Village Board of Trustees Regular Meeting June 7, 2022 7:30 p.m. A Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held at the William J. Vescio Community Center on the 7th of June, 2022 commencing at 7:30 p.m. Present Steven A. Vescio, Mayor Peter S. Chatzky, Deputy Mayor Kevin Hunt, Trustee Rhea Mallett, Trustee Edward E. Midgley, Trustee Also Present Josh Ringel, Village Manager Christine Dennett, Village Clerk Josh Subin, Village Attorney David Turiano, Village Engineer Pledge of Allegiance Continued Public Hearing to Create a New Chapter 94, Building Numbering Deputy Mayor Chatzky gave a brief summary of the proposed changes. Upon motion by Trustee Midgley, seconded by Deputy Mayor Chatzky, the Board voted unanimously to close the public hearing. The Board thanked the Fire Department, Ambulance Department and Trustee Hunt for their input. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the proposed local law to create a new Chapter 94, Building Numbering is hereby adopted. Roll Call: Trustee Mallett Aye Trustee Midgley Aye Trustee Hunt Aye 1 Deputy Mayor Chatzky Aye Mayor Vescio Aye Board of Trustees Announcements  The Briarcliff Manor Fire Department offered tips on heat related fire safety and encouraged residents to volunteer and become a member of the Department. Village Manager’s Report  Traffic Advisory tomorrow during the popular rummage sale at the Congregational Church.  There will be a 5k on June 18.  The former President was here yesterday and the Police Department did an exceptional job.  The State Legislature approved the Village’s Hotel Tax request and it now needed a signature by the Governor. Special thanks to the Village’s Summer Intern, Craig Chambers for driving the document to Albany. Village Engineer’s Report  The new house numbering law will be a good project for the Summer Intern.  The Village is working on digitizing its files.  A paving bid will go out shortly. Committee Reports Library Board:  The Library offers many programs to all age groups. Visit their website for information.  The flower show hosted by the Garden Club this past weekend was well attended. Recreation Advisory Committee:  The Recreation Department is back in their office after the renovation from flood damage.  Late hours being offered for registration. Check the website for details.  Registration for Camp is still open.  The tennis courts are open and permits are on sale.  Pool permits are available.  Summer Kickoff Concert on Friday, June 17. Beautification Committee:  The plantings are blooming and hanging baskets and planters all complete. 2  Flags were put up throughout the Village by DPW> Public Comments There were no public comments. Schedule Public Hearing to Amend Chapter 207, Vehicle and Traffic Deputy Mayor Chatzky gave a brief summary of the proposed changes. Upon motion by Trustee Mallett, seconded by Deputy Mayor Chatzky, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that a Public Hearing is hereby scheduled for the June 21, 2022 Board of Trustees meeting at 7:30pm at the William J. Vescio Community Center located at 1 Library Road, Briarcliff Manor, New York to hear and discuss a proposed local law to amend Chapter 207, Vehicle and Traffic of the Code of the Village of Briarcliff Manor. Acceptance of Donations The Board thanked all for their generous donations. Acting Mayor Chatzky stated the remainder of the Board was in agreement with the chosen candidates. 3 Trustee Mallett explained why the Mayor recused himself. The Board thanked all residents that submitted interest and stated there would be many more opportunities to volunteer in the future. Mr. Dan Zucchi of Locust Road thanked the Board for acquiring 1050 Pleasantville Road and stated he hoped a committee would be created. He further stated he disagreed with disqualifying a candidate for their familial relationship to a Board member and that he was the most qualified person for the Planning Board. Upon motion by Trustee Hunt, seconded by Trustee Mallett, the Board voted unanimously to approve the following resolution: BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby make the following appointments: Ethan Goodman as a member of the Planning Board to fill the unexpired term of Edward Nolan to expire on April 1, 2023. Kevin Veitinger as the Planning Board Alternate Member for a term to expire on April 1, 2023. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Midgley, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the Village Manager is hereby authorized and directed to execute a retainer agreement with Ira Levy for Services as set forth in the proposal. Creation of Environmental Sustainability Advisory Committee 4 Upon motion by Trustee Mallett, seconded by Deputy Mayor Chatzky, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the Board of Trustees does hereby establish the Environmental Sustainability Advisory Committee, which will be comprised of seven (7) members; and BE IT FURTHER RESOLVED that the mission statement of the Environmental Sustainability Advisory Committee is as follows: About the Environmental Sustainability Advisory Committee The Environmental Sustainability Advisory Committee makes recommendations to the Village Board of Trustees on matters related to sustainability, reduction of carbon footprint, recycling, reusable products and technologies, and reduction of waste products. The Committee provides research and proposals for applying cleaner technologies in Village operations, promoting environmentally friendly activities, and making the Village of Briarcliff Manor more “earth-friendly.” Potential activities include, but are not limited to:  Review and evaluation of policies and recommendations relating to energy management, transportation, waste management, construction, and land use.  Make recommended modifications to improve fuel efficiency, reduce fuel consumption and promote alternative fueled vehicles in Village fleet.  Monitor and promote the reduce, reuse and recycle approach to waste management throughout the Village.  Establish, implement, and monitor programs to increase education and awareness of actionable items to improve sustainability among households.  Disseminate information and educational materials, through in-person or online resources, related to reducing energy use, implementing reduce, reuse and recycle approaches to waste management, encouraging the use of green products and renewable energy sources, implementing food scraps initiative, and other home-based programs for residents.  