MINUTES PLANNING AND ZONING COMMISSION MEETING BOERNE CITY HALL RONALD C. BOWMAN CITY COUNCIL CHAMBERS 447 North Main Street Monday, April 1, 2024 – 6:00 p.m. Minutes of the Planning and Zoning Commission meeting of April 1, 2024 at 6:00 p.m. Present: 6- Chairman Tim Bannwolf, Vice Chair Lucas Hiler, Commissioner Bill Bird, Commissioner Susan Friar, Commissioner Carlos Vecino, Commissioner Terry Lemoine Absent: 1 - Commissioner Bob Cates Staff Present: Mick McKamie, Kristy Stark, Barrett Squires, Heather Wood, Nathan Crane, Liz Huvalla, Sara Varvarigos, Jeff Carroll, Cheryl Rogers, Andrew Wilkerson Recognized and Registered Guests: Nancy Fultenfuss, Lori Franke, Shawn Franke, Yvette Rendon, Pete Cardenas, Vance Stahl, Larry Stahl 1. CALL TO ORDER – 6:00 PM Chairman Bannwolf called the Planning and Zoning Commission to order at 6:00 p.m. Pledge of Allegiance to the United States Flag Pledge of Allegiance to the Texas Flag (Honor the Texas flag, I pledge allegiance to thee, Texas – one state under God, one and indivisible.) 2. CONFLICTS OF INTEREST No conflicts were declared. 3. Chairman Bannwolf closed public comments at 6:00 p.m. 4. CONSENT AGENDA: A motion was made by Commissioner Hiler, seconded by Commissioner Friar, to approve the consent agenda as presented. The motion carried by the following vote: Yea: 6- Chairman Bannwolf, Commissioner Lemoine, Commissioner Bird, Commissioner Friar, Commissioner Vecino, Commissioner Hiler 4.A. 2024-135 Consider approval of the minutes of the Planning and Zoning Commission meeting of March 4, 2024. 4.B. 2024-136 Consider a request for a 30-Day Time Extension of the Preliminary plat of Ranches at Creekside Unit 7 & 8 located southwest of the intersection of State Hwy 46 and the proposed extension of Copper Creek. 5. REGULAR AGENDA: 5.A. 2024-137 Consider a request by Boerne Bible Evangelical Free Church to rezone approximately 3.47 acres from R1-M (Medium-density Residential District) and C2 (Transitional Commercial District) to CIV (Civic and Institutional District) for the property located at 1022 and 1026 East Blanco Road (KAD 38082, 24309, and 20065). Take necessary action. I. Staff presentation II. Public hearing III. Recommendation Nathan Crane, Planning Director, gave a brief overview of the proposed rezoning request although the applicant had requested postponement of this item shortly before this April 1, 2024 Planning and Zoning Commission meeting. City of Boerne Page 2 Printed on 5/21/2024 Planning and Zoning Commission Official Meeting Minutes April 1, 2024 Chairman Bannwolf opened the public hearing at 6:07 p.m. Pete Cardenas had a question regarding the height of the proposed structure, specifically if it would be a two story building. Larry Stahl asked why there was a public meeting being held when it is unknown what is being proposed. Yvette Rendon spoke regarding concerns for privacy as the playground at the church is located right behind her house. Chairman Bannwolf closed the public hearing at 6:13 p.m. Commissioner Friar spoke regarding the Boerne Neighborhood Discussion meeting that was held virtually on March 19, 2024. She explained that there were no members of the public that joined but the applicant was on the call and explained that they need to expand the church to accommodate church members. No action taken due to the applicant requesting postponement. 5.B. 2024-138 Request for approval of a Historic Landmark Designation for 717 North Main Street. (KAD 19840) . Sara Varvarigos, City Planner II., presented the proposed Historic Landmark Designation application. Commission discussion ensued regarding the lack of requests seen by the commission for historic landmark designations. They questioned why this historic structure has not been brought forth for this type of designation prior to now. Sara Varvarigos clarified that the structure is already a part of the city's historic district and identified as a significant structure to the district. She further explained that it is up to individual property owners to request this type of historic designation. Commission discussion continued regarding this designation allowing for City of Boerne Page 3 Printed on 5/21/2024 Planning and Zoning Commission Official Meeting Minutes April 1, 2024 more government oversight (more stringent requirements), benefits of tax abatements, and possible processes for revoking the designation. Sara further clarified that if the current owner can prove an economic hardship to city council there could be the potential to revoke the designation and the city can also initiate revocation. Shawn and Lori Franke, property owners, made themselves available for questions and explained their reasons for the request and their desire to preserve the structure; the historic designation would allow them to fall under International Existing Building Code rules and allow them to apply for future tax abatement. A motion was made by Commissioner Vecino, seconded by Commissioner Hiler, to recommend approval to Boerne City Council for the request of a Historic Landmark Designation for 717 North Main Street. (KAD 19840) .The motion carried by the following vote: Yea: 6- Chairman Bannwolf, Commissioner Lemoine, Commissioner Bird, Commissioner Friar, Commissioner Vecino, Commissioner Hiler 5.C. 2024-139 Consider a request for a variance to the Unified Development Code (UDC), Section 7.6 Water and Sewer for a property located along Cibolo Creek Northeast of Switchback Trail that intersects with IH-10 Frontage Road just south of Ranger Creek Road (KAD 49814) Cheryl Rogers, Assistant City Engineer, presented the proposed variance. Commissioner Bird questioned if future development would be responsible for making any connections to the water and sewer main, or if the city will incur some expenses. Cheryl clarified that the cost would be absorbed by the next developer as they would be responsible for extending the main from wherever it ends, to and through their property; . A motion was made by Commissioner Vecino, seconded by Commissioner Bird, to approve a request for a variance to the Unified Development Code (UDC), Section 7.6 Water and Sewer for a property located along Cibolo Creek Northeast of Switchback Trail that intersects with IH-10 Frontage Road just south of Ranger Creek Road (KAD 49814) with the following condition: Applicant must record permanent and temporary easements required for construction prior to final plat approval. The motion carried by the following vote: Yea: 6- Chairman Bannwolf, Commissioner Lemoine, Commissioner Bird, Commissioner Friar, Commissioner Vecino, Commissioner Hiler 6. COMMENTS FROM COMMISSION/LEGAL COUNSEL/STAFF - No discussion or action may take place Sara Varvarigos, City Planner II, invited the Commission and staff to attend the Historic Hill Festival that will be held on April 13, 2024 at the Kuhlmann-King Historic Complex. Chairman Bannwolf recognized Jeff Carroll, Director of Engineering and Mobility for the City of Boerne, for being named the 2024 Floodplain Manager of the Year by the Texas Floodplain Management Association. He also recognized City Engineer Andrew Wilkinson for recently obtaining a certification in floodplain management. Nathan Crane announced the resignation of Sara Serra-Bennett and Martha Bernal from their positions with the City. 7.
