BORDENTOWN, NEW JERSEY APRIL 11, 2022 The regular meeting of the Board of Commissioners was held at the Carslake Community Center on the above date at 7:00 PM and broadcast using the ZOOM Virtual Platform available to members of the public. The meeting was called to order by Mayor Jennifer L. Sciortino. The meeting was opened with a prayer by City Clerk Grace I. Archer followed by the Pledge of Allegiance. The City Clerk read the Sunshine Notice as follows: This meeting is being held in accordance with the provisions of the Open Public Meetings Act. Adequate public notice of this meeting has been given by the City Clerk of the City of Bordentown in the following manner: 1. Posting written notice of the time, date, and place on the official bulletin board at the Bordentown City Hall, 324 Farnsworth Avenue, Bordentown, New Jersey on January 11, 2022. 2. Electronic Submission and Mailing written notice of the time, date and place to The Times of Trenton and The Burlington County Times on January 11, 2022, and duly advertised in The Burlington County Times on January 14, 2022. 3. Notice of information and official meeting links to be published on the City’s official website for the Zoom Virtual format was included with the legal advertisement in The Burlington County Times on January 14, 2022. 4. Filing written notice with the Clerk of the City of Bordentown on January 11, 2022. The following named Commissioners answered the roll call: Mayor Jennifer L. Sciortino, Deputy Mayor Joseph D. Myers and Commissioner James E. Lynch, Jr. Commissioner Lynch moved the approval of the minutes of the Commission Meeting held on March 14, 2022, seconded by Mayor Sciortino. Motion carried with all Commissioners present voting in the affirmative. COMMUNICATIONS The City Clerk presented the following communication: 1. Application for Raffle License from Knights of Columbus Council #570: Off Premise 50/50 Raffle w/Drawing on July 11 and December 12, 2022 @ 8:00pm. 2. E-mail from Diane Glace on behalf of Princeton Area Walkers, and New Jersey’s AVA walk group requesting permission to set up a table for registration in front of the Divine Word gym and use of the restrooms for a 5k or 10k walk on October 1, 2022, from 9:30 am until 12:00 pm. 3. E-mail from Kara DeRose requesting permission to use Second Street Playground for a birthday party on Saturday, May 28, 2022 (rain date May 29) from 1:00PM until 3:00 PM. The Park will remain open to the public. 4. Request from Vera Appleby to have the Annual 500 Block of Prince Street Block Party on Saturday, June 18, 2022 (rain date June 19) between the hours of 4:00PM and 10:00PM with a road closure at the intersections of Prince and Chestnut Street and Prince and W. Union Street. 5. E-mail from Sarah McEwan on behalf of Girl Scout Troop 25340 Leader Meredith Sano requesting permission to have tables outside Mimosa Goods on Friday evenings in July from 5:00pm until 8:00pm to help the Girl Scout Troop host a Fairy Walk/Scavenger Hunt as the next segment toward earning their Bronze Award. The Troop will make fairy doors to place in windows of participating businesses and for a small donation, participants will receive a hunt map and receive a prize when they complete the scavenger hunt. 6. E-mail from Brenna Jobes requesting permission to host a LGBTQ Parade on Sunday, June 12, 2022 at 1:00pm. The parade will begin at the NJ Transit Riverline Parking lot, continue toward Park St., down Farnsworth Avenue to Crosswicks Street, turn toward Second Street and then down Second Street ending at The HOB Tavern 7. E-mail request from Mary Buhrer of The HOB Tavern requesting permission to hold a memorial gathering and fundraiser to honor Sam Vail, Township Employee and Resident, and celebrate his life and service to his community. She would like Second Street closed from 4:00pm to 8:00pm from Church Court to Railroad Avenue; the Township Color Guard will be in attendance to honor Sam as well as Township Officials. Commissioner Lynch moved the approval of the request, seconded by Mayor Sciortino. Motion carried in the affirmative with all Commissioners present with the exception of communication #5 with Deputy Mayor Myers abstained MAYOR SCIORTINO, DIRECTOR OF REVENUE AND FINANCE Mayor Sciortino, Director of Revenue and Finance presented the following Proclamation: CITY OF BORDENTOWN NEW JERSEY Child Abuse Prevention and Awareness Month WHEREAS, the maltreatment, abuse and neglect of children is a significant social problem that damages children physically, mentally, and emotionally and inflicts immeasurable harm on society as a whole and all