Establish, implement, and monitor water conservation practices to protect and conserve our water supplies.  Recommend new technology and research into alternatives for reducing greenhouse gas emissions, cooperating with other municipal jurisdictions and neighboring communities to amplify positive results.  Advise on local building codes and guidelines for new construction and renovation projects to promote environmentally sustainable practices. 5 Meetings The Environmental Sustainability Advisory Committee meets once per month on a date chosen by the Chair and on an ad hoc basis when requested by the Village Board of Trustees. BE IT FURTHER RESOLVED that the Environmental Sustainability Advisory Committee will operate in accordance with the Policies and Procedures for Advisory and Ad-Hoc Committees adopted annually at the Organizational Meeting. Creation of Horticultural Advisory Committee Upon motion by Trustee Mallett, seconded by Deputy Mayor Chatzky, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the Board of Trustees does hereby establish the Horticultural Advisory Committee, which will be comprised of five (5) members; and BE IT FURTHER RESOLVED that the mission statement of the Horticultural Advisory Committee is as follows: Horticultural Advisory Committee (to replace, eventually, Tree Preservation Board) Role & Responsibility (Horticultural Advisory Committee) The Horticultural Advisory Committee advises the Board of Trustees on matters related to the preservation, cultivation and management of flora, indigenous plantings, trees, and green spaces within the Village. HAC provides input for significant plantings in Village parks, public walkways, the Central Business District, and the welcome ways at Village boundaries. The goal of the Committee is to foster sustainable natural plantings, reduce ongoing maintenance costs, and encourage the selection of appropriate horticultural efforts to create enduring green spaces that are aesthetically pleasing. Representative activities include, but are not limited to:  Assist and advise the Planning Board for any application related to a Special Permit, related to the preservation or planting of any tree on a subject site.  Disseminate news and information regarding the protection, maintenance, removal and planting of trees on public or private property. 6  Develop and disseminate educational programs related to local garden cultivation, pollinator pathways, biodiversity, lawncare, mulching, fallen leaf management, pest control, healthy yards, native species, and natural options for property maintenance.  Advise the Board of Trustees and make recommendations as to appropriate plantings or horticultural maintenance programs on Village- owned properties, parks, sidewalks, and other places of public gatherings.  Make recommendations to the Board of Trustees as to desirable legislation concerning the tree program and activities related to plantings within the Village. Meetings The Board meets monthly, and as needed. BE IT FURTHER RESOLVED that the Horticultural Advisory Committee will operate in accordance with the Policies and Procedures for Advisory and Ad-Hoc Committees adopted annually at the Organizational Meeting. The Board put out a call for volunteers for both committees and requested residents submit resumes and letters of interest through the website or directly to BOT@briarcliffmanor.gov. Minutes Upon motion by Trustee Hunt, seconded by Deputy Mayor Chatzky, the Board voted unanimously to approve the minutes of May 17, 2022. Adjournment The Board stated a work session would be held on June 23, 2022 at 6pm to discuss the Mobility Project. BE IT RESOLVED that the proposed local law to create a new Chapter 94, Building Numbering is hereby adopted. Chapter 94 Building Numbering FOR BOT DISCUSSION ONLY 5-13-2022 LOCAL LAW NO. _____ ADOPTED CHAPTER 94 BUILDING NUMBERING BE IT ENACTED by the Board of Trustees of the Village of Briarcliff Manor, New York, as follows: Section 1. The Code of the Village of Briarcliff Manor is amended by adding a new chapter, designated as “Chapter 94 Building Numbering,” to read as follows: §94-1. Legislative intent. A Village-wide uniform numbering system of all buildings and the prominent easily read display of the individual property and street address numbers will assist emergency personnel in responding efficiently and quickly to an emergency. It is, therefore, in the best interest of the public health, safety and welfare of the Village of Briarcliff Manor to enact this chapter. §94-2. Definitions. As used in this chapter, the following term(s) shall have the meanings indicted: BUILDING The principal building or buildings on each lot and, unless otherwise determined by the Building Inspector, shall not include any accessory building on a single-family residential lot. For the purposes of this chapter, any separately partitioned unit of a multi-family residence, multi-tenant commercial building, or other multi-unit structure with separate entrances shall each be considered a Building. CODE ENFORCEMENT OFFICER The Briarcliff Manor Building Inspector, Assistant Building Inspector, their designees or Chiefs of the Briarcliff Manor Fire Department, or other authorized Village employees. IDENTIFYING NUMBER A unique number designating a particular building located on the street of the lawfully assigned property address. STREET Any street, road, parkway, or public right of way used by vehicular traffic. §94-3. Duty of building owners, occupants, and tenants. It shall be the duty of every owner, occupant, or tenant of any building in the Village of Briarcliff Manor to cause to be displayed and maintained an Identifying Number representing the street address of each building as per the contents of this chapter. Identifying Numbers shall be {01230620.docx.