Planning Commission meeting minutes – December 18, 2023 8. OLD BUSINESS A. Clean Water State Revolving Fund Opportunity Consider the following recommendations from City Manager Michael Cain and Director of Public Works and Utilities Doug Varney: 1) Scope of Project Recommendation: Based on the needs of the system as outlined in the 2023 CWSRF Project Plan submittal, discussions with the City Commission and our consultants and the rate impact report from Bakertilly recommends that the City proceed with the full $12.8 million project. 2) Notice of Intent Resolution Recommendation: That the City Commission approve the proposed notice of intent resolution, inserting the appropriate bonds amount based on the scope of project determined. 3) Retaining of Consultants Related to this Project Recommendation: That the City Commission approve the proposed agreements for a) Design, Bidding and Construction Engineering to C2AE, for b) Financial Consultant to Bakertilly, and c) Bond Counsel to Miller Canfield based on the fees proposed for the City approved project scope. B. Historic District Ordinance Repeal Second Reading Consider the recommendation from Planning Director Scott McPherson to adopt the proposed ordinance repealing City of Boyne City Ordinance Chapter 30 Article II-Historic Districts. 9. NEW BUSINESS A. Snow Groomer Replacement Recommendation Consider the recommendation from the Parks and Recreation Commission to approve the use of $8,000 of the $70,000 budgeted for capital outlay for the Parks Department for the purchase of a new trail groomer. 1) Snow Groomer Video B. Lake Charlevoix Association Shoreline District Gardens Recommendation Consider the recommendation from the Parks and Recreation Commission to approve the Lake Charlevoix Association Shoreline District Gardens plans as presented. C. MDOT Agreement 23-5443 Consider the recommendation from Director of Public Works and Utilities Doug Varney to approve a certified resolution authorizing the City Manager and City Clerk/Treasurer to execute contract 23-5443 and all necessary documents with the Michigan Department of Transportation for this Front St. road improvement project. D. Staff and Command School Consider the recommendation from Chief of Police Kevin Spate to authorize the City Manager to approve and pay the tuition bill for MSU Staff and Command School for Assistant Chief Mercer in the amount of $3,700. ALTERNATE E. Water Repair Near 643 W. Michigan Ave. Consider the recommendation from Director of Public Works and Utilities Doug Varney approve accepting the quoted price of $10,000 - $15,000 from Matt’s Excavating to make the necessary repairs.  F/E. Closed Session Request Consider the request from City Manager Michael Cain to go into closed session for the purpose of attorney client privilege discussion pursuant to Section 8(h) of the Open Meetings Act (MCL 15.268(1)(h)) to discuss material protected by the attorney client privilege, which is exempt from disclosure under the Freedom of Information Act (MCL 15.243(1)(g)). 10.
