Village Board of Trustees Regular Meeting July 6, 2021 7:30 p.m. A Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held at the William J. Vescio Community Center on the 6th of July, 2021 commencing at 7:30 p.m. Present Steven A. Vescio, Mayor Peter S. Chatzky, Deputy Mayor Kevin Hunt, Trustee Edward E. Midgley, Trustee Also Present Philip Zegarelli, Village Manager Dan Pozin, Village Attorney Christine Dennett, Village Clerk Absent Sabine Werner, Trustee David Turiano, Village Engineer Pledge of Allegiance Continued Public Hearing - Chapter 220-10, Affordable Housing Deputy Mayor Chatzky gave a brief synopsis of the proposed amendments. Mr. Keith Austin of 55 Hawthorn Place stated he drafted the original law in the late 1990’s and it was now out of date. He thanked the Board for their great work on the entire Village Code. Upon motion by Trustee Werner, seconded by Deputy Mayor Chatzky, the Board voted unanimously to adjourn the public hearing to July 20, 2021. The Mayor noted a letter was received by Westchester County regarding the proposed amendments. There were no public comments. Upon motion by Trustee Hunt, seconded by Deputy Mayor Chatzky, the Board voted unanimously to close the public hearing. Roll Call: Trustee Hunt Aye Trustee Midgley Aye Deputy Mayor Chatzky Aye Mayor Vescio Aye Public Hearing to Renew a Special Use Permit for Scarborough Presbyterian Church Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to open the public hearing. The Board had general discussion regarding the renewal and noted a fire inspection was done and there were no issues or violations. Upon motion by Trustee Hunt, seconded by Deputy Mayor Chatzky, the Board voted unanimously to close the public hearing. Roll Call: Trustee Hunt Aye Trustee Midgley Aye Deputy Mayor Chatzky Aye Mayor Vescio Aye 2 Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to approve the following resolution: RESOLUTION OF THE VILLAGE OF BRIARCLIFF MANOR BOARD OF TRUSTEES SPECIAL USE PERMIT RENEWAL SCARBOROUGH PRESBYTERIAN CHURCH WHEREAS, by Resolution adopted June 27, 1985, the Board of Trustees of the Village of Briarcliff Manor issued a Special Use Permit to the Scarborough Presbyterian Church (“Church”) to operate a nursery school facility for young children with their instructors (the “Nursery School”), subject to the conditions set forth therein, for a period of five (5) years at 671 Scarborough Road, Briarcliff Manor, New York (the “Premises”); and WHEREAS, by Resolution adopted March 11, 2003 the Village of Briarcliff Manor Planning Board granted Site Plan Approval for the Church; and WHEREAS, the said Special Permit, has been renewed from time to time by the Village Board, most recently on June 17, 2015; and WHEREAS, by letter dated May 12, 2021, the Church has applied to the Board of Trustees to renew its said Special Permit for an additional five years; and WHEREAS, pursuant to Village Code Section 220-6(C), the Board of Trustees held a duly noticed public hearing on July 6, 2021, at 7:30pm at which time the public was invited to provide comments on the Special Use Permit; and WHEREAS, the Board of Trustees has previously reviewed a Short Environmental Assessment Form submitted by the Applicant and determined that the Project is an Unlisted action in accordance with the New York State Environmental Quality Review Act (“SEQRA”). NOW THEREFORE, BE IT RESOLVED THAT, in accordance with SEQRA, the Board of Trustees hereby determines that the proposed action will not have a significant impact upon the environment as it will not significantly alter the existing use of the Premises and it will not have an adverse impact upon the character of the area; and 3  BE IT FURTHER RESOLVED THAT the Special Use Permit for the Church is hereby renewed subject to the same conditions included in the original Special Use Permit approval dated June 27, 1985, as renewed and amended from time to time, said renewal herein to extend retroactively to June 17, 2020; and BE IT FURTHER RESOLVED THAT should the Church desire to renew this Special Use Permit for another five year period, commencing in 2025, the Church shall be responsible for requesting the renewal at least sixty (60) days prior to the expiration of the Special Use Permit; and BE IT FURTHER RESOLVED THAT, the violation of any term or condition of this Resolution or the Special Use Permit as renewed, shall place the Special Use Permit and any associated Certificate of Occupancy in jeopardy and subject to revocation by the Village; and BE IT FURTHER RESOLVED THAT except as otherwise provided herein, all other terms and conditions of the Special Use Permit as amended and renewed from time to time shall remain in full force and effect. Please submit resumes of interest.  Summer Reading on Wednesday’s in the pavilion.  The BMFD gave tips for fireworks safety and encouraged residents to become volunteers.  There are several Recreation Programs available. Sign up for their E- News and visit their site for more information.  Family Bingo Night is scheduled for July 14th.  A summer concert is scheduled for July 8th.  Pool, Tennis and Pickleball Permits are available.  