Council Members present were Terry Phillips, Raymond Ledezma, Curtis Owens, Vickie Roddie, and Gabe Moreno. City staff present were City Manager James Stewart, Public Works Director Steven Miller, Finance Director Lisa McElrath, Police Chief Randy Batten, Purchasing Agent Taylor Hoffpauir, Purchasing Agent Shailyn Cook, Wastewater Superintendent Santiago Rodriguez, City Attorney Sharon Hicks and City Secretary Tina Keys. Also in attendance were Matt Andrews, Charles Hodges, Sheila Hemphill, James Griffin, Charles Bush, Daniel Mendoza, Karen Langseth, Julia McAnelly, Raina Hornaday, Dale Vander Woude, Bob Hoeppner, Nan Crouch, and Jan Wigginton. 1. INVOCATION AND PLEDGE OF ALLEGIANCE Council Member Phillips gave the invocation, and the Pledge of Allegiance was recited. 3. PUBLIC COMMENTS Public comments were reserved for agenda item. A. PUBLIC HEARINGS AND INDIVIDUAL CONCERNS ON PUBLIC HEARING  Public Hearing to receive comments from the public regarding a request for a SUP (Specific Use Provision) to permit a concrete batch plant (permanent) in the Commercial District for property located at 2500 S. Bridge St., Hemmerle F. Subdivision, Block 389 Public Hearing was opened at 6:40 p.m. Shiela Hemphill said that company was talking about asphalt and asked if they are doing asphalt. James said no, its concrete. Shiela said in that case there shouldn’t be the dust concerns that were mentioned at a previous meeting. Shiela asked if these businesses have to be on a main road. Council Member Phillips said part of the issue is the availability of water. Public Hearing was closed at 6:44 p.m. 7. INDIVIDUAL CONCERNS Council started the meeting with item J and took a break at 7:40. And resumed at 7:50 A. Discussion, consideration and possible action approving the purchase of a 2024 Elliot Model D47i Digger Derrick truck from Central Texas Equipment, Pflugerville, TX in the amount of $294,923.20. Lisa McElrath presented. Council Member Moreno moved to approve the purchase of the 2024 Elliot Model D47i Digger Derrick truck from Central Texas Equipment, Pflugerville, TX in the amount of $294,923.20. Seconded by Council Member Roddie. All Council Members voted “aye” and none “nay”. Motion passed with a 5 – 0 vote. B. Discussion, consideration and possible action approving the purchase of a Ditch Witch RT45B from EKA (Earle Kinlaw & Associates, Inc.), Monroe, GA in the amount of $79,203.47. Lisa McElrath presented. Council Member Ledezma moved to approve the purchase of the Ditch Witch RT45B from EKA (Earle Kinlaw & Associates, Inc.), Monroe, GA in the amount of $79,203.47. Discussion, consideration and possible action regarding the first reading of Ordinance 1411 of the City of Brady granting a SUP (Specific Use Provision) to permit a concrete batch plant in the Commercial District for property located at 2500 S. Council Member Owens moved to approve the first reading of Ordinance 1411 granting a Specific Use Permit to allow a concrete batching plant (permanent) in the Commercial District for property located at 2500 S. Bridge Street, Hemmerle F Subdivision, Block 398, subject to the conditions set forth in the ordinance. Seconded by Council Member Moreno. All Council Members voted “aye” and none “nay”. Motion passed with a 5 – 0 vote. D. Discussion, consideration and possible action regarding the first reading of Ordinance 1412 of the City of Brady granting a SUP (Specific Use Provision) to permit a caretaker or guard residence for property located at 1508 S. Blackburn St., Spiller Subdivision, Lots 4-5, Block 9. James Stewart presented. Council Member Roddie said there are six or seven males living in those two residences. Very young males traveling in and out of this property. Mayor Groves said that was part of the P & Z discussion and consideration. Mayor Groves said that should be a law enforcement issue rather than an issue with the request. Council Member Roddie said she does not know if they are documented workers or not. They are friendly and nice and ride their bicycles. James Stewart said people who spoke at P & Z, there were problems with previous owners. Attorney Sharon Hicks said the number of people living in the primary location generally is no more than four unrelated people, so it would be a zoning violation to be addressed. Also, the request for a caretaker, when we looked at definitions, that is designed for a single person to oversee or caretake of a facility. James Stewart said Building Official Kyle Reeves said the house has been rented. Council Member Moreno