Tuesday, June 6, 2023
A meeting of the Committee of Ways & Means was held in Johnson Chambers on Tuesday, June 6, 2023 at
6:00pm.
Councilor Reynolds was in the Chair.
Clerk of the Council, Susan Cimino conducted the roll call.

• 23 029 Mayor: Establishment of New Revolving Fund for Tree Replacement or take up any action
relative thereto

Noted: Per legal, the language for the tree enterprise fund must denote the Mayor as the sponsor. It is
not a substantive edit so has no effect. (Not Council President Boericke)
Chairman Reynolds asked if anyone would like to speak on Order 23 029.
President Boericke was in attendance to explain the new revolving fund and stating this is part of our Tree
Protection Ordinance we voted in Council on April 25, 2023. There are 3 components to this Ordinance.
First was the Tree Ordinance which we voted. This is the second item which is to set up a revolving
account which will pay for replacement trees. The third component will be to incentivize large-scale
developers through the site plan review process which will eventually be funding this tree replacement
fund.
General Ordinance 3.140.00 – Departmental Revolving Funds
Amend 3.140.050 Authorized Revolving Funds to include new subsection J. as set forth below:
J. Tree Replacement Revolving Fund
(1) Fund Name: Tree Replacement
(2) Revenues: The Town Accountant shall establish the Tree Replacement Revolving
Fund as a separate account and credit to the fund all permit fees, and payment in
lieu of replacement fees received under General Ordinance 12.30, as well as fees
received under Zoning Ordinance §135-711(as amended).
(3) Purpose and Expenditures: During each fiscal year, the Mayor, in conjunction with
the Director of Public Works, may incur liabilities against and spend monies from
the Tree Replacement Revolving Fund for the payment of salaries, expenses and
contractual services associated with the Tree Replacement Revolving Fund.
(4) Fiscal Years: The Tree Replacement Revolving Fund shall operate for fiscal years
that begin on or after July 1, 2023.

Motion: To amend municipal code 3.140.050 to include subsection J establishing the Tree Replacement
Revolving Fund.

Motion: That, in accordance with the provisions of chapter 44, section 53e1/2 of the General Laws, the
Town of Braintree hereby sets the maximum amount that may be spent during fiscal year 2024 beginning
July 1, 2023 for the Tree Replacement Revolving Fund as $100,000.

Chairman Reynolds asked if anyone would like to speak on Order 23 035.
Cindy DePina, HR Director stated this is for the raises we negotiated with the Fire Department. This is the
Fiscal Year 23 1.5% annual cost of living increase.
This is not a new request for money. We had this set aside and the Council needs to authorize moving it
from one bucket to another bucket.
Chairman Reynolds asked if any Committee members would like to speak on Order 23 035.

Motion read by Councilor Flaherty for Favorable Recommendation to the full Council:
MOTION: That the Town vote to amend the wage and salary classification schedules, as most recently
amended by appropriating the sum of $115,378.90 for the purpose of funding a wage increase for the
IAFF 920 employees effective July 1, 2022, and for this purpose the sum of $115,378.90 be transferred
from the FY 2023 Salary Reserve Article and further, that the Director of Municipal Finance is authorized
to allocate said sums to and among the various accounts affected thereby in such amounts as are proper
and required. In anticipation of approval of these agreements, funds were appropriated to the reserve
account in the originally approved Fiscal Year 2023 budget.

Union .5% COLA) or take up any action relative thereto
Chairman Reynolds asked if anyone would like to speak on Order 23 036.
Cindy DePina, HR Director stated this is for the .5%. We settled with other unions and this is the “me too”
clause so unions are not penalized for settling earlier. This is the ½ percent we gave to fire, schools and
library.

MOTION: That the Town vote to amend the wage and salary classification schedules, as most recently
amended by appropriating the sum of $6,059.18 for the purpose of funding a wage increase for the Utility
Workers Union of America, AFL-CIO, Local No. 466 (UWUA) employees effective July 1 2022, and for this
purpose the sum of $6,059.18 be transferred from the Human Resources Salary Reserve Article and
further, that the Director of Municipal Finance is authorized to allocate said sums to and among the
various accounts affected thereby in such amounts as are proper and required.

the Human Resources Salary Reserve Article and further, that the Director of Municipal Finance is
authorized to allocate said sums to and among the various accounts affected thereby in such amounts as
are proper and required.

Cindy DePina, HR Director stated this is for FY23 for the schools. We have settled at 1.5%.

amended by appropriating the sum of $930,871.09 for the purpose of funding a wage increase for the
Braintree Educator employees effective July 1, 2022, and for this purpose the sum of $930,871.09 be
transferred from the Human Resources Salary Reserve Article and further, that the Director of Municipal
Finance is authorized to allocate said sums to and among the various accounts affected thereby in such
amounts as are proper and required.

Chairman Reynolds asked if anyone would like to speak on Order 23 039.
Cindy DePina, HR Director stated this is for FY24. We are trying to plan ahead for calculations for July 1.
This is for Utility, Non-Union, Fire. The other departments we settled with had time to budget it for FY24
so that is why they are not all listed.

MOTION: That the Town vote to amend the wage and salary classification schedules, as most recently
amended by appropriating the sum of $24,357.92 for the purpose of funding a wage increase for the
Utility Workers Union of America, AFL-CIO, Local No. 466 (UWUA) employees effective July 1, 2023, and
for this purpose the sum of $24,357.92 be transferred from the Finance/Administration/Reserve Account

and further, that the Director of Municipal Finance is authorized to allocate said sums to and among the
various accounts affected thereby in such amounts as are proper and required.

MOTION: That the Town vote to amend the wage and salary classification schedules, as most recently
amended by appropriating the sum of $156,146.11 for the purpose of funding a wage increase for the
International Association of Fire Fighters, Local 920 (IAFF) employees effective July 1, 2023, and for this
purpose the sum of $156,146.11 be transferred from the Finance/Administration/Reserve Account and
further, that the Director of Municipal Finance is authorized to allocate said sums to and among the
various accounts affected thereby in such amounts as are proper and required.

Union employees effective July 1, 2023, and for this purpose the sum of $64,878.39 be transferred from
the Finance/Administration/Reserve Account and further, that the Director of Municipal Finance is
authorized to allocate said sums to and among the various accounts affected thereby in such amounts as
are proper and required.

Cindy DePina explained the Mayor is asking for a favorable recommendation on this appointment.

MOTION: Upon the request of his honor, the Mayor, the Town of Braintree, through the Braintree Town
Council, and in accordance with sections 3-3 of the Charter of the Town of Braintree to approve the re-
appointment of Frank Collins to the Weymouth Braintree Regional Conservation District.
Motion: by Councilor Flaherty to approve Order 23 038