} Chapter 94 Building Numbering FOR BOT DISCUSSION ONLY 5-13-2022 constructed of durable material and shall be maintained in such condition as to be readily visible as required by Section 94-6 herein. §94-4. Determination of Building Inspector. On any lot containing more than one building, the Building Inspector, or his designee, shall be authorized to decide which buildings shall be uniquely numbered. §94-5. Size and display of numbers. A. Size. (1) On all lots containing single family homes in residential districts, the figures comprising the Identifying Number are to be reflective and at least four inches in height with a minimum width of 0.5 inches (12.7mm). (2) On all lots containing multi-family homes in residential districts, or any buildings in commercial districts, or any building on any lot operating under a Special Permit, the figures comprising the Identifying Number are to be reflective and at least six inches in height with a minimum width of 0.5 inches (12.7mm). (3) If the building upon which the number is to be displayed is not visible from the street, or is more than fifty (50) feet from the edge of the right-of-way (whether improved or not) of the street or road serving the building, the number shall be displayed on a mailbox, lamppost, sign, pole, driveway marker or other non-building structure, of at least four feet in height and not exceeding 10 feet in height in a prominent and conspicuous place readily visible from the road or street and in no event further back than five (5) feet from said road or street right-of-way. Where numbers are affixed or placed on a driveway markersaid non-building structures, such marker must be no more than five (5) feet from the driveway. B. Font. The displayed numbers shall be block Arabic numerals. C. Color. The color of said figures shall be in sharp contrast to the color of the background. §94-6. Visibility from Roadway. A. To the maximum extent practicable, identifying numbers shall be displayed in such a manner as to be plainly legible and visible from the center of the street of address when facing the building at all times between sunrise and sunset. B. To the maximum extent practicable, the numbers shall be placed so that they are seen from either direction while driving on the street or road. C. The numbers shall not be placed on any door of a building, garage, or any other door. {01230620.docx.} Chapter 94 Building Numbering FOR BOT DISCUSSION ONLY 5-13-2022 D. The numbers shall not be obstructed by trees, shrubbery, porches or other extensions of the building, shoveled or plowed snow, or any other obstruction. E. Lighting. Wherever practicable, the numbers shall be reflective and placed near a light or other source of downward illumination so that the numbers may be readily seen at night. §94-7. Signage required on shared driveways. On parcels where more than one building accesses the street from a single driveway or roadway, an Identifying Number or directional signage for each building must be displayed and maintained at each location where the driveway access diverges from the common access to the street. §94-8. Rear Identifying Numbers required All multi-family homes, multi-tenant commercial buildings, and any building on a lot operating under Special Permit, shall also display and maintain an Identifying Number upon, above, or to the side of each exterior door facing the rear of such property. §94-9. Display of other numbers prohibited. The display of any number other than the Identifying Number authorized or assigned by the Building Inspector is prohibited. §94-10. Private roads and new Village roads. A. New subdivisions. Prior to final approval by the Planning Board, in any subdivision which has one or more private roads or proposed new Village roads, the developer or owner shall propose a name of each such road. The name of all private roads and proposed new Village roads shall be approved by the Village Board prior to Planning Board approval or as a condition of final subdivision approval. The Planning Board and the owner shall notify the Superintendent of the Department of Public Works, the Building Inspector, Fire Department, Ambulance Department, and Briarcliff Manor Police Department, and Westchester County Department of Emergency Services of the new road name and location. B. Existing properties. Any existing private road or driveway which serves three or more buildings, separate parcels and/or building lots shall be considered a private road. Such private roads shall be named according to the policies approved by a resolution of the Board of Trustees. C. Signage. The approved name of a private road and of a proposed new Village road shall be posted by a street sign at each intersection of the road. All signs shall be similar in terms of construction and character to those signs installed by the Village of Briarcliff Manor for public roadways. The private road signs shall state the name of the private road, and shall include, under the name, the words “Private Road” in smaller letters. For private roads existing and not signed at the date of adoption of this chapter, the Superintendent of the Department of Public Works shall purchase and install the signs. In all new subdivisions the signs shall be installed prior to issuance of any building permits and construction of any structures, and the signs shall {01230620.docx.} Chapter 94 Building Numbering FOR BOT DISCUSSION ONLY 5-13-2022 be paid for and installed by the owner or developer. §94-11. Noncompliance; notice; remedy; costs. A. Noncompliance deemed a violation. The failure of any person, corporation, partnership or other entity owning a building within the Village of Briarcliff Manor to comply with the requirements of this chapter within 30 days after initial notice from a Code Enforcement Officer, shall be deemed a violation of this chapter. B. Non-maintenance deemed a violation. The failure of any person, corporation, partnership or other entity owning a building within the Village of Briarcliff Manor to maintain the numbers in accordance with the requirements of this chapter shall be deemed a violation of this chapter. C. Service of notice. A notice of violation may be given by personal service or by certified mailing to the last known address of the owner as shown on the most recent assessment roll on file in the Assessor’s office of the Village of Briarcliff Manor. D. Numbering of building and property by Village. In the event of the failure, neglect or refusal of any owner and/or occupant/tenant, after notice, to comply with the requirements of this chapter, the Building Inspector, or his designee, may cause said building and property to be numbered in accordance with the requirements of this chapter to the extent practicable. E. Report; assessment of costs. The Building Inspector shall report the cost of said