children deserve to be nurtured, protected and free from physical or emotional harm; and WHEREAS, the State of New Jersey and the Department of Children and families believe that strong, healthy families are the best place to raise children; and WHEREAS, the State of New Jersey is committed to building a continuum of community-based child abuse prevention and intervention programs that are culturally competent, strength-based and family centered and that achieve positive outcomes for parenting and family relationships as well as the empowerment of domestic violence victims and their children; and WHEREAS, the New Jersey Department of Children and Families embraces the Standards for Prevention Programs developed by the New Jersey Task Force on Child Abuse and Neglect; and  WHEREAS, all sectors of the community, including law enforcement, medical professionals, schools, courts, and media outlets, as well as numerous public and private agencies, have joined forces to promote public awareness and community involvement in strengthening families during the month of April and continuing throughout the years; NOW, THEREFORE, BE IT RESOLVED this 11th day of April 2022 that I, Jennifer L. Sciortino, Mayor of the City of Bordentown, in recognition of the social problems of child abuse and neglect do hereby join with my fellow Commissioners, Deputy Mayor Joe Myers and Commissioner James E. Lynch, Jr., in declaring the month of April 2022 as Child Abuse Prevention and Awareness Month and urge all residents of the State of New Jersey to become involved in efforts aimed at strengthening families and communities and preventing our children from being abused and neglected. Mayor Sciortino read the Treasurer’s Report for the month ending March 31, 2022, as follows: Mayor Sciortino read the Tax Collector’s Report for the month ending March 31, 2022, as follows: Commission Meeting April 11, 2022 2  At this time, Mayor Sciortino apologized and explained that she meant to turn the meeting over to Commissioner Lynch for some special promotions; joking that she knew the families and officers did not want to hear this boring stuff about treasurer’s reports and tax collector’s reports. (brought smiles and chuckles from the public) The order of the Agenda was then turned to Commissioner Lynch for the Promotions of Police Officers. The order of the Agenda was returned to the Mayor who continued her reports following the completion of the Police Department promotions. Mayor Sciortino read the Tax Collector’s Annual Statement of Receipts for Calendar Year 2021 as follows: Mayor Sciortino acknowledged the diligence and strong efforts of the Tax Collector, Jennifer Smith, for staying on top of collections in the tax office. Lynch, Jr } Absent} Mayor Sciortino presented Resolution 2022-054 for adoption and approval as follows: CITY OF BORDENTOWN RESOLUTION 2022-054 INTRODUCTION OF 2022 MUNICIPAL BUDGET MUNICIPAL BUDGET OF THE CITY OF BORDENTOWN COUNTY OF BURLINGTON FOR THE CALENDAR YEAR 2022 BE IT RESOLVED that the following statements of revenues and appropriations shall constitute the Municipal Budget for the year 2022; BE IT FURTHER RESOLVED that the said Budget be published in the Burlington County Times in the issue of April 15, 2022; The Governing Body of the City of Bordentown does hereby approve the following as the Budget for the year 2022. Commission Meeting April 11, 2022 3  Mayor Sciortino presented Resolution 2022-055 for adoption and approval as follows: CITY OF BORDENTOWN RESOLUTION 2022-055 RESOLUTION APPROVING THE PAYMENT OF BILLS BE IT RESOLVED this 11th day of April 2022 that the following purchases, contracts or agreements for the performance of any work or the furnishing or hiring of materials or supplies, which have either been awarded after competitive bidding, or are exempt from competitive bidding, or the cost or price of which, together with any other sums expended for the performance of any work or services in connection with the same immediate program, undertaking, activity or project, or the furnishing of similar materials or supplies during the same fiscal year paid with or out of public funds which does not or will not exceed the total sum of $44,000 in the current fiscal year, or in the case of purchases that are not annually recurring, in a period of one (1) year, be and the same are hereby approved for payment by the City of Bordentown. Mayor Sciortino presented Resolution 2022-060 for adoption and approval as follows: CITY OF BORDENTOWN RESOLUTION 2022-060 AUTHORIZING THE RESTRUCTURING OF THE SUBCOMMITTEE UNDER THE BCEC “CREATIVE TEAM” TO BE KNOWN AS