MINUTES of REGULAR MEETING of the BOARD of COMMISSIONERS of the CITY of BOWLING GREEN, KENTUCKY held MAY 20, 2014 The Board of Commissioners of the City of Bowling Green, Kentucky met in regular session in the Commission Chamber of City Hall, Bowling Green, Kentucky at 7:00 p.m. on May 20, 2014. Mayor Bruce Wilkerson called the meeting to order and gave the invocation. All present recited the Pledge of Allegiance. Assistant City Manager/City Clerk Katie Schaller called the roll, and the following members were present: Commissioner Joe W. Denning, Commissioner Melinda M. Hill, Commissioner Bill Waltrip, Commissioner Rick Williams and Mayor Bruce Wilkerson. Absent: none. There was a full quorum of the Board of Commissioners. CITY MANAGER City Manager Kevin D. DeFebbo requested the addition of a late-filed item related to economic development. Motion was made by Hill and seconded by Williams to add Municipal Order No. 2014 – 99 to the end of the agenda. APPROVAL OF MINUTES Minutes of Regular Meeting May 6, 2014 Minutes of the above-referenced meeting were distributed to the Board of Commissioners with the Agenda for their review. MUNICIPAL ORDER NO. 2014 – 94 MUNICIPAL ORDER APPROVING RECOMMENDATION FROM THE BOWLING GREEN AREA CONVENTION AND VISITORS BUREAU TO DISTRIBUTE $119,084 OF TRANSIENT ROOM TAXES TO THE KENTUCKY SOFTBALL ASSOCIATION, INC. DeFebbo commented about the special tourism money which was made available to help fund projects that promote local tourism activities. Bowling Green Area Convention and Visitor’s Bureau Executive Director Vicki Fitch gave a brief overview of the proposal to continue to draw softball tournaments to the area. At the request of Commissioner Hill, Ms. Fitch also explained the requirements for both the City and County to approve any disbursement of funds. Following the discussion, a roll call vote was taken. MUNICIPAL ORDER NO. 2014 – 95 MUNICIPAL ORDER AMENDING THE CITY OF BOWLING GREEN ECONOMIC DEVELOPMENT ANNEXATION INCENTIVE POLICY Summary of Municipal Order No. 2014 - 95 was read by the Assistant City Manager/City Clerk. DeFebbo recounted that a recent work session was held to discuss the current Incentive Policy and as the City begins to move through its implementation, revisions have been proposed to make improvements. He provided an overview of the recommended changes which included, the extension of the start period for incentives to begin and the ability to expand target areas to include contiguous or adjacent properties as approved by the Board. There was discussion about how agricultural farm land might be impacted if annexed into the City years before any development of that property would begin. Chief Financial Officer Jeff Meisel commented about the process by which an Ag-exemption could be applied by the Property Valuation Administrator’s (PVA) office, which would write-down the taxable value of the property. Once the discussion ended, a roll call vote was taken. With regard to a new development, DeFebbo remarked that the City was approached about placement of a commercial sign on public right-of-way. City Attorney Gene Harmon confirmed that there were no issues and sign placement was cleared by the Public Works Department. MUNICIPAL ORDER NO. 2014 – 98 MUNICIPAL ORDER ASSUMING OWNERSHIP AND MAINTENANCE RESPONSIBILITY FOR A PORTION OF MOUNT VICTOR LANE RIGHT-OF-WAY AT THE INTERSECTION OF BRITEWAY DRIVE FROM THE KENTUCKY TRANSPORTATION CABINET (KYTC) Summary of Municipal Order No. 2014 - 98 was read by the Assistant City Manager/City Clerk. DeFebbo reviewed the request by KYTC for the City to take over a portion of State right-of- way following its resurfacing. Per the City’s standing protocol with KYTC, he recommended its approval. Commissioner Waltrip commented about being able to solve a problem for a couple of homeowners that use the roadway to access their property. BG2014 – 11 (First Reading) ORDINANCE AMENDING CODE OF ORDINANCES ORDINANCE AMENDING CHAPTER 23 (WATER AND SEWER) OF THE CITY OF BOWLING GREEN CODE OF ORDINANCES AS PROPOSED BY BOWLING GREEN MUNICIPAL UTILITIES (BGMU) AND TO MAKE OTHER ADMINISTRATIVE CHANGES Title and summary of Ordinance No. BG2014 - 11 