numbering to the Village Board, and the Village Board shall order said cost to be levied and assessed as a lien against the property of the owner and collected in the same manner as other Village taxes. The remedy provided in these subsections D and E shall be in addition to, and not in lieu of, the penalties provided in section 94-12 hereunder. §94-12. Penalties for offenses. Any person, corporation, partnership or other entity violating any of the provisions of this chapter shall, upon conviction, be guilty of a violation punishable by a fine not to exceed $250. Each calendar week or portion thereof that said violation continues shall be deemed a separate and distinct violation. §94-13. Enforcement official. This chapter shall be enforced a by any Code Enforcement Official, Officer as defined in Chapter 104 or as defined herein., or any other officer or employee designated by resolution of the Village Board of Trusteesduly authorized representee. §94-14. Conflict with NYS Law. If any provision of this chapter conflicts with the Property Maintenance Code of New York State, the more restrictive provision shall prevail. {01230620.docx.} Chapter 94 Building Numbering FOR BOT DISCUSSION ONLY 5-13-2022 Section 2. Severability. The invalidity of any word, section, clause, paragraph, sentence, part or provision of this local law shall not affect the validity of any part of this local law which can be given effect without such valid part or parts. Section 3. Effective Date. SCHEDULE PUBLIC HEARING – AMEND CHAPTER 207, VEHICLE AND TRAFFIC BE IT RESOLVED that a Public Hearing is hereby scheduled for the June 21, 2022 Board of Trustees meeting at 7:30pm at the William J. Vescio Community Center located at 1 Library Road, Briarcliff Manor, New York to hear and discuss a proposed local law to amend Chapter 207, Vehicle and Traffic of the Code of the Village of Briarcliff Manor. A LOCAL LAW AMENDING CHAPTER 207 ENTITLED “VEHICLES AND TRAFFIC” IN THE CODE OF THE VILLAGE OF BRIARCLIFF MANOR Section 1. Chapter 207 of the Code of the Village of Briarcliff Manor entitled “Vehicles and Traffic” is amended as follows: Article I General Provisions § 207-1 Definitions. A. The words and phrases used in this chapter shall, for the purposes of this chapter, have the meanings respectively ascribed to them by Article 1 of the Vehicle and Traffic Law of the State of New York. B. The following words and phrases, which are not defined by Article 1 of the Vehicle and Traffic Law of the State of New York, shall have the meanings respectively ascribed to them in this section for the purposes of this chapter: CURBLINE The prolongation of the lateral line of a curb or, in the absence of a curb, the lateral boundary line of the roadway. HOLIDAYS New Year's Day, Lincoln's Birthday, Washington's Birthday, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving Day and Christmas Day. MOTOR VEHICLES Includes all vehicles propelled by power and shall include motorcycles and motor scooters. MUNICIPAL PARKING LOTS All parking lots within the Village of Briarcliff Manor controlled, owned, or operated by the Village. OFFICIAL TIME STANDARD Whenever certain hours are named herein or on traffic control devices, they shall mean the time standard which is in current use in this state. PERMIT-ENFORCED PARKING Parking restricted to those vehicles displaying a lawfully acquired permit provided by the Village of Briarcliff Manor. TIME-LIMITED PARKING Parking restricted to a limited amount of continuous time for a fee paid, where applicable, as may be implemented, monitored and enforced by signage, patrol, pay stations, cameras, or any other technology approved by resolution of the Briarcliff Manor Board of trustees. § 207-2 Authority to install traffic control devices. The Village Manager shall have traffic control devices installed and maintained as requiredThe Village Manager shall oversee the placement and maintenance of traffic-control devices, conforming to the NYS {01229388.doc.2} manual and specifications for a uniform system of traffic-control devices, as he may deem necessary to indicate and effect the provisions of this chapter and other local traffic ordinances, orders, rules or regulations, and to otherwise regulate, warn, or guide traffic, as permitted under the provisions of this chapter and §§ 1682 and 1684 of the Vehicle and Traffic Law of the State of New York. § 207-3 Adoption of regulations. A. Regulations may be adopted by the Board of Trustees in accordance with provisions of the Village Law and the Vehicle and Traffic Law. B. Pursuant to and consistent with Vehicle and Traffic Law § 1603, and unless otherwise indicated herein, the Village Manager is hereby authorized to promulgate rules and regulations, to be exercised in a manner consistent with the provisions of Vehicle and Traffic Law Article 39, and to revoke, alter or amend such rules and regulations with respect to the following:related thereto. (1) Designation and marking of parking spaces or stalls and placement of signs in any street or portion thereof, or in any public parking area maintained by the Village. Where appropriate, such rules and regulations may designate the direction in which a motor vehicle shall be faced when parking in any such parking space or stall. (2) Designation of an intersection within the Village as a stop intersection. (3) Designation of locations for traffic control devices. No motor vehicle, motorcycle or other vehicle of any description whatever shall be run, driven or operated upon Village highways within the Village of Briarcliff Manor at a rate of speed greater than the rates of speed hereinafter specified: A. The speed limit for motor vehicles, motorcycles and other vehicles on all Village highways located within the Village of Briarcliff Manor is established at 30 miles per hour, except as provided in Subsection B and § 207-6 of this chapter. B. No southbound driver on Route 9, S.H. 5361, shall enter the intersection of Route 9 with Revolutionary Road in the Village of Briarcliff Manor, unless there is sufficient unobstructed space beyond the intersection to accommodate the vehicle he or she is operating, notwithstanding any traffic control signal indication to proceed. B. No driver on North State Road shall block the entrance/exit of the shopping center known as 72-94 North State Road as identified with "DO NOT BLOCK" signage or pavement