Village Board of Trustees Regular Meeting October 19, 2021 7:30 p.m. A Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held at the William J. Vescio Community Center on the 19th of October, 2021 commencing at 7:30 p.m. Present Steven A. Vescio, Mayor Peter S. Chatzky, Deputy Mayor Kevin Hunt, Trustee Edward E. Midgley, Trustee Sabine Werner, Trustee Also Present Robin Rizzo, Interim Village Manager Christine Dennett, Village Clerk Dan Pozin, Village Attorney David Turiano, Village Engineer Pledge of Allegiance Continued Public Hearing - Create a New Chapter 142, Cannabis and Tobacco (formerly entitled “Marijuana”) Deputy Mayor Chatzky gave a brief synopsis of the proposed changes There were no public comments. Upon motion by Trustee Werner, seconded by Deputy Mayor Chatzky, the Board voted unanimously to close the public hearing. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Werner, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the proposed local law to create a new Chapter 142, Marijuana (Cannabis) and Tobacco of the Code of the Village of Briarcliff Manor is hereby adopted. Public Hearing – Chapter 195, Taxation Upon motion by Deputy Mayor Chatzky, seconded by Trustee Midgley, the Board voted unanimously to open the public hearing. 1 Deputy Mayor Chatzky gave a brief synopsis of the proposed changes There were no public comments. Upon motion by Trustee Werner, seconded by Deputy Mayor Chatzky, the Board voted unanimously to adjourn the public hearing to November 9, 2021. Board of Trustees Announcements  The BMFD Annual Inspection will be on October 23rd at 7pm.  Ricki Goe left the Village to go work for the Scarsdale Library. Best wishes to her success.  There are a few vacancies on various Village Committees. Residents interested should email BOT@briarcliffmanor.org  A letter was received from Sandy Galef regarding the Route 9A corridor safety study. Appointment of Village Manager Mayor Vescio stated the Board conducted a large search and had over 30 candidates apply for the position. The Board welcomed Josh Ringel to the Village. Upon motion by Trustee Hunt, seconded by Trustee Werner, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the Board of Trustees does hereby appoint Joshua Ringel to the position of Village Manager effective November 15, 2021 for a term to expire on April 1, 2022 with an annual salary of $175,000. BE IT FURTHER RESOLVED that Joshua Ringel is hereby appointed to the Tree Preservation Board and Ethics Board for terms to expire on April 1, 2022. BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute an Employment Agreement dated October 15, 2021, with Joshua Ringel to serve as Village Manager, effective November 15, 2021, for a period ending May 31, 2024[, and including the term ending May 31, 2022]. Roll Call: Trustee Werner Aye Trustee Hunt Aye Trustee Midgley Aye Deputy Mayor Chatzky Aye 2 Mayor Vescio Aye Incoming Village Manager Joshua Ringel read a statement and stated he looked forward to working in the Village. Village Manager’s Report by Interim Village Manager Rizzo  The main doors to Village Hall are now accessible and the ADA project continues with the Police Department entrance.  The Tuttle Road project is in the final phase and paving will begin this week. Police Outreach Report  9pm routine. Lock your cars and doors! Village Engineer’s Report  Meadows at Briarcliff is a large subdivision in the Town of Mount Pleasant that the Village supply water too. Comments have been submitted.  The Hazard Mitigation Plan is being reviewed with Westchester County.  The Mobility Enhancement Grant will likely be announced in January or February. Plans are moving ahead and a Streetscape Presentation will be given on November 16th.  A wetlands survey is being done for the trail study and dog park.  The Recreation Office hardening and remediation work will begin shortly.  The Cell Tree should be fully completed by Thanksgiving. Committee Reports Library Board:  The programs are listed and continually updated on the website.  The Human Library will be in the Village in February 2022. Recreation Advisory Committee:  The tree inventory is nearly complete.  Scarecrow Making on October 23rd.  The Ragamuffin Parade will be on October 30th.  Platform Tennis permits are on sale.  A photo contest in which residents can submit photographs of Scarborough Park will be through the end of the month.  The next meeting is scheduled for Thursday 10/21 at 7PM.  Stay informed and sign up for enews. Beautification Committee:  No report. 