Village Board of Trustees Regular Meeting June 15, 2021 7:30 p.m. A Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held remotely via Zoom on the 15th of June, 2021 commencing at 7:30 p.m. Present Steven A. Vescio, Mayor Peter S. Chatzky, Deputy Mayor Kevin Hunt, Trustee Edward E. Midgley, Trustee Sabine Werner, Trustee Also Present Philip Zegarelli, Village Manager Dan Pozin, Village Attorney Christine Dennett, Village Clerk David Turiano, Village Engineer Pledge of Allegiance Continued Public Hearing - Chapter 220-6, Special Permit Uses Deputy Mayor Chatzky gave a brief synopsis of the proposed amendments and stated the hearing had been open for quite some time. He further stated the Board looked into these changes when the code was revised for the CT Zones. There were no public comments. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to close the public hearing. Roll Call: Trustee Hunt Aye Trustee Werner Aye Trustee Midgley Aye Deputy Mayor Chatzky Aye Mayor Vescio Aye Upon motion by Deputy Mayor Chatzky, seconded by Trustee Werner, the Board voted unanimously to adopt the following resolution: SEQRA NEGATIVE DECLARATION ZONING TEXT AMENDMENT 1  WHEREAS, the Board of Trustees of the Village of Briarcliff Manor, Westchester County, New York, is considering amendments to Chapter 220- Zoning; and WHEREAS, the amendments pertain to Section 220-6 regarding special permit uses; and WHEREAS, pursuant to 6 NYCRR Part 617 the Project is classified as an Unlisted Action; and WEHERAS, as no other agency can act as the SEQR Lead Agency for this review, the Board of Trustees of the Village of Briarcliff Manor is the Lead Agency for the SEQR review of this Unlisted Action; and WHEREAS, the Board of Trustees of the Village of Briarcliff Manor reviewed a Short Environmental Assessment Form (Short EAF) Parts 1, 2 and 3 dated June 7, 2021. NOW THEREFORE BE IT RESOLVED, that pursuant to 6 NYCRR Part 617, State Environmental Quality Review, the Board of Trustees of the Village of Briarcliff Manor hereby confirms its Lead Agency designation for the SEQR Review of the Proposed Action. BE IT FURTHER RESOLVED, that pursuant to Part 617 of the implementing regulations pertaining to Article 8 (State Environmental Quality Review Act) of the Environmental Conservation Law, the Lead Agency has determined that the Proposed Action will not have a significant adverse effect on the environment for the reasons enumerated in the attached Negative Declaration Form (Short EAF Part 3). BE IT FINALLY RESOLVED that this SEQR Negative Declaration resolution shall have an effective date of June 15, 2021. Roll Call: Trustee Hunt Aye Trustee Werner Aye Trustee Midgley Aye Deputy Mayor Chatzky Aye Mayor Vescio Aye Continued Public Hearing - Chapter 220-10, Affordable Housing Deputy Mayor Chatzky gave a brief synopsis of the proposed amendments and stated while the public hearing had been open for a couple of months there were still some issues to be resolved. He stated they amended the law to incorporate feedback by the Planning Board. There were no public comments. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to adjourn the public hearing to July 6, 2021. Roll Call: Trustee Hunt Aye Trustee Werner Aye Trustee Midgley Aye Deputy Mayor Chatzky Aye Mayor Vescio Aye Public Hearing Chapter 220-9.1 Regulation of Solar Energy Collectors Deputy Mayor Chatzky gave a brief synopsis of the proposed amendments and stated the Board was looking to expand on solar requirements and put further control and safety measures in place. Village Attorney Pozin stated the Planning Board reviewed the proposed legislation and generally supported green energy initiatives but deferred to the Board of Trustees. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to open the public hearing. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to open the public hearing. Sign up for their E-News and visit their site for more information. • Pool and Camp registration and summer hiring has begun. • Swim Team begins on June 21st. • Tennis Courts can be reserved online. • AYSO registration for the fall will begin soon. • Big Brothers and Big Systems is doing a clothing drop on June 26th. • There is a call letters regarding Route 9A Safety. Letters of support can be emailed to BOT@briarcliffmanor.org. Village Manager’s Report by Village Manager Zegarelli • Tuttle Road should be completed on time. • The first half of Village Taxes is due by July 1st. • Spring plantings are being finished. • There was a grant received for trails. • Mortgage tax is up. Police Outreach Report • No report. Village Engineer’s Report by Village Engineer Turiano • There are several mixed used applications before the Planning Board. • A study is being done for electric charging stations. • Wifi is being looked into the business district. • The Tuttle Road project is underway. • The Village Hall ADA Project is underway. • The Streetscape Project (Phase 1) will be awarded tonight. Committee Reports Beautification Committee: • No report. Recreation Advisory Committee: • The first summer concert was a big hit. 5  • There are several events planned for the summer. • Hike the Cliff T-Shirts are on sale. • The next meeting will be at the pavilion on June 23rd. Library Board: • No report. Public Comments Mr. Roger Battacharia of Holbrook Road stated there were still issues at the Philips property with loud music and property maintenance. He also stated he was having a runoff issue leaving dirt on his property. Village Engineer Turiano stated there was a security detail present at the site and they were issued a summons regarding the grass. Mr. Dan Zucchi of Locust Road thanked the Board for the fine job they’ve done keeping the Village running during COVID. Schedule Public Hearing to Renew a Special Use Permit for Scarborough Presbyterian Church Upon motion by Trustee Werner, seconded by Trustee Hunt, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that a Public Hearing is hereby scheduled for July 6, 2021 at 7:30pm or soon thereafter to be held either via in-person meeting, or Zoom Video Conference, depending on the State’s directives about gatherings under NY on Pause to hear and consider an application to renew a Special Use Permit issued to the Scarborough Presbyterian Church.