THE BORDENTOWN CITY CREATIVE TEAM IN SUPPORT OF A SUSTAINABLE AND ECONOMIC COMMUNITY WHEREAS, the Board of Commissioners recognizes Creative Teams oversee, assess, and evaluate creative placemaking efforts in understanding the community’s cultural assets; building a plan for creative placemaking, promoting multiple types of support for the arts, and influencing other leaders to build more creative communities and economies; and WHEREAS, the City of Bordentown has been home to prominent artists since revolutionary times, and continues to host a vibrant community of artists and local groups who strive to ensure that cultural plans and projects are inclusive, well integrated, and impactful; and WHEREAS, there is an emerging body of knowledge and case studies that demonstrate tangible outcomes from connecting with the arts and creativity to build stronger and economically vibrant communities; what matters most is that the Board of Commissioners recognizes that the arts contribute to robust and vital communities, and enhance the overall quality of life; and WHEREAS, the Board of Commissioners recognizes the need to restructure the Creative Team to advance the arts to provide an opportunity to engage all community members in a shared experience, to celebrate nature and build awareness of and an appreciation for our physical environment; the arts increase prosperity, economic development, and cultural tourism; to guide the City in ways that it can support a more creative community and economy; and NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the City of Bordentown that the Creative Team shall be restructured as a Committee to be known as the Bordentown City Creative Team and shall be guided by the following parameters: 1. The Bordentown City Creative Team will consist of a minimum of a Chairperson appointed by the Mayor, a City representative to act as a liaison between the Committee and the City, two artists or arts leaders from the community, an arts leader from the educational community, an arts business leader, city resident and a member from the Green Team. 2. The Creative Team will communicate regularly and maintain a relationship with City elected officials, the Green Team, and function with a perspective of engaging arts practice with economic and community development. 3. The Creative Team will explore how arts and creative strategies and initiatives can contribute to livability and quality of life for our community. 4. The Creative Team will ensure that arts initiatives are linked to an inclusive understanding of sustainability, engage with a broad cross-section of our community, and encourage participation with the intent of making the City of Bordentown a truly sustainable community. Mayor Sciortino presented Ordinance 2022-07 An Ordinance Of The City Of Bordentown, In The County Of Burlington, New Jersey, Providing For Various Capital Improvements And Related Expenses In And For The City, Appropriating $1,746,255 Therefor, And Authorizing The Issuance Of $1,660,842 In General Improvement Bonds Or Notes Of The City To Finance The Same for First Reading. Later this year it is planned to plant more trees on Oliver Street now that the water main improvements and road resurfacing projects are complete. Deputy Mayor Myers presented Resolution 2022-057 for adoption and approval as follows: CITY OF BORDENTOWN RESOLUTION 2022-057 AUTHORIZING AN AGREEMENT FOR CONSTRUCTION PHASE SERVICES WITH REMINGTON & VERNICK ENGINEERS FOR THE BORDENTOWN WATER UTILITY PROJECT: WATER METER REPLACEMENT WHEREAS, the Board of Commissioners of City of Bordentown on the 10 th of January 2022 adopted Resolution 2022-019 appointing Remington and Vernick Engineers as Water Utility and Municipal Engineer; and WHEREAS, the Board of Commissioners wishes to authorize an agreement with Remington and Vernick Engineers for Construction Phase Services, Project: Water Meter Replacement of approximately 5,600 meters throughout the City and Township of Bordentown, Burlington County, New Jersey; and WHEREAS, funding for this Project has been applied for through the State of New Jersey, Department of Environmental Protection Infrastructure Loan Program (I-Bank); and WHEREAS, the Local Public Contracts Law N.J.S.A. 40A:11-1 et seq. requires that the Resolution authorizing the award of contract for “professional services” without competitive bids and the resulting contract must be available for public inspection; and WHEREAS, the Local Public Contracts Law further requires that a Notice of the award of the contract be printed as a legal advertisement. NOW, THEREFORE, BE IT FURTHER