APPROVAL OF AGENDA Motion: Council Member Jennifer Kravassi to approve the agenda, second by Victor Olano The Agenda was approved unanimously with addition of: - Street Signs - Payment of CDC- Under Old business - Proposal of Complus- Under old business - Correction of next Meeting will be made from January 20, 2015 to February 3th, 2915 - Purchase orders- Under Treasurer Report - Signal bus shelter agreement photos- Under Treasurer Report PUBLIC INPUT / COMMENTS : COMMENT: GINA MORTAN Upshur St Questions & Observations: Accounts payable Schedule Recreation Landscape and Maintenance Open space project and should be reflected under 5-9350? Revenue Insurance premiums are now double from 8,000 to 14,000 why? Who reviews transfers and bank statements? Also the $1000.00 settlements check from our insurance company why does the town have that claim. Agenda items for executive meetings should be given not what were discuses. Website is very important and 19,000 was for webpage development, and we get an interactive website, taking freeing time for the staff here and I(resident) hope that the town moves forward with it. RESPONSE: N/A 1 Council of the Town of Brentwood Town Hall, Brentwood, Maryland Council Meeting COMMENT: CHRISTIAN KELLEHER 3901 Perry St Mr. Kelleher brought pictures for council. #1 is the front of the building; his company is trying to restore the building. Martha sited him for a dumpster that was kept in with in city other picture shows the dumpster in front of the building but citizen wishes it to be kept there in the back for an indefinite time period. Mr. Kelleher came to ask for exemption to keep it by the railroad track and not in front of the business. It’s a value for the city that it be held in the back and if fine was reasonable they would be willing to pay a fee so that it could be at the end of the street as a permanent measure and dumped out about once a month. This leads to another problem of the dumpster being emptied. RESPONSE: Council Member Olano suggests taking a look for a permanent solution that is not a dumpster on an empty parking lot. Town Administrator George Denny mentioned it is a long dumpster much larger and that there is no authorization for it. Gateway Art Center complains that it takes two parking spaces. Once building project is completed there will be more shortage and he will need permission since it is not authorized however it does not affect emergency or maintenance. Vice Mayor Kravassi asked if they have talked to Gateway, Mr. Keller responded that he has not, and half of the dumpster is in the weed half is in the parking lot. Only takes up one space. Council Member Murphy mentioned that to make one exception would open the door to other exception. Vice Mayor Kravassi asked about the possibility of making the dumpster smaller so it only uses one space. However Mayor Treminio-Lopez is concerned that once the demolition begins traffic will pick up as well as the use of more dumpsters. Council will look at it further in other to be fair to everyone and will get back to him. COMMENT: JEFF CLARK Perry St Commented on Mr. Kelleher’s comment, suggesting the council to schedule a hearing for the first meeting of February, February 3, 2015. Ordinance does call for hearing in the newsletter or the hearing will have to be in March in order to pass an exception. Resident would also like the agenda sooner or switch to having the minutes discussed before the meeting and asked that the council discuss the creation of the finance committee, and even post something in the newsletter. This was passed as a resolution. Actions as of late have not been placed in the newsletter and he would like that again for transparency. As far as the website posting things to the website should the responsibility of the staff, each can post their own items to the website. RESPONSE: N/A COMMENT: RON BRETEMPS Perry St In regards to the dumpster publics work committee has looked at that block to increase parking for Gateway and increasing parking. The committee will be revisiting the subject and will report back to the council and would like to suggest that it is scheduled for the second meeting of the month. Parking Spaces available at Town Hall are not enough, why there is no parking. RESPONSE: N/A COMMENT: BARBARA HOUSE 38th Street Letter read by Town Clerk RESPONCE: Mayor mentioned that we need to be considerate of senior citizens, this doesn’t mean she is exempt but we must consider and it might be important to identify these people and some way of helping them. Vice Mayor Kravassi and Council Member Barnett received a warning as well, and he mentions that we need to try to find a way to help senior citizens and will look into it. In this case Code Enforcement was consistent and was not picking on any one person. Council Member Olano says that Council of the Town of Brentwood Town Hall, Brentwood, Maryland Council Meeting the letter reminds us so that we are safe and no liability fall on the resident. Mr. Denny letter is just a warning so clarification is that it is not a punitive thing not a violation but a warning. Council Member Murphy mentions that the points brought up have been good and need to look out of the box. Call for help could be something for website. MINUTES : - January 7, 2015 Motion to approve made by Council Member Jennifer Murphy, seconded by Vice Mayor Jason Barnett. Approved unopposed. TREASURERS REPORT: - CASH ON HAND REPORT (DECEMBER)- Shows beginning balance and credits and withdraws and ending balances. 