Kennedy Memorial Drive, Braintree MA Thursday, May 16, 2019, 4:30 p.m. IN ATTENDANCE: Dr. Arthur Bregoli, Chairman Dr. Philip Nedelman, Vice Chairman NOT PRESENT: Laurie Melchionda, Clerk ALSO PRESENT: Marybeth McGrath, Director of ML & I Dr. Bregoli called the meeting to order at 4:30 p.m. Approval of Meeting Minutes: March 14, 2019 Motion By: Dr. Nedelman to approve the meeting minutes of March 14, 2019. Second By: Dr. Bregoli Unanimously voted List of Complaints: The board reviewed a list of complaints received from March 11-May 10, 2019. New Business: Request for Lifeguard Variance: Jonathan’s Landing-400 John Mahar Highway Ms. McGrath stated that this is a renewal of the annual request for lifeguard variance. They are requesting a partial variance. They would like to operate their pool from 8:30 a.m. to 8:00 p.m. They would like the lifeguard to come on duty at 12:00 p.m. until 8:00 p.m. on Monday through Friday, with no lifeguard working in the morning from 8:30am to 12:00pm, due to low bather log activity. The majority of bathers are seen during the hours of 12:00pm through 8:00pm. This is the same request they have had in previous years. Motion By: Dr. Nedelman to approve a lifeguard variance for Jonathan’s Landing at 400 John Mahar Highway. Second By: Dr. Bregoli Unanimously Voted Request for Lifeguard Variance: Turtle Crossing- 501 Commerce Drive Ms. McGrath stated that this is the same request they have had in previous years. It is a partial request for variance. They would like to not have a lifeguard Monday through Friday, but have a lifeguard on Saturdays, Sundays, and holidays. Their bathers average between one and twenty- seven. Braintree Board of Health, May 16, 2019 Page 2 of 2 Motion By: Dr. Nedelman to approve a lifeguard variance for Turtle Crossing at 501 Commerce Drive. Second By: Dr. Bregoli Unanimously Voted Request for Lifeguard Variance: Reservoir Crossing- 614 Pond Street Ms. McGrath stated that this is a request for partial variance. The bather load is low during the weekdays. They would like to offer lifeguards Saturdays, Sundays, and holidays. Their highest bather level last year was 18. Motion By: Dr. Nedelman to approve a lifeguard variance for Reservoir Crossing at 614 Pond Street. Second By: Dr. Bregoli Unanimously Voted Request for keeping of chickens: 87 Shepard Road Present: Jennifer O’Connell and Jason Sorden, property owners. Ms. McGrath stated that this is a request for the keeping of up to 12 chickens. Ms. O’Connell and Mr. Sorden currently have 12 chickens on the property and were unaware that they needed a permit. Their house is on the corner of Jefferson Street and Shepard Road. The coop is located in a portion of their garage, and they have a run area which is fenced-in outside of the garage. The applicant provided photographs for the Board. Abutters to their property have provided letters indicating they have no objection to the chickens. Motion By: Dr. Nedelman to approve a request for the keeping of up to 12 chickens maximum at 87 Shepard Road. Second By: Dr. Bregoli Unanimously Voted Request for keeping of chickens: 101 Stetson Street Ms. McGrath stated that this property is on the corner of Stetson Street and Pilgrim Road. They are requesting to keep six chickens on the property. Department staff has conducted a site visit and do not foresee any problems. The abutters have received written notification and have indicated no objection to the request. Motion By: Dr. Nedelman to approve a request for keeping 6 chickens at 101 Stetson Street.