markings, as said markings may be amended from time to time. C. No person shall drive a vehicle into the following intersections when making a turn unless there is adequate space on the opposite side of the intersection to complete the turn and accommodate the vehicle, notwithstanding the indication of any traffic control signal which would permit the driver to proceed: (1) Route 9 southbound at Revolutionary Road; (2) North State Road, in either direction, at the entrance/exit to the shopping center at 72-94 North State Road (the "Squires" Shopping Center); and (3) Pleasantville Road, northbound or southbound, at the traffic light, at 1192 Pleasantville Road. D. No vehicle shall stop, stand, or park in any intersection, or in any portion of any roadway, marked with signage or pavement markings such as "Do Not Block," or similar language to prevent gridlocking or interfering with the free flow of traffic, or inhibiting vehicles from entering or exiting any driveway. § 207-17 Restricted traffic lanes in parking area adjoining Scarborough Station. A. The traffic lanes in the parking area adjoining Scarborough Station are hereby designated as restricted traffic lanes, and vehicles shall pass or move in said traffic lanes only in the directions indicated by signs posted within the parking area by the Village of Briarcliff Manor. B. The curbside lane on the northerly side of the traffic lane bordering Kemeys Cove in the parking area adjoining Scarborough Station shall be used only for the discharge and pickup of railroad passengers, and no vehicle shall park, stand or stop in said lane for any other purpose. C. The turning area at the northwest corner of the parking area, adjoining the northbound platform of the {01229388.doc.2} Metro-North Railroad, shall be a restricted area, and no private vehicle shall park in said area. The Police Department of the Village is hereby authorized to designate and to mark or indicate by suitable lines or markers, or by suitable signs, as a taxicab stand, sufficient to accommodate four taxicabs, a portion of the parking area immediately adjacent to and along that portion of the northbound platform of the Scarborough Station of the Metro North Commuter Railroad lying south of the station building. Any area so designated is hereby reserved and shall be used only for the parking or standing of taxicabs in the picking up or discharging of passengers at such railroad station. § 207-29 Bus stops. The following described locations are hereby designated as bus stops. No person shall park a vehicle in any designated bus stops. No. 5-2018] The parking of motor vehicles is hereby prohibited on all Village streets, and highways and municipal parking lots within the Village of Briarcliff Manor between the hours of 2:00 a.m. and 6:00 a.m., beginning each year on December 1 and ending on the following March 31, except at Scarborough Station where the prohibition is between the hours of 3:00 a.m. and 6:00 a.m. and subject to § 207-32E hereof. § 207-32 Parking at Scarborough Train Station. A. The use of the parking area, or portions thereof, owned or leased by or under the control of the Village of Briarcliff Manor at the Scarborough Railroad Station is hereby restricted to motor vehicles displaying, in a manner to be directed by resolution of the Board of Trustees, a parking permit issued by the Village of Briarcliff Manor. B. Upon written application on the form supplied by the Village Clerk and upon payment of the required permit fee which shall be set forth by the Village Board of Trustees in the Master Fee Schedule, which {01229388.doc.2} may be amended, and submission of proof satisfactory to the Village Clerk that the applicant is a bona fide resident of the Village of Briarcliff Manor, the Village Clerk shall issue a parking permit for each motor vehicle for which application is duly made. C. Parking permits shall be offered for suchA. Parking within the Scarborough municipal parking lot may include designated areas allowing Time-Limited Parking and Permit-Enforced Parking. Consistent with the powers of § 207-3, such designated parking areas shall be defined and marked under the direction of the Village Manager. The locations and parking capacity of each area may be changed from time to time. B. Authorization for parking in any areas designated as Time-Limited or Permit-Enforced Parking shall be offered for such fees and time periods as authorized by a resolution of the Board of Trustees at rates to be published in the Master Fee Schedule. Resident and nonresident rates may be established, and resident permits shall be issued only to current residents of the Village of Briarcliff Manor. [Amended 10-6-2020 by L.L. No. 9-2020] C. Vehicles parked in Permit-Enforced Parking areas shall display proof of a duly issued permit. Such permit may be provided after submitting a written application on a form supplied by the Village Clerk, satisfactory proof of residency as determined by the Village Clerk, and payment of any required permit fee as may be determined by a resolution of the Village Board of Trustees and published in the Master Fee Schedule, which may be amended from time to time. D. A replacement permit for any period shall be issued upon proof of loss of such permit, reapplication and payment of the required permit replacement fee, which shall be set forth by the Village Board of Trustees in the Master Fee Schedule, which may be amended. A permit may be transferred to a different vehicle owned by the same applicant or his or her spouse, upon reapplication and payment of the required transfer fee, which shall be set forth by the Village Board of Trustees in the Master Fee Schedule, which may be amended. E. No commercial vehicle shall be permitted to park in any Time-Limited or Permit-Enforced Parking area. F. Except where necessary to provide emergency services to a disabled vehicle, no mechanical work may be performed on any vehicle located within the designated parking areas. G. Notwithstanding theany other provisions of any other section requiring the purchase and display of permits issued by the Village of Briarcliff Manor207-32, no parking permit nor fee shall be required to park at the Scarborough Railroad Station in the parking areas owned or leased by or under the control of the Village, such parking areas shall be available for parking of motor vehicles, with or without the permit