BORDENTOWN, NEW JERSEY MAY 8, 2023 The regular meeting of the Board of Commissioners was held at the Carslake Community Center on the above date at 7:00 PM and broadcast using the ZOOM Virtual Platform available to members of the public. The meeting was called to order by Mayor Jennifer L. Sciortino. The meeting was opened with a prayer by City Clerk Grace I. Archer followed by the Pledge of Allegiance. The City Clerk read the Sunshine Notice as follows: This meeting is being held in accordance with the provisions of the Open Public Meetings Act. Adequate public notice of this meeting has been given by the City Clerk of the City of Bordentown in the following manner: 1. Posting written notice of the time, date, and place on the official bulletin board at the Bordentown City Hall, 101 E. Park Street, Bordentown, New Jersey on January 11, 2023. 2. Myers and Commissioner James E. Lynch, Jr. Commissioner Lynch moved the approval of the minutes of the Commission Meeting April 10, 2023, seconded by Mayor Sciortino. Motion carried. Mike Van Clef, Program Director for the FoHVOS Invasive Species Strike Team, gave a presentation providing information and statistics on the activity of invasive species in our parks and open spaces throughout New Jersey. Information that was presented can be obtained in the office of the Municipal Clerk or from the Bordentown City Environmental Commission. MAYOR SCIORTINO, DIRECTOR OF REVENUE AND FINANCE CITY OF BORDENTOWN NEW JERSEY PEACE OFFICERS MEMORIAL DAY NATIONAL POLICE WEEK MAY 14  WHEREAS, police officers across the United States work selflessly to serve and protect the citizens of our nation without regard to personal hazard or peril; and WHEREAS, on October 1, 1961 Congress asked President John F. Kennedy to designate May 15 to honor peace officers who have been disabled or killed in the line of duty; and WHEREAS, on October 1, 1962 the bill was signed into law and a Proclamation signed by President John F. Kennedy which declared May 15 of each year as “Peace Officers Memorial Day” and the calendar week of each year during which such May 15 occurs as “National Police Week”; and WHEREAS, on this day all officials of the Government are directed to display the American Flag at half-staff on all government buildings as provided by the Act of June 22, 1942. NOW, THEREFORE, BE IT RESOLVED that I, Jennifer L. Sciortino, Mayor of the City of Bordentown along with Deputy Mayor Joe Myers and Commissioner James E. Lynch, Jr., do hereby recognize May 14 as Peace Officers Memorial Day and ask the citizens of our community to remember those who have been disabled or made the ultimate sacrifice in the line of duty; and BE IT FURTHER RESOLVED that the Board of Commissioners of the City of Bordentown recognizes the week of May 14 through May 20, 2023, as National Police Week and asks the residents to join with us to commend and thank the Officers of the Bordentown City Police Department for the selfless service they provide to each of us here in Bordentown City each and every day of the year; and BE IT FINALLY RESOLVED that the American Flag be lowered to half-staff on all government buildings in the City in accordance with the Act of June 22, 1942. Mayor Sciortino presented Resolution 2023-065 for adoption and approval as follows: CITY OF BORDENTOWN RESOLUTION 2023-065 RESOLUTION APPROVING THE PAYMENT OF BILLS BE IT RESOLVED this 8th day of May 2023 that the following purchases, contracts or agreements for the performance of any work or the furnishing or hiring of materials or supplies, which have either been awarded after competitive bidding, or are exempt from competitive bidding, or the cost or price of which, together with any other sums expended for the performance of any work or services in connection with the same immediate program, undertaking, activity or project, or the furnishing of similar materials or supplies during the same fiscal year paid with or out of public funds which does not or will not exceed the total sum of $44,000 in the current fiscal year, or in the case of purchases that are not annually recurring, in a period of one (1) year, be and the same are hereby approved for payment by the City of Bordentown. Commission Meeting May 8, 2023 3  Mayor Sciortino moved the adoption and approval of Resolution 2023-065, seconded by Commissioner Lynch. Motion carried with all Commissioners present voting in the affirmative Mayor Sciortino presented Resolution 2023-066 for adoption and approval as follows: CITY OF BORDENTOWN RESOLUTION 2023-066 SELF-EXAMINATION OF BUDGET RESOLUTION WHEREAS, N.J.S.A. 40A:4-78b has authorized the Local Finance Board to adopt rules that permit municipalities in sound fiscal condition to assume the responsibility, normally granted to the Director of the Division of Local Government Services, of conducting the annual budget examination; and WHEREAS, N.J.A.C. 5:30-7 was adopted by the Local Finance Board on February 11, 1997; and WHEREAS, pursuant to N.J.A.C. 5:30-7.2 through 7.5, the Chief Financial officer has determined that the City of Bordentown meets the necessary conditions and is eligible to participate for the 2023 budget year. NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the City of Bordentown that in accordance with N.J.A.C. 5:30-7.6a & 7.6b and based upon the Chief Financial Officer's certification, the governing body finds that the budget has met the following requirements: 1. That the amounts for the following items have been calculated pursuant to law and appropriated as such in the budget: a. Payment of interest and debt redemption charges b. Deferred charges and statutory expenditures Commission Meeting May 8, 2023 4  c. Cash deficit of preceding year d. Reserve for uncollected taxes e. Other reserves and non-disbursement items f. Any inclusions of amounts required for school purposes. 