BORDENTOWN, NEW JERSEY AUGUST 29, 2022 This special meeting of the Board of Commissioners was held at the Carslake Community Center, 207 Crosswicks Street, Bordentown, NJ on the above date at 6:00 PM. The meeting was called to order by Mayor Jennifer L. Sciortino. The meeting was opened with a prayer by City Clerk Grace I. Archer followed by the Pledge of Allegiance. The City Clerk read the Sunshine Notice as follows: This special meeting is being held in accordance with the provisions of the Open Public Meetings Act. Adequate public notice of this meeting has been given by the City Clerk of the City of Bordentown in the following manner: 1. Posting written notice of the time, date, and place on the official bulletin board at the Bordentown City Hall, 101 E. Park Street, Bordentown, New Jersey on August 10, 2022. 2. Electronic Submission and Mailing written notice of the time, date and place to The Times of Trenton and The Burlington County Times on August 10, 2022, and duly advertised in The Burlington County Times on August 12, 2022 and The Times of Trenton on August 15, 2022. 3. Notice of information and official meeting links to be published on the City’s official website for the Zoom Virtual format was included with the legal advertisement in The Burlington County Times on August 15, 2022. 4. Filing written notice with the Clerk of the City of Bordentown on August 10, 2022. The following named Commissioners answered the roll call: Mayor Jennifer L. Sciortino, Deputy Mayor Joseph D. Myers and Commissioner James E. Lynch, Jr. Commissioner Lynch moved the approval of the minutes of the Commission Meeting August 8, 2022, seconded by Mayor Sciortino. Motion carried. COMMUNICATIONS The City Clerk presented the following communication: 1. E-mail from Carlene Evans requesting permission to use Second Street Playground for a picnic on Saturday September 24, 2022, from 12:00PM until 5:00 PM with approximately 50 guests. The Park will remain open to the public. Commissioner Lynch moved the approval of the request, seconded by Mayor Sciortino. Motion carried. MAYOR SCIORTINO, DIRECTOR OF REVENUE AND FINANCE Mayor Sciortino, Director of Revenue and Finance, Resolution 2022-123 for adoption and approval as follows: CITY OF BORDENTOWN RESOLUTION 2022-123 RESOLUTION APPROVING THE PAYMENT OF BILLS BE IT RESOLVED this 29th day of August 2022 that the following purchases, contracts or agreements for the performance of any work or the furnishing or hiring of materials or supplies, which have either been awarded after competitive bidding, or are exempt from competitive bidding, or the cost or price of which, together with any other sums expended for the performance of any work or services in connection with the same immediate program, undertaking, activity or project, or the furnishing of similar materials or supplies during the same fiscal year paid with or out of public funds which does not or will not exceed the total sum of $44,000 in the current fiscal year, or in the case of purchases that are not annually recurring, in a period of one (1) year, be and the same are hereby approved for payment by the City of Bordentown.  Mayor Sciortino moved the adoption and approval of Resolution 2022-123, seconded by Deputy Mayor Myers. Mayor Sciortino presented Resolution 2022-125 for adoption and approval as follows: CITY OF BORDENTOWN RESOLUTION 2022-125 RESOLUTION AUTHORIZING A MEMORANDUM OF UNDERSTANDING BETWEEN NEW JERSEY TRANSIT AND THE CITY OF BORDENTOWN FOR USE OF THE RIVER LINE STATION PARKING LOT WHEREAS, the need for additional parking in the City of Bordentown (“City”) is a continuous concern as the City continues to grow and attract more visitors to the City’s restaurants, shops, and historical attractions; and WHEREAS, the Board of Commissioners of the City of Bordentown (“Board of Commissioners”) has recognized the need for additional parking and has explored creative ways to increase available parking in the City; and WHEREAS, New Jersey Transit has offered the City the opportunity to use the River Line Station’s parking lot as additional, free of charge parking for the City’s general population and visitors; and WHEREAS, the City and New Jersey Transit have mutually prepared, and