PROCEEDINGS OF THE CITY COUNCIL OF BOSSIER CITY STATE OF LOUISIANA TAKEN AT A REGULAR MEETING MAY 20, 2025 The City Council of the City of Bossier City, State of Louisiana, met in Regular session in Council Chambers, 620 Benton Road, Bossier City, Louisiana, May 20, 2025 at 3:00 PM Council President, Don Williams called the meeting to order. Invocation was given by Council Member Chris Smith Pledge of Allegiance led by Council Member Vince Maggio Roll Call as follows: Present: Honorable Councilor, President Don Williams, Honorable Councilors, Chris Smith, Brian Hammons, Jeffery Darby, Jeff Free and Vince Maggio Absent: Honorable Councilor, David Montgomery, Jr. Also Present: Mayor, Thomas Chandler, City Attorney, Charles Jacobs, and City Clerk, Phyllis McGraw City Clerk, Phyllis McGraw read the statement about decorum during the meeting and public participation in the meeting. Ceremonial Matters/Recognition of Guests Bill Alley, Shannon Hollier, Linc Coleman, Dusty Williams, Ty Alley and Doug Brown all voiced their concerns about the change in Sanitation charges and how it affects their apartments complexes and their profits. They noted they can’t charge their renters more due to limits on Section 8 housing and leases that their other renters have. They are not objecting to paying additional fees, they would just like them to be more equitable. They are asking for a 90 day stay to work with the city to come up with a better plan. Mr. Williams noted he would be open to meeting with them. Mr. Hammons addressed Council and audience that he and Mr. Maggio would abstain from any vote and any meetings on this matter. Mayor Chandler addressed property owners that he had not received any phone calls and would have responded if he had. Seconded by Hammons Mr. Hammons and Ben Rauschenbach, City Engineer, discussed project and possible changes No further comment Vote in favor of motion is unanimous New Business – The following Ordinance offered and adopted: Ordinance No. 66 Of 2025 AN ORDINANCE TO DECLARE THAT EMERGENCIES DID EXIST IN THE CITY OF BOSSIER CITY WHICH AFFECTED PROPERTY, PUBLIC HEALTH, AND SAFETY DUE TO THE REQUIREMENT TO REPLACE THE DISCHARGE MAINFOILD AND SUPPORTS AND REHABILITATE THE INFLUENT MANHOLE AT THE BOARDWALK LIFT STATION AT A COST OF $77,220.90 TO COME FROM SEWER CAPITAL AND CONTINGENCY FUND. WHEREAS, gravity sewer manhole’s and lift stations are critical infrastructure in Bossier’s wastewater collection system and were badly damaged from excessive use and corrosive H2S gases; and WHEREAS, the Public Utilities Lift Station Department needed emergency support to rehabilitate the influent sewer manhole and replace the Boardwalk lift station discharge manifolds and support brackets; and WHEREAS, the scope of work involved is beyond the Utility Department’s capabilities due to the size and scale of the equipment, material, and labor required; and WHEREAS, it will cost $77,220.90 in labor, equipment, and materials to complete the repair efforts; and WHEREAS, $77,220.90 shall be appropriated from the Sewer Capital and Contingency Fund. NOW, THEREFORE, BE IT RESOLVED, in regular session convened that the City Council of Bossier City, Louisiana, does hereby declare that an emergency exists and authorizes the Mayor to appropriate $77,220.90 to come from the Sewer Capital and Contingency Fund to be used for the purpose to rehabilitate the influent sewer manhole and replace the Boardwalk lift station discharge manifolds and support brackets; and authorizes the City to enter into any necessary contracts for completion of the work. BE IT FURTHER ORDAINED, that the Mayor is authorized to sign any and all documents in connection with the furtherance of this Ordinance. BE IT FURTHER ORDAINED, that the 2025 Sewer Capital and Contingency Budget is hereby amended to increase expenditures for required repairs by $77,220.90 and decrease Fund Balance by $77,220.90. The above and foregoing Ordinance was discussed and opened for public input at open and legal session convened, was on motion by Mr. Brian Hammons, and seconded by Mr. Vince Maggio, and adopted on this the 20th, day of May 2025, with the votes listed below. Further this Ordinance becomes legal immediately. Seconded by Mr. Smith No comment Vote in favor of motion is unanimous  Resolution No. 25 of 2025 Resolution that the City of Bossier City joins the president of the United States of America in proclaiming May 22, 2025 as National Maritime Day honoring the contribution of the American Merchant Marines who have defended the freedom of the United States and join in recognition of this important date in Maritime History WHEREAS, on May 22, 1819, the steamship The Savannah set sail from Savannah, Georgia on the first successful transoceanic voyage under steam propulsion, thus making a material contribution to the advancement of ocean transportation; and WHEREAS, on May 20, 1933, the Senate and House of Representatives of the United States of America assembled and designated May 22nd of each year as National Maritime Day; and WHEREAS, during WW II in what became the world’s largest sealift operation, more than 250,000 members of the American Merchant Marines