issued by the Village of Briarcliff Manor: [Amended 7-25-2018 by L.L. No. 5-2018] from: (1) (1) Beginning on April 1 and ending on the following November 30, between the hours of 6:00 p.m. on Friday tothrough 6:00 a.m. on Monday; and (2) (2) Beginning on December 1 and ending on the following March 31, duringbetween the hours fromof 6:00 ap.m. on Saturday to 3:00 a.m. on Sunday, fromFriday through 6:00 a.m. Sunday to 3:00 a.m. on Monday,; and from {01229388.doc.2} (2)(3) All day on any published Village holiday, provided that no parking shall be permitted during these calendar days from 3:00 a.m. to 6:00 a.m. on a legal holiday to 3:00 a.m. on the day following a legal holiday. to allow for snow plowing or any other required property maintenance. § 207-33 Manner of parking. No motor vehicle shall be parked on such streets or parking areas where parking spaces or stalls have been designated and marked pursuant to this chapter, unless such motor vehicle is wholly within such a marked or indicated parking space or stall and, where so designated, faced in the direction designated. B. Except temporarily in the event of an emergency, no person shall park: (1) Partly or wholly upon the shoulder or any unpaved portion of any Village, County or State-owned roadway, except for municipal or public utility employees while performing services to the Village; (2) In a Village easement area or right-of-way owned by another property owner, except with the permission of such owner; (3) In any direction other than parallel to and facing the flow of traffic; or (4) In any case where doing so would obstruct the free flow of traffic or otherwise create a hazardous condition for passing vehicles, cyclists, or pedestrians. § 207-34 Seasonal restriction in vicinity of Neighborhood Park. A. Parking shall be controlled on a seasonal basis in the vicinity of Neighborhood Park. These restrictions will be varied on a seasonal basis. No parking shall be allowed along the following roads as defined below. The use of the parking areas located in thewithin off-street municipal parking north of the Village pocket park located on Pleasantville Road is herebylots may be restricted to one-hour, two-hourby duration, type of vehicle, payment of fee, and twenty-minute parking in such locationspermitted hours and days, as may be determined appropriate by a resolution of the Village Board of Trustees, and as may be amended from time to time. B. Time limits and fees, if any, for the use of any restricted parking spaces in all Municipal Parking Lots shall be visibly posted, be it for Permit Enforced Parking, Time Enforced Parking, or any combination thereof. C. Residents of the Village may, at the sole discretion of the Village Manager, reserve exclusive use of parking spots available outside of regular business hours within Municipal Parking Lots by submitting an application for approval to the Village Clerk and paying a fee, as determined by a resolution of the Village Board of Trustees and published in the Master Fee Schedule, and as may be amended from time to time. D. The parking of motor vehicles is hereby prohibited in all Municipal Parking Lots within the Village of Briarcliff Manor between the hours of 2:00 a.m. and 6:00 a.m., beginning each year on December 1 and ending on the following March 31. E. Except where necessary to provide emergency services to a disabled vehicle, no mechanical work may be performed on any vehicle located within the designated parking areas. F. A. Except where angle parking is authorized, every vehicle stopped, standing, or parked partly upon a roadway shall be so stopped, standing, or parked parallel to the curb or edge of the roadway. On a one- way roadway, such vehicle shall be facing in the direction of authorized traffic movement, with its right- hand wheels within 12 inches of the right-hand curb or edge of the roadway, or its left-hand wheels within 12 inches of the left-hand curb or edge of the roadway; on a two-way roadway, such vehicle shall be facing in the direction of authorized traffic movement on that portion of the roadway on which the vehicle rests, with its right-hand wheels within 12 inches of the right-hand curb or edge of the roadway. B. Except when necessary to avoid conflict with other traffic, or when in compliance with law or the directions of a police officer or official traffic-control device, no person shall: (1) Stand or park a vehicle, whether occupied or not, except momentarily to pick up or discharge a passenger or passengers in front of a public or private driveway; (2) Stop, stand or park a vehicle on a sidewalk; (3) Stop, stand or park in a crosswalk; (4) Stand or park on the roadway side of any vehicle stopped, standing or parked at the edge or curb of a street; (5) Except where angle parking is authorized, every vehicle stopped, standing, or parked wholly upon a one-way roadway. C. Marked Village vehicles performing Village business, or those vehicles otherwise displaying a permit issued by the Village Manager, are specifically exempted from parking limitations of this Chapter 207. Article IV Removal and Storage of Vehicles § 207-37 Authority to impound vehicles. A. When any vehicle is parked or abandoned on any highway or public parking lot within this municipality during a snowstorm, flood, fire or other public emergency which affects that portion of the public highway or parking lot upon which said vehicle is parked or abandoned, said vehicle may be removed by or under the direction of the Briarcliff Manor Department of Public Works and/or the Briarcliff Manor Police Department. B. When any vehicle is found unattended on any highway or public parking lot within the municipality where said vehicle constitutes an obstruction to traffic, said vehicle may be removed by or under the direction of the Briarcliff Manor Department of Public Works and/or the Briarcliff Manor Police Department. {01229388.doc.2} C. When any motor vehicle is parked or abandoned on any street or highway within the Village of Briarcliff Manor where stopping, standing or parking is prohibited, said motor vehicle may be removed by or under the direction of the Briarcliff Manor Department of Public Works and/or the Briarcliff Manor Police Department. § 207-38 Storage and charges. After removal of any vehicle as provided in this article, the Briarcliff Manor Department of Public Works and/or the Briarcliff