There is nothing in this proposed ordinance that allows for retail sales within the Town of Braintree and no delivery is allowed within the Town of Braintree. Chairman Ringius stated we will have a presentation from the proponent. We will then have staff comment from various agencies within the town including police and fire. Public Comment will be allowed at this meeting. Chairman Ringius stated before we begin with the meeting I would like to set some ground rules. Dr. Bregoli read a statement from the Board of Health objecting to any change to the Town’s current ordinances. June 22, 2022 Committee on Ordinance & Rules 2 of 12 Dru Ledbetter, CEO FlowerXpress shared a presentation. Flower Express was formed in 2021. We're a 100% owned by people of color, majority owned by women. Our leadership team has over 60 years of experience professionally. Our mission is to create and bridge a gap between adult sales. What we call adult sales in the cannabis industry and medical grade quality cannabis production. We want to grow medical grade cannabis in a consistent high-tech environment and want to partner with grow organizations and research organizations as well as life sciences sectors to ensure that they're having a good quality medical product. Our values are, of course, integrity. We lead with integrity and everything we do; We want to be fully transparent. We believe in Environmental sustainability; community empowerment and fiscal responsibility as well as social equity and social justice. Our advantage is our Genetics portfolio with over a 100 new strains not previously seen in any cannabis. market. We have a proprietary grow technique that are high tech, low touch. We have state of the art vertical grow boxes as well that are armed at artificial intelligence that will help us with analytics in terms of growing techniques as well. We have partnered with some cannabis research organizations in the state to ensure we have those partnerships. The cannabis industry in the United States is essentially growing. It's a budding market right now worth it 61 billion dollars. 13 States are currently legal. It's expected to go to 15 States by the end of 2022. Alone in 2022 cannabis sales have reached $384Million. Massachusetts believes that its only capturing about 20% of the market. In 2021 $176Million in tax revenue was generated for the state of Massachusetts. For us we believe medical research is the future of the cannabis industry. We see a lot of companies investing in cannabis research. The NFL awarded $1million dollars to cannabis research to try to manage pain and we see that Pfizer invested $6.7 billion dollars in cash to purchase a cannabis research company. The licensure process in Massachusetts is a long process to obtain a canvas license. Essentially we have to build a team, apply for local zoning and special permitting. The reason we feel we are going to be successful is because we've done this already, and we're just duplicating our efforts here in the eastern part of the State (Colerain) and hopefully in Braintree our team has to essentially obtain your host community agreement with the town. That kind of dictates how you do business in the town. You still have to go through special permitting and going through that zoning process. And then, after you go through that local process, you then have to go to the State and apply through the Cannabis control Commission. Then you will obtain a provisional license and get the approval to start building out your canvas facility, and then they will issue a final license, in which they will send out inspectors to ensure everything's up to par and then you'll get a commence operations approval. We requested these proposed changes in early May to the Planning Board. We are respectfully requesting that the Town zoning ordinance be amended to remove the existing section 135 that does not allow for non-medical marijuana establishments and be replaced with a new section that allows medical and non-medical marijuana establishments. This would be allowed only in highway business and commercial zoning districts of the town of Braintree. Amendments are new sections that would define the submission requirements. We would have to submit our business plan, ensure we are meeting buffer zone requirements as well as enter into a host community agreement with the municipality. We would also be adding a special permit criteria. We had security plans submitted to June 22, 2022 Committee on Ordinance & Rules 3 of 12 fire and police departments as part of our proposal as well. We added principal use and parking changes proposals. Member Kroha made a positive recommendation to the Town Council with notes. The definition to clarify non-retail establishment to make it very clear we are not seeking a retail proposal for cannabis at all in this town. The final text amendment recommendations were that no property containing marijuana establishment shall be located within a 100 feet of any property that contains a residential use. That