Village Board of Trustees Regular Meeting September 24, 2019 7:30 p.m. The Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held in the Village of Briarcliff Manor at the William J. Vescio Community Center, at 1 Library Road, Briarcliff Manor, New York on the 24th of September, 2019 commencing at 7:30 p.m. Present Steven A. Vescio, Mayor Peter S. Chatzky, Deputy Mayor Cesare DeRose, Jr., Trustee Kevin Hunt, Trustee Edward E. Midgley, Trustee Also Present Philip Zegarelli, Village Manager Daniel Pozin, Village Attorney Christine Dennett, Village Clerk David Turiano, Village Engineer Absent Pledge of Allegiance Continued Public Hearing to amend the following Village Code Chapters: Chapter 157 - Peddling and Soliciting; Chapter 161 - Property Maintenance, and Chapter 207 - Vehicles and Traffic, and to add the following new Chapters: Chapter 138 - Littering and Handbills; and Chapter 124 - Film and Photography The Board agreed to separate out Chapter 161 – Property Maintenance from Omnibus 1. Upon motion by Trustee DeRose, seconded by Deputy Mayor Chatzky, the Board voted unanimously to close the public hearing for Chapter 157 - Peddling and Soliciting; and Chapter 207 - Vehicles and Traffic, and to add the following new Chapters: Chapter 138 - Littering and Handbills; and Chapter 124 - Film and Photography. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Midgley, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the proposed Local Law to amend the following Village Code Chapters: Chapter 157 - Peddling and Soliciting; and Chapter 207 - 1 Vehicles and Traffic, and to add the following new Chapters: Chapter 138 - Littering and Handbills; and Chapter 124 - Film and Photography of the Code of the Village of Briarcliff Manor to is hereby adopted. Upon motion by Trustee Hunt, seconded by Deputy Mayor Chatzky, the Board voted unanimously to adjourn the Public Hearing for Chapter 161 – Property Maintenance to October 10, 2019. Public Hearing to Amend the Following Village Code Chapters: Chapter 220-8 - Tennis Courts; Chapter 220-9 - Swimming Pools; Chapter 220-17G Zoning Board of Appeals Notifications and Chapter 45-1 and Chapter 45-2 Planning Board Notifications and to add the following new Chapter 126 – Fireworks The Board stated the amendments were to address quality of life issues. Upon motion by Trustee Hunt, seconded by Trustee DeRose, the Board voted unanimously to adjourn the Public Hearing to October 10, 2019. Public Hearing to amend Chapter 146 – Noise of the Village Code Mr. Bruce Yeager of 450 Central Drive requested the Board add restrictions to large commercial projects in the Village to preclude working on weekends. Upon motion by Trustee DeRose, seconded by Deputy Mayor Chatzky, the Board voted unanimously to adjourn the Public Hearing to October 10, 2019. Board of Trustees Announcements  The Fire Department offered tips to prevent scalding.  The Library and Community Center has several upcoming programs and events. Please visit their website for further information.  The Recreation Advisory Committee will be holding their annual public meeting on September 25th.  Halloween Window Painting will be on October 19th.  The Ragamuffin Parade will be on October 26th.  Sign up for all Village News and stay informed.  The Board welcomed the Briarcliff Baking Company to the Village.  A letter of resignation was received by Village Treasurer Edward Ritter. The Board thanked him for his service and wished him luck. Village Managers Report by Village Manager Zegarelli  The Town of Ossining is doing a reappraisal project to refine their data. There’s a video on their website explaining the project.  The Pocantico River Bridge is progressing. 2  Pond Dredging has begun.  The DOT will meet with the Village to discuss the Route 100/9A bridge repairs.  The Club has its first occupants and the second TCO will be submitted. Remaining plantings will be done shortly.  The next meeting of the Board of Trustees will be on October 10th. Mayor Vescio requested the County be put on notice regarding the deficiencies in the sidewalks along Pleasantville Road. Public Comments Mr. David Reisman of 354 Elm Road stated he had a pool project pending and wondered when the legislation might move forward. The Board said they could potentially move forward at the next meeting. Mr. Bruce Yeager of 450 Central Drive, submitted a photo of the Club at night. He asked for the average grade of the soccer field be clarified as well as the elevations of the western façade and requested the Board reinstate the no work on Saturday’s rule. The Board requested the as-built drawings and topographical information be distributed to Mr. Yeager. Legislative Update: B Zone  Village Consultant, Patrick Cleary will give a public presentation on October 22nd.  