Manor Police Department may store or cause such vehicle to be stored in a suitable place at the expense of the owner. The reasonable charges for removal and storage shall be paid to the Village Clerk by the owner or his or her agent and should be deposited to the credit of the appropriate Village account. Such vehicle shall be released only to the owner or his or her duly authorized agent upon the production of proof of ownership satisfactory to the Chief of Police and upon production of payment of the reasonable expenses and charges for such removal and storage. Charges for such removal shall be set forth by resolution by the Village Board in the Master Fee Schedule, which may be amended, and storage charges shall be as set forth by resolution of the Village Board as set forth in the Master Fee Schedule, which may be amended. The Chief of Police and the Superintendent of Highways are authorized to use Village equipment, if available, and, if not, to authorize or lease from others or contract for tow trucks and other necessary equipment required for such purpose. § 207-39 Notice of removal. It shall be the duty of the Briarcliff Manor Police Department to ascertain to the extent possible the owner of the vehicle or the person having the same in charge and to notify him of the removal and disposition of such vehicle and of the amount which will be required to redeem same. Said Briarcliff Manor Police Department shall also, without delay, report to the Village Clerk the removal and disposition of any vehicle removed as provided in this article. Article V Fire Lanes § 207-40 Establishment of fire lanes. A. The Village Board of Trustees of the Village of Briarcliff Manor may establish fire lanes with respect to the parking areas and driveways on private property, as set forth in New York State Vehicle and Traffic Law § 1640-a, as same may be amended, to be devoted to public use where the parking and standing of motor vehicles or other obstructions may interfere with the ingress of Fire Department or other emergency vehicles for the protection of life and property, and pursuant to the written request of either the property owner, the person in general charge of the operation and control of such areas, the Fire Chief of the Fire Department or the Police Chief of the Police Department serving such area. B. Fire lanes shall be marked with standard signs and/or such other markings and signs which conform to accepted sign standards as set forth in the New York State Manual of Uniform Traffic Control Devices and the National Fire Protection Association and which are necessary by the Fire Chief of the Fire Department serving the Village of Briarcliff Manor or the Building Inspector of the Village of Briarcliff Manor. Such signs and markings shall be installed by the Village of Briarcliff Manor following 120 days' written notice by the Fire Chief of the Fire Department serving the affected area of the Village of Briarcliff Manor or the Building Inspector of the Village of Briarcliff Manor to the affected property owner, designating and depicting areas and locations of such signs and markings. The fire lane shall be effective upon the installation of signs and/or markings giving notice of the fire lane. {01229388.doc.2} C. Fire lanes shall be located at the following properties, in such areas and of such size as more fully set forth in the maps of the individual properties set forth below and on file in the Village Clerk's office: (Reserved) D. The parking, placing, stopping or standing of any motor vehicle or any other object or material within any area designated as a fire lane shall be a violation of this article. It shall be the duty of the Police Department of the Village of Briarcliff Manor and the Village's duly appointed fire inspectors, building inspectors and code enforcement officers to inspect and enforce fire lanes and to see that the lanes are maintained free from obstruction. In addition to the penalties set forth in § 207-50 of this chapter, the Police Department shall have the authority to have any motor vehicle, object or material in violation of this article towed or otherwise removed at the owner's expense. § 207-41 Hydrants and standpipes. A. Notwithstanding and not in limitation of any other provisions hereof, no automobile, truck or other motor vehicle and no physical object or material of any nature shall be parked, placed or permitted to remain for any length of time whatever within 15 feet in any direction from any fire hydrant located on private property. B. A minimum clearance of three feet in any direction from the fire standpipe and sprinkler siamese connections shall be maintained at all times to allow the Fire Department serving the affected area of the Village of Briarcliff Manor adequate access to same. Article VI Inspection and Registration of Vehicles § 207-42 Certificate of inspection required. No motor vehicle shall be operated or parked on the public highways of this state unless a certificate or certificates of inspection, as required by New York State Vehicle and Traffic Law § 306(b), is or are displayed upon the vehicle or affixed to the registration certificate for the vehicle. § 207-43 Registration required. No motor vehicle shall be operated or driven upon the public highways of the Village without first being registered in accordance with the provisions of New York State Vehicle and Traffic Law § 401(1)(a). Article VII Enforcement and Penalties § 207-44 Enforcement. A. It shall be the duty of the Police Department of the Village of Briarcliff Manor and the Village's duly appointed fire inspectors, building inspectors and code enforcement officers to enforce the provisions of this chapter. B. There shall be a presumption of validity of any notice, notice of violation, ticket, summons, or other enforcement action. C. There shall be a rebuttable presumption that the owner of a vehicle was the operator of such vehicle at the time of the issuance of a summons for a violation in connection with any provision of this article {01229388.doc.2} relating to parking of a motor vehicle. § 207-45 Notice of violation; summons. Any police officer of the Village of Briarcliff Manor Police Department shall issue a summons for the violation of this chapter to the owner or any person operating or controlling any automobile, truck or motor vehicle parked or placed within any restricted fire