MINUTES of SPECIAL MEETING of the BOARD of COMMISSIONERS of the CITY of BOWLING GREEN, KENTUCKY held MARCH 23, 2004 The Board of Commissioners of the City of Bowling Green, Kentucky met in special session in the Commission Chamber of City Hall, Bowling Green, Kentucky at 3:00 p.m. on March 23, 2004. Mayor Sandy Jones called the meeting to order. City Manager Charles W. Coates called the roll, and the following members were present: Commissioner Jim Bullington, Commissioner Dan Hall and Mayor Sandy Jones. Absent: Commissioner Joe W. Denning and Commissioner Alan Palmer. There was a quorum of the Board of Commissioners. CITY MANAGER City Manager Charles W. Coates had no comments at this time. ORDINANCE NO. BG2004 – 9 (Second Reading) ORDINANCE ANNEXING PROPERTY BY CONSENT ORDINANCE ANNEXING 10.74 ACRES OF PROPERTY LOCATED AT THE INTERSECTION OF VETERANS MEMORIAL BOULEVARD AND MORGANTOWN ROAD (US 231), WITH PROPERTY PRESENTLY OWNED BY THE EVANS PROPERTY COMPANY, LLC, AND SAID TERRITORY BEING CONTIGUOUS TO EXISTING CITY LIMITS Title and summary of Ordinance No. BG2004 - 9 was read by the City Manager. Motion was made by Hall and seconded by Bullington for second reading of said Ordinance. Mayor Jones asked for discussion, and with none, a roll call vote was taken. ROLL CALL: Voting Yea: Bullington, Hall and Jones Voting Nay: None Ordinance No. BG2004 - 9 was adopted by unanimous vote. ORDINANCE NO. BG2004 – 10 (Second Reading) ORDINANCE AMENDING CODE OF ORDINANCES ORDINANCE AMENDING CHAPTER 6 (BUILDING REGULATIONS) OF THE CITY OF BOWLING GREEN CODE OF ORDINANCES RELATED TO ADOPTION OF THE UNIFORM STATEWIDE MANDATORY KENTUCKY BUILDING CODE AS RECOMMENDED BY THE BOARD OF HOUSING, BUILDINGS AND CONSTRUCTION OF THE COMMONWEALTH OF KENTUCKY, AND ADOPTION OF THE KENTUCKY RESIDENTIAL CODE FOR ONE AND TWO-FAMILY DWELLINGS *Note: Minutes are a summary of the discussions; a video tape of this entire meeting is maintained by the Office of City Clerk. BG2004 – 11 (Second Reading) ORDINANCE PROVIDING FOR THE ISSUANCE OF GENERAL OBLIGATION BONDS AN ORDINANCE OF THE CITY OF BOWLING GREEN, KENTUCKY, PROVIDING FOR THE ISSUANCE OF THE CITY'S GENERAL OBLIGATION BONDS, SERIES 2004A, FOR THE PURPOSE OF PROVIDING FUNDS TO PAY COSTS OF CERTAIN PUBLIC PROJECTS OF THE CITY; SETTING FORTH THE TERMS AND CONDITIONS UPON WHICH THE SERIES 2004A BONDS ARE TO BE ISSUED AND OUTSTANDING; ORDERING AND PROVIDING FOR THE LEVY OF AN ANNUAL TAX, TO THE EXTENT NECESSARY, SUFFICIENT TO PAY THE INTEREST ON AND PRINCIPAL OF THE SERIES 2004A BONDS; AND PROVIDING FOR A PUBLIC SALE OF THE SERIES 2004A BONDS AND THE APPLICATION OF THE PROCEEDS THEREOF Title and summary of Ordinance No. BG2004 - 11 was read by the City Manager. BG2004 – 12 (Second Reading) ORDINANCE PROVIDING FOR THE ISSUANCE OF GENERAL OBLIGATION BONDS AN ORDINANCE OF THE CITY OF BOWLING GREEN, KENTUCKY, PROVIDING FOR THE ISSUANCE OF THE CITY'S GENERAL OBLIGATION BONDS, SERIES 2004B (TAXABLE), FOR THE PURPOSE OF PROVIDING FUNDS TO PAY COSTS OF ACQUISITION AND CLEARING OF LAND IN THE HISTORIC BOWLING GREEN REVITALIZATION PROJECT TARGET AREA; SETTING FORTH THE TERMS AND CONDITIONS UPON WHICH THE SERIES 2004B BONDS ARE TO BE ISSUED AND OUTSTANDING; ORDERING AND PROVIDING FOR THE LEVY OF AN ANNUAL TAX, TO THE EXTENT NECESSARY, SUFFICIENT TO PAY THE INTEREST ON AND PRINCIPAL OF THE SERIES 2004B BONDS; PROVIDING FOR THE ESTABLISHMENT AND ADMINISTRATION OF A REVOLVING FUND TO FINANCE ADDITIONAL LAND ACQUISITION IN THE REVITALIZATION 2 (Minutes-Board of Commissioners-March 23, 2004) PROJECT TARGET AREA; AND PROVIDING FOR A PUBLIC SALE OF THE SERIES 2004B BONDS AND THE APPLICATION OF THE PROCEEDS THEREOF Title and summary of Ordinance No. BG2004 - 12 was read by the City Manager. Motion was made by Hall and seconded by Bullington for second reading of said Ordinance. Mayor Jones asked for discussion, and with none, a roll call vote was taken. MUNICIPAL ORDER NO. 2004 – 68 MUNICIPAL ORDER AUTHORIZING SUBMISSION OF A GRANT APPLICATION TO THE FEDERAL EMERGENCY MANAGEMENT AGENCY’S ASSISTANCE TO FIREFIGHTERS GRANT PROGRAM IN THE AMOUNT OF $413,915 Summary of Municipal