was read by the Assistant City Manager/City Clerk. Motion was made by Williams and seconded by Hill for first reading of said Ordinance. BGMU Water/Wastewater Systems Manager Mike Gardner provided an overview of the recommended revisions related to the creation of a new subchapter for water requirements and establishment of a fats, oil and grease program (FOG). He indicated that BGMU was trying to be proactive to address certain elements before they become issues. Mr. Gardner also responded to questions about FOG and industrial pretreatment requirements. Mayor Wilkerson expressed appreciation for the work involved with putting this together. With no additional discussion, a roll call vote was taken. BG2014 – 12 (First Reading) ORDINANCE AMENDING CODE OF ORDINANCES ORDINANCE AMENDING CHAPTERS 2 (ADMINISTRATION) AND 27 (PROPERTY CODE) OF THE CITY OF BOWLING GREEN CODE OF ORDINANCES TO ADOPT RECOMMENDED CHANGES FROM THE CITIZENS COMMITTEE ESTABLISHED TO REVIEW THE CITY’S PROPERTY CODE AND CHANGES RECOMMENDED BY THE NEIGHBORHOOD AND COMMUNITY SERVICES DEPARTMENT Title and summary of Ordinance No. BG2014 - 12 was read by the Assistant City Manager/City Clerk. Motion was made by Hill and seconded by Williams for first reading of said Ordinance. DeFebbo recounted a review of the City’s Property Code with assistance by a Citizen Committee began over a year ago. He recommended approval of the changes which were presented at a previous work session. Commissioner Hill inquired if there had been any other discussion about developing a definition for excessive yard art and overgrown shrubbery. Neighborhood and Community Services Director Brent Childers responded that the Code Enforcement staff had discussed it internally. He stated that he would like to separate out that specific item in order to move forward with these revisions and to continue work on developing an appropriate standard to consider. Mr. DeFebbo interjected that the Code Enforcement Board (CEB) would be the arbitrator of such standards. Mr. Childers said they were still working on a mechanism to get from point A (complaint) to B (Code Enforcement Board) and would develop an internal policy for Code Enforcement Officers to follow. Commissioner Williams stated he thought that was a good starting point. Mayor Wilkerson voiced concern with language in Section 2-23.04(d) allowing the CEB to appoint its own member if the Board of Commissioners did not act within 60 days to fill a vacancy. He felt it was important that any prospective CEB member be accepted by the entire Board of Commissioners. Mayor Wilkerson also voiced concern with Section 2-23.10 which would allow the CEB to appoint a single hearing officer. He commented he did not like the idea of an individual hearing a case and thought it was more appropriate to have the entire CEB hearing cases. City Attorney Gene Harmon confirmed that the language contained in the ordinance regarding the vacancy issue was already existing language and both issues came straight out of state statutes. There was additional discussion about whether or not the state language was required or could be considered as a policy decision by the Board of Commissioners to remove it. There was also an inquiry if any other boards/commissions had the ability to appoint their own members if the Board of Commissioners did not act within a specified timeframe to fill a vacancy. Both Mr. Harmon and Ms. Schaller thought there was at least one other board/commission with similar language, but was unsure at this point which one. Since there was no rush to adopt the recommended changes, Mr. DeFebbo suggested the ordinance be tabled in order to find the answers to the questions. Motion was made by Wilkerson and seconded by Denning to table Ordinance No. BG2014 – 12 until the next meeting to 9 (Minutes-Board of Commissioners-May 20, 2014) allow the City Attorney to complete the requested research. As discussed with the previous item, Neighborhood and Community Services Director Brent Childers indicated several other chapters in the Code of Ordinances included civil penalties and would be cleaned up to move all specific enforcement action language to Chapter 2.