negotiated a Memorandum of Understanding (“MOU”) to outline the City’s use of the River Line Station’s parking lot; and WHEREAS, the Board of Commissioners believes it to be in the City’s best interest to execute an MOU with New Jersey Transit to help ease the City’s parking concerns with no additional costs to the City, its residents, or its visitors. NOW, THEREFORE, BE IT RESOLVED this 29th day of August 2022 by the Board of Commissioners of the City of Bordentown that the Mayor is hereby authorized to execute the Memorandum of Understanding with New Jersey Transit for the provision of additional parking, free of charge, through use of the River Line Station’s parking lot, in a form acceptable to the City Solicitor and Commissioners. Mayor Sciortino moved the adoption and approval of Resolution 2022-125, seconded by Commissioner Lynch. Motion carried with all Commissioners present voting in the affirmative. DEPUTY MAYOR MYERS, DIRECTOR OF PUBLIC PROPERTY, STREETS AND WATER Deputy Mayor Myers, Director of Public Property, Streets and Water, presented Resolution 2022-126 for adoption and approval as follows: CITY OF BORDENTOWN RESOLUTION 2022-126 AWARD OF CONTRACT FOR FY’2021 NJDOT TRUST FUND RESURFACING OF EAST & WEST UNION STREET WITHIN THE CITY OF BORDENTOWN IN AN AMOUNT NOT TO EXCEED $ 366,213.13 Special Commission Meeting August 29, 2022 2  WHEREAS, the City of Bordentown duly advertised on August 16, 2022 according to the law for bids for resurfacing of East & West Union Street within the City of Bordentown; and WHEREAS, (2) bids were received, opened, and announced by Remington & Vernick Engineers at the City of Bordentown, 101 E. Park Street Bordentown NJ 08505 on August 26, 2022; and WHEREAS, Remington & Vernick Engineers have tabulated the bids received on August 26, 2022, and find the apparent low bidder as Earle Asphalt Company bids as follows: Earle Asphalt Company, P.O. Box 556, Farmingdale NJ 07727 Base Bid: $ 366,213.13 Alt. Bid No. 1 $ 111,800.00 American Asphalt Company, Inc. 100 Main Street, West Collingswood NJ 08059 Base Bid: $ 420,548.20 Alt Bid No. 1 126,805.40 WHEREAS Earle Asphalt Company is the lowest responsible bidder with a Base Bid in the amount of $ 366,213.13 and such bid package is in compliance with the bid specifications as prepared by Remington & Vernick Engineers; and WHEREAS, the Chief Financial Officer of the City does hereby recommend the awarding of this contract through the open competitive bidding process consistent with N.J.S.A. 40A:11-1 et seq to; and WHEREAS, funds are available for this purpose. NOW, THEREFORE, BE IT RESOLVED this 29th day of August 2022 by the Board of Commissioners of the City of Bordentown that it does hereby award a contract for the FY ’2021 NJDOT Trust Fund Resurfacing of East Union Street within the City of Bordentown to Earle Asphalt Company. BE IT FURTHER RESOLVED that the Mayor and City Clerk are hereby authorized and directed to execute any and all contracts and related documents with Earle Asphalt Company necessary to award and complete the Contract. All contracts and related documents necessary to award and complete the award of the contract should be in a form acceptable to the City Solicitor. Deputy Mayor Myers noted that over the last few weeks there have been tree branches falling, a water leak that had to be fixed while the line was “live” (unable to turn water off), several other water leaks in various locations and sinkholes Special Commission Meeting August 29, 2022 3 that have appeared and needed attention and with all of this, the Public Works and Water Departments have been dealing with extreme heat and it just reminds him of what a great team they are as they continue to “get the job done” under some of the worst of circumstances. COMMISSIONER LYNCH, DIRECTOR OF PUBLIC SAFETY AND AFFAIRS Commissioner Lynch, Director of Public Safety and Affairs, presented Resolution 2022-129 for adoption and approval as follows: CITY OF BORDENTOWN RESOLUTION 2022-129 RESOLUTION OF THE CITY OF BORDENTOWN, COUNTY OF BURLINGTON, NEW JERSEY, MAKING CERTAIN DETERMINATIONS FOR THE ADDITION AND ALTERATIONS TO CITY OF BORDENTOWN POLICE DEPARTMENT, REJECTING ALL BIDS AND AUTHORIZING RE-BID IN CONNECTION