moved to approve the first reading of Ordinance 1412 granting a Specific Use Provision to allow a caretaker’s or guard’s residence at 1508 S. Blackburn Street, Brady, Texas. Seconded by Council Member Ledezma. Four Council Members voted “aye” and one, Council Member Roddie voting “nay”. Motion passed with a 4 - 1 vote. E. Discussion, consideration and possible action of considering whether to participate in a 50/50 cost share with McCulloch County for radio tower replacement of the tower located on the hill above the G. Rollie White Complex. James Stewart presented. Council Member Moreno said after looking at different options, Page 2|5 3|Page – Brady City Council Minutes April 21, 2026 this is the most economical and best option. Sheriff Andrews said if we don’t replace the tower, we’re going to have to repaint it or take it down. Council Member Moreno moved to approve the participation in a 50/50 cost share with McCulloch County to replace the radio tower located on the hill above GRW complex not to exceed $200,000 for our share with the caveat that the interlocal agreement stay the same and subject to the finance department bringing back a budget amendment for approval. Council Member Owens asked where the money is coming from. Lisa McElrath said it would require a budget amendment. The motion was seconded by Council Member Ledezma. All Council Members voted “aye” and none “nay”. Motion passed with a 5 – 0 vote. F. Discussion, consideration and possible action on awarding professional services to Centurion Planning and Design, San Angelo, Texas to develop engineering plans & specifications for public bidding purposes describing 6-in. water main improvements along Calf Creek Road. Steven Miller presented. Council Member Owens moved to authorize the city manager to execute engineering service agreement with Centurion Planning and Design, San Angelo, Texas in the amount of $59,212.00. Seconded by Council Member Phillips. All Council Members voted “aye” and none “nay”. Motion passed with a 5 – 0 vote. G. Discussion, consideration and possible action approving the purchase of a 2026 Ford Explorer Police Interceptor from Mak Haik Ford, Georgetown, Texas in the amount of $58,716.11. Lisa McElrath presented. Council Member Phillips moved to approve the purchase of the 2026 Ford Explorer Police Interceptor from Mac Haik Ford, Georgetown, Texas in the amount of $58,716.11. ($51,716.11 net of trade in value). Seconded by Council Member Owens. All Council Members voted “aye” and none “nay”. Motion passed with a 5 – 0 vote. H. Discussion, consideration and possible action regarding approval of Resolution 2026-003 to enter into a finance contract with Government Capital Corporation (GCC) for the purpose of procuring (1) Police vehicle ($51,000). Lisa McElrath presented. Council Member Owens moved to approve Resolution 2026-003 to enter into a finance contract with Government Capital Corporation for a total principal amount not to exceed $51,000 accepting the 7.014% interest rate from Brady National. Seconded by Council Member Roddie. All Council Members voted “aye” and none “nay”. Motion passed with a 5 – 0 vote. I. Discussion, consideration and possible action to appoint Jim Lero and Charles Hodges to the Tourism Board. Daniel Mendoza presented. Council Member Phillips moved to appoint Jim Lero and Charles Hodges to the Tourism Board. Seconded by Council Member Ledezma. All Council Members voted “aye” and none “nay”. Motion passed with a 5 – 0 vote. J. Discussion, consideration and possible action considering whether to entertain a lease of property to Caprock Renewables for the purpose of locating a Batter Energy Storage System on said property. James Stewart presented and introduced representatives from Caprock Renewables. James said they are looking for a location on which to locate a battery energy storage system. Raina Hornaday and Dale Vander Woude presented to Council. Council Member Phillips gave some of his background and said they thought about battery storage systems for a long time. He is against putting them in a residential area. There have been 26 fires in the US. It does happen. He doesn’t think the systems are perfected yet. They drive real estate prices down. Why are you not doing revenue sharing on these instead of property. Dale said he would have to convince them of the revenue profile. Council Member Phillips said our citizens don’t want it in town. We have to represent what our citizens want. He’s all about making money. We would only benefit from a small