MINUTES of REGULAR MEETING of the BOARD of COMMISSIONERS of the CITY of BOWLING GREEN, KENTUCKY held DECEMBER 15, 2015 The Board of Commissioners of the City of Bowling Green, Kentucky met in regular session in the Commission Chamber of City Hall, Bowling Green, Kentucky at 4:30 p.m. on December 15, 2015. Mayor Bruce Wilkerson called the meeting to order. An invocation was given by Pastor Laura Vincent with Broadway United Methodist Church, and all present recited the Pledge of Allegiance. Assistant City Manager/City Clerk Katie Schaller-Ward called the roll, and the following members were present: Commissioner Melinda M. Hill, Commissioner Sue Parrigin, Commissioner Rick Williams, Commissioner Joe W. Denning and Mayor Bruce Wilkerson. Absent: none. There was a full quorum of the Board of Commissioners. AWARDS & RECOGNITIONS Kentucky League of Cities (KLC) Governmental Affairs Advocacy Manager Bryanna Carroll presented the 2015 Kentucky Friend of Cities Award to Representative Jody Richards for his efforts to support cities during the 2015 Kentucky General Assembly Session, and in particular for his crucial assistance with getting internet sweepstakes café legislation passed. Representative Richards expressed his appreciation for the recognition. Mayor Wilkerson thanked Representative Richards for helping to address issues impacting Bowling Green. Later during the meeting, City-County Planning Commission Executive Director Steve Hunter mentioned the recent passing of John Matheney, who was the Planning Commission’s first Executive Director. PRESENTATION City Manager Kevin D. DeFebbo indicated several community members got together to help preserve and celebrate local history from two former schools, High Street School and State Street School. He explained that several photographs from the two schools, which have been on the walls at the F.O. Moxely Community Center, were reformatted and the City assisted with the cost for that process, referring to the picture boards on display. Stan England, Athletic History Committee (AHC) Chair, expressed appreciation for the City’s support and for the work of the Committee to preserve the history captured in the photographs of past athletes, cheerleaders and coaches. After describing the background of the photographs and the Committee’s desire to find a better way to display them, Mr. England recognized all the volunteers on the Committee. Bowling Green High Coach Chuck Glass outlined the importance of athletes and preserving their history for future generations. Bowling Green Independent School District Superintendent Gary Fields also remarked about how the photo boards provided a great reflection on the history of this community and school system. He also expressed his appreciation for the work of the Committee. Parks and Recreation Director Brent Belcher stated the photos belong at Parks and Recreation and will be brought back to the Bowling Green Community Center (BGCC) as soon as the renovations at the facility are complete. Commissioner Denning commented about the veracity and determination of Mr. England. He also thanked everyone for their work on this project and he described how the photographs tell the story of the two schools represented. Commissioner Denning further requested the pictures remain at BGCC forever and asked that there be a document prepared to officially make that declaration. CITY MANAGER City Manager Kevin D. DeFebbo requested a closed session for the purpose of discussion which might lead to the discipline or dismissal of an individual employee without restricting that employee’s right to a public hearing if requested. Motion was made by Hill and seconded by Williams to convene in closed session following the regular meeting pursuant to KRS 61.810 (1) (f). Mayor Wilkerson called for roll call vote. APPROVAL OF MINUTES Minutes of Regular Meeting December 1, 2015 Minutes of the above-referenced meeting were distributed to the Board of Commissioners with the Agenda for their review. Motion was made by Hill and seconded by Denning to approve said minutes as written. Mayor Wilkerson asked for discussion, and with none, a roll call vote was taken. PUBLIC COMMENTS Ann Marie Summers came forward and asked the Board of Commissioners for help. She said she had gone as far as she could on her own to make improvements in her neighborhood near Chuck Crume, Jr. Nature Park, also known as Crestmoor Woods Park. She reported the once single-family neighborhood was in transition to becoming more rental property with multi-unit rentals on a single property and the home next to hers had been converted to house up to six renters with only four parking spaces available on the property. She expressed concerns about the quality of life diminishing in her neighborhood due to increased traffic and parking in front yards from all the rentals. Ms. Summers pointed out that according to Zoning Ordinance Section 4.5.4 (B) this rental property was in violation of parking requirements and she was not getting any assistance or response from the City- County Planning Commission regarding enforcement of the ordinance. Mayor Wilkerson suggested Ms. Summers leave her phone number with the City Clerk, and he advised he would make sure someone at the Planning Commission called her back the next day. Although, he pointed out he did not know what the response would be regarding the issue. REGULAR AGENDA 2 (Minutes-Board of Commissioners-December 15, 