Village Board of Trustees Regular Meeting February 2, 2021 7:30 p.m. A Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held remotely via Zoom on the 2nd of February, 2021 commencing at 7:30 p.m. Present Steven A. Vescio, Mayor Peter S. Chatzky, Deputy Mayor Kevin Hunt, Trustee Edward E. Midgley, Trustee Sabine Werner, Trustee Also Present Philip Zegarelli, Village Manager Dan Pozin, Village Attorney Christine Dennett, Village Clerk David Turiano, Village Engineer Pledge of Allegiance Ms. Victoria Gearity Director of Constituent Services for Senator Reichlin-Melnick stated she was looking forward to working with the Village and many things were already happening at the State level. Continuation of Public Hearing - Chapter 131, Freshwater Wetlands, New Chapter 218, Wetlands Deputy Mayor Chatzky gave a brief synopsis the proposed changes. The Board had general discussion regarding the changes to the previous drafts. Mr. Steven Kavee of Ingham Road asked for clarification on the buffer and pools and stated he was concerned with it being too vague and recommended codifying the buffer encroachment. He further stated he submitted a letter to the Board. Mrs. Meghan Behzadi of 115 Holly Place asked how the proposed law would impact her application currently before the Planning Board. Village Attorney Pozin stated until the law was adopted and filed the current provisions remained in place. 1 Mrs. Rhea Mallett of 57 Old Sleepy Hollow Road stated it was less encouraging to hear that pools and sports courts might be allowed in the 50-100 foot buffer but understood it was a balancing act. She urged the Board to protect the wetlands and keep the buffer intact. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Midgley, the Board voted unanimously to adjourn the Public Hearing to February 16, 2021. Visit their website for more information. They will be doing a survey to see what services residents are interested in.  The BMFD offered tips for generator safety.  There are several Recreation Programs available. Platform Tennis, a Running Club, Geo-caching Challenge, Senior Shopping and many more. Sign up for their E-News and visit their site for more information.  Assistance is being offered to seniors in getting their COVID vaccine. Call Stephanie at the Recreation Department for information. 914-941-6560.  There is a continued call for support for Route 9A safety.  There will be a Streetscape Presentation on February 16th during the Work Session.  The pole from the middle of Central Drive has been removed at no cost to residents. Village Manager’s Report by Village Manager Zegarelli  Due to the storm recycling will be picked up tomorrow and garbage on Thursday and Friday.  The next Police Reform Committee meeting is scheduled for February 8th with a second public forum on February 6th. A survey is available on the website or for drop off at various locations until midnight tonight.  Chilmark Park cleanup is underway.  Court is fully remote. Village Engineer’s Report by Village Engineer Turiano  The Village Hall ADA Project is being reviewed. 2   The Streetscape Project will be presented on February 16th.  There was a presentation about the Cross Access Easement in the Central Business District during the Work Session.  Heat Smart Westchester has kicked off. Committee Reports Beautification Committee:  No report. Recreation Advisory Committee:  Dog waste bags, trash receptacles and new signage will be installed at trailheads.  The next meeting will be via zoom on February 10 th. Library Board:  No report. Police Outreach Report  Residents are encouraged to complete the survey for the Police Reform Advisory Committee. Public input is important. Public Comments Ms. Sara Kenney of 222 Elm Road stated a portion of her front lawn was being taken to install a sidewalk without discussion and it would cause additional maintenance and liability as well as safety concerns. Mayor Vescio stated a long term goal of the Board was to make the Village more walkable and safer for pedestrians and the Board would look into her concerns. Mr. Brendan Kenney of 222 Elm Road congratulated Dominick Bueti on becoming Chief and stated he was great choice. He stated he recently read an article regarding development in the Village and encourage the Board to work with developers. He further stated a housing development at the former Pace site would be welcomed with open arms. Appointment of Provisional Police Chief The Board congratulated and thanked Chief Bueti for his dedication to the Village and stated he was the only clear choice and would make a great Chief. Chief Bueti thanked the Board for the great honor. 3 Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to approve the following resolution: BE IT FURTHER RESOLVED that Dominick Bueti of Garrison, New York is hereby appointed as Provisional Police Chief effective February 6, 2021 with a salary of $152,391.15. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Midgley, the Board voted unanimously to approve the following resolution: BE IT RESOLVED, that the Board of Trustees hereby accepts a donation in the amount of $500.00 from the Sabbah Family Fund for use by the Village Fire Department. The Fire Department is requesting to amend the 20/21 Budget as proposed below: Increase General Fund Revenue – Gifts and Donations (A0101.2705) by $500.00 Increase Fire Department Expense – Advertising (A3410.401) by $500.00 Roll Call: Trustee Hunt Aye Trustee Werner Aye Trustee Midgley Aye Deputy Mayor Chatzky Aye Mayor Vescio Aye Schedule Public Hearings Special Use Permit Amendment – St. Theresa’s Church 4 Upon motion by Trustee Werner, seconded by Deputy Mayor Chatzky, the Board voted unanimously to approve the following resolution: 1. Referral to the Planning Board BE IT RESOLVED that the request for the amendment of a Special Use Permit issued to the St. Theresa’s Church/School located at 300 Dalmeny Road is hereby directed to the Planning Board for review and recommendation. 2. Schedule Public Hearing BE IT RESOLVED that a Public Hearing is hereby scheduled for February 16, 2021 at 7:30pm or soon thereafter via Zoom to hear and consider an application to amend a Special Use Permit issued to St. Theresa’s Church/School. Roll Call: Trustee Hunt Aye Trustee Werner Aye Trustee Midgley Aye Deputy Mayor Chatzky Aye Mayor Vescio Aye Award of Bid – Roadway Rehabilitation – Tuttle Road 5 Upon motion by Trustee Werner, seconded by Trustee Hunt, the Board voted unanimously to approve the following resolution: WHEREAS the Village received 15 bids for the Roadway Rehabilitation – Tuttle Road Project (VM-1920-5); and NOW, THEREFORE, BE IT RESOLVED that the bid for the Roadway Rehabilitation – Tuttle Road Project (VM-1920-5) is hereby awarded to Bradhurst Site Construction per their bid of $1,443,660.00 and charged to H1440.201.21220. BE IT FURTHER RESOLVED that the Village Manager is hereby authorized and directed to execute a contract with Bradhurst Site Construction for said project. Roll Call: Trustee Hunt Aye Trustee Werner Aye Trustee Midgley Aye Deputy Mayor Chatzky Aye Mayor Vescio Aye Authorize Village Manager to Execute an Agreement – Hendrickson Fire Equipment Upon motion by Trustee Hunt, seconded by Trustee Werner, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the Village Manager is hereby authorized and directed to execute an agreement with Hendrickson Fire Rescue Equipment for the purchase of a Rescue Emergency Vehicle in the amount of $862,851.00 and as approved in the FY2020-2021 Capital Budget adopted on July 14, 2020. Roll Call: Trustee Hunt Aye Trustee Werner Aye Trustee Midgley Aye Deputy Mayor Chatzky Aye Mayor Vescio Aye Election Resolution for Annual Village Election 2021 Upon motion by Deputy Mayor Chatzky, seconded by Trustee Midgley, the Board voted unanimously to approve the following resolution: 6 BE IT RESOLVED that the Annual Village Election will be held in the Village of Briarcliff Manor at the Library and Community Center (1 Library Road) in said Village on Tuesday, March 16, 2021 between the hours of 6:00am and 9:00pm during which the polls will be open. BE IT FURTHER RESOLVED that the polling places for the Village of Briarcliff Manor, will be designated as follows, the Village’s Single Election District (Town Voting districts #15, #16, #17, #19, #26, #27 and #29) will vote in the Briarcliff Manor Library and Community Center (1 Library Road). Roll Call: Trustee Hunt Aye Trustee Werner Aye Trustee Midgley Aye Deputy Mayor Chatzky Aye Mayor Vescio Aye Election Inspectors for Annual Village Election 2021 Upon motion by Trustee Werner, seconded by Deputy Mayor Chatzky, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that, Celianne Silverstein and Estelle Kersch are hereby appointed Inspectors of Election for the March 16, 2021 Village Election. BE IT FURTHER RESOLVED that Celianne Silverstein is hereby designated as Inspector of Election and Chairperson. BE IT FURTHER RESOLVED that Rhonda, Alomar, Georgina Gualdino, Lauren Gualdino, Joyce Perlmutter, Joyce Silverstein, and Audrey May June are hereby appointed as Alternate Inspectors of Election. BE IT FURTHER RESOLVED that the compensation for each Inspector of Election other than the Inspector designated as Chairperson is hereby fixed at Three Hundred and Fifty ($350) dollars per day or prorated to $22 per hour worked if necessary. BE IT FURTHER RESOLVED that the compensation for the Inspector of Election that is designated as Chairperson shall be Three Hundred Seventy-Five ($375) dollars per day. Roll Call: 7 Trustee Hunt Aye Trustee Werner Aye Trustee Midgley Aye Deputy Mayor Chatzky Aye Mayor Vescio Aye Justice Court Annual Auditors Report for FY 2019-2020 Upon motion by Deputy Mayor Chatzky, seconded by Trustee Werner, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the Village Justice Court conducted an Independent Audit for Fiscal Year 2019-2020 in accordance with Section 2019-a of the Uniform Justice Court Act. BE IT FURTHER RESOLVED that the Board of Trustees does hereby approve and accept into the record the Village Justice Court Independent Audit for Fiscal Year 2019-2020.
