Braintree Board of Health Johnson Meeting Room, Town Hall 1 John F. Kennedy Memorial Drive, Braintree MA Thursday, March 12, 2020, 7:00 p.m. IN ATTENDANCE: Dr. Arthur Bregoli, Chairman Dr. Philip Nedelman, Vice Chairman Laurie Melchionda, Clerk ALSO PRESENT: Marybeth McGrath, Director of ML & I Dr. Bregoli called the meeting to order at 7:00 p.m. Approval of Meeting Minutes: February 13, 2020 Motion By: Dr. Nedelman to approve the meeting minutes of February 13, 2020. Second By: Ms. Melchionda Unanimously Voted List of Complaints: Ms. McGrath stated she will provide a list of complaints at the Board’s next meeting. New Business: Request for Variance of Lifeguard Provision a. Royal Lake Village Condominium Trust, 3 Royal Lake Drive b. Turtle Crossing, 501 Commerce Drive Ms. McGrath asked that the Board table the Royal Lake Village request as she has not received their bathing log data. Motion By: Dr. Nedelman to table the request for 3 Royal Lake Drive. Second By: Ms. Melchionda Unanimously Voted Susan Ebersol, Property Manager, was present before the Board. They are requesting a partial variance for Monday through Friday. She provided data for 2019 weekdays only, as they do have a lifeguard on duty on weekends and holidays. On certain days the bather load was higher, in the range of 25 bathers. She stated it is difficult because she knows when bathers check in, but has no way of tracking when they leave. Braintree Board of Health, March 12, 2020 Page 2 of 3 Ms. Melchionda asked if there is a way to change this. Ms. Ebersol stated she would have to check with the software people. She stated the numbers may be higher because people have to check back in every time they leave the pool area to use the pool house. Ms. McGrath stated that her inspectors have expressed concern that many times there is only one bather in a pool area and recommend that when the Board grants variances they require that persons cannot swim unless there is more than one adult in the pool enclosure. She stated there is state approved and required signage in the area indicating that adults should not swim alone. Motion By: Dr. Nedelman to approve the variance request for Turtle Crossing, 501 Commerce Drive Second By: Ms. Melchionda Unanimously Voted Body Art Establishment/Practitioner: Advanced Aesthetics/Ana Zavodini, 150 Wood Road Ana Zavodini was present before the Board. Ms. McGrath stated that Ms. Zavodini is requesting two permits. She would like to provide permanent cosmetic tattooing and needs an establishment permit as well as a practitioner permit. An inspection of the establishment has been conducted and the treatment room is fully equipped. They are working on paperwork such as an exposure control plan and incident reports. She stated Ms. Zavodini has provided all her training certificates and proof that she has worked through an apprenticeship for two years. She currently has a licensed establishment in Everett and will continue to offer services in both locations. Ana Zavodini addressed the Board. She stated she has been doing this for eight years. This is her second location working along with her partner. She will be doing body art as well as other aesthetic services. At this location she will be offering permanent makeup including eyebrows, eyeliner, lips, areolar restoration and stretch mark and vitiligo camouflage. Dr. Nedelman asked if Ms. Zavodini requires malpractice insurance and she indicated she does. Ms. McGrath stated that the Town of Braintree requires Planning Board approval through a special permit to open an establishment for body art. If the Board approves these permits they would have to be conditional upon receiving their special permit through the Planning Board. Dr. Nedelman asked if Ms. McGrath is responsible for ensuring this license is renewed on an annual basis, along with her insurance. Ms. McGrath indicated yes, and in order to do so all the criteria has to be met. Braintree Board of Health, March 12, 2020 Page 3 of 3 Motion By: Dr. Nedelman to approve the Body Art Establishment License for Advanced Aesthetics, and Body Art Practitioner license for Ana Zavodini, conditional upon approval of Special Permit by the Planning Board. Second By: Ms. Melchionda Unanimously Voted Definitive Subdivision Plan: Citgo Petroleum Corporation, 345-395 Quincy Avenue Ms. McGrath stated Citgo came before the Board in June 2019 to seek endorsement of their preliminary subdivision so they could go before the Planning Board for a preliminary subdivision. Citgo has done this, and the next step is to seek approval through the Planning Board for a definitive subdivision. They are carving out a small piece of their property which would still be owned by Citgo. They are seeking the Board’s endorsement of this request. Motion By: Dr. Nedelman to endorse the request for Definitive Subdivision Plan. Second By: Ms. Melchionda Unanimously Voted Other Business: Ms. McGrath provided an update on COVID-19. She stated she has been providing the Board daily updates from the CDC and Mass Department of Public Health. She stated as things move forward she will continue to update the Board, including anything pertinent to Braintree. Dr. Nedelman asked if Ms. McGrath will be involved in the distribution of test kits once they become available. Ms. McGrath stated that the Mass Department of Health has been testing since February 29 and the distribution of test kits is not really a local Board of Health responsibility. To date they have not been asked to be part of that process. Ms. Melchionda stated that several states have closed schools and it is anticipated that Massachusetts will do so as well. Dr. Bregoli expressed concern about having patients tested in doctor’s offices. Ms. McGrath indicated that drive through clinics have been setup at hospitals and local laboratories would be involved with testing as well. Motion By: Dr. Nedelman to adjourn the meeting at 7:25 p.m. Second By: Ms. Melchionda Unanimously Voted
