Village Board of Trustees Regular Meeting July 9, 2019 7:30 p.m. The Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held in the Village of Briarcliff Manor at the William J. Vescio Community Center, at 1 Library Road, Briarcliff Manor, New York on the 9th of July, 2019 commencing at 7:30 p.m. Present Steven A. Vescio, Mayor Peter S. Chatzky, Deputy Mayor Cesare DeRose, Jr., Trustee Kevin Hunt, Trustee Edward E. Midgley, Trustee Also Present Philip Zegarelli, Village Manager Daniel Pozin, Village Attorney Christine Dennett, Village Clerk David Turiano, Village Engineer Edward Ritter, Village Treasurer Pledge of Allegiance Board of Trustees Announcements • The Library has many upcoming events and the Spring/Summer Brochure is available. Visit the website for more information. • The Pool and Tennis season is underway. Permits are required. • An acoustic series will be poolside on Sundays in the months of July and August. • The Recreation Spring/Summer Brochure is available. • Stay connected and sign up for weekly updates. • The Chamber of Commerce Concert Series begins July 11th. • A letter was sent to the New York State Department of Transportation to raise awareness of the Route 9A safety hazards. • The Ambulance and Fire Departments are always looking for volunteers. • The Historical Society is seeking volunteers. Village Managers Report by Village Manager Zegarelli • The Pocantico River Bridge is well underway. The first shut down is scheduled for tonight from 8pm-6am. 1 • Emails were sent to the State regarding the status of the railings over Route 100. • The Club was issued their Temporary Certificate of Occupancy Application. • The Lodge Room is available to be used by residents. • DPW has begun the façade repair work at the Library. • Taxes were due July 1st and penalties now apply. Public Comments There were no public comments. Legislative Update: B Zone Moratorium The Board recapped where they were individually in the review process of the documents and reports done by past Boards and Committees and stated they would go through the BZone Committee recommendations at the next meeting. Authorize Village Manager to Execute a Fire Protection Agreement with the Town of Mount Pleasant Upon motion by Trustee Hunt, seconded by Trustee DeRose, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the Village Manager is hereby authorized and directed to execute a Fire Protection Agreement with the Town of Mt. Pleasant for ambulance services to the Mount Pleasant West Ambulance District in the amount of $4,016 to expire on December 31, 2019 subject to non-material changes. Board Appointments and/or Execution of Contracts Re-appointment of Village Treasurer Upon motion by Mayor Vescio, seconded by Deputy Mayor Chatzky, the Board voted unanimously to approve the following resolution: BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby reappoints Edward Ritter as Village Treasurer for a term to expire on April 5, 2021. Cleary Consultant Agreement Upon motion by Deputy Mayor Chatzky, seconded by Trustee Midgley, the Board voted unanimously to approve the following resolution: 2 WHEREAS, by local law adopted on June 4, 2019, the Village Board imposed a temporary moratorium on the acceptance, processing and approval of applications in the Planned Office Building and Laboratory B District and Business Transitional BT district (the “B Zone”) of the Village to, among other things, allow the Village to undertake a more comprehensive and extensive review of the provisions of Chapter 220 of the Village Code and The Village of Briarcliff Manor Comprehensive Plan Addendum – B/BT District Recommendations, dated October 4, 2017, as amended, among other things, that may be necessary to address the needs of the Village pertaining to the B Zone, and WHEREAS, the Village wishes to engage Cleary Consulting to provide professional consulting services in connection with such review, and RESOLVED, that the Village Manager is hereby authorized to enter into a contract with Cleary Consulting for professional consulting services in connection with the said temporary moratorium based upon the June 3, 2019 proposal of Cleary Consulting subject to non-material changes deemed necessary by the Village Manager and Village Attorney. ZBA/Beautification Committee The Board thanked residents for their generous response to volunteerism in the Village. Upon motion by Mayor Vescio, seconded by Trustee DeRose, the Board voted unanimously to approve the following resolution: BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby makes the following appointments: Wayne Edwards as a Zoning Board of Appeals Member to fill the unexpired term of Brian Weinstein to expire on April 1, 2020. Conor Savage as the Zoning Board of Appeals Alternate Member for a term to expire on April 1, 2020. John O’Leary as the Chairman of the Beautification Committee for a term to expire on April 1, 2020. John O’Leary as a Member of the Beautification Committee for a term to expire on April 1, 2022. Jerry Moylan as a Member of the Beautification Committee for a term to expire on April 1, 2022. 3 Joannah Livingston as a Member of the Beautification Committee for a term to expire on April 1, 2022. Mary Moller as a Member of the Beautification Committee for a term to expire on April 1, 2022. Michele Hulea as a Member of the Beautification Committee for a term to expire on April 1, 2022. Budget Amendment: Library Repairs/Utilities Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the budget for fiscal year 2018-2019 is hereby amended as follows: LIBRARY UTILITY/GENERAL REPAIRS Increase Expense L7410.440 Electric Utility $2,059.37 Increase Revenue L0599 Fund Balance $2,059.37 Increase Expense L7410.211 General Repairs $161.15 Increase Revenue L0599 Fund Balance $161.55 Water Fund: Transite Water Main Replacement Upon motion by Trustee Hunt, seconded by Trustee DeRose, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the budget for fiscal year 2018-2019 is hereby amended as follows: WATER FUND Increase Expense F8340.460 Contractual Services $9,000.00 Increase Revenue F0599 Fund Balance $9,000.00 Acceptance of a Donation from the Friends of the Library The Board thanked the Friends for their gift and contribution to the Village. 4 Upon motion by Deputy Mayor Chatzky, seconded by Trustee Midgley, the Board voted unanimously to approve the following resolution: BE IT RESOLVED, that the Board of Trustees hereby accepts a donation in the amount of $600.00 from the Friends of the Library for the purposes of hosting a volunteer reception and square dance. Increase Revenue – Gifts (L0108.2705) by $600.00 Increase Expenses – Special Matching Expenses (L7410.206) by $600.00 Report on Proposed Legislation: Process and Procedures for Revised Parking Time and Signage The Board had general discussion regarding signage in the downtown district and requested legislation for the next meeting. Village Engineer Turiano suggested language to address prohibiting parking in shoulders of roadways. Minutes Upon motion by Trustee Hunt, seconded by Trustee DeRose, the Board voted unanimously to approve the minutes of June 18, 2019. Adjournment There will be a Regular Meeting on July 16, 2019 at 7:30pm with a Work Session preceding it at 5:30pm.