Swim Team begins on June 21st.  Tennis Courts can be reserved online.  Verizon is looking into the issue of poor service in the Village.  Tuttle Road is one way during construction. Tickets will be issued. 4   Condolences to Dominick Bueti for the loss of his father, David Turiano for the loss of his mother and Michael Mas for the loss of his father. Village Manager’s Report by Village Manager Zegarelli  Tax Bills were due by July 1st. Penalties now apply.  Village Hall is open to the public.  The ADA project is moving along nicely.  Spring plantings are being finished. Fire Department Report  The Department has had 203 fire calls since January 1st and 485 ambulance calls. A 6% and 21% increase over last year. Police Outreach Report  No report. Village Engineer’s Report  No report. Committee Reports Beautification Committee:  No report. Recreation Advisory Committee:  No report. Library Board:  No report. Public Comments There were no public comments. Authorize Village Manager to Execute a Master Municipal Multi-Modal (MM) Capital Project Agreement with the New York State Department of Transportation Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to approve the following resolution: Authorizing the implementation, and funding in the first instance of the State Multi-Modal Program-aid [and State administered federal program-aid] eligible costs, of a capital project, and appropriating funds therefore. 5 WHEREAS, a Project for the Enhanced sidewalks, crosswalks traffic signals and curb ramps to improve the pedestrian safety at the intersection of NYS Route 9A and North State Road P.I.N. 8MA509.30A (the Project") is eligible for funding (under Title 23 U.S. Code, as amended, and) New York State’s Multi-Modal Program administered by the NYS Department of Transportation (NYSDOT); and WHEREAS, the Village of Briarcliff Manor desires to advance the Project by making a commitment of advance funding of the non-local share and funding of the full local share of the costs of the Project; and NOW, THEREFORE, the Village of Briarcliff Manor Board, duly convened does hereby RESOLVE, that the Village of Briarcliff Manor Board hereby approves the above- subject project; and it is hereby further RESOLVED, that the Village of Briarcliff Manor Board hereby authorizes the Village of Briarcliff Manor to pay in the first instance 100% of the federal and non-fed $518,000 is hereby appropriated from budget line H5110.201.18221 and made available to cover the cost of participation in the above phase of the Project; and it is further RESOLVED, that in the event the full federal and non-federal share costs of the project exceeds the amount appropriated above, the Village of Briarcliff Manor Board shall convene as soon as possible to appropriate said excess amount immediately upon the notification by the Village Manager thereof, and it is further RESOLVED, that the Manager of the Village of Briarcliff Manor be and is hereby authorized to execute all necessary Agreements, certifications or reimbursement requests for Federal Aid and/or Multi-Modal Program Funding on behalf of the Village of Briarcliff Manor with NYSDOT in connection with the advancement or approval of the Project and providing for the administration of the Project and the municipality's first instance funding of project costs and permanent funding of the local share of federal-aid and all Project costs that are not so eligible, and it is further RESOLVED, that a Certified Copy of this Resolution be filed with the Commissioner of Transportation of the State of New York by attaching it to any required and/or appropriate Agreements executed in connection with the project between Village of Briarcliff Manor and the State of New York; and it is further RESOLVED, that this Resolution shall take effect immediately. 6 Roll Call: Trustee Hunt Aye Trustee Midgley Aye Deputy Mayor Chatzky Aye Mayor Vescio Aye Acceptance of a Donation and Fundraising The Board thanked all those that donated and thanked Trustee Werner for helping with the fundraising event. Upon motion by Trustee Hunt, seconded by Deputy Mayor Chatzky, the Board voted unanimously to approve the following resolution: BE IT RESOLVED, that the Board of Trustees hereby accepts a donation in the amount of $105.00 from Christophe’s Crepes for Village Trails. In addition, the Recreation Advisory Committee was able to fund raise $614.00 for the same cause: Increase Special Revenue – Gifts and Donations-Trails (CM0107.2705.TRAIL) by $719.00 Increase Special Expense– Other Expenses - Trails (CM7020.400) by $719.00 Roll Call: Trustee Hunt Aye Trustee Midgley Aye Deputy Mayor Chatzky Aye Mayor Vescio Aye Fire Department Memberships The Board thanked the new members for volunteering. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to approve the following resolution: BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby approves the under 18 membership of Daniel Sugrue to the Scarborough Engine Company. 7 BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby approves the membership of Fatma Ghailan to the Briarcliff Manor Hook and Ladder Company.