3 Public Comments There were no public comments. Amend Master Fee Schedule – Parking Permit Fees Upon motion by Trustee Werner, seconded by Deputy Mayor Chatzky, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the Board of Trustees does hereby amend the Master Fee Schedule for the Village of Briarcliff Manor as follows: Amusement Device Annual Fee Remove Cabaret Annual fee 250 Parking Permit (RR Station) Resident Quarterly 215 Resident Monthly 95 Resident Weekly Remove Non-Resident Annual 1100 Non-Resident Quarterly 300 Non-Resident Monthly 110 Non-Resident Weekly Remove Election Resolution for Annual Village Election 2022 Upon motion by Deputy Mayor Chatzky, seconded by Trustee Werner, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the annual Village Election will be held in the Village of Briarcliff Manor on Tuesday, March 15, 2022 between the hours of 6:00am and 9:00pm during which the polls will be open. BE IT FURTHER RESOLVED that the following Village Offices are to be elected at the annual Village Election of March 15, 2022 for the terms as set forth herein: Office Term Trustee (2) 2 Years Authorize Interim Village Manager to Execute an Agreement - Westchester Library System (WLS) Upon motion by Deputy Mayor Chatzky, seconded by Trustee Werner, the Board voted unanimously to approve the following resolution: 4 BE IT RESOLVED that the Interim Village Manager is hereby authorized and directed to execute an Information Technology Service Level Agreement (SLA) with the Village of Briarcliff Manor on behalf of the Briarcliff Manor Public Library from January 1, 2022 through December 31, 2022 in the amount of $41,049.08. Schedule Public Hearings: Schedule a Public Hearing to Consider a Local Law Opting Out of the Licensing of [Cannabis Retail Dispensaries and/or Cannabis On-Site Consumption] Establishments Within the Village of Briarcliff Manor Pursuant to NYS Cannabis Law § 131 Upon motion by Trustee Werner, seconded by Deputy Mayor Chatzky, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that a Public Hearing is hereby scheduled for the November 9, 2021 Board of Trustees meeting at 7:30pm at the William J. Vescio Community Center located at 1 Library Road, Briarcliff Manor, New York to Consider a Local Law Opting Out of the Licensing of [Cannabis Retail Dispensaries and/or Cannabis On-Site Consumption] Establishments Within the Village of Briarcliff Manor Pursuant to NYS Cannabis Law § 131.” Schedule Public Hearing and Planning Board Referral for a Special Permit Application for Morrell and Company the Wine Emporium, LTD – 600 Albany Post Road Upon motion by Deputy Mayor Chatzky, seconded by Trustee Werner, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the Board of Trustees hereby declares its intent to act as Lead Agency in connection with the SEQRA review of the Application of Morrell and Company the Wine Emporium, LTD for Special Permit and Site Plan Approvals for the use of the property located at 600 Albany Post Road as a specialty warehouse for the storage of fine wine. BE IT FURTHER RESOLVED that a Public Hearing is hereby scheduled for the November 9, 2021 Board of Trustees meeting at 7:30pm at the William J. Vescio Community Center located at 1 Library Road, Briarcliff Manor, New York to hear and consider an application for a Special Use Permit request by Morrell and Company the Wine Emporium, LTD located at 600 Albany Post Road. BE IT FURTHER RESOLVED that the request for a Special Use Permit for Morrell and Company the Wine Emporium, LTD located at 600 Albany Post Road is hereby directed to the Planning Board for review and recommendation. 5 Acceptance of Donations and Fundraising Upon motion by Trustee Werner, seconded by Trustee Hunt, the Board voted unanimously to approve the following resolution: BE IT RESOLVED, that the Board of Trustees hereby accepts a donation in the total amount of $985.00 from the Recreation Advisory Committee. The following events raised funds as follows:  50/50 Cornhole Tournament - $420.00  50/50 Family Trivia Night - $315.00  Community Day Commercial Vendor Table Donations: $250.00 Increase Special Revenue – Gifts and Donations-Trails (CM0107.2705.TRAIL) by $985.00 Increase Special Expense– Other Expenses - Trails (CM7020.400) by $985.00 Capital Budget Increase FY 2021-2022 Upon motion by Trustee Werner, seconded by Deputy Mayor Chatzky, the Board voted unanimously to approve the following resolution: BE IT RESOLVED, that the Board of Trustees hereby accepts a grant from NYSERDA Clean Energy Communities Program in the amount of $5,000. BE IT RESOLVED, that the Board of Trustees hereby accepts a grant from the Westchester Urban County Community Development Block Grant Program in the amount of $65,000.
