December 11, 2024 BOROUGH OF BRALDEY BEACH RESOLUTION 2024-216 AUTHORIZING THE DISPOSITION OF BOROUGH PROPERTY LOCATED AT 319 LAREINE AVENUE WHEREAS, the Borough of Bradley Beach has determined that certain items of Borough property are no longer needed for public use and should be disposed of in accordance with applicable laws; and WHEREAS, the Borough engaged Rose O’Connor-Myer, owner of Shore Antique Center, who has over twenty-five years of experience as an art consultant, art historian, appraiser, lecturer, and is a recognized expert in American and European paintings, sculpture, and prints; and WHEREAS, Rose O’Connor-Myer presented her appraisal findings regarding the artifacts located at 319 LaReine Avenue to the Governing Body during a public presentation at the Council Business Meeting held on September 13, 2023; and WHEREAS, Rose O’Connor-Myer identified items of historical and monetary value to be sold or donated, solicited no fewer than six qualified buyers or recipients, and identified the qualified buyers as listed below; and WHEREAS, the sale and donation of these items is in the best interest of the Borough and its residents and gives a majority of the artifacts a new home within six miles of the Borough at the Church of the Presidents located in Long Branch, New Jersey; and WHEREAS, pursuant to N.J.S.A. 40A:11-36, the Borough is required to dispose of surplus public property through a resolution of the Governing Body as formal acknowledgment; and WHEREAS, the Borough employs a Qualified Purchasing Agent, and the estimated fair value of the artifacts is below the bid threshold, thereby not requiring a public auction; and WHEREAS, the Borough recognizes that the Long Branch Historical Museum Association - Church of the Presidents has expressed a need for additional items, including those appraised at no monetary value due to lack of demand or deterioration, and desires to retain these historical artifacts within the local community; NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Bradley Beach, County of Monmouth, State of New Jersey, as follows: 1. Compliance with Law The sale and donation of the items listed above shall comply with all applicable state and local laws governing the disposition of municipal property. 3. Execution of Sale and Donation The Borough Administrator and appropriate officials are hereby authorized to take all necessary actions to complete the sale, donation, and transfer of the items listed. 4. Effective Date This resolution shall take effect immediately upon adoption. BE IT FURTHER RESOLVED, that a certified copy of this resolution be forwarded to the Borough Administrator, and the buyers and recipients listed above.
