Village Board of Trustees Regular Meeting November 5, 2019 7:30 p.m. A Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held in the Village of Briarcliff Manor at the William J. Vescio Community Center, at 1 Library Road, Briarcliff Manor, New York on the 5th of November, 2019 commencing at 7:30 p.m. Present Steven A. Vescio, Mayor Peter S. Chatzky, Deputy Mayor Cesare DeRose, Jr., Trustee Kevin Hunt, Trustee Edward E. Midgley, Trustee Also Present Philip Zegarelli, Village Manager Daniel Pozin, Village Attorney Christine Dennett, Village Clerk David Turiano, Village Engineer Pledge of Allegiance Continued Public Hearing to Repeal and Replace Chapter 179 with Chapter 125 Garbage and Recycling Deputy Mayor Chatzky gave an overview of the proposed changes. Upon motion by Trustee Hunt, seconded by Trustee DeRose, the Board voted unanimously to adjourn the public hearing to November 19, 2019 at 7:30pm. Public Hearing to Amend Chapter 220-9 – Regulation of Solar Energy Collectors Deputy Mayor Chatzky gave an overview of the proposed changes. The Board had general discussion regarding freestanding units and added language to eliminate any view of them from neighboring properties. Mr. Robert Soffer of 178 Larch Road stated he supported the changes to the law and it was keeping up with the national trend and stated a homeowner should have the right to harness technology to improve their home. Upon motion by Trustee Hunt, seconded by Trustee DeRose, the Board voted unanimously to close the Public Hearing. 1 Upon motion by Deputy Mayor Chatzky, seconded by Trustee Midgley, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the proposed Local Law to amend Chapter 220-9 – Regulation of Solar Energy Collectors of the Code of the Village of Briarcliff Manor is hereby adopted. Public Hearing to Discuss the Abandonment of a Sewer Easement at 270- 278 River Road Village Attorney Pozin stated a draft determination agreement was received and noted it was a Type II action under SEQRA. There were no public comments. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Midgley, the Board voted unanimously to close the Public Hearing. Upon motion by Trustee Midgley, seconded by Trustee Deputy Mayor Chatzky, the Board voted unanimously to approve the following resolution: WHEREAS, the Village has a sewer easement extending from River Road west along the northern boundary of private property at 270 River Road to a point at which the easement turns north, bisects private property at 278 River Road, and continues onto private property lying to the north of 278 River Road; and WHEREAS, the Village Board of Trustees has received a joint request from the owner of 270 River Road (River Road Realty LLC), and 278 River Road (278 River Road Realty LLC) to abandon the said sewer easement to accommodate a boundary line modification between the two said properties, and a proposed addition to be built on the residence at 270 River Road; and WHEREAS, based upon the advice of the Building Inspector and Superintendent of Public Works, the sewer easement is no longer needed for current or future sewer services as all effected properties may access an existing municipal sewer main located in River Road without the sewer easement; and WHEREAS, in light of the above, the said owners have asked the Board of Trustees to abandon, terminate, extinguish and release the sewer easement; and NOW THEREFORE BE IT RESOLVED that the Village Board of Trustees hereby abandons the said sewer easement as it is no longer needed for sewer service to the any property, and BE IT FURTHER RESOLVED that the Village Manager is authorized to execute such documentation as reasonably necessary to memorialize such action. 2 Board of Trustees Announcements • The Fire Department reminded everyone to check their smoke detectors and change the batteries with the time change. • The Library is hosting a number of programs for all ages. Visit the website for more information. • The Recreation Fall Brochure is posted on the website. • Platform Tennis Season is underway. Permits are required. • A press conference was held regarding the safety concerns with Route 9A. Thanks to all that have given their support. • The October 29th Streetscape meeting was recorded and will be rebroadcasted. Participation is encouraged. Village Managers Report by Village Manager Zegarelli • The Pocantico River Bridge should be fully open by Thanksgiving. • Law Park Pond Dredging is complete and the cleanup process is underway. • Leaf Collection has begun. Do not put them in the street! • Scarborough Station Parking Permits for 2020 are sale. • An application was received to move cell tree at the Club and will be on the November 14th Planning Meeting Agenda. • The Farm Road pipe replacement project has begun. • A report was requested on Club Field drainage repairs at the next meeting. Committee Reports • Henry Jamin, Superintendent of Recreation gave a presentation on the Hiking Project to map the Village Trails. The Board thanked the Recreation Advisory Committee and the Eagle Scouts for their work on the project. Public Comments There were no public comments. Resolution to Amend Chapter 146 – Noise of the Village Code Deputy Mayor Chatzky gave an overview of the proposed changes. The Board discussed the changes affecting businesses that open early in the Village. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Midgley, the Board voted unanimously to approve the following resolution: 3 BE IT RESOLVED that the proposed Local Law to amend Chapter 146 - Noise of the Code of the Village of Briarcliff Manor to is hereby adopted. Acceptance of Justice Court Audit Upon motion by Trustee Hunt, seconded by Trustee DeRose, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the Village Justice Court conducted an Independent Audit for Fiscal Year 2018-2019 in accordance with Section 2019-a of the Uniform Justice Court Act. BE IT FURTHER RESOLVED that the Board of Trustees does hereby approve and accept into the record the Village Justice Court Independent Audit for Fiscal Year 2018-2019. Budget Transfer – Treasurer Payout Upon motion by Trustee Hunt, seconded by Trustee DeRose, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the Board of Trustees does hereby authorize the following budget transfers for FY 2019-2020: TREASURER VACATION PAYOUT From: A1990.499 Contingency $19,507.51 To: A1325.107 Vacation $19,507.51 Schedule a Public Hearing for 401 Old Briarcliff Road for a Proposed Land Swap and to Secure an Easement. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the Board of Trustees hereby schedules a Public Hearing to held on Tuesday, November 19, 2019 at 7:30pm at the William J. Vescio Community Center regarding a proposed swap of land and easements relative to property at 401 Old Briarcliff Road and adjacent rights of way. Beautification Committee Appointment The Board thanked Ms. Beebe for volunteering and stated she was very experienced and knowledgeable about plantings. 4 Upon motion by Deputy Mayor Chatzky, seconded by Trustee Midgley, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the Board of Trustees does hereby appoint Brooke Beebe to the Beautification Committee for a term to expire on April 1, 2022. Minutes Upon motion by Trustee Hunt, seconded by Trustee DeRose, the Board voted unanimously to approve the minutes of October 10, 2019 and October 29, 2019 as amended. Adjournment The next Regular Meeting will be on November 19th with a Work Session prior at 6:00pm.
