Village Board of Trustees Executive Session December 17, 2024 6:59 p.m. An Executive Session of the Board of Trustees of the Village of Briarcliff Manor, New York was held at the William J. Vescio Community Center on the 17th of December, 2024 commencing at 6:59 p.m. Present Steven A. Vescio, Mayor Peter S. Chatzky, Deputy Mayor Kevin Hunt, Trustee Malcolm Netburn, Trustee Also Present Josh Ringel, Village Manager Josh Subin, Village Attorney Christine Dennett, Village Clerk/Assistant Village Manager Upon motion by Trustee Netburn, seconded by Deputy Mayor Chatzky, the Board voted unanimously to adjourn into an Executive Session to discuss a real estate matter. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Netburn, the Board voted unanimously to authorize the Village Attorney to execute an agreement for an appraisal for real property. Vescio Community Center on the 17th of December, 2024 commencing at 7:30 p.m. Present Steven A. Vescio, Mayor Peter S. Chatzky, Deputy Mayor Kevin Hunt, Trustee Rhea Mallett, Trustee via Zoom Malcolm Netburn, Trustee Also Present Josh Ringel, Village Manager Josh Subin, Village Attorney Christine Dennett, Village Clerk/Assistant Village Manager Pledge of Allegiance Village Manager Ringel noted that Trustee Mallett was attending the meeting via zoom. Continued Public Hearing to Amend Chapter 90, Vacant Building Registry Deputy Mayor Chatzky gave a brief synopsis of the proposed changes. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Netburn, the Board voted unanimously to adjourn the public hearing to January 7, 2025. Public Hearing to Amend a Special Use Permit and Intent to Declare Lead Agency – Trump National Upon motion by Trustee Hunt, seconded by Deputy Mayor Chatzky, the Board voted unanimously to open the public hearing. Mr. Michael Kapareiko, Geologist, explained the request to install irrigation wells. Deputy Mayor Chatzky requested a fiscal analysis be submitted to include water usage and potential revenue impacts. Dr. Amy Karpati of 209 Willow Drive stated she hoped the DEC looked into the impact to surface waters and how long the aquifers would take to recharge. Mr. Steve Dimovski, Architect for the Applicant, reviewed the request for the storage building. The Board had general discussion regarding the location, impact to the easement and requested information on what the easement was for and what it serviced. Upon motion Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to approve the following resolution: LEAD AGENCY DETERMINATION BE IT RESOLVED that the Village of Briarcliff Manor Board of Trustees issues this Notice of Intent for the purpose of determining lead agency pursuant to the requirements of the State Environmental Quality Review Act (SEQRA) and Part 617 (6NYRR Part 617), the Statewide implementing regulations pertaining to SEQRA. If no written objections are received the Village of Briarcliff Manor Board of Trustees will assume lead agency 30 days after the date of this notice. This notice has been prepared pursuant to Article 8 of the Environmental Conservation Law. Project Title: Trump National Golf Club Westchester Project Location: 100 Shadow Tree Lane, Village of Briarcliff Manor, Westchester County, New York SEQRA Type: Unlisted Action Project Description: The Trump National Golf Club Westchester (the “Applicant”) is seeking an Amended Special Use Permit from the Village of Briarcliff Manor Board of Trustees to install a new 2,138 square foot single‐story prefabricated storage building and drill and construct up to seven additional irrigation test wells (the “Project”) on their property located at 100 Shadow Tree Lane within the R40B Zoning District in the Village of Briarcliff Manor, NY (the “Project Site”). The new building would be constructed in an existing paved area adjacent to the tennis courts and would be used for equipment and supply storage by the maintenance staff. The seven proposed test well locations are located within existing maintained areas of the golf course and would be used to replenish the Irrigation Pond and reduce the use of purchased municipal water as an irrigation source. Several of the test wells are located in designated wetland buffer areas and areas with steep slopes between 15% ‐ 25%. Committee Reports – Environmental Advisory Council Update Dr. Amy Karpati, Chairperson of the EAC, gave an overview of projects the Council had been working on • Various Planting Plans throughout the Village. • A pollinator garden was installed at the school in conjunction with the Girl Scouts. • A pollinator garden will be installed at the Library in the Spring. • The seasonal gardener made a huge impact on invasive species. • A public outreach regarding best practices for winter should be sent out. • A Natural Resource Inventory be completed. The Board thanked Dr. Karpati and the EAC for their valuable contribution to the Village. Board of Trustees Announcements • Program Information is listed on the Recreation Department landing page on the website. • Volunteers always needed to join the Fire and Ambulance Departments. Mayor Vescio stated 2024 was a productive and fun year and he looked forward to continuing to work for the Village in 2025. Village Manager’s Report • Jackson Road Park playground equipment was delayed and will be installed later in the week. Public Comments There were no public comments. 23/24 Audit Presentation (PKF O’Connor Davies) Mr. Jeffrey Shaver, Partner at PKF, gave reviewed the 2023/2024 Village Audit and stated the Village was in a strong financial position with a healthy fund balance. The Board thanked Mr. Shaver as well as the Village Treasurer for her close watch of the Village budget. Budget Transfers 23/24 Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the Board of Trustees does hereby authorize the following budget transfer for FY 2023-2024 as follows: A. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Netburn, the Board voted unanimously to approve the following resolution: BE IT RESOLVED, that the Village Manager is hereby authorized to execute a Parking Enforcement and Management Services Agreement with Fundamental Business Service, Inc. (FBS) for a term of three years with the ability to extend for an additional three years subject to review and approval by the Village Attorney. DASNY Grant Funding Commitment – Chilmark Park Pickleball Court Conversion Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to approve the following resolution: WHEREAS, the Village endeavors to convert two underutilized tennis courts into six dedicated pickleball courts WHEREAS, the Village has a Capital Project as described below: • Convert two Tennis Courts at Chilmark Park for 6 more pickleball courts - This capital initiative involves the conversion of two underutilized tennis courts into six dedicated pickleball courts, responding directly to the escalating popularity of this fast-paced sport. Concurrently, the project encompasses a comprehensive overhaul of the original six tennis  courts, which have experienced spidering cracks in the asphalt, compromising their playability and safety. To meet the diverse needs of our active community, state-of-the-art lighting will be installed, allowing extended playtime and accommodating varying schedules. This project signifies our commitment to providing world-class recreational facilities, promoting pickleball, and fostering a vibrant, inclusive space for residents of all ages. The Court Transformation and Expansion Project aims to create a hub for pickleball enthusiasts, ensuring that our facilities align with the evolving preferences of our dynamic community and provide more space to hold tournaments and events like Picks and Pickleball. WHEREAS, the Village has been working with Senator Peter Harckham on a $100,000 grant to complete this work, and WHEREAS, DASNY requires a funding commitment from the Village for any project costs exceeding the total grant amount; and NOW, THEREFORE, BE IT RESOLVED that the Village of Briarcliff Manor is committed to completing this project in its entirety and will cover all costs in excess of the grant via borrowing, cash or other means, and formally approve such funding as a part of the Capital Budget process. BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby approves the under 18 membership of Luke Ghazal to the Briarcliff Manor Fire Department. Minutes Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted to approve the minutes of the November 26, 2024 Regular Meeting. Adjournment The Board wished a Happy Birthday to Josh Ringel, Georgina Gualdino, Bill Vescio, Jessica Vescio, Nikki Kenneally and Deputy Mayor Chatzky who all celebrated birthdays in December. Merry Christmas, Happy Hanukkah, Happy Kwanzaa and Happy New Year to all that celebrate.