zone or lane as hereby designated or within 15 feet in any direction from any fire hydrant located on private property. Whenever any other violation of any of the provisions of this chapter is found to exist, it shall be reported by either the Fire Chief or fire inspectors of the Fire Department serving the affected area of the Village of Briarcliff Manor to the Building Inspector of the Village of Briarcliff Manor or reported by the Building Inspector or by the Code Enforcement Officer. The Building Inspector or the Code Enforcement Officer shall then issue an order, directed to the owner or occupant of the premises affected, to remove any dangerous materials or remedy any other hazardous conditions as he may direct, within 24 hours, and, upon the failure or refusal of the person to whom such order is directed duly to comply with such order, the Building Inspector or Code Enforcement Officer shall issue an appearance ticket to such person for such violation. § 207-46 Service of orders. The service of any order hereunder may be made upon the occupant of the premises to which it is directed either by delivering a copy of the same personally or by leaving it with any person of suitable age and discretion in charge of such premises or, if no such person is found upon the premises, by affixing a copy thereof in a conspicuous place on the front door of said premises. An order may be served upon the owner of such premises by delivering to and leaving with him a copy thereof or, if such owner is absent from the Village, by mailing a copy to his last-known address. § 207-47 Refusal to permit inspection. It shall be unlawful for any person willfully to refuse to permit an inspection as provided herein. § 207-48 Compliance required. It shall be unlawful for any person, being the owner or occupant, lessee or otherwise in charge or control of any premises subject to an order made pursuant to this article, to fail or refuse to comply with such order within the time specified therein or to violate any of the provisions of this article. § 207-49 Penalties for speeding violations. Any person or persons, firm, partnership or corporation violating any of the provisions of § 207-5 of this chapter, entitled "Speed limits," and § 207-6, entitled "School speed limits," shall, upon conviction, be punished by a fine of not more than $100 or by imprisonment for not more than 30 days, or by both such fine and imprisonment, for a first conviction; by a fine of not more than $200 or by imprisonment for not more than 90 days, or by both such fine and imprisonment, for a second conviction within 18 months; and by a fine of not more than $500 or by imprisonment for not more than 180 days, or by both such fine and imprisonment, for a third or subsequent conviction within 18 months. § 207-50 Penalties for offenses. A. Penalties in general. Violation of any of the provisions of this chapter, except with respect to § 207-49 and those sections and subsections which provide for specific violations or which are referenced in Subsection B below, shall be punishable by a fine of $50; if such fine remains unpaid after 30 days of its issuance, same shall be increased to $100; if unpaid after 60 days of its issuance, same shall be increased to $130; and if unpaid after 90 days from its issuance, same shall be increased to $150 or by imprisonment for not more than 15 days, or by both such fine and imprisonment. {01229388.doc.2} B. I will provide tax certiorari special counsel services to the Village of Briarcliff Manor, which are anticipated to include, but not be limited to, the following: review and analysis of pending proceedings, including the analyses of appraisals and other property information; advising the Village on pending cases, proposed settlements, and potential future settlements (for both assessment and refund impacts); intervention and participation in the defense of tax certiorari proceedings pending against the Village; communications and meetings with Village, Town and School District personnel and counsel, appraisers and Petitioners’ counsel; and Court appearances. Working with Town and School District personnel and counsel (several of whom I have worked with for many years1), I will enhance and strengthen the defense of the tax certiorari proceedings. With a stronger defense, I anticipate that we will be able to resolve proceedings on more favorable terms, saving the Village money in refunds. Furthermore, I will provide information to the Village on pending proceedings, including proposed and potential future settlements, assessment reductions and refunds. This information will enable the Village to incorporate this information into its planning; moreover, this will give the Village the ability to provide me with feedback, so that I can work to structure settlements for the Village’s maximum benefit (or minimized loss), as the situation may call for (e.g., payment plans, timing for refund management, etc.) 1 I have worked with Marc Sharff, whose firm represents the Briarcliff Manor School District, since we were both at Plunkett & Jaffe in the mid-1990s; currently, Marc’s firm represents the Harrison School District, and I represent the Town/Village of Harrison, and we work together defending their pending tax certiorari proceedings. The Town of Ossining’s tax certiorari trial counsel, Dan Vincelette, is my co-tax certiorari counsel for the Pocantico Hills School District, which is partially in the Town of Mount Pleasant (where I have worked with the Assessor, Jim Timmings, and Chris Feldman, from the Town Attorney’s office, for years as well). Policy 3 The Village Manager is hereby authorized to accept any gift a) valued at $750 or less and not likely to create any additional financial expense to the Village; or b) as part of a fundraising program previously approved by a resolution of the Board of Trustees. All other donations of gifts to the Village shall be subject to the approval of a majority of members of the Board of Trustees. Hotel Occupancy Tax Upon motion by Deputy Mayor Chatzky, seconded by Trustee Mallett, the Board voted unanimously voted to approve the following resolution: BE IT RESOLVED the Village Manager is hereby authorized and directed to work with the our NYS Legislator and Elected Officials to request an act that amends the tax law authorizing the Village of Briarcliff Manor to impose Hotel Occupancy Tax.