served their country, with over 6,700 losing their lives, hundreds being detained as prisoners of war and in excess of 800 ships being sunk or damaged; and WHEREAS, waterways have greatly contributed to expanding America's economy, developing cities near waterways, and facilitating vast domestic and international commerce crucial to our economy today; and WHEREAS, merchant mariners have served America with distinction throughout our history, but especially at critical moments of war and natural disaster; and WHEREAS, the United States Merchant Marines and thousands of other workers in our Nation's maritime industry continue to make immeasurable contributions to our economic strength and ongoing efforts to build a more peaceful world; and WHEREAS, the United States Merchant Marines also shepherd the safe passage of American goods, move exports to customers around the world, support the flow of domestic commerce on our maritime highways, strengthen our Nation's economy, bolster job creation, and, along with the transportation industry, employ Americans on ships and tugs, and in ports, like our Port of Caddo Bossier; and WHEREAS, it is the desire of the City of Bossier City to increase the awareness of the maritime industry within Caddo and Bossier Parishes and the State of Louisiana. NOW, THEREFORE BE IT RESOLVED that the City of Bossier City joins the President of the United States of America in proclaiming May 22, 2025, as National Maritime Day and calls upon the citizens of Bossier City to celebrate this observance. Audience members David Crockett and Cassie Rogers spoke about the election and the new Charter changes. Mr. Crockett hopes the city can move pass this and Ms. Rogers expressed concern that the website had not been updated with the changes.  The following resolution was offered by Mr. Brian Hammons and seconded by Mr. Chris Smith: RESOLUTION 26 OF 2025 A resolution providing for canvassing the returns and declaring the results of the special election held in the City of Bossier City, State of Louisiana, on Saturday, May 3, 2025, to vote upon the adoption of amendments to the current City Charter of the City of Bossier City. BE IT RESOLVED by the City Council of the City of Bossier City, State of Louisiana (the "Governing Authority"), acting as the governing authority of the City of Bossier City, State of Louisiana (the "City"), that: SECTION 1. Canvass. This Governing Authority does now proceed in open and public session to examine the official tabulations of votes cast at the special election held in the City of Bossier City, State of Louisiana, on SATURDAY, MAY 3, 2025 (the "Election"), to vote upon the adoption of amendments to the current City Charter of the City of Bossier City pursuant to the following propositions (the "Propositions"): CHARTER AMENDMENT PROPOSITION NO. 1 OF 2 Shall Section 3.01(b) of the City Charter for Bossier City be amended to read as follows: Members of the City Council shall be eligible for re-election. No person who has been elected or appointed to serve as at-large and/or district Councilman/woman for three (3) terms shall be eligible to be appointed or elected to an additional term or portion thereof. For the purposes of this Section, all terms, or portions thereof, to which a person has been elected or appointed prior to January 1, 2024, will be counted toward the limitation provided for herein? CHARTER AMENDMENT PROPOSITION NO. 2 OF 2 Shall Section 4.01 of the City Charter for Bossier City be amended to read as follows: (a) The Mayor shall be elected according to the laws of the state and serve a term of four (4) years. The term of office shall begin on July 1 of the year in which he/she was elected. (b) The Mayor shall be eligible for re-election. No person who has been elected to serve as Mayor for three (3) terms shall be eligible to be appointed or elected to an additional term or portion thereof. For the purposes of this Section, all terms, or portions thereof, to which a person has been elected or appointed prior to January 1, 2024, will be counted toward the limitation provided for herein? This Governing Authority does further proceed to examine and canvass the returns of the Election thereof. SECTION 2. Election Results. According to the official certified tabulation of votes cast at said Election, (i) there was a total of 2,517 votes cast IN FAVOR OF Proposition No. 1 and a total of 520 votes cast AGAINST Proposition No. 1, resulting in a majority of 1,997 votes cast IN FAVOR OF Proposition No. 1; and (ii) there was a total of 2,557 votes cast IN FAVOR OF Proposition No. 2 and a total of 479 votes cast AGAINST Proposition No. 2, resulting in a majority of 2,078 votes cast IN FAVOR OF Proposition No. 2.  