Village Board of Trustees Regular Meeting April 18, 2023 7:30 p.m. A Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held at the William J. Vescio Community Center on the 18th of April, 2023 commencing at 7:30 p.m. Present Steven A. Vescio, Mayor Peter S. Chatzky, Deputy Mayor Kevin Hunt, Trustee Rhea Mallett, Trustee Edward E. Midgley, Trustee Also Present Josh Ringel, Village Manager Christine Dennett, Village Clerk Josh Subin, Village Attorney David Turiano, Village Engineer Pledge of Allegiance Continued Public Hearing Fiscal Year 2023-2024 Tentative Budget The Board requested some changes to the budget. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Midgley, the Board voted unanimously to adjourn the public hearing to April 25, 2023 as amended. Roll Call: Trustee Mallett Aye Trustee Midgley Aye Trustee Hunt Aye Deputy Mayor Chatzky Aye Mayor Vescio Aye Continued Public Hearing - Property Tax Levy in Excess of the Limit Established in General Municipal Law §3-c Village Manager Ringel explained the proposed local law. The Board had general discussion regarding the proposed law. 1 Upon motion by Trustee Hunt, seconded by Deputy Mayor Chatzky, the Board voted unanimously to close the public hearing. Roll Call: Trustee Mallett Aye Trustee Midgley Aye Trustee Hunt Aye Deputy Mayor Chatzky Aye Mayor Vescio Aye Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the proposed local law authorizing a property tax levy in excess of the limit established in General Municipal Law §3-c is hereby adopted. Roll Call: Trustee Mallett Aye Trustee Midgley Aye Trustee Hunt Aye Deputy Mayor Chatzky Aye Mayor Vescio Aye Continued Public Hearing Amend Chapter 195, Taxation, Article VII Hotel Room Occupancy Tax Deputy Mayor Chatzky gave a brief synopsis of the proposed changes. The Board requested the two impacted properties be contacted. There were no public comments. Upon motion by Trustee Hunt, seconded by Deputy Mayor Chatzky, the Board voted unanimously to adjourn the public hearing to May 2, 2023 Continued Public Hearing Amend Chapter 178, Solar and Alternative Energy, Article III, Alternate Energy System PILOT Deputy Mayor Chatzky gave a brief synopsis of the proposed changes. There were no public comments. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to adjourn the public hearing to May 2, 2023. 2 Continued Public Hearing Special Use Permit Request - 345 Scarborough Road, Briarcliff Solar, LLC. Mr. William Null, Attorney for the Applicant, reviewed the revised submission. Mr. David Magid stated he wanted to be a contributing member to the community. Ms. Susan Jainchil, Landscape Architect for the Applicant, reviewed the visual analysis from various locations neighboring the property. The Board had general discussion regarding the application. Mr. Sal Maglietta of 100 Holbrook Road stated the recent submission were voluminous and a lot to review. He stated most solar farms were on bare properties and there were a lot of little red flags in the application. He stated the sewer was an easement and not a license agreement. He further stated he didn’t think it was the right property for a solar farm. Mr. Charles Blowe of 14 Colby Lane asked if the applicant had any affiliation with the prior owner. Mr. Jeb Weisman of 285 Scarborough Road stated he could see the property in the winter and asked how long the construction would take. Mr. Magid stated they had no affiliation with the prior owner and construction would take approximately eight months. He stated they’d have discussions with neighbors regarding visual impacts and the sewer issue. Ms. Carmin Santos of Sustainable Westchester reviewed the subscription benefits and the program would benefit the community as a whole. Mr. Maglietta stated he’d submit photos and videos of the site condition during a rain event. Mr. Jason Barn of EJ Electric stated there were challenges with Local Law 97 throughout the State. Village Attorney Subin stated the submission would be reviewed by the Village’s consultants. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Mallett, the Board voted unanimously to adjourn the public hearing to May 16, 2023. 3 Public Hearing Special Use Permit Request – IPPsolar Integration LLC, Chilmark Shopping Center, 1856 Pleasantville Road Upon motion by Deputy Mayor Chatzky, seconded by Trustee Midgley, the Board voted unanimously to open the public hearing. Mr. Maziar Dalaeli, Applicant, explained the proposed application. The Board had general discussion regarding the size, capacity, fire safety and potential noise. Village Engineer Turiano stated he’d review the noise and was engaging a fire safety consultant to review the plan as well. Mr. Charles Blowe of 14 Colby Lane stated he was glad the Board was looking into fire safety. Mr. Andrew Wolf of 15 Apple Lane asked if it caught on fire what the dangers to nearby homes would be and how loud 65 decibels were. Mr. Dalaeli stated there were several fire safety mechanisms including online monitoring, individual unit shut down capabilities and dispatching of first responders. Upon motion by Trustee Mallett, seconded by Deputy Mayor Chatzky, the Board voted unanimously to adjourn the public hearing to May 16, 2023. Board of Trustees Announcements  The Fire Department is hosting an Open House event on April 23rd.  Call for volunteers. Send letters of interest and resumes to BOT@briarcliffmanor.gov.  Recreation Advisory Committee:  There are many programs and events coming up.  Earth Day Celebration 4/22.  Picks and Pickleball 5/20.  The pool opens on 5/28.  The first summer concert is 6/2.  Summer help is needed. Library Board:  Many program offerings listed on their website. Village Manager’s Report  No report. 4  Village Engineer’s Report  An asbestos permit was issued for 1123 Pleasantville Road.  Cross Access bids are due.  1050 Pleasantville Road crews are returning tomorrow. Public Comments Mr. Charles Blowe of 14 Colby Lane stated construction began too early on Pleasantville Road last Saturday. He asked if the zig zag on the trail was still part of the plan. Village Engineer Turiano stated the zig zag component was part of the mobility project. Award of Bid – Hudson River Valley Greenway Grant – North County Trailway Connection VM-2021-5 (REBID) Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to approve the following resolution as amended: WHEREAS the Village received 6 bids for the Hudson River Valley Greenway Grant – North County Trailway Connection Project VM-2021-5 (REBID) and; NOW, THEREFORE, BE IT RESOLVED that the bid for the Hudson River Valley Greenway Grant – North County Trailway Connection VM- 2021-5 (REBID) is hereby awarded to Westchester Hills Landscaping Inc. per their bid of $74,745 to be charged as follows: Budget Code Amount H1680.201.22280 - VH and CC Communication Lines $46,693.82 H1680.201.22281 - VH IT Space Renovation $3,074.76 H7110.201.22781 - Walking Trail (Includes $72,550 Grant) $114,704.76 TOTAL: $164,473.34 BE IT FURTHER RESOLVED that the Village Manager is hereby authorized and directed to execute a contract with Westchester Hills Landscaping Inc. for said project. Upon motion by Trustee Hunt, seconded by Trustee Mallett, the Board voted unanimously to approve the following resolution: BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby approve the membership of Isabella Florez Monroy to the Scarborough Engine Company. Minutes Upon motion by Trustee Mallett, seconded by Deputy Mayor Chatzky, the Board voted unanimously to approve the minutes of the April 4, 2023 regular and organizational meetings.