2015) ORDINANCE NO. DeFebbo reviewed the unexpected need to proceed with replacement of the HVAC system this year and recommended the bid award. OF MANSFIELD, OHIO IN THE AMOUNT OF $50,420 Summary of Municipal Order No. 2015 - 221 was read by the Assistant City Manager/City Clerk. Motion was made by Hill and seconded by Parrigin for consideration of said Municipal Order. DeFebbo explained the need to perform maintenance of the pool filters and recommended the bid award. D/B/A PERDUE ENVIRONMENTAL CONTRACTING COMPANY, INC. OF NICHOLASVILLE, KENTUCKY IN AN AMOUNT NOT TO EXCEED $120,000 Summary of Municipal Order No. 2015 - 222 was read by the Assistant City Manager/City Clerk. Motion was made by Hill and seconded by Denning for consideration of said Municipal Order. In conjunction with the next item on the agenda, Municipal Order No. 2015 – 223, DeFebbo explained the two step approach to manage the leachate at the Butler County Landfill. He noted this item provided a short-term solution to remove and treat the leachate while the next item provided the long-term solution to disperse the leachate on site. He recommended approval of both bids. With no additional discussion, and with none, a roll call vote was taken. As one of the largest parks in the city, DeFebbo indicated the City supported greenways and would continue to help leverage funds as needed for continued development. Mayor Wilkerson advised the 6 (Minutes-Board of Commissioners-December 15, 2015) Master Plan was available for public review on the City-County Planning Commission website. DeFebbo described the proposed use for this property, including providing an access point to the closed landfill and providing future parking for other proposed park developments. DeFebbo recommended acceptance of grant funds to be used to help pay overtime costs for two Bowling Green Police Officers assigned to the Bowling Green/Warren County Drug Task Force. MUNICIPAL ORDER NO. 2015 – 227 MUNICIPAL ORDER AUTHORIZING THE SUBMISSION OF AN APPLICATION FOR BROWNFIELDS ASSESSMENT FUNDS TO THE U.S. ENVIRONMENTAL PROTECTION AGENCY IN AN AMOUNT UP TO $200,000 7 (Minutes-Board of Commissioners-December 15, 2015) Summary of Municipal Order No. 2015 - 227 was read by the Assistant City Manager/City Clerk. Motion was made by Hill and seconded by Parrigin for consideration of said Municipal Order. DeFebbo pointed out that most communities have contaminated properties known as brownfields. He recommended submission of this grant to apply for funds that would be used to help identify and map brownfields as part of the Neighborhood Improvement Program. Mayor Wilkerson stated he was excited about the possibility of receiving this grant. Once the discussion ended, a roll call vote was taken. MUNICIPAL ORDER NO. 2015 – 228 MUNICIPAL ORDER APPROVING AMENDED AND RESTATED WORKFORCE COORDINATOR AGREEMENT AMONG THE CITY OF BOWLING GREEN, WARREN COUNTY AND BOWLING GREEN AREA CHAMBER OF COMMERCE Summary of Municipal Order No. 2015 - 228 was read by the Assistant City Manager/City Clerk. Motion was made by Hill and seconded by Williams for consideration of said Municipal Order. DeFebbo outlined the request to extend this agreement another two years at a cost of $35,000 per year. Mayor Wilkerson remarked the Workforce Coordinator was averaging about 26 job placements per month since starting. Bowling Green Area Chamber of Commerce COO/CFO Meredith Robinson reported she expected that rate to increase in the coming months as unemployed skilled workers from eastern Kentucky were being brought to this area for employment. Commissioner Williams indicated he was impressed with the results achieved so far. Following the discussion, a roll call vote was taken. MUNICIPAL ORDER NO. 2015 – 229 MUNICIPAL ORDER APPROVING A JOB DEVELOPMENT INCENTIVE PROGRAM EMPLOYEE WITHHOLDINGS CREDIT AGREEMENT WITH GENERAL MOTORS, LLC Summary of Municipal Order No. 2015 - 229 was read by the Assistant City Manager/City Clerk. Motion was made by Hill and seconded by Parrigin for consideration of said Municipal Order. DeFebbo remarked the City did its share in trying to foment job creation in the community by providing incentives for new or expanding businesses of up to 1% credit from employee withholdings generated by the new jobs over a ten-year period. Chief Financial Officer Jeff Meisel gave an overview of the agreement. He also recounted the Board had previously approved a similar agreement under the code name Project Icon, which has now been rolled into this agreement. Under this agreement, Mayor Wilkerson reaffirmed the City would be returning 1% of the 1.85% occupational 8 (Minutes-Board of Commissioners-December 15, 2015) fee GM will generate in payroll taxes through the creation of up to 600 new jobs. ROLL CALL: Voting Yea: Hill, Parrigin, Williams, Denning and Wilkerson Voting Nay: None Municipal Order No. 2015 - 229 was approved by unanimous vote. 9 (Minutes-Board of Commissioners-December 15, 2015) CLOSED SESSION Following a brief recess to clear the Commission Chamber, the Board of Commissioners met at approximately 5:35 p.m. in closed session pursuant to KRS 61.810 (1) (f) as previously approved. DeFebbo confirmed there was no action expected to follow the discussion. ADJOURNMENT Once all discussion concluded in closed session and there being no further business to come before the Board of Commissioners, at approximately 6:10 p.m., Mayor Wilkerson declared this meeting adjourned.