monthly rental and we will have a lot of liability. He doesn’t know that we have the resources to handle a fire. Dale said if there is a fire detected, then the system will overload the others within that individual unit to have them all burn out simultaneously. Council Member Phillips said he thinks it’s a good thing but not a good thing in the city limits of Brady. Council Member Moreno said they are currently looking at two locations, and asked if there any more. Dale said they’re also looking at a location on the north side; one is not enough for Brady. Mayor Groves asked about vulnerability of the area, specifically related to security. Dale said the sites are more secure than the substations. They are happy to work with us on security. They will have cameras with remote monitoring. Council Member Moreno said his concern is the liability. If there is a contamination leak or someone got hurt or someone got sick. He doesn’t know if that would increase the city’s insurance premiums. Raina said they carry insurance as an owner of the site. They would be happy to do an insurance analysis. Council Member Moreno said it’s not beneficial for the city. Dale said there are no other municipalities who have indicated their insurance premiums have increased. Council Member Moreno said all homeowners in Brady’s insurance premiums would go up. Dale said if there is a cost they would want to address it. Sheila Hemphill handed out information to the Council. She thinks the location is horrendous and urges council to say no thank you. Council Member Phillips. moved to not entertain a lease for a BESS at the location they are requesting. Seconded by Council Member Moreno. Four Council Members voted “aye” and one, Council Member Owens, voting “nay”. Motion passed with a 4-1 vote. 8. STAFF REPORTS A. BRIDGE ST., HEMMERLE F SUBDIVISION, BLOCK 398 WHEREAS, Chapter 211 of the Texas Local Government Code empowers the City of Brady, Texas, to enact zoning regulations and provide for their administration, enforcement, and amendment; and WHEREAS, the City has previously deemed it necessary and desirable to adopt zoning regulations to provide for the orderly development of property within the City in order to promote the public health, safety, morals, and general welfare of the residents of the City; and WHEREAS, Chapter 14 of the Brady Code of Ordinances constitutes the City’s Zoning Regulations and requires property to be zoned in accordance with proper designations as defined by the City; and WHEREAS, Ingram Readymix No. 46, LLC, by and through its authorized agent, Jeff Roberts, has requested approval of a Specific Use Provision to permit a concrete batching plant on property located at 2500 S. Bridge St., Hemmerle F Subdivision, Block 398, Brady, Texas; and WHEREAS, the Planning and Zoning Commission of the City, after providing adequate notice and conducting a public hearing on April 14, 2026, in accordance with the Brady Code of Ordinances and Chapter 211 of the Texas Local Government Code, unanimously voted to recommend approval of the Specific Use Provision for the designated property and found that the request conforms to the purpose and intent of the City’s zoning regulations; and WHEREAS, the City Council finds that approval of the Specific Use Provision will not adversely affect the character of the area in which it is proposed, will not substantially depreciate the value of adjacent or nearby properties, will be in keeping with the spirit and intent of the City’s Zoning Ordinance, will comply with applicable standards of the district in which it is located, and will not adversely affect traffic, public health, public utilities, public safety, or the general welfare of the residents of the City; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BRADY, TEXAS, THAT: A Specific Use Provision is hereby granted to permit a concrete batching plant on property located at 2500 S. There are over 100 routes being considered by Oncor/LCRA. One of the routes crosses near the airport that could prohibit expansion. The City desires to protect its interest in the airport’s future and desires to intervene. There will be a timeline and review set by the PUC and the State Office of Administrative Hearings. The City may cease participation at any time depending on facts as they develop. The City had to file its intervention by April 27, 2026, hence the request to ratify. If the City chooses not to ratify, a notice withdrawing the intervention will be filed. RECOMMENDED ACTION: Move to approve