2. That the provisions relating to limitation on increases of appropriations pursuant to N.J.S.A. 40A:4-45.2 and appropriations for exceptions to limits on appropriations found at N.J.S.A. 40A:4-45.3 et seq., are fully met (complies with CAP law). 3. That the budget is in such form, arrangement, and content as required by the Local Budget Law and N.J.A.C. 5:30-4 and 5:30-5. 4. That pursuant to the Local Budget Law: a. All estimates of revenue are reasonable, accurate and correctly stated, b. Items of appropriation are properly set forth c. In itemization, form, arrangement and content, the budget will permit the exercise of the treasurer function within the municipality. 5. The budget and associated amendments have been introduced and publicly advertised in accordance with the relevant provisions of the Local Budget Law, except that failure to meet the deadlines of N.J.S.A. 40A:4-5 shall not prevent such certification. 6. That all other applicable statutory requirements have been fulfilled. BE IT FURTHER RESOLVED that a copy of this resolution will be forwarded to the Director of the Division of Local Government Services upon adoption. Mayor Sciortino moved the adoption and approval of Resolution 2023-066, seconded by Deputy Mayor Myers. Roll Call: (Sciortino Ayes (Myers Nays ( (Lynch Mayor Sciortino presented Resolution 2023-067 for adoption and approval as follows: CITY OF BORDENTOWN RESOLUTION 2023-067 AUTHORIZING READING OF THE 2023 BUDGET BY TITLE ONLY WHEREAS, N.J.S.A. 40A:4-8 provides that the municipal budget may be read by title only at the time of the public hearing providing that; a. At least one week prior to the date of the public hearing, and at the public hearing, a complete copy of the approved budget shall be made available for public inspection and shall be made available to each person upon request; and, b. The governing body shall, by resolution passed by not less than a majority of the full membership, determine that the budget shall be read by its title and declare that the conditions set forth above have been met; NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the City of Bordentown that it does hereby determine that the conditions set forth above have been met and that the budget shall be read by title only. Mayor Sciortino moved the adoption of Resolution 2023-068, seconded by Commissioner Lynch. Roll Call: (Sciortino Ayes (Myers Nays ( (Lynch Mayor Sciortino opened the Hearing on the 2023 Municipal Budget as amended. City resident Joe Malone addressed the Commissioners asking why such an increase this year. Mayor Sciortino explained there has been an increase in the cost of workers’ compensation insurance, pension costs are higher and an unprecedented 24% increase to the cost of state health benefits which are all mandatory expenses and out of the control of the City. She further stated they are hopeful the cannabis dispensary will open towards the end of the year whereby the City would begin receiving a 2% revenue tax benefit from purchases. Lastly, she thanked Margaret M. Peak, City Admin., and Chief Financial Officer for her efforts in putting this year’s budget together; noting that this budget probably caused some sleepless nights. There were no other questions or comments, and Mayor Sciortino closed the public hearing. Mayor Sciortino commended Leon Stanley and Bordentown Arts for hosting the 2 nd Annual Porchfest and Cathy Elliot-Shaw and the Environmental Commission for hosting the 1 st Green Home and Garden Tour, both events had great weather and were well attended. DEPUTY MAYOR MYERS, DIRECTOR OF PUBLIC PROPERTY, STREETS AND WATER Deputy Mayor Myers echoed the Mayor’s sentiments congratulating everyone for their help preparing the new budget for 2023. He then complimented Leon Stanley for a successful turnout for Porchfest 2023. He recalled last year receiving a phone call from his very excited daughter asking if “Mr. Leon” could do this every weekend; he thanked everyone for doing this event again. Furthermore, he thanked the Shade Tree Committee for their efforts with the Annual Tree planting, the General Parks Committee and residents who helped with the Lime Kiln Alley Park clean-up. Lastly, he congratulated the Environmental Commission for having a successful Green Home and Garden Tour. Deputy Mayor Myers, Director of Public Property, Streets and Water, presented Resolution 2023-070 for adoption and approval as follows: CITY OF BORDENTOWN RESOLUTION 