BORDENTOWN, NEW JERSEY OCTOBER 6, 2022 The regular meeting of the Board of Commissioners was held at the Carslake Community Center on the above date at 7:00 PM and broadcast using the ZOOM Virtual Platform available to members of the public. The meeting was called to order by Mayor Jennifer L. Sciortino. The meeting was opened with a prayer by City Clerk Grace I. Archer followed by the Pledge of Allegiance. The City Clerk read the Sunshine Notice as follows: This meeting is being held in accordance with the provisions of the Open Public Meetings Act. Adequate public notice of this meeting has been given by the City Clerk of the City of Bordentown in the following manner: 1. Posting written notice of the time, date, and place on the official bulletin board at the Bordentown City Hall, 101 E. Park Street, Bordentown, New Jersey on September 15, 2022. 2. Electronic Submission and Mailing written notice of the time, date and place to The Times of Trenton and The Burlington County Times on September 15, 2022, and duly advertised in The Burlington County Times on September 18, 2022. 3. Notice of information and official meeting links to be published on the City’s official website for the Zoom Virtual format was included with the legal advertisement in The Burlington County Times on September 18, 2022. 4. Filing written notice with the Clerk of the City of Bordentown on September 11, 2022. The following named Commissioners answered the roll call: Mayor Jennifer L. Sciortino, Deputy Mayor Joseph D. Myers and Commissioner James E. Lynch, Jr. Commissioner Lynch moved the approval of the minutes of the Commission Meeting September 12, 2022 seconded by Deputy Mayor Myers. Motion carried with all Commissioners present voting in the affirmative. MAYOR SCIORTINO, DIRECTOR OF REVENUE AND FINANCE Mayor Sciortino, Director of Revenue and Finance, read the Treasurer’s Report for the month ending September 30, 2022, as follows: Mayor Sciortino presented Resolution 2022-137 for adoption and approval as follows: CITY OF BORDENTOWN RESOLUTION 2022-137 RESOLUTION APPROVING THE PAYMENT OF BILLS BE IT RESOLVED this 6th day of October 2022 that the following purchases, contracts or agreements for the performance of any work or the furnishing or hiring of materials or supplies, which have either been awarded after competitive bidding, or are exempt from competitive bidding, or the cost or price of which, together with any other sums expended for the performance of any work or services in connection with the same immediate program, undertaking, activity or project, or the furnishing of similar materials or supplies during the same fiscal year paid with or out of public funds which does not or will not exceed the total sum of $44,000 in the current fiscal year, or in the case of purchases that are not annually recurring, in a period of one (1) year, be and the same are hereby approved for payment by the City of Bordentown. Commission Meeting October 6, 2022 2 Mayor Sciortino moved the adoption and approval of Resolution 2022-137, seconded by Commissioner Lynch. Motion carried with all Commissioners present voting in the affirmative. Mayor Sciortino presented Resolution 2022-138 for adoption and approval as follows: CITY OF BORDENTOWN RESOLUTION 2022-138 AFFIRMING THE CITY OF BORDENTOWN’S CIVIL RIGHTS POLICY WHEREAS, it is the policy of the City of Bordentown to treat the public, employees, prospective employees, appointees, volunteers, and contractors in a manner consistent with all applicable civil rights laws and regulations including, but not limited to the Federal Civil Rights Act of 1964 as subsequently amended, the New Jersey Law against Discrimination, the Americans with Disabilities Act and the Conscientious Employee Protection Act, and WHEREAS, the Board of Commissioners of the City of Bordentown has determined that certain procedures need to be established to accomplish this policy. NOW, THEREFORE, BE IT ADOPTED by the Board of Commissioners of the City of Bordentown, County of Burlington and State of New Jersey that: Section 1: No official, employee, appointee or volunteer of the City of Bordentown by whatever title known, or any entity that is in any way a part of the City of Bordentown shall engage, either directly or indirectly in any act including the failure to act that constitutes discrimination, harassment or a violation of any person’s constitutional rights while such official, employee, appointee volunteer, or entity is engaged in or acting on behalf of the City of Bordentown’s business or using the facilities or property of the City of Bordentown. Section 2: The prohibitions and requirements of this resolution shall extend to any person or entity, including but not limited to any volunteer organization or inter-local organization, whether structured as a governmental entity or a private entity, that receives authorization or support in any way from the City of Bordentown to provide services that otherwise could be performed by the City of Bordentown. Section 3: Discrimination, harassment and civil rights shall be defined for purposes of this resolution using the latest definitions contained in the applicable Federal and State laws concerning discrimination, harassment, and