is the additional buffer zone in addition to what the state mandates, which is 500 feet from any public or private school, and one-half mile from any other cannabis establishment. Our goal is to have 3 different license types. One for cultivation product, manufacturing and delivery License types. Which are only available to social equity applicants in the state. So essentially, we would have an e-commerce site in which people can go online to order and pay. Product would discreetly be delivered to their home if they live in a yes town. We would not have cash onsite. We have a letter of intent for 280 ivory Street. It is existing 90,000 square foot warehouse is known as the Carter Rice Building. It's been vacant for over 25 years in dismal condition, and we are hoping to help unify once we secure the necessary approvals. We are not located within a 500 feet of public or private school. There'll be no personal transactions on site, and we've partnered with electronics where the leading security operators in Massachusetts for Cannabis They also service hospitals and the MBTA. Essentially the walkability path in front of Ivory Street and around District 5, and we talked about increasing the tree canopy in this district and creating a more walkable path to the T station. Zoning change impact. It would have little to no impact on the current use of the zone. It would be the highway district business zoning only. We will still need a special permit that would allow the town to have complete discretion, and where any establishment is allowed, even if our this is not our location or the zoning amendment goes through and this location is very favorable, because it's been a vacant for so long and it's across from this transfer station, which is probably why it's been vacant for so long. The transfer station would not impact our operations, and we would be a closed-loop system with HVAC completely internal. There will be no odor escaping from the building and no ordor entering the building so we would not mind having the transfer station across the street. Our other community benefits are for fiscal benefits. The community, by the State, you are allowed to have a cannabis excise tax of 3% of your gross revenue which can potentially bring over 6 million dollars of revenue to the town of Braintree based on our very conservative projections for our first year of operation. We would also be impacting job creation in the town. We would have no minimum education requirement, and we would do on job training. and there would be 3 workday shifts and over 200 positions spread out over those 3 work shifts. We would have incentivized subsidized T passes as well as other mode of transportations and memberships for our employees. We also want to create a fund with significant philanthropic investment to support community improvement efforts. Other concerns that have come up in our conversations with the community are traffic. We don't believe that it would be a significant impact on traffic as deliveries cannot be done in the Town of Brain tree and orders would be coming in via a computer program. Our cars will be exiting out of the facility, June 22, 2022 Committee on Ordinance & Rules 4 of 12 and getting directly on the highway to perform their deliveries and be coming back after the business day has ended. We would address this with the Special Permit. We want to definitely increase the tree canopy in District 5, as is one of the districts at the lowest tree canopy in town. Lighting would be code conforming to minimize nuisance. Our lights would not be able to be on after 10pm per state law. We also want to create a comprehensive education plan and support the work of the established addiction, prevention efforts that are already happening in the town. Dru Ledbetter, CEO FlowerXpress stated we have a great team including a Braintree resident who is part of the team who speaks very highly of Braintree and wants to see all the benefits of the tax revenue stay in the Town of Braintree. Chairman Ringius stated we received a letter from the Braintree Board of Health. This letter is objecting to changes being proposed to the zoning ordinance. As Chairman of this committee, I reached out to our public safety officials being the Braintree Police Department and the Braintree Fire Department. In a response dated May 10, 2022 from Chief Dubois reads: Braintree Police Department On May 10, 2022, in response to a request for comments from Planning Director Melissa SantucciRozzi, Braintree Police Chief Mark Dubois provided the following statement: “After reviewing the proposed application the Police Department does not oppose the changes.” In response to a request for further comment from the Ordinance and Rules Committee, please note the following from Chief Mark Dubois: “Based on my current knowledge, the cannabis industry is heavily regulated in Massachusetts and includes very specific security requirements above and beyond those currently applicable to other commercial businesses. The