2,966.00 for credit card payment to BB&T, out of convenience it is paid online from BB&T -Public Safety and then money is placed back from Suntrust -General Account. Paying by check causes late fees. August was when credit card was created and policy was presented, and council approved a 10,000.00 limit. BB&T does not charge an interest. Expense of Kellies Performance 150.00 has no receipt and or documentation Treasurer would like to pay all bills with exception of Kellies Performance. Mayor noted too much access of Credit Card, it should have been signed out and there need to be record of all usage. Council will discuss later how to handled payments made to the Credit Card. With the idea of changing the process to make the payments attached to the General funds thus cutting the card from BB&T and moved to SunTrust to be attached to General funds. Mayor suggest to moving back to checks Motion to Approve Cash on hand report by CM Barnett seconded by CM Kravassi. Approved unopposed. - REVENUE AND EXPENSES REPORT-Over the budget for the month, but next month we will be getting more revenue. Council Member Murphy mentioned that things are not lining up from November to December. Approved Dec 4th 2014 small items where approved by the Mayor and then larger items where approved. Mayor has requested that we get the schedule every meeting even as bills arrive. Council Member Murphy would like to have a schedule of everything to avoid confusion. Previous Mayor had the practice that 500.00 could be approved to be paid, but now clarification has been made that this is not the case. Purchase approval can be done but all on the council must approve payment. This will change going forward. Acting Town Administrator George Denny says that to bring something like items not matching up should not be done in the meeting this is not the place for questions such as those asked by Council Member Murphy. Council Member Murphy responded that because questions emailed had not been answered she must take up time at council meeting. Treasurer suggests future meeting with Mayor Council of the Town of Brentwood Town Hall, Brentwood, Maryland Council Meeting and CM Murphy to aid answer questions for Council Member Murphy. Expenses are not recorded till checks are cut and cleared (Line Item 5-1155 $379.99 was in question in this instance). Motion by Council Member Jennifer Kravassi to approve Revenue and Expenses report for month of December, Seconded by Council Member Jason Barnett abstained by Mayor yes by Olano and rejected by all others - BREKFORD POLICE CRUISER MARK-UP- price went down with PD reviewing the orders and the markings for PD vehicle approved for $1500 but invoice $1700 with purchase and new markings cost be paid from the Public Safety. The vehicle that costs more will be already be wired for emergency equipment. Motion to approve the $25,899 to purchase the 2015 Ford Police Interceptor made by CM Jennifer Murphy. Funds to be taken from budget line item 5-4295. Police Department New Vehicle transferred from Public Safety Account $30,000 will be transferred from budget line items 5-4200 and 5-4280 seconded by CM Jennifer Kravassi. Approved unopposed. SUSPEND for clarification by Mayor Treminio-Lopez rules and reinstated SIDE NOTE : (NINA YOUNG) Public safety BB&T are restricted funds that come from the speed camera with a specific amount dedicated to public safety. From this account $297,000 was moved to be used for Public Safety Services. Anything not used is rolled over to the next FY. Motion to pay for old marking from line 5-4280 and transfer $1750.00 from 5-4010. Invoice# 14059S from public safety checking account by Vice Mayor Kravassi seconded by Barnett. Abstained by Mayor and Council Member Olnao but all other voted yes. Passed 3 to 2. Motion to purchase vehicle not to exceed $26,000 from line 5-4295 Seconded by Jason Barnett. Approved unopposed. SIDE NOTE : Sargent mentioned that we will need to consider getting another vehicle due to having new hires treasurer suggest getting another vehicle now for the deal on the table since the public safety. - SAPP ANNUAL REPORT: States the award by the state for Police Protection. Previously there was transfer of funds from Public Safety to General expenses that needs to be reimbursed to the General Fund. - JANUARY (INTERIM) A/P SCHEDULE AND BILLS: All bills this far from 1st -13th of January 2015 have been submitted and will be received again before next meeting. Council Member Jennifer Murphy needs the report to be cleared up with transfers being made and recorded to create clarity. Move to approve the January A/P Interim and bills by Vice Mayo Kravassi to pay $28,922.38 removing items that need transferred Seconded by Jason Barnett. Approved unopposed Council of the Town of Brentwood Town Hall, Brentwood, Maryland Council Meeting - ESTEMATED HIGHTWAY USER REVENUE FY 2016: Letter from H.A.S. and have adjusted the amounts estimated for $18,772.46 to $19,069.77 - AUDIT CORRECTIVE ACTIONS STATUS: Following Council Member Victor Olano’s suggestion an additional schedule has been created, giving end dates and notes with attachment of who is responsible for