civil rights. Section 4: The Municipal Clerk shall establish written procedures for any person to report alleged discrimination, harassment and violations of civil rights prohibited by this resolution. Such procedures shall include alternate ways to report a complaint so that the person making the complaint need not communicate with the alleged violator in the event the alleged violator would be the normal contact for such complaints. Section 5: No person shall retaliate against any person who reports any alleged discrimination, harassment, or violation of civil rights, provided however, that any person who reports alleged violations in bad faith shall be subject to appropriate discipline. Section 6: The Municipal Clerk shall establish written procedures that require all officials, employees, appointees, and volunteers of the City of Bordentown as well as all other entities subject to this resolution to periodically complete training concerning their duties, responsibilities and rights pursuant to this resolution. Section 7: The Municipal Clerk shall establish a system to monitor compliance and shall report at least annually to the governing body the results of the monitoring. Section 8: At least annually, the Municipal Clerk shall cause a summary of this resolution and the procedures established pursuant to this resolution to be communicated within the City of Bordentown. This communication shall include a statement from the governing body expressing its unequivocal commitment to enforce this resolution. This summary shall also be posted on the City of Bordentown’s website. Section 9: A copy of this resolution shall be published in the official newspaper of the City of Bordentown in order for the public to be made aware of this policy and the City of Bordentown’s commitment to the implementation and enforcement of this policy. Section 10: This resolution shall take effect immediately. Mayor Sciortino moved the adoption and approval of Resolution 2022-138, seconded by Commissioner Lynch. Motion carried with all Commissioners present voting in the affirmative. Commission Meeting October 6, 2022 3 Mayor Sciortino presented Resolution 2022-139 for adoption and approval as follows: CITY OF BORDENTOWN RESOLUTION 2022-139 APPROVING THE CITY OF BORDENTOWN CIVIL RIGHTS COMPLAINT FORM WHEREAS, the Board of Commissioners of the City of Bordentown adopted Resolution 2022-139 Affirming the City of Bordentown’s Civil Rights Policy on October 6, 2022; and WHEREAS, the Board of Commissioners has deemed it necessary to adopt a Civil Rights Complaint Form to properly provide for the investigation and enforcement of the City’s Civil Rights Policy. NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the City of Bordentown, County of Burlington, and State of New Jersey that it does hereby approve of the Civil Rights Complaint Form attached hereto and made a part thereof; and BE IT FURTHER RESOLVED that the Board of Commissioners does hereby direct that the City Clerk shall post the Civil Rights Complaint Form on the City’s website and provide for distribution to all officials, employees, appointees, volunteers, or entity that is engaged in or acting on behalf of the City of Bordentown’s business or using the facilities or property of the City of Bordentown. Mayor Sciortino moved the adoption and approval of Resolution 2022-139, seconded by Commissioner Lynch. Motion carried with all Commissioners present voting in the affirmative. APPOINTMENTS TO BOARDS/COMMITTEES/COMMISSIONS: Mayor Sciortino made the following committee appointments: Bordentown City Creative Team Rick Ellis – City Resident DEPUTY MAYOR MYERS, DIRECTOR OF PUBLIC PROPERTY, STREETS AND WATER Deputy Mayor Myers expressed his gratitude to Community Garden Volunteers Maxine Brimmer and Cathy Elliot-Shaw and 2022 Farmer’s Market Managers Yasmin Qazilbash and Cara Murphy for their time and dedication this summer. He further thanked Cathy Elliot-Shaw for her continuing efforts for submitting documents for Sustainable New Jersey. Deputy Mayor Myers announced Union Street mobilization will be discussed next week to see what can be done before the Halloween Parade. COMMISSIONER LYNCH, DIRECTOR OF PUBLIC SAFETY AND AFFAIRS Commissioner Lynch, Director of Public Safety and Affairs, gave the Police Report detailing the activities of the Department from September 12 to October 5, 2022. Commissioner Lynch moved the approval of a Motor Vehicle Commission Business License: Brother’s Auto Body, seconded by Mayor Sciortino. Motion carried. Commissioner Lynch presented Resolution 2022-140 for adoption and approval as follows: CITY OF BORDENTOWN RESOLUTION 2022-140 A RESOLUTION ADOPTING TECHNOLOGY RISK MANAGEMENT STANDARDS IN COMPLIANCE WITH THE NEW JERSEY MUNICIPAL EXCESS LIABILITY JOINT INSURANCE FUND’S CYBER RISK MANAGEMENT PLAN’S TIER TWO REQUIREMENTS WHEREAS, the City of Bordentown is a member of the Burlington County Municipal JIF which secures insurance protection through the New Jersey Municipal Excess Liability Joint Insurance Fund (NJ MEL); and WHEREAS, through its membership in the Burlington County Municipal JIF, the City of Bordentown enjoys cyber liability insurance coverage to protect the City of