Village Board of Trustees Regular Meeting March 23, 2021 7:30 p.m. A Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held remotely via Zoom on the 23rd of March, 2021 commencing at 7:30 p.m. Present Steven A. Vescio, Mayor Peter S. Chatzky, Deputy Mayor Kevin Hunt, Trustee Edward E. Midgley, Trustee Sabine Werner, Trustee Also Present Philip Zegarelli, Village Manager Dan Pozin, Village Attorney Christine Dennett, Village Clerk David Turiano, Village Engineer Pledge of Allegiance Promotion of Police Officer to Detective Mayor Vescio swore in Detective Jan Pierre “JP” Chavez and the Board thanked him for his service. Chief Bueti stated Detective Chavez would continue to serve the department well. Detective Sergeant Galbraith presented Detective Chavez with his new badge. Public Hearing – Police Reform Advisory Committee Draft Report The Board reopened the public hearing. Reverend Anthony Karlik, Chairman of the Police Reform Advisory Committee thanked Chief Bueti, Village Manager Zegarelli and the Board for all their work. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Werner, the Board voted unanimously to close the public hearing. Roll Call: 1 Trustee Hunt Aye Trustee Werner Aye Trustee Midgley Aye Deputy Mayor Chatzky Aye Mayor Vescio Aye Certification of Police Reform Advisory Committee Report Upon motion by Trustee Werner, seconded by Deputy Mayor Chatzky, the Board voted unanimously to approve the following resolution: WHEREAS, on June 12, 2020, Governor Andrew Cuomo signed Executive Order 203, requiring local municipalities with police departments to develop a reform plan based on community input; and WHEREAS, on October 20, 2020, the Village appointed volunteers to serve on an advisory committee for the purposes of developing the aforementioned plan; and WHEREAS, the advisory committee held two public forums for residents to provide input on the police department and conducted a survey on the community’s interactions with the police department, which was completed by 231 respondents; and WHEREAS, the draft police reform plan that was developed has taken into account all of the above feedback; and WHEREAS, the Village Board of Trustees held public hearings on March 2, 2021 and March 23, 2021 to hear public comments on the Police Reform Task Force Plan; and WHEREAS, following the public hearing, the Village Board reviewed the action items proposed by the plan; and NOW THEREFORE BE IT RESOLVED: that the Village Board of Trustees hereby adopts the Village of Briarcliff Manor Police Reform and Reinvention Collaborative Report subject to non-material changes; and AND BE IT FURTHER RESOLVED: that certification of such plan shall be transmitted to the state budget director as required by Executive Order 203. Roll Call: Trustee Hunt Aye 2 Trustee Werner Aye Trustee Midgley Aye Deputy Mayor Chatzky Aye Mayor Vescio Aye Board of Trustees Announcements  The Police Department will be having a “Books and Badges” event on April 10th.  The BMFD reminded residents to locate exit points and encouraged all to volunteer and join the Fire Department and/or Ambulance Department.  The Library has many virtual programs and curbside pickup available. Visit their website for more information.  There are several Recreation Programs available. Platform Tennis, a Running Club, Senior Shopping and many more. Sign up for their E-News and visit their site for more information.  Pool and Camp registration begins next week and summer hiring has begun.  The Egg Hunt will be Saturday, March 27th.  Spring window painting will be April 10th.  The Rotary Club meets every Friday.  Thank you to all that have submitted support for the Route 9A Safety initiative. It was approved by the Senate Transportation Committee and was making its way to the Finance Committee.  There is a “Talk to us” feature on the website. Residents are encouraged to communicate with the Board and various departments. Village Manager’s Report by Village Manager Zegarelli  The Annual Village Election was held on March 16th. All incumbents were reelected and the Service Awards Program level was increased.  There will be an Indian Point siren test tomorrow at 10am.  The remaining work at the Lantern will be done next week.  Work and cleanup continues at Chilmark Park.  Road repairs from winter damage is underway.  Curb your dogs! Village Engineer’s Report by Village Engineer Turiano  The Tuttle Road project will begin in mid-April. Plantings are being reviewed.  The Village Hall ADA Project is on the agenda to be awarded.  The Streetscape Project (Phase 1) is out to bid.  Cross Access Easement Plans are being worked on.  The DEC approved the decommissioning of the Long Hill Road Pump Station. Committee Reports 3 Beautification Committee:  No report. Recreation Advisory Committee:  A subcommittee is being formed to look into a dog park.  Camp Enrollment is underway.  Dog waste bags will be available at trailheads.  The next meeting will be via zoom on April 14th. Library Board:  No report. Police Outreach Report  No report. Public Comments There were no public comments. Adoption of Public Health Emergency Plans The Board thanked Village Manager Zegarelli for keeping the Village fully operational during the pandemic. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Midgley, the Board voted unanimously to approve the following resolution: WHEREAS, the State of New York has enacted legislation, Labor Law § 27-c, which requires public employers to adopt a plan for operations if the Governor declares a public health emergency involving a communicable disease; and WHEREAS, the Village has prepared health emergency plans in accordance with the legislation; and WHEREAS, the draft plans have been circulated to the collective bargaining units of the Village, CSEA and PBA (Civil Service Employees Association, Inc., Local 1000, AFSCME-AFL/CIO, Village of Briarcliff Manor Unit (9242), as required by law for review and comment; and WHEREAS, the law requires the Village Board of Trustees to adopt the plans by resolution, NOW THEREFORE BE IT RESOLVED: that the Village Board of Trustees hereby adopts the Public Employer Health Emergency Plan for the Village of 4 Briarcliff Manor and the Briarcliff Manor Public Library subject to non-material changes; and BE IT FURTHER RESOLVED: that the Village Clerk shall post the adopted plans in the necessary locations per the adopted legislation. Dewey, Esq. P.C. is hereby appointed serve as the Village Prosecutor for Vehicle and Traffic Court effective April 5, 2021 for a one year term; and BE IT RESOLVED that the Village Manager is hereby authorized and directed to execute a retainer agreement with Stephen P. Dewey, Esq., P.C. for Village Prosecution Services as set forth in the agreement. Roll Call: Trustee Hunt Aye Trustee Werner Aye Trustee Midgley Aye Deputy Mayor Chatzky Aye Mayor Vescio Aye Schedule Public Hearing – Amend Chapter 90, Building Construction and Fire Prevention Upon motion by Trustee Werner, seconded by Deputy Mayor Chatzky, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that a Public Hearing is hereby scheduled for the April 6, 2021 Board of Trustees meeting at 7:30pm to be held either via in-person meeting, or Zoom Video Conference, depending on the State’s directives about gatherings under NY on Pause to hear and discuss a proposed local law to amend Chapter 90 “Building Construction and Fire Prevention”, Article III “Unsafe Buildings and Structures”, Article V “Vacant Building Registry” and Chapter 90-12 “Permits required; applications; amendments” of the Code of the Village of Briarcliff Manor.