Police Department would collaborate with any in house security personnel associated with such an establishment to monitor the property and address any concerns that may present themselves. As proposed, there will be no retail sales of recreational marijuana on the property—this is not the type of establishment that is believed to contribute to the local drug trade and would be more like existing armored car services that operate with large volumes of cash. Based on my review of the application, and the limited operations proposed, I cannot anticipate a public safety impact to the surrounding neighborhoods and maintain no objection to the proposal.” Braintree Fire Department On May 10, 2022, in response to a request for comments from Planning Director Melissa SantucciRozzi, Braintree Fire Chief James O’Brien provided the following statement: “No objection from the Fire Dept” June 22, 2022 Committee on Ordinance & Rules 5 of 12 Chairman Ringius stated the Planning Board has made a vote for favorable action from them which thus puts it before the Ordinance & Rules Committee. They did make some planning board recommendation proposed text amendments which included: Planning Board Recommendation Member Kroha makes a positive MOTION to the Town Council that the Text Amendment be approved, with notes on what other communities do, with the definition clarified as “non-retail establishment” and adding a proposed Section 135-1805 to include an appropriate residential buffer; seconded by Member Kent; 4:1:0 (Member Grove was opposed). Director SantucciRozzi clarifies that Member Kroha is referencing a “residential use” offset would be more protective, and the Director details the difference for Member Connolly. Member Grove MOTIONS to close the Public Hearing; seconded by Member Kent; 5:0:0. NOTE: Based on the Planning Board recommendation the proposed text Amendment be revised as follows: 1. Add Section 135-1805n No Property containing a Marijuana Establishment shall be located within 100 Ft. of any property that contains a residential use. The 100 Ft. distance shall be measured from the Property line(s) in all cases. 2. Add Section 135-1805o No property containing a Marijuana Establishment shall be located within ½ Mile of any property that contains a Marijuana Establishment. The ½ Mile distance shall be measured from the Property line(s) in all cases. 3. Modify Proposed Definition (by adding in the words Non-Retail before Marijuana Establishment) ** Proposed: NON-RETAIL MARIJUANA ESTABLISHMENT: A Marijuana Cultivator, Craft Marijuana Cooperative, Marijuana Product Manufacturer, Marijuana Microbusiness, Marijuana Delivery Operator, Marijuana Independent Testing Laboratory, Marijuana Research Facility, Marijuana Transporter, or any other type of licensed marijuana-related business, excluding marijuana retailers and social consumption establishments. **Any place in the text where MARIJUANA ESTABLISHMENT is used as a defined term shall be modified to include the words NON-RETAIL before it. PUBLIC COMMENTS: Dan Clifford, 265 Saint Claire Street, former Town Councilor for 10 years. The reason I am here is to ask you suspend the 4-minute rule for speakers. Chairman Ringius stated respectfully we have about 30 people who have signed up to speak. We will maintain the 4-minute limit. There will be additional time to be recognized for a second time after everyone has been recognized for a first time. Note: you are always free to reach out to your Councilors. June 22, 2022 Committee on Ordinance & Rules 6 of 12 Chairman Ringius stated there is no final vote being taken tonight. Jane O’Brien, 130 Franklin Street stated I am opposed to all of this. We are talking about drugs… I am disgusted. Taking revenue is taking dirty money. Paul O’Brien, 130 Franklin Street stated it seems we already demonized the retail store but Braintree shouldn’t supply all the surrounding communities. I would rather make our money somewhere else. Paul Pasmiocus, 17 Allen Street stated I am conflicted about this because generally speaking I am pro- business but I must express my opposition to this. People of Braintree have already spoken and the zoning does not permit that. Why are we going out of our way to change the existing zoning. There must be other uses for the property. It seems these 200 jobs will be part time jobs. My other concern is the optics of this. I have worked in the recovery field for over 12 years. Every kid in Braintree will be talking about that weed place. James Miller, 55 French Avenue stated my main concern is the proposed location which is directly behind my home. According to google maps the distance from my backyard to the proposed building is less than 200 feet. For reference the distance between the front of town hall and the library is 223 feet. My biggest concern is the odor and air quality and long-term health impacts… who will monitor emissions and ensure they are consistently at safe levels. If not enough research has been done I feel the town should gather more information