2023-070 WHEREAS, it is necessary to obtain competitive bids in accordance with N.J.S.A. 40A:12-14 hereinafter set forth; and WHEREAS, funds are available for such materials. NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the City of Bordentown that the City Clerk be and is hereby authorized to advertise for bids for the following: Reconstruct/Reconfigure Existing Parking Lot at City Municipal Complex Deputy Mayor Myers moved the adoption and approval of Resolution 2023-070, seconded by Commissioner Lynch. Motion carried with all Commissioners present voting in the affirmative. Deputy Mayor Myers presented Resolution 2023-071 for adoption and approval as follows: CITY OF BORDENTOWN RESOLUTION 2023-071 AUTHORIZING A SHARED SERVICES AGREEMENT BETWEEN THE CITY OF BORDENTOWN AND THE TOWNSHIP OF BORDENTOWN WHEREAS, the City of Bordentown desires to contract with the Township of Bordentown for the provision of sign printing services on an “as needed” basis; and WHEREAS, the Township of Bordentown is agreeable to providing the services as described to the City of Bordentown in return for payment of the associated costs; and WHEREAS, the Uniform Shared Services and Consolidation Act, N.J.S.A. 40A:65-1 et seq. permits local units of this State to enter into a contract with any other local unit for the joint provisions within their combined jurisdictions of any service which any party to the agreement is empowered to render within its jurisdiction; and NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the City of Bordentown, in the County of Burlington, State of New Jersey, that a Shared Services Agreement between the City of Bordentown and the Township of Bordentown as stated above is authorized and accepted with a termination date of March 31, 2025 and the option to renew upon sixty (60) days’ notice. BE IT FURTHER RESOLVED that the Mayor and City Clerk are hereby authorized and directed to execute any and all related documents necessary to complete this Agreement for Shared Services. BE IT FURTHER RESOLVED that a copy of this resolution and agreement shall be forwarded to the Director of the Division of Local Government Services pursuant to N.J.S.A. 40A:65-4(3) b. Deputy Mayor Myers moved the adoption and approval of Resolution 2023-071, seconded by Mayor Sciortino. Motion carried with all Commissioners present voting in the affirmative.  Deputy Mayor Myers presented Resolution 2023-073 for adoption and approval as follows: CITY OF BORDENTOWN RESOLUTION 2023-073 AMEND QUALIFIED PRIVATE COMMUNITY REIMBURSEMENT AGREEMENT BETWEEN THE CITY OF BORDENTOWN AND THE KINGSGATE CONDOMINIUM ASSOCIATION WHEREAS, the Board of Commissioners of the City of Bordentown adopted Resolution 2023-056 authorizing the execution of a three-year Qualified Private Community Reimbursement Agreement effective January 1, 2023 and set to expire on December 31, 2025; and WHEREAS, the KingsGate Condominium Association and the Board of Commissioners wish to amend said Agreement authorized on April 10, 2023. NOW, THEREFORE, BE IT RESOLVED and agreed upon by all parties that the following paragraph be removed from the Agreement: 6. Leaf Removal – Leaf removal will be provided by the City’s DPW along the main access route through the Association’s complex as delineated on the attached sketch. (see Exhibit “A” attached hereto). No leaf removal will be done outside the indicated area; no secondary roadway within the complex will be cleared of leaves by the DPW; no sidewalks within the complex will be cleared of leaves. Leaf pickup and removal services will be administered to the Association whenever such work is being completed along nearby public streets. BE IT FURTHER RESOVED that the Mayor and City Clerk are hereby authorized to execute an Amended Agreement with the KingsGate Condominium Association in accord with the terms of the foregoing Resolution. Deputy Mayor Myers presented Ordinance 2023-06 An Ordinance Amending Portions Of The City Of Bordentown Code To Reflect The Updated Facility Use Policies For Old City Hall for Second Reading and Hearing. Mayor Sciortino opened the Hearing on Ordinance 2023-06 for public comment. Joe Malone commended Carol Hill, Chair of Old City Hall Committee, for her commitment to keeping Old City Hall in tip top shape. COMMISSIONER LYNCH, DIRECTOR OF PUBLIC SAFETY AND AFFAIRS Commissioner Lynch, Director of Public Safety and Affairs, gave the Police Report detailing the activities of the Department from April 7 to May 5, 2023. Commissioner Lynch moved the approval of a Seasonal Farm Market Permit: Disch & Sons Distillers LLC, (Sourland Mountain Spirits) for the 2023 Farmers Market on Sundays, June 4 to October 29, 2023 from 9:00AM until 1:00PM., seconded by Mayor Sciortino. Motion carried. Commissioner Lynch presented Resolution 2023-072 for adoption and approval as follows: CITY OF BORDENTOWN RESOLUTION 2023-072 SUPPORTING THE CLICK IT OR TICKET SEATBELT ENFORCEMENT MOBILIZATION FROM MAY 22 THROUGH JUNE 4, 2023 WHEREAS, the National Highway Traffic Safety Administration estimates that 15,000 lives were saved nationally by safety belt usage in 2017 alone; and WHEREAS, the