Bordentown from the potential devastating costs associated with a cyber related claim; and WHEREAS, in an attempt to prevent as many cyber related claims as possible, the NJ MEL developed and released to its members the NJ MEL Cyber Risk Management Plan; and WHEREAS, the NJ MEL Cyber Risk Management Plan outlines a set of best practices and standards broken out into Tier 1, Tier 2, and Tier 3 standards that if adopted and followed will reduce many of the risks associated with the use of technology by the City of Bordentown; and WHEREAS, in addition to the reduction of potential claims, implementing the following best practices and standards will enable the City of Bordentown to claim a reimbursement of a paid insurance deductible in the event the member files a claim against City of Bordentown’s cyber insurance policy, administered through the Burlington County Municipal JIF and the Municipal Excess Liability Joint Insurance Fund. NOW, THEREFORE, BE IT RESOLVED that the City of Bordentown does hereby adopt the following best practices and standards, a copy of which is attached hereto and incorporated herein by reference, in accordance with Tier 2 of the NJ MEL Cyber Risk Management Plan: Server Security Remote Access - VPN Access Privilege Controls Leadership Expertise Technology Support IT Business Continuity Planning System and Event Logging Banking Controls Commission Meeting October 6, 2022 4 Protected Information BE IT FURTHER RESOLVED that a copy of this resolution along with all required checklists and correspondence be provided to the NJ MEL Underwriter for their consideration and approval. Commissioner Lynch moved the adoption and approval of Resolution 2022-140, seconded by Mayor Sciortino. Motion carried with all Commissioners present voting in the affirmative. Commissioner Lynch moved the adoption and approval of Resolution 2022-141, seconded by Deputy Mayor Myers. Motion carried with all Commissioners present voting in the affirmative. Commissioner Lynch presented Resolution 2022-142 for adoption and approval as follows: CITY OF BORDENTOWN RESOLUTION 2022-142 AUTHORIZE SUBMITTAL OF NJ DEPARTMENT OF COMMUNITY AFFAIRS GRANT FY2023 AND EXECUTION OF GRANT CONTRACT IN THE AMOUNT OF $100,000 FOR THE NEW MUNICIPAL COMPLEX LOCATED AT 101 E. PARK STREET NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the City of Bordentown, County of Burlington, New Jersey that it formally authorizes the submission and execution of a NJ Department of Community Affairs Grant for FY2023 in the amount of $100,000 for the new municipal complex located at 101 E. Park Street; and BE IT FURTHER RESOLVED that the Mayor and Clerk are hereby authorized to submit an electronic grant application identified as FY 2023-09024-0300 under the NJ Department of Community Affairs on behalf of the City of Bordentown; and BE IT FURTHER RESOLVED that the Mayor and Clerk are hereby authorized to sign the grant agreement on behalf of the City of Bordentown and that their signature constitutes acceptance of the terms and conditions of the grant agreement and approves the execution of the grant agreement. Commissioner Lynch moved the adoption and approval of Resolution 2022-142, seconded by Deputy Mayor Myers. Motion carried with all Commissioners present voting in the affirmative. Commissioner Lynch sympathized and stated that it was unfortunate that the bad weather from Tropical Storm Ian caused the cancellation of this year’s Cranberry Festival, acknowledging the tremendous amount of work and efforts that it takes to organize this event each year. Commissioner Lynch then hoped for nicer weather for Saturday, the 15 th of October when Hope Hose Humane Fire Company will hold its Annual RiverFest. Mayor Sciortino announced that French Ambassador Philippe Étienne along with the Consulate General of France in New York, Jérémie Robert, and Ann de Broca-Hoppenot, the French Consul to New Jersey, toured the Bonaparte Exhibit and Point Breeze property during a recent visit coordinated by Director Peter Tucci of the Bordentown Historical Society. The Mayor further revealed that she and members of the Bordentown Historical Society, Bonnie Goldman, Steve Lederman and Peter Tucci would be traveling to France on Monday, October 12th and staying in the City of Mortefontaine where they will execute the Sister City Agreement between the two cities. Mayor Sciortino further explained the deeper connection between the two cities revealing that the Castle of Mortefontaine was bought by Joseph Bonaparte, thereby connecting us to Mortefontaine by virtue of Joseph Bonaparte purchasing Point Breeze as his home here in Bordentown. Leaders have graciously opened their doors to the small group extending hospitality along with tours and other activities planned during Commission Meeting October 6, 2022 5 their stay. The signing ceremony will be live streamed on YouTube so that those who wished to view the ceremony would be able to do so. Mayor Sciortino opened the meeting for public comment. Hearing no questions or comments from the public, Mayor Sciortino closed the public portion of the meeting. With no further business to conduct, Mayor Sciortino moved to adjourn, seconded by Commissioner Lynch. Motion carried.