especially regarding air quality and public health before we change an ordinance. Dan Dunn, 31 Washington Park Road stated I want to speak in favor of this proposal. I feel the jobs and the income can greatly benefit the town and possibly lower property taxes. We already host Total Wine and Breweries in town. I have been an RN for almost 40 years. I have never had a problem giving Narcan to anyone on marijuana, but I have on opioids. I’ve had some highly addicted alcoholics and had to treat them. It would be discriminatory to not allow a legitimate legal business that could benefit this town. I am in favor of this. Edward Marks, 61 French Avenue stated I am an abutter to the proposed facility. My concern is what type of odor will be sent into the atmosphere. T. Denise Brown, 195 Elm Street stated I am a parent with a child in the middle school and a woman of color. I am opposed to this. I have found out my son was vaping at the middle school and volunteered by town to go into the school and be another set of eyes… It is about the message you will send… It’s not good for our youth here in Braintree or anywhere else. Ryan Lovara, 55 Kelly Drive stated I am for the measure largely because the town does need significant revenue opportunities. We need to balance the risks on what is coming to the community but I think its being done in a very well regulated manner. June 22, 2022 Committee on Ordinance & Rules 7 of 12 Dan Clifford, 265 Saint Claire Street, former Town Councilor for 10 years stated there have been votes on recreational marijuana in the past and resolutions signed by Town Council in the past. I have 21 files with me from state police, and state officials, who have all opposed recreational marijuana. In 2016 Question 4 on a state-wide referendum ballot was rejected by Braintree that no recreational marijuana. This has nothing to do with medical marijuana. Medical marijuana stands alone. In 2016 our Town Council signed a resolution. As Town Councilors you are to support your constituents. Every district except for district 3 opposed it. Put it back on the ballot. Jill Coyle, District 1 resident stated in an email dated June 20, 2022: To the Members of the Town Council and the Ordinance & Rules Committee: I am writing to express my concern regarding a non-medical marijuana manufacturing facility proposed on the Ivory Street corridor. The project has yet to be submitted to the Planning Board, however, the needed zoning changes to make this project a reality are before the Council. I, personally, do not have concerns over the proposed project but do have great concern over the approval process currently unfolding. Based on the history of the marijuana business, specifically in Braintree, I feel it is disingenuous for the Town Council to make this decision unilaterally when the initial decisions for adoption of marijuana uses was based on a ballot question to the residents of Braintree, which failed. I feel that the Council is circumventing their own constituents by not allowing this issue to be placed on a ballot as it was in the past. The residents have been extremely concerned about transparency in town government and this is one example of residents being removed from the process for a decision that will affect them and their town. I hope that you will consider doing what is right for the residents. I also ask that if this is placed on the ballot, that you ensure that it does NOT allow retail sales as that is the main reason many do not object to what is currently being proposed. Thank you. Jill Coyle, District 1 Michael Higgins, Brookside Road – email dated June 22, 2022 Hello All, Thank you to a few of our Town Councilors posting information about a proposed marijuana factory on Ivory St. Thank you for that transparency. Regarding the news of a marijuana factory on Ivory St, I recall the voters of Braintree decided by a ballot referundum question in 2016 that there would be no marijuana manufacturing, distribution, wholesale, or retail commercial activity located in Braintree. The sudden news of such a proposed business in Braintree runs counter to what the voters of Braintree wanted and voted for. I certainly do not want this vote to be over-ridden by anyone, other than the voters of Braintree. If Braintree wants such business activity in Braintree, let the voters of Braintree decide this by putting another referendum question on this November's ballot. A committee or any body of 9 should not decide this. You, the Town Council DID NOT CAMPAIGN on breaking the will of the voters. Do this responsibly and let the town voters decide this. Thanks to a retired Town Councilor, this voting result was made avail to me. In 2016 by a margin of 54% (NO) to 46% (YES), (referendum question #4), Braintree Residents voted NO June 22, 2022 Committee on Ordinance & Rules 8 of 12 to Recreational Marijuana businesses!! 