WITH THE FOREGOING WHEREAS, the City of Bordentown, County of Burlington, New Jersey (“City”) advertised for bids for the Addition and Alterations to the City of Bordentown Police Department, together with all work incidental thereto (“Project”); and WHEREAS, on August 10, 2022, one (1) bid was received, as shown in the below bid tabulation, in response to the City’s solicitation; and Contractor Base Bid Scozzari Builders Incorporated $ 1,523,243.00 1891 North Olden Avenue Trenton, NJ 08638 WHEREAS, based upon the review and evaluation of the proposal by James Foran, Architect for the City of Bordentown and Margaret M. Peak, City Administrator, the bid substantially exceeded the cost estimates prepared for the Project; and WHEREAS, as a result of the foregoing, pursuant to N.J.S.A. 40A:11-13.2(a), it is the desire of the Board of Commissioners to reject all bids received and re-advertise and re-bid for the Project. NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the City of Bordentown, County of Burlington, State of New Jersey as follows: 1. The bid received on August 10, 2022 for the Addition and Alterations to City of Bordentown Police Department is hereby rejected. 2. The City Administrator is hereby authorized to re-advertise and re-bid for the Addition and Alterations to City of Bordentown Police Department. Commissioner Lynch moved the adoption and approval of Resolution 2022-129, seconded by Deputy Mayor Myers. Motion carried with all Commissioners present voting in the affirmative. Commissioner Lynch talked about receiving only one (1) bid on this project and it came in extremely over the amount budgeted by the City. Commissioner Lynch said he was going to sit with Chief Lafferty and other personnel to review the plans and specifications as they had been prepared to see where some items could be scaled back or removed from the plans completely. He hopes to get this accomplished relatively soon so the City can advertise again; hoping to be able to move the Police Station out to its new location before the summer of 2023. Commissioner Lynch presented Ordinance 2022-14 An Ordinance Amending The Code Of The City Of Bordentown Amending Chapter 37 Entitled, “Fees And Licenses” for Second Reading and Hearing. Mayor Sciortino opened the Hearing on Ordinance 2022-14 for public comment. Hearing no questions or comments from the public, Mayor Sciortino closed the Hearing for Ordinance 2022-14. Lynch, Jr. Absent} Commissioner Lynch presented Ordinance 2022-15 Amending Chapter 258 Of The Code Of The City Of Bordentown, Entitled “Vehicles And Traffic” for First Reading. Second Reading and Hearing will be held on September 12, 2022. Commissioner Lynch moved the approval of Ordinance 2022-15 on First Reading, seconded by Mayor Sciortino. } Jennifer L. Lynch, Jr. Absent} Mayor Sciortino opened the meeting for public comment Richard Ryan addressed the Commissioners with a few inquiries regarding the resurfacing/watermain replacement project for E. Union Street: 1. What is the information on the bid for resurfacing E. Union Street? Response: Deputy Mayor Myers advised there are copies of the bid specs at City Hall he could look at. 2. Who designs the specs for these types of projects? Response: Deputy Mayor Myers stated the city’s engineering firm, Remington & Vernick Engineers. 3. How is the topping of the watermain replacements done to make sure there will not be any ruts so that when it rains there will not be any puddles? Response: Deputy Mayor Myers discussed the company does a concrete base, then black top, and milling all materials used are DOT approved. Special Commission Meeting August 29, 2022 4  Hearing no further questions or comments from the public, Mayor Sciortino closed the public portion of the meeting. Commissioner Lynch did announce that a longtime resident of the City, Ed Koenig, had passed away. Ed lived in the City, operated a business in the City, was involved in the local government many years ago. He had moved to Homestead Village in Columbus, New Jersey and remained active in the housing association, even selling homes there. With no further business to conduct, Mayor Sciortino moved to adjourn, seconded by Commissioner Lynch. Motion carried.