what. - AUCTION OF F250 4x4: Maintenance department has towed it and has to be publicly auctioned and set by govdeals.com as well as newsletter for all residents. Mentioned that anything that need to be audited it can be placed with govdeals.com. - Purchase order for Signal plus center agreement: Larger trash cans have been installed - Purchase order for police department for mock turtle necks and trauma pack and outer carrier as well as sirens and outer carrier. Motion to approve purchase order #4346 for $36.49 and #4349 of $1166.91 from A-1 Uniforms (budget line item 5-4180) by Council Member Jennifer Murphy. Second Council Member Barnett Approved. Approved unopposed. Motion to approve purchase order #4345 for $1067.26 from Commercial Safety Services, LLC (budget line item 5-4280) by Council Member Murphy second by Vice Mayor Kravassi Approved unopposed. Code Enforcement Report: Report given by Town Administrator George Denny Motion to accept Town Administrator Report made by Vice Mayor Kravassi. Seconded by Council Member Murphy. Council Member Victor Olano proposes clarifying the definition of a vacant home. Police Department Report: - Brentwood is determined by time of day and we were not completely operational till second week of December. - Will be hiring another full time officer and will need about getting a new vehicle Mayor suggested to continue the activity log so that we can see what each officer did. Moved to accept Code and Police Report by Vice Mayor Jennifer Kravassi motion for report Murphy second. All in favor. Town Administrator Rep ort - 2 out of 39 applicants have responded and two more applicants have come in today interviews will begin to be set after January 26, 2015 - Landex send a letter letting then know there will be disruption - Website is down - Two residents have shown interest so far we will have till Friday - Golf cart has been designated surplus will be added to action. Murphy to pay Stuart with Hyattsville CDC of 9500 to close PY34 in discussion. Kravassi seconded and approved to be paid. ComPlus very detailed and has requirements and is has monthly fee and is required to look at the contract. Mayor mentioned that it is good for when we have more officers online. Mayor pushed to permit parking since the new construction will mean that there will be more parking citations. Officer Bragg was on hold for MVA moving toward getting the vehicles flagged and will be discussed later Will be reviewed NEW BUSINESS : - STATE HIGH WAY ADMINISTRATION- Motion to approve the use of town hall on open date in March Thursday or Wednesday for SHA by CM Kravassi seconded by CM Murphy. All in favor. - Signs for 6 stop signs 4 street name signs and hardware $687.64. Another sign needs to be added. Line item 5-8025. Approved signs not more than $780. For 5-8025 by k seconded by Barnett all in favor. Listed below are the Town Council's procedures. Presiding Officer The Presiding Officer of the Council is responsible for conducting the meeting. When present and participating, the Mayor shall serve as presiding officer. When the Mayor is not present or if the mayor abstains from participation on a matter, the Vice Mayor shall serve as the presiding officer. If neither the Mayor nor the Vice Mayor is able to serve, the remaining Council Members may designate a Member of the Council to preside over the meeting. Publics Participation in Town Council Meetings (1) In accordance with the terms of the Maryland Open Meetings Act all meetings of the Town Council shall be open to the public unless the Council is in Executive Session or State law otherwise allows a meeting to be closed. (2) At the Town Council's discretion, the Council may permit a person to address the Council concerning an item on the agenda or to present a subject for the Council's consideration during the Public Comment period. (3) Persons wishing to make public comments shall abide by the following rules: (a) When recognized by the Presiding Officer, the speaker should approach the podium, state his/her name and address for the record, and, if speaking on behalf of an organization or other group, identify the group represented. (b) Only one person may address the Council at any one time. (c) Speakers must limit presentations to matters within the Town's subject matter jurisdiction. (d) Speakers should address all remarks to the Town Council as a whole, not to individual members or to the audience. (e) Speakers should limit their presentations to no more than three (3) minutes each. There shall be no substitutions or pooling of speakers. (f) The Presiding Officer may encourage speakers to not merely repeat views expressed by others. (g) Once all comments have been heard, Council will begin their discussion on the item. (h) Any point during the meeting, the Town Council may opt to limit the number of speakers on a particular topic or topics not yet reached. (i) In compliance with the Open Meetings Act, the Council shall not deliberate or vote on a matter not appearing on the agenda (non-agenda items), except for purposes of presenting statements of current fact or policy or for determining whether the matter should appear on a future Agenda. (j) Engaging in verbal comments intended to insult or slander anyone may be cause for termination of speaking privileges and/or removal from the Council Chambers.