20,000 Braintree voters cast their vote. The NO vote was substantial with 11,000 voting NO compared to 9,000 who voted YES! An 8% margin. Sincerely, Michael Higgins, Brookside Road James Donoghue, 261 Old Country Way stated I worked for various agencies one of which is the Cannabis Control Commission in the Department of Public Health Medical Marijuana Program. I’ve seen and opened a lot of these facilities. In 2016 I voted no. I am shocked the Town Council will try to overturn this vote. It should be back on the ballot. The facility here is inappropriate for this location. You will get odors. The Braintree Baseball Club is right next door probably less than 100 feet away where kids go in for batting practice. They are going for adult use license, cultivating license and delivery license. They are going to grow, process and deliver. There are 25 bay doors out back. Traffic will be bad with the facility. John Mahoney, 463 Pawn Street stated I recommend this be allowed. The town can use the money. I do not know anyone with marijuana problems. If you don’t allow it it is discrimination. I believe it is a good thing for the town. Pat Melkarin 12 Ellery Street stated I speak in favor and I represent 2300 union plumbers that work in the area. The Town of Braintree is in a tough way revenue wise. This is sustainable to continue to bring money to the town. Nick Bickerton 121 West Street stated I am in favor. Matthew Joy 174 Middle Street stated I am in favor of approving this. Tom Killowan, Charleton Avenue stated anything that is going to bring down our taxes I am totally in favor of. If Police, Fire and Town Council are in favor I totally support it. Mike Higgins stated I would like to reiterate the voters voted no on this in 2016. I don’t remember any Town Councilors campaigning to undermine that vote. If the town wants this put it on the ballot. Jeff Saliba speaking on behalf of Eddie Saliba. He thinks the building will not be noticed. Why would we give up that tax revenue. He is in favor of the zoning change. Peter Thompson, 269 Peach Street stated I called each Councilor and one called me back. I am prejudice to this and lost a son to addiction. Do the right thing like before and voted no… Dave Ricca, 49 Sterling Street stated I am interested in the environmental impact and release of chemical pollutants. Mike Ford, Cardinal Court stated I work for BELD and speak with a number of companies wanting to come into town. This company is one of the most professional I have ever dealt with. It is a good proposal. I do stand in favor of this. The redevelopment of that area is a positive thing. June 22, 2022 Committee on Ordinance & Rules 9 of 12 TEXT Messages received during the meeting: Tom Grogan stated what is the plan to deal with wastewater? Where will it go? Who will be tasked with oversight of this issue in the town? I ask this as someone who has worked for multistate operators, as well as craft operators in Maine who has witnessed it dumped out the back door several times. This is a 100k sq ft facility, and the issues regarding this question in my mind, are more relevant to if an indoor industrial farm were to open in the town. Dom Scopa stated I am strongly in favor of rezoning in order to build medical marijuana research facility. Bob Rizzi stated I stand in total support of this project and we have opposed many projects as you know. This is a legal medical product substance controlled by the commission, it affords many jobs. And revenue to the town, the police support it, and fire. The revenue alone is substantial. And the 5,800 trades people in Braintree are in favor. Eddie Saliba I am in favor of the zoning change. I believe the town could most benefit from the additional revenue. I live with muscle dystrophy and believe the extra tax revenue should be used to fix the sidewalks. I also believe the facility as is now is an eyesore. Chairman Ringius stated we will now go back to our in-person comments: Louis Christian, 59 Dividend Street, Chelsea stated I had a chance to review the building and will work and the odor can be controlled within the environment. The ventilators can control the odor and we can control how odor would escape from the 5 doorways. John Mullaney, Herbert Road, former District 2 Town Councilor. I speak in favor of this motion. I have been in favor of cleaning up eyesores. I consider putting people to work. I chaired the committee that told me that Dave&Buster’s was terrible and it would bring down Braintree. I like to think after all these years it was the right decision. We cleaned up an old building. I am a strong supporter of unions. I hate to see anyone laid off. I would like to see some of these monies used to secure the prevention of children drinking/drugs while on town premises. I’d like you to collect the money, put people to work and beautify the building. Juliana Melchionda, 1074 Washington Street, stated you heard my opposition as a member of the Board of Health. I now speak as a resident and on behalf of my father Bob Melchionda. I am a nurse and come across oncology patients who use marijuana for their benefit. It is amazing the benefits to these patients. These