MINUTES of REGULAR MEETING of the BOARD of COMMISSIONERS of the CITY of BOWLING GREEN, KENTUCKY held NOVEMBER 17, 2015 The Board of Commissioners of the City of Bowling Green, Kentucky met in regular session in the Commission Chamber of City Hall, Bowling Green, Kentucky at 4:30 p.m. on November 17, 2015. Mayor Bruce Wilkerson called the meeting to order. An invocation was given by Mayor Wilkerson, and all present recited the Pledge of Allegiance. Assistant City Manager/City Clerk Katie Schaller-Ward called the roll, and the following members were present: Commissioner Rick Williams, Commissioner Joe W. Denning, Commissioner Melinda M. Hill, Commissioner Sue Parrigin and Mayor Bruce Wilkerson. Absent: none. There was a full quorum of the Board of Commissioners. PUBLIC HEARING City Engineer Melissa Cansler conducted a public hearing to review the proposed use of Municipal Aid Program (Liquid Fuel Tax) funds, and Coal Severance and Processing Tax and Mineral Severance Tax funds for Fiscal Year 2016. She reported the Fiscal Year 2016 Liquid Fuel Tax (LFT) unencumbered balance was $1,071,784 and projected revenues were $1,487,000 with proposed expenditures totaling $1,410,000. She reviewed the projects proposed for Street Resurfacing (Overlay) of 9.8 miles in the total amount of $1,300,000 and sidewalk, curb and gutter repair in the amount of $110,000. The total projected ending balance was designated to be $1,148,784. Ms. Cansler further reported there was no projected increase in asphalt costs from the previous fiscal year. Ms. Cansler also reported the Fiscal Year 2016 Coal-Mineral Severance Tax projected revenues were $30,000, with an opening balance of $9,283. She explained there were no specific projects to apply the Coal-Mineral Severance funds in Fiscal Year 2016; however, she identified these funds could be used for transportation safety related issues or the purchase of additional deicer should the need arise later in the year. The projected ending fund balance was $39,283 for Coal-Mineral Severance. In response to a question from Commissioner Denning regarding the number of downtown streets on the preliminary paving list, Ms. Cansler confirmed no preferential treatment was applied to the downtown streets. She explained some of the segments had been delayed from past years anticipating completion of underground utility projects in the downtown. With no further questions or comments, the public hearing was closed. AWARDS & RECOGNITIONS Mayor Wilkerson praised Bowling Green Police Officer Todd Porter for doing a fantastic job as the speaker for the VFW on Veterans Day. He also expressed his appreciation for Mr. Porter’s service to the community as a Police Officer and in the military. DeFebbo indicated he arranged for Community Services Specialist/International Communities Liaison Leyda Becker to describe the difference between a refugee and an immigrant as well as provide an overview of the referral and resettlement process by which refugees enter the United States. Ms. Becker specified local governments had absolutely no role in the placement of refugees. She also explained that it takes 18-24 months before any refugee could be resettled in the United States. Of the 400 refugees to be located in Bowling Green in the coming year, Ms. Becker confirmed the countries of origin were already known and none were coming from Syria. APPROVAL OF MINUTES Minutes of Regular Meeting November 3, 2015 Minutes of the above-referenced meeting were distributed to the Board of Commissioners with the Agenda for their review. Motion was made by Hill and seconded by Williams to approve said minutes as written. Mayor Wilkerson asked for discussion, and with none, a roll call vote was taken. PUBLIC COMMENTS Representatives from the Bowling Green Fairness Coalition and Kentuckians for Fairness, Don Langley, Sean Stevens and Patty Minter, urged the Board of Commissioners to consider adopting a fairness ordinance for Bowling Green. Mr. Langley provided an overview of proposed language to include anti-discrimination protections for sexual orientation and gender identity. He also mentioned other cities which have already passed such an ordinance. Mr. Stevens stated over 100 businesses in Bowling Green were in support of a fairness ordinance, and he provided a list of those businesses to the Board. Ms. Minter conveyed the Coalition collected nearly 1,000 individual signatures from Bowling Green residents in support of LGBT fairness. The stack of signature cards was handed to the City Clerk. REGULAR AGENDA ORDINANCE NO. BG2015 – 41 (Second Reading) ORDINANCE RELATED TO WKU GATEWAY TO DOWNTOWN BOWLING GREEN TIF DEVELOPMENT AREA ORDINANCE APPROVING AMENDED AND RESTATED LOCAL PARTICIPATION AGREEMENT #4 AND GENERAL OBLIGATION SUBLEASE AGREEMENT WITH MANHATTAN CAPITAL BG LLC RELATED TO THE WKU GATEWAY TO DOWNTOWN BOWLING GREEN TIF DEVELOPMENT AREA Title and summary of Ordinance No. BG2015 - 41 was read by the Assistant City Manager/City Clerk. Motion was made by Hill and seconded by Parrigin for second reading of said 2 (Minutes-Board of Commissioners-November 17, 2015) Ordinance. Attorney Scott Bachert, representing the Warren County Downtown Economic Development Authority, Inc., reported the new bonds would be issued in a few weeks and everything else was on track and moving forward. MUNICIPAL ORDER NO. 2015 – 203 MUNICIPAL ORDER APPROVING THE CAREER PATH ADVANCEMENT OF TRAVIS D. FINDLEY TO THE POSITION OF OPERATIONS TECHNICIAN I IN THE PUBLIC WORKS DEPARTMENT Summary of Municipal Order No. 2015 - 203 was read by the Assistant City Manager/City Clerk. Motion was made by Hill and seconded by Denning for consideration of said Municipal Order. DeFebbo reviewed the career path program which was established several years ago. Since all requirements were met, he recommended the promotion. Mayor Wilkerson asked for additional discussion, and with none, a roll call vote was taken. MOSLEY TO THE CONTRACTORS LICENSING BOARD Summary of Municipal Order No. 2015 - 204 was read by the Assistant City Manager/City Clerk. Motion was made by Hill and seconded by Williams for consideration of said Municipal Order. Mayor Wilkerson indicated these reappointments were for long standing members who represented specific specialties on the Contractors Licensing Board. Contractors Licensing Director Bob Appling confirmed the request for approval and the service provided by the individuals. Once the discussion concluded, a roll call vote was taken. OF CORONA, CALIFORNIA IN THE TOTAL AMOUNT OF $48,306 3 (Minutes-Board of Commissioners-November 17, 2015) Summary of Municipal Order No. 2015 - 205 was read by the Assistant City Manager/City Clerk. Motion was made by Hill and seconded by Parrigin for consideration of said Municipal Order. DeFebbo reviewed the purchase for fire training purposes and recommended the bid award. DeFebbo recounted the City previously issued General Obligation bonds in collaboration with Warren County to refinance the ITA debt. He reported that if the bonds were refinanced, the City and County could save money. Chief Financial Officer Jeff Meisel surmised that up to $1.4 million could be saved through 2023. He said the advanced refunding would take place after the first of the new year while interest rates were still low. Mr. Meisel confirmed this refinancing would not extend the life of the bonds or add any new debt. Following the discussion, a roll call vote was taken. Parks and Recreation Director Brent Belcher introduced Patrick Hoagland with Brandstetter Carroll, who gave the presentation.