Order No. 2004 - 68 was read by the City Manager. Deputy Fire Chief Walter Jordan outlined the grant and proposed use of funds for the purchase of communication and computer equipment. Motion was made by Bullington and seconded by Hall for consideration of said Municipal Order. Mayor Jones asked for additional discussion, and with none, a roll call vote was taken. ROLL CALL: Voting Yea: Bullington, Hall and Jones Voting Nay: None Municipal Order No. 2004 - 68 was approved by unanimous vote. MUNICIPAL ORDER NO. 2004 – 69 MUNICIPAL ORDER RELATING TO THE SALE AND ISSUANCE OF CITY OF BOWLING GREEN, KENTUCKY, GENERAL OBLIGATION BONDS, SERIES 2004A Summary of Municipal Order No. 2004 – 69 was read by City Attorney Gene Harmon. Chief Financial Officer Davis Cooper stated that the successful bidder, Banc One Capital Markets, Inc., offered an average interest rate of 3.955% over the 20-year term of the bonds. Motion was made by Hall and seconded by Bullington for consideration of said Municipal Order. Mayor Jones asked for additional discussion, and with none, a roll call vote was taken. ROLL CALL: Voting Yea: Hall, Bullington and Jones Voting Nay: None Municipal Order No. 2004 - 69 was approved by unanimous vote. MUNICIPAL ORDER NO. 2004 – 70 3 (Minutes-Board of Commissioners-March 23, 2004) MUNICIPAL ORDER RELATING TO THE SALE AND ISSUANCE OF CITY OF BOWLING GREEN, KENTUCKY, GENERAL OBLIGATION BONDS, SERIES 2004B (TAXABLE) Summary of Municipal Order No. 2004 - 70 was read by the City Attorney. Cooper stated Raymond James & Associates, Inc. was the successful bidder, offering an average rate of 4.834% over the 20-year life of the taxable bonds. Motion was made by Bullington and seconded by Hall for consideration of said Municipal Order. Mayor Jones asked for additional discussion, and with none, a roll call vote was taken. ROLL CALL: Voting Yea: Bullington, Hall and Jones Voting Nay: None Municipal Order No. 2004 - 70 was approved by unanimous vote. ADJOURNMENT This being a special meeting of the Board and with no further business to come before the Board of Commissioners, at approximately 3:10 p.m., Mayor Jones declared this meeting adjourned. SPECIAL MEETING of the BOARD OF COMMISSIONERS CITY OF BOWLING GREEN, KENTUCKY March 23, 2004, 3:00 p.m. I, Mayor Sandy Jones of the City of Bowling Green, Kentucky, pursuant to KRS 83A.150(4), do hereby call a special meeting of the Board of Commissioners of the City of Bowling Green, Kentucky beginning at 3:00 p.m. on Tuesday, March 23, 2004 in the Commission Chamber at Bowling Green City Hall, 1001 College Street, for the following: CALL TO ORDER/ROLL CALL CITY MANAGER COMMENTS 1. Ordinance No. BG2004 – 9 ORDINANCE ANNEXING PROPERTY BY CONSENT (Second Reading) Ordinance annexing 10.74 acres of property located at the intersection of Veterans Memorial Boulevard and Morgantown Road (US 231), with property presently owned by The Evans Property Company, LLC, and said territory being contiguous to existing City limits 2. Ordinance No. BG2004 – 10 ORDINANCE AMENDING CODE OF ORDINANCES (Second Reading) Ordinance amending Chapter 6 (Building Regulations) of the City of Bowling Green Code of Ordinances related to adoption of the uniform statewide mandatory Kentucky Building Code as recommended by the Board of Housing, Buildings and Construction of the Commonwealth of Kentucky, and adoption of the Kentucky Residential Code for one and two-family dwellings 3. Ordinance No. BG2004 – 11 ORDINANCE PROVIDING FOR THE ISSUANCE OF (Second Reading) GENERAL OBLIGATION BONDS An Ordinance of the City of Bowling Green, Kentucky, providing for the issuance of the City's General Obligation Bonds, Series 2004A, for the purpose of providing funds to pay costs of certain public projects of the City; setting forth the terms and conditions upon which the Series 2004A Bonds are to be issued and outstanding; ordering and providing for the levy of an annual tax, to the extent necessary, sufficient to pay the interest on and principal of the Series 2004A Bonds; and providing for a public sale of the Series 2004A Bonds and the application of the proceeds thereof 4.