The Propositions were therefore duly CARRIED by a majority of the votes cast by the qualified electors voting at the Election. SECTION 3. Promulgation of Election Result. The results of said election shall be promulgated by publication in the manner provided by law, after receipt from the Secretary of State’s office of the actual costs of the election, as required by §18:1292 of the Louisiana Revised Statutes of 1950, as amended. SECTION 4. Declaration. The foregoing results of the Election are hereby declared by this Governing Authority and shall be published as required by law. SECTION 5. Procès Verbal. A Procès Verbal of the canvass of the returns of the Election shall be made and a certified copy thereof shall be forwarded to the Secretary of State, Baton Rouge, Louisiana, who shall record the same in her office; another certified copy thereof shall be forwarded to the Clerk of Court and Ex-Officio Recorder of Mortgages in and for the Parish of Bossier, who shall record the same in the Mortgage Records of said Parish; and another copy thereof shall be retained in the archives of this Governing Authority. Audience member Kevin Blunk with D.O.T.D. spoke in favor of City hiring Andy Bajnauth. Mr. Hammons reported that the contract with the Waggoner Group will be adjusted in the next 6 months. Mr. Rauschenbach reported on how the transition will work and the role that his company will have for the next 6 months. Council members praised Ben Rauschenbach, acting City Engineer for his dedication and service to the city. Audience member, Tyree Venius spoke in favor of Mr. Andy Bejnauth and thanked Mr. Rauschenbach for doing a great job. Following the vote, City Public Relations Officer, Louis Johnson addressed the Council and audience concerning the work that Mr. Rauschenbach and his team have done for the city. Their work has been measurable and they both thanked Mr. Rauschenbach for his service to the city and to make the city better. Mr. Williams and Mr. Johnson both agreed that Mr. Rauschenbach is the best at what he does. The following Resolution offered and adopted: RESOLUTION 27 OF 2025 A RESOLUTION AUTHORIZING THE APPOINTMENT OF ANDY BAJNAUTH AS CITY ENGINEER FOR THE CITY OF BOSSIER CITY ___________________________________________________________ WHEREAS, Section 9.02 of the Bossier City Charter provides for the appointment of a City Engineer as nominated by the Mayor and approved by the City Council; and WHEREAS, said position is currently vacant; and WHEREAS, Andy Bajnauth has been nominated by said Mayor and approved by said City Council. NOW, THEREFORE, BE IT RESOLVED by the City Council of Bossier City, Louisiana, in regular session convened, that Andy Bajnauth be appointed and hired as the City Engineer for the City of Bossier City.  The above and foregoing Resolution was presented and opened for public comment in open and legal session convened, was adopted on a motion by and seconded by and adopted on the 20th, day of May 2025 by the following vote: Yeas: Mr. Smith, Mr. Hammons, Mr. Darby, Mr. Williams, Mr. Free and Mr. Maggio Nays: none Absent: Mr. Montgomery, Jr. Abstain: none _____________________________ _________________________________ Don Williams, President Phyllis McGraw, City Clerk A The following Resolution offered and adopted: Resolution No. 28 Of 2025 A RESOLUTION FOR PARKS AND RECREATION TO FILL A FOREMAN POSITION IN THE PARKS AND RECREATION DIVISION AND BACKFILL ANY VACANT POSITION THIS CREATES. _____________________________________________________________________________ WHEREAS, Ordinance No. 76 of 2019 implemented a budgetary control requiring a resolution to be approved by the Bossier City Council prior to hiring or employment of any individual receiving wages, compensation, or remuneration for labor including temporary or contractual employment; and WHEREAS, a Foreman position is vacant due to retirement, creating the need to fulfill by hiring or promoting from within and backfill any position this creates; and WHEREAS, the administration and department assure that the current budget has been verified and that funding available in the total budgeted salaries is not exceeded; and NOW, THEREFORE, BE IT RESOLVED by the City Council of Bossier City, Louisiana, in regular session convened, that the Department of Parks and Recreation is hereby authorized to replace a position due to openings and backfill any position this creates by hiring or promoting within the Department of Parks and Recreation with no impact to the existing budget. WHEREAS, the position of Foreman is vacant due to resignation and WHEREAS, the administration and the department assured that all current budgets have been verified and that no authorized salary has been exceeded; and  NOW, THEREFORE, BE IT RESOLVED by the City Council of Bossier City, Louisiana, in regular session convened, that the administration is authorized to proceed with hiring procedures for the fulfillment of this position. He explained how the Swepco utility grid is set up as required by the Federal Energy Regulatory Commission. He answered questions concerning the issue from Councilmembers. Simon Zika, Community Planner for Barksdale Air Force Base – AICUZ Study meeting – Mr. Zika was not present but Ms. Askew-Brown updated Council on the upcoming meeting, what the meeting is and why it is needed. Angela Williamson, Monthly Financial Report gave Council Monthly Budget Report noting that Sales Taxes were up and that expenses are 9% below budget. Engineering Department – Monthly Project Report – Mr. Rauschenbach went over the current and upcoming City projects and current private developments.