national seat belt use rate in 2019 was 90.7% the other 9.3% need to be reminded that seat belts save lives; and WHEREAS, the most effective device, when used consistently, for preventing deaths and injuries in motor vehicle crashes remains the seat belt; and WHEREAS, the State of New Jersey will participate in the nationwide “Click It or Ticket” seat belt mobilization from May 22 through June 4, 2023 to raise awareness and increase seat belt usage through a combination of high visibility enforcement and public education; and Commission Meeting May 08, 2023 36  WHEREAS, the Division of Highway Traffic Safety notes that New Jersey’s seat belt usage rate currently stands at 92.97%, according to a statewide survey taken in June of 2022; and WHEREAS, this project will provide funding to implement a targeted seat belt enforcement campaign in New Jersey as part of the nationwide “Click It Or Ticket” seat belt mobilization utilizing police officers to conduct special enforcement patrols issuing summonses for all violations of Title 39 of the Motor Vehicle Code; and WHEREAS, the focus of these patrols will be to stop and issue summonses to motorists, front and rear seat passengers who are not complying with the state’s seat belt laws and Officers will also enforce the child safety restraint law as appropriate. NOW, THEREFORE, BE IT RESOLVED that the Board of Commissioners of the City of Bordentown and the City of Bordentown Police Department declare their support for the “Click It or Ticket” seat belt mobilization both locally and nationally from May 22 through June 4, 2023 and pledge to increase awareness of the mobilization and the benefits of seat belt use. BE IT FURTHER RESOLVED that the Board of Commissioners of the City of Bordentown does hereby authorize the submission of the 2023 “Click It or Ticket” Grant Application to the NJ State Highway Division of Traffic Safety. Commissioner Lynch moved the adoption and approval of Resolution 2023-072, seconded by Deputy Mayor Myers. Motion carried with all Commissioners present voting in the affirmative. Commissioner Lynch presented Ordinance 2023-08 Ordinance Establishing Municipal Construction Code Enforcement Agency, Creating A New Chapter 245 To The Bordentown City Code for Second Reading and Hearing. Mayor Sciortino opened the Hearing on Ordinance 2023-08 for public comment. Commissioner Lynch commented that the Department of Community Affairs has been handling our Construction Office for some time now; providing a brief background of issues leading up to the City’s decision to end the Agreement with the Department of Community Affairs. Citing especially the limited availability of the officials to the residents and contractors, it is felt that this move would be in the best interest of the City. He added that they will be talking with the Bordentown Township Construction office to help assist us in this transition. Hearing no more questions or comments from the public, Mayor Sciortino closed the Hearing for Ordinance 2023-08. Commissioner Lynch moved the adoption of Ordinance 2023-08 on Second Reading and Hearing, seconded by Mayor Sciortino. } Jennifer L. Sciortino Nays} Roll Call: Ayes} Joseph D. Myers Abstain} } James E. Lynch, Jr. Absent} Commissioner Lynch echoed his fellow Commissioners sentiments regarding the 2023 Municipal Budget, Porchfest and the Green Home and Garden Tour. He continued to thank the Bordentown City Police Department for their efforts covering these events, considering a fellow officer was getting married and some of the officers had attended the ceremony. He announced the Street Fair is Saturday, May 20, 2023, with a rain date Sunday, May 21 and the Street of Dreams Car Show is on June 17, with a rain date June 24, 2023. Lastly, he was excited to share that he had the privilege to have a tour of the Discovery Center at Point Breeze, it is something you should want to check out, soon it will be open to the public a few days a week. He stated he is thankful for the partnership with Linda Mead from the D & R Greenway and Father Padovani for allowing the city to be apart of helping preserve the property and the history that goes along with it. Mayor Sciortino opened the meeting for public comment. Joe Malone stated he attended a presentation at Old City Hall on the Gate House given by Linda Mead of D & R Greenway Land Trust a few weeks ago that was very well attended and quite interesting. Cathy Elliot-Shaw thanked everyone who was involved in the Green Garden and House Tour. She further thanked Grace I. Archer, City Clerk for recommending the use of the City Shuttle to provide transport for those who needed a ride and JC Platt for opening and closing Carslake once it was over. John Hill inquired if there was any update to be given on the status of Clare Estates, the assisted living facility across the street from him. Mayor Sciortino stated as of this moment they have not been contacted by anyone from the facility and had no update to provide. Zoom Attendee, Leon Stanley thanked the Commissioners for their kind words and thanked everyone involved with Porchfest, stating they were looking forward to next year.