patients don’t want this in their town. I would not want kids to be exposed to such an industry at such a young age. I do believe there could be a lot of other establishments that could go in this spot. Myself and my father do oppose this. June 22, 2022 Committee on Ordinance & Rules 10 of 12 Mary Grogan, 72 Columbus Avenue, mother of Tom Grogan who sent in a text message. What is the plan for the wastewater. Where will these hundreds of thousands of gallons of water per day be going. Most of these jobs will pay under $20 per hour, how are these good employment opportunities for a town where studio apartments that cost $1800 per month go. Mary Grogan stated my understanding that the money we make for the town would be the equivalent of about $110 per person. Personally, my family will donate that amount to the town. I think others would too. I would pay the $110, I have no problem with that. Dan Clifford, Saint Claire Street for the second time. We have heard a lot of speakers, emotions on their opinions. Where are the experts. There are people here that may have conflicts of interest and have spoken for it. This committee needs to bring experts to be heard and not just the general public with their feelings. Alternatively, to that put it back on the ballot and let your constituents speak to it. Mike Ford, Cardinal Court stated I came here as a representative of BELD and a resident. There is no conflict of interest. We work to make sure buildings are not left empty. I stand for this both as a resident and an employee of BELD. Jim Donoghue, Old Country Way stated you really do need to look at the licenses they are applying for. A cultivation license is allowed to transport cannabis. There will be trucks filled with flower and other deliveries as well. There are a lot of questions like what is the impact on the sewer system and water supply. This is a huge facility and does not belong in a densely populated area such as this. Peter Thompson, for the second time stated above Bertucci’s there is a new facility opening with a 12- step addiction program. We are going backwards to take money. Don’t do it. You can’t fix this. We just need to leave it better than we found it. This town voted no. Lisa Fiske-Heger, Chairwoman of the Braintree School Committee in a Text Message stated I can’t make the public meeting tonight about the potential ordinance change for cannabis cultivation. I support the change. I watched the meeting on June 1st. As we know the revenue potential is substantial. Braintree is in need of additional revenue sources. The Braintree Public Schools could use additional funding. Marijuana is legal in the state of Massachusetts. Dru Ledbetter stated thank you to the residents of Braintree. Our position is always to work with the municipality. We will have full-time jobs and first right will go to residents of Braintree. We will not have testing. It would create a conflict of interest. In terms of transport, we would only have about 5 harvests a year which would mean only about 5 times a year would we be able to transport wholesale products to other businesses. Only about $10,000 of marijuana is allowed to be transported at a time. They are typically like the armored trucks. There is a lot of new technology to mitigate the impact of the environment and the surrounding communities. In terms of emission and odor we are very committed to ensuring that we have the best technology and the best systems. Our plan is to be really good neighbors. June 22, 2022 Committee on Ordinance & Rules 11 of 12 A security expert who works with the FlowerXpress team stated I have done over 50 dispensaries and 15 cultivation sites. My company is Citronic Security. We are up and down the east coast. We design, install and monitor them and service them. I work closely with the police departments in the town where my customers are as well as town officials and state police. There is a lot of security protection. We do not want to give our design to the public but I can answer any questions. We do remote viewing along with the police department. The vehicles have video on them at all times as well. Denise Brown stated I do not want my message to get lost. I am thinking about the youth of Braintree and the message that is getting out. We don’t want the message to be that this is ok. We can find other ways to bring that revenue into the town. Dan Dunn, 31 Washington Park Road stated I we tried prohibition in the past, it didn’t work. This is going to be regulated. I sympathize with anyone who had a tragedy with drugs or alcohol. We do have to do everything we can to protect our children. This facility will benefit the town and I fully support it. Joann McCarthy stated I have lived here since 1993 and didn’t know about the Carter Rice building. There must be other kinds of businesses that can go into that building and our town. I don’t like to be a gateway to dispense drugs. Chairman Ringius thanked everyone for coming out tonight. We will continue to seek out your opinion.
