Blue Springs prior to authorizing submission of a request for release of funds. ENVIRONMENTAL CERTIFICATION The City of Blue Springs certifies to HUD that Chris Lievsay, Certifying Officer, in his capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Blue Springs to use HUD program funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of fund and the City of Blue Springs certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Blue Springs; (b) the City of Blue Springs has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be emailed to: CPDRROFKAN@hud.gov. Potential objectors should contact HUD to verify the actual last day of the objection period.