RESOLVED this 11th day of April 2022 by the Board of Commissioners of the City of Bordentown in the County of Burlington, State of New Jersey, that an Agreement between the City of Bordentown and Remington and Vernick Engineers as stated above is authorized and accepted. BE IT FURTHER RESOLVED that the Mayor and City Clerk are hereby authorized and directed to execute any and all related documents with Remington and Vernick Engineers necessary to authorize this Agreement for Construction Phase Services and any and all Agreements and related documents necessary should be in a form acceptable to the City Solicitor. Deputy Mayor Myers presented Ordinance 2022-03 An Ordinance Of The City Of Bordentown, In The County Of Burlington, New Jersey, Providing For The Replacement Of Filtration Technology For Public Water Wells Operated By City’s Water Utility In And For The City, And Appropriating $1,500,000 Therefor, And Providing For The Issuance Of $1,425,000 In Water Utility Bonds Or Notes Of The City Of Bordentown To Finance The Same for Second Reading and Hearing. Commission Meeting April 11, 2022 6  Mayor Sciortino opened the Hearing on Ordinance 2022-03 for public comment. Hearing no questions or comments from the public, Mayor Sciortino closed the Hearing for Ordinance 2022-03. Lynch, Jr. Absent} Deputy Mayor Myers then made the following points regarding some ongoing projects in the Public Works Department:  West Street Park: Public Works will begin taking down the existing playground equipment within the next couple of days and readying the area for the installation of the new equipment this Spring  Summer Youth Program will resume this year, a start date and coordination have not been determined  Department of Public Works will be installing the docks at the city beach boat ramp before the end of the month  Thanked the residents of Union St. and Brooks Ave. for their patience during the water main construction these past few weeks and the water main break last week; he indicated that the project is about 97% complete with a few punch list items to be addressed COMMISSIONER LYNCH, DIRECTOR OF PUBLIC SAFETY AND AFFAIRS Commissioner Lynch announced this evening there were going to be a couple of promotions within the Police Department, thanking Mayor Sciortino for giving him the floor out of order of the Agenda to allow for the promotions with all the family, friends, and fellow police officers present here this evening. Commissioner Lynch then read a short bio of Lt. Simmons’ service and achievements with the Bordentown City Police Department congratulating him on tonight’s well-deserved promotion to Captain. City Clerk Grace Archer administered the Oath of Office to Captain Matthew J. Simmons as his son, Matty, held the Bible and his wife, Christie, looked on. Captain. Simmons’ father, former BCPD Police Chief Matthew J. Simmons III, did the honors of pinning on his son’s Captain’s bars. Captain Simmons expressed his gratitude to the Mayor and Commissioners, his fellow officers and family for their support through the years. He thanked the residents for their support of the Police Department and pledged to continue to do his best to continue to serve them and the City. Commissioner Lynch then read a bio of the service and achievements of Sgt. Daniel Anderson with the Department congratulating him on tonight’s promotion to the rank of Lieutenant. Sgt. Anderson came forward with his wife. Marie; children, Alan and Ivy and his Mother. City Clerk Grace Archer administered the Oath of Office to Lt. Anderson while his wife, Marie, held the Bible and family and friends looked on. Lieutenant Anderson thanked everyone for giving him this opportunity stating he is looking forward to what the future holds for the City of Bordentown and continuing to serve the community. Commissioner Lynch then finished the promotions announcing that Patrolman Ryan Lynch was being promoted to Sergeant. Commissioner Lynch then read a brief bio of Patrolman Lynch’s service and achievements with the BCPD adding that he was also Fire Chief at the Chesterfield Fire Company and possessed extensive training in many areas including emergency management, fire, and rescue, EMT training, etc. Commissioner Lynch congratulated Patrolman Lynch on his promotion and achievements in the BCPD. City Clerk Grace Archer administered the Oath of Office as Sgt. Lynch, his wife, Christina, held the Bible and his children, “Buddy” and Isla looked on. Sgt. Lynch thanked the Mayor and Commissioners and his family for their support, adding he was born and raised in the City of Bordentown. Sgt. Lynch is looking