Village Board of Trustees Regular Meeting July 16, 2024 7:30 p.m. A Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held at the William J. Vescio Community Center on the 16th of July, 2024 commencing at 7:30 p.m. Present Steven A. Vescio, Mayor Peter S. Chatzky, Deputy Mayor Kevin Hunt, Trustee Rhea Mallett, Trustee Malcolm Netburn, Trustee Also Present Josh Ringel, Village Manager Josh Subin, Village Attorney Amy Karpati, EAC Chairperson Absent Christine Dennett, Village Clerk/Assistant Village Manager Pledge of Allegiance Continued Public Hearing to Amend Chapter 220-6, Special Permit Uses, Chapter 220, Table 2, Permitted Lot Sizes, Setbacks, Height Requirements (Residential) and Table 3, Permitted Principal and Accessory Uses (Commercial) Deputy Mayor Chatzky gave a brief synopsis of the proposed changes and noted comments were received from Westchester County. He stated further information and clarification would be provided to them. There were no public comments. Upon motion by Trustee Hunt, seconded by Trustee Mallett, the Board voted unanimously to close the public hearing. The Board had general discussion regarding amendments to the resolution to include SEQR and stated a vote on the resolution would occur once it was sorted out. Public Hearing to amend Chapter 220, Table 4 Permitted Lot Sizes, Setbacks, Height Requirements (Commercial) and Chapter 220-2, Definitions Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to open the public hearing. Deputy Mayor Chatzky gave a brief synopsis of the proposed changes. There were no public comments. Upon motion by Trustee Netburn, seconded by Deputy Mayor Chatzky, the Board voted unanimously to adjourn the public hearing to August 6, 2024. Amend Chapter 220-6, Special Permit Uses, Chapter 220, Table 2, Permitted Lot Sizes, Setbacks, Height Requirements (Residential) and Table 3, Permitted Principal and Accessory Uses (Commercial) Upon motion by Trustee Netburn, seconded by Deputy Mayor Chatzky, the Board voted unanimously to approve the following resolution as amended: SEQR NEGATIVE DECLARATION AMENDMENTS TO VILLAGE CODE CHAPTER 220-6 AND 220 TABLES 2 AND 3 WHEREAS, the Board of Trustees of the Village of Briarcliff Manor, Westchester County, New York, is proposing minor amendments to Village Code Chapter 220-6 Special Permit Uses and Chapter 220 Attachment 2, Table 2 and Attachment 3, Table 3 (the “Proposed Action”); and WHEREAS, pursuant to 6 NYCRR Part 617 (“SEQR”) the Project is classified as an Unlisted Action; and WHEREAS, the Board of Trustees of the Village of Briarcliff Manor have conducted an Uncoordinated Review of the Proposed Action under SEQR and is the Lead Agency for the SEQR review of this Unlisted Action; and WHEREAS, the Board of Trustees of the Village of Briarcliff Manor reviewed a Short Environmental Assessment Form (Short EAF) Parts 1, 2 and 3 dated June 21, 2024. NOW THEREFORE BE IT RESOLVED, that pursuant to 6 NYCRR Part 617, State Environmental Quality Review, the Board of Trustees of the Village of Briarcliff Manor hereby confirms its Lead Agency designation for the SEQR Review of the Proposed Action. BE IT FURTHER RESOLVED, that pursuant to Part 617 of the implementing regulations pertaining to Article 8 (State Environmental Quality Review Act) of the Environmental Conservation Law, the Lead Agency has determined that the Proposed Action will not have a significant adverse effect on the environment for the reasons enumerated in the attached Negative Declaration Form (Short EAF Part 3). BE IT FINALLY RESOLVED that this SEQR Negative Declaration resolution shall have an effective date of July 16, 2024. LOCAL LAW ADOPTION BE IT RESOLVED that the proposed local law to amend Chapter 220, Table 4 Permitted Lot Sizes, Setbacks, Height Requirements (Commercial) and Chapter 220-2, Definitions is hereby adopted. Hours are posted and may be impacted by swim meets. o Briarcliff Bash at Neighborhood Park is rescheduled for 7/31. o Briarcliff Bash at Scarborough Park is scheduled for 8/11. o Community Day 9/7.  Residents are reminded to curb and leash their dogs.  Residents are encouraged to join the Fire Department. Village Manager’s Report  Procedures for proper paint disposal were sent out.  A greenhouse gas inventory will be done at no cost to the Village. It will be used for future Climate Smart grants and programs. Committee Report – Environmental Advisory Council Dr. Amy Karpati, Chairperson of the EAC gave an overview of some programs and initiatives they’ve been working on including plantings around the Village, collaborations with other committees and staff, and public outreach. The Board thanked the EAC and stated there was a noticeable difference in the Village. Public Comments There were no public comments. JAM 555 Storage, LLC – 555 Pleasantville Road - Special Use Permit Presentation Mr. David Steinmetz, Attorney for the Applicant, explained the proposal for an adaptive re-use of one of the existing building to convert it to self-storage. Mr. Paul DuMont, Engineer for the Applicant, explained the site plan. Mr. Steven LaRocco, Architect for the Applicant, reviewed the overall plan for the site’s use including access, landscaping, staffing and hours. The Board had general discussion regarding parking, occupancy, traffic and the overall process of the Special Use Permit. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Netburn, the Board voted unanimously to refer the application to the Village Planning Board and the Westchester County Planning Board for review and comment and to schedule a public hearing for Tuesday, August 20, 2024 at 7:30pm in the William J. Vescio Community Center. Roll Call: Trustee Hunt Aye Trustee Mallett Aye Trustee Netburn Aye Deputy Mayor Chatzky Aye Mayor Vescio Aye Resolution of the Board of Trustees Authorizing Submission of Climate Smart Communities Grant Application (Law Park Drainage Basin Phase 3 Project) Village Manager Ringel thanked Village Engineer, Kevin Leddy and Superintendent of Public Works, Greg McCann for completing on short notice. Upon motion by Trustee Hunt, seconded by Deputy Mayor Chatzky, the Board voted unanimously to approve the following resolution as amended: WHEREAS the Village of Briarcliff Manor hereby requests financial assistance from the New York State Climate Smart Communities Grant Program pursuant to Environmental Conservation Law Article 54, Title 15. WHEREAS the Village of Briarcliff Manor certifies that it has identified $1,581,797 in matching funds from the Village’s capital bonded funds pursuant to the grant program requirements. The matching funds represent 50% of the total project cost. NOW THEREFORE BE IT RESOLVED that the Board of Trustees of the Village of Briarcliff Manor hereby authorizes Joshua Ringel, Village Manager, and Christine Dennett, Assistant Village Manager, employees, to act on its behalf in submittal of an application through the Consolidated Funding Application for a grant in the amount of $3,163,595 to be used for the Law Park Drainage Basin Phase 3 project. Upon motion by Trustee Hunt, seconded by Deputy Mayor Chatzky, the Board voted unanimously to approve the following resolution: BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby approves the membership of Caroline Weber to the Briarcliff Manor Fire Department. BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby approves the membership of Katerina Trantzas to the Briarcliff Manor Fire Department. Minutes Deputy Mayor Chatzky noted his name was mentioned 21 times and the minutes were well done. Upon motion by Trustee Netburn, seconded by Deputy Mayor Chatzky, the Board voted unanimously to approve the minutes of the July 2, 2024 regular meeting.