The current marketplace trends and driving factors will be reviewed.  Village Staff is working on the infrastructure analysis and culling through the original BZone applications. Schedule a Public Hearing to Repeal and Replace Chapter 179 – Solid Waste with Chapter 125 – Garbage Collection and Recycling Upon motion by Deputy Mayor Chatzky, seconded by Trustee DeRose, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that a Public Hearing is hereby scheduled for the October 22, 2019 Board of Trustees meeting at 7:30pm to hear and discuss a proposed local law to repeal and replace Chapter 179 – Solid Waste with Chapter 125 – Garbage Collection and Recycling of the Code of the Village of Briarcliff Manor. Donation from the Friends of the Library 3 The Board thanked the Friends for their donation. Upon motion by Trustee Hunt, seconded by Trustee DeRose, the Board voted unanimously to approve the following resolution: BE IT RESOLVED, that the Board of Trustees hereby accepts a donation in the amount of $499.00 from the Friends of the Library for the purchase of cultural materials in the name of Donna Fredican. Increase Revenue – Gifts (L0108.2705) by $499.00 Increase Expenses – Special Matching Expenses (L7410.206) by $499.00 Authorize Village Manager to Extend the Valet Parking Services for the Scarborough Station with Pro-Park America for 2020 Upon motion by Deputy Mayor Chatzky, seconded by Trustee Midgley, the Board voted unanimously to approve the following resolution: WHEREAS the Valet Parking Services for the Scarborough Station was awarded on December 6, 2017 to ProPark America for a two year period commencing on January 1, 2018 and ending on December 31, 2019 with an optional third year extension; and WHEREAS the Village wishes to exercise their right to extend the agreement for a third year with a 2% increase as provided for in the December 6, 2017 resolution; NOW, THEREFORE, BE IT RESOLVED that the valet parking services at Scarborough Station is hereby extended with ProPark America as per its proposal of $11,215 per month for a period of one (1) year commencing January 1, 2020, and expiring on December 31, 2020; and BE IT FURTHER RESOLVED that the Village Manager is hereby authorized and directed to execute an extension to the contractual agreement with ProPark America for valet parking services at the Scarborough Station to cover such period of time with such terms and conditions in keeping with the revised RFP and the provisions of Pro Park's proposal. Authorize Village Manager to Execute an Agreement with Hudson Engineering – Phases 1 – 4 Upon motion by Trustee Hunt, seconded by Trustee DeRose, the Board voted unanimously to approve the following resolution: 4 BE IT RESOLVED that the Village Manager is hereby authorized and directed to execute on behalf of the Village a Professional Services Agreement with Hudson Engineering and Consulting, P.C. to provide Engineering Services for Phases 1-4 of the Law Park Drainage Basin Project and authorize funding for Phase 1 in the amount of $32,000 to be charged to budget code H5110.201.18220. Accept Resignation of Village Treasurer Upon motion by Trustee Hunt, seconded by Trustee DeRose, with nay votes from Deputy Mayor Chatzky and Trustee DeRose, the Board voted to accept the resignation of Village Treasurer Edward Ritter effective October 25, 2019. Village Engineer’s Update  Scarborough Park. All the erosion and work is above the high water line which only requires a NYS Wetlands Permit. Resident Krista Mastrocola is assisting with the process.  Streetscape Project – The Contract was executed with the Surveyor and phase 1 is complete. The Landscape designer will move forward once the CAD drawings are received. Concrete samples will be discussed. Minutes Upon motion by Trustee Hunt, seconded by Trustee DeRose, the Board voted unanimously to approve the minutes of September 10, 2019. Adjournment Upon motion by Deputy Mayor Chatzky, seconded by Trustee Midgley, the Board voted unanimously to adjourn the Regular Meeting at 8:57pm.