forward to serving and giving back to the community that he grew up in. Following the Oaths of Office, Captain Simmons, Lieutenant Anderson, and Sergeant Lynch received congratulations from Mayor Sciortino, Deputy Mayor Myers, Commissioner Lynch, and members of the Bordentown City Police Department, along with officers from Bordentown Township, Chesterfield Township and Chesterfield Fire Department. in attendance as a show of support. Commissioner Lynch thanked the family, friends and officers from Bordentown City, Township and Chesterfield Police Departments and the Chesterfield Fire Departments for coming out tonight to show their support. He noted it is really nice to see the support between the Departments. The meeting then had a ten-minute recess to allow for the exit of the families and officers before the meeting resumed returning to the regular order of the Agenda under the Mayor’s reports. Commissioner Lynch’s reports under the regular order of the Agenda resumed below: Commissioner Lynch, Director of Public Safety and Affairs, gave the Police Report detailing the activities of the Department from March 14 to April 10, 2022. Commissioner Lynch moved the approval of an Application for Extension of Premises Permit from Old Town Pub to allow for outside dining on Farnsworth Avenue on April 30, 2022 for the Stepping Out For Spring event sponsored by the DBA, seconded by Mayor Sciortino. Motion carried. Commissioner Lynch presented Resolution 2022-059 for adoption and approval as follows: Commission Meeting April 11, 2022 7  CITY OF BORDENTOWN RESOLUTION 2022-059 SUPPORTING THE CLICK IT OR TICKET SEATBELT ENFORCEMENT MOBILIZATION FROM MAY 23 THROUGH JUNE 5, 2022 WHEREAS, the National Highway Traffic Safety Administration estimates that 15,000 lives were saved nationally by safety belt usage in 2017 alone; and WHEREAS, the national seat belt use rate in 2019 was 90.7% the other 9.3% need to be reminded that seat belts save lives; and WHEREAS, the most effective device, when used consistently, for preventing deaths and injuries in motor vehicle crashes remains the seat belt; and WHEREAS, the State of New Jersey will participate in the nationwide “Click It or Ticket” seat belt mobilization from May 23 through June 5, 2022 to raise awareness and increase seat belt usage through a combination of high visibility enforcement and public education; and WHEREAS, the Division of Highway Traffic Safety notes that New Jersey’s seat belt usage rate currently stands at 90.23%, according to a statewide survey taken in June of 2019; and WHEREAS, this project will provide funding to implement a targeted seat belt enforcement campaign in New Jersey as part of the nationwide “Click It Or Ticket” seat belt mobilization utilizing police officers to conduct special enforcement patrols issuing summonses for all violations of Title 39 of the Motor Vehicle Code; and WHEREAS, the focus of these patrols will be to stop and issue summonses to motorists, front and rear seat passengers who are not complying with the state’s seat belt laws and Officers will also enforce the child safety restraint law as appropriate. NOW, THEREFORE, BE IT RESOLVED that the Board of Commissioners of the City of Bordentown and the City of Bordentown Police Department declare their support for the “Click It or Ticket” seat belt mobilization both locally and nationally from May 23 through June 5, 2022 and pledge to increase awareness of the mobilization and the benefits of seat belt use. BE IT FURTHER RESOLVED that the Board of Commissioners of the City of Bordentown does hereby authorize the submission of the 2022 “Click It or Ticket” Grant Application to the NJ State Highway Division of Traffic Safety. Lynch, Jr. Absent} Commissioner Lynch commented there has been good and bad with the budget for the past couple of years, and he expressed his many thanks to Peggy Peak, CFO and Mayor Sciortino for a well thought out budget and diligent efforts that helped the City preserve its A1 Bond Rating. Commissioner Lynch added his thanks to Peggy for correcting past issues with the budget. Commissioner Lynch presented Resolution 2022-058 for adoption and approval as follows: CITY OF BORDENTOWN RESOLUTION 2022-058 RESOLUTION PROVIDING FOR PROVISIONAL APPOINTMENT OF POLICE CAPTAIN WHEREAS, Chapter 66 of the Code of the City of Bordentown as adopted and amended from time to time establishes the Bordentown City Police Department; and WHEREAS, more specifically Chapter 66-3 defines the composition of the members of the Bordentown City Police Department which allows for the position of Police Captain; and WHEREAS, the Director of Public Safety and Affairs has determined that it would be in the best interest of the Bordentown City Department and the residents of the City that there be appointed an officer to serve in the position of Police Captain; and WHEREAS, it is the desire of the Board of Commissioners of the City of Bordentown to provisionally appoint Lt. Matthew J. Simmons IV, a veteran of the Department, to serve as Police Captain pending the outcome of promotional testing as conducted by the Civil Service Commission. NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the City of Bordentown that Lt. Matthew J. Simmons IV be and is hereby appointed to serve provisionally as Police Captain within the Bordentown City Police Department pending Civil Service Commission testing and approval. Commission Meeting April 11, 2022 8  Commissioner Lynch moved the adoption and approval of Resolution 2022-058, seconded by Mayor Sciortino. Motion carried with all Commissioners present voting in the affirmative. Mayor Sciortino opened the meeting for public comment. Kathy Dawson addressed the Commissioners with several questions: 1. Is there an Ordinance in place that prevents you from setting up a table on the sidewalk to sell items? Bob Erickson stated he believes you can have a yard sale 3 or 4 times a year, all depends on what you will be selling. She stated setting up a table in front of empty business during one of these small events. CJ Mugavero injected you need to be a member of the DBA to participate in a DBA event. 2. What are the recourses for your neighbor having dead trees on their property that are close to hitting my car, what can be done? Bob Erickson commented that sounds like a property maintenance issue, he suggested to reach out to Michael Tunney or Jennifer Smith. 3. Anything in the works for jet ski issues that occurred last year. The Commissioners advised that they address any issues as they occur. 4. Asked for clarification on the property tax increase amount for the City. Mayor Sciortino commented the average homeowner will pay an estimated $73.51 this year to support a proposed $7.1 million-dollar municipal budget. Which will call for a 0.03 cent increase. Commissioner Lynch added that $34,000 equals .01 cent on the budget Cathy Shaw asked for a better understanding of the pipes that need to be replaced from the curb to the house and the timetable for notification and the replacement process. Deputy Mayor Myers explained that notice is made and the time to replace is dependent upon the condition of the existing service line. Ed Foley, Water Utility employee, explained that while doing new watermains they can see what type of service line is ran from the curb box to the house, if the service line is galvanized it needs to be replaced and all the lines needed to be replaced on E. Union had been identified and completed. John Brodowski (virtual attendee) asked for a breakdown of Ordinance 2022-07, Deputy Mayor Myers stated that the funds will go towards a new roof, generator at Divine Word, and a hybrid vehicle for the Police Department and that the pending Ordinance will be posted on the website tomorrow morning. Mr. Brodowski then congratulated the members of the Bordentown City Police Department who were promoted. John then inquired about a Bond Sale in 2021 to which Ms. Peak addressed his question and explained that Moody’s had questioned the Bond rating for the City because of comments in the 2019 and 2020 audit, of which he was acquainted with and she had to have a telephone conference with them to explain procedures that were followed to reassure them that the City finances were in good shape and the A1 rating should be maintained. CJ Mugavero reminded everyone Saturday, April 30th is also the Music Porchfest from 12:00PM until 5:00PM, be on the lookout for live music on a porch near you! In addition to Porchfest the DBA Event “Stepping Out For Spring” will be happening, during the day there will be sidewalk shopping and food trucks if the establishment owns one and on behalf of Bordentown City Clean Communities, they donated recyclable take out containers. For the DBA event, from 3:00PM until 10:00PM Farnsworth Avenue will be closed to traffic between E/W Church Street and Veterans Way for outside dining with live music from 5:00PM until 9:00PM. Mayor Sciortino reminded everyone that Post 26 will be holding a Memorial Day Ceremony on May 28 th at 11:00AM and it will be a full ceremony with the school choir and other special guests. There were no further questions or comments, and Mayor Sciortino